IV. CONTRACTOR RESPONSIBILITY
(a) FAR Subpart 9.1 requires that contracts be awarded only to responsible prospective Contractors.
(b) To be determined responsible, a prospective Contractor must meet the standards in FAR 9.104 and any other standards set forth in the solicitation.
(c) To be determined responsible, Offerors must provide a statement regarding previous experience completing comparable work as well as information about the business organization, financial resources, and equipment to be used in performing the contract, by completion of a Pre-Award Survey (see solicitation Attachment 6).
(d) If the Offeror does not demonstrate sufficient resources in the completed Pre-Award Survey, acceptable evidence of "ability to obtain" the required adequate resources normally consists of a commitment or explicit arrangement that will be in existence at the time of contract award to rent, purchase or otherwise acquire the needed facilities, equipment, other resources, or personnel.
(e) Additionally, Offerors shall provide letter(s) from banks or other financial institutions with which the Offeror conducts business. The letters should contain information about your firm's accounts, loans, lines of credit, etc.
to assist the Government in determining financial stability, history of timely payments, the length and nature of the relationship between the firm and the financial institution, and the firm's financial ability to perform the contract. The letters should also provide the name and telephone number of the bank representative the Government may contact. If responding to the solicitation as a Joint Venture (JV), provide this information for each JV participant.
V. CONTRACTOR TEAMING ARRANGEMENTS
(a) “Offeror” may include a group of two (2) or more entities that have formed a “Contractor team arrangement”
(CTA) as defined in FAR 9.601; this includes partnerships, JVs, and Subcontractor agreements.
(b) In the case of entities that have formed a CTA, the experience and performance history of any member of the team, whether or not gained while working with the other member(s) of the currently proposed CTA, may be considered as a part of the evaluation of the Offeror’s proposal.
(c) In the case of CTAs involving a prime Contractor and Subcontractor(s), where the prime Contractor submits the proposal in response to this IFB, the prime Contractor must have completed at least two (2) of the total projects submitted for Factor 3, Past Performance.
(d) An Offeror that relies upon the experience or past performance of a CTA member must maintain that CTA throughout contract performance. The Government must approve any changes to CTAs.
VI. SUBMISSION REQUIREMENTS
(a) Media Limits. Only submit the electronic files specifically requested in this section. Do not submit excess information, audio-visual materials, electronic media, etc. Do not include links to information on websites in lieu of incorporating the information in the offer.
(b) Page Limits. There is not a page limit for the overall offer; however, page limits may be imposed at the Volume and/or Tab levels.
(c) Page Definition. For Volumes and/or Tabs with page limitations, pages will be counted as follows: One (1) side of the paper is one (1) page; information on both the back and front of one sheet of paper is two (2) pages.
Where authorized, a foldout sheet will count as one (1) page. Pages furnished for organizational purposes, such as Volume Coversheets and Table of Contents or divider tabs, are excluded from page limits.
(d) Page Size, Margin, and Font Limitations. Except where another size is specifically authorized for a submission, submit only 8.5” x 11” pages. Do not use unusual font styles such as script or condensed fonts; all text and graphics must be clearly legible.
(e) Volume Tabs. Volume Tabs directly correlate to evaluation factors. Although the Government may evaluate information contained anywhere in an Offeror’s proposal, the Government is not obligated to search for or consider information that is not located in the specified Tab. For electronic proposals, Tab means a PDF bookmark. If a Tab is not applicable to your proposal, omit that Tab but do not renumber subsequent Tabs.
(f) Conditioning of Offer. Offerors may not propose exceptions to the solicitation. Inclusion of any standard company terms and conditions that conflict with the solicitation may result in a determination that the offer is unacceptable and thus ineligible for award. Questions about the terms and conditions or technical requirements must be resolved through ProjNet prior to offer submission.
(g) Restrictions on Offeror-Provided Information. Offers shall not contain classified data. “Confidential” projects may be submitted to demonstrate capability if all information required for evaluation can be provided to the Government. Offerors that include data in their proposals that they do not want disclosed or used except for evaluation purposes must redact the data in accordance with FAR 52.215-1, Instructions to Offerors -
Competitive Acquisition.

(b) Pledges of acceptable assets shall be in the form of (1) evidence of an escrow account and/or (2) a recorded lien on real estate.
(c) Failure to provide all required bonding documents will render the Offeror non-responsible and thus ineligible for award.
VIII. AVAILABILITY OF FUNDS
Funds are not presently available for this acquisition. No contract award will be made until appropriated funds are made available. The Government reserves the right to cancel this solicitation before or after the closing date. In the event the Government cancels this solicitation, the Government has no obligation to reimburse an Offeror for any costs.

SECTION 00 22 00 - SUPPLEMENTARY INSTRUCTIONS
SUPPLEMENTARY INSTRUCTIONS
XI. AWARD BASIS
(a) The Government intends to award one (1) firm-fixed-price (FFP) contract to the responsive and responsible
Offeror that provides the best value to the Government, considering all price and non-price factors.
XII. EVALUATION OVERVIEW
(a) This requirement will be solicited and awarded using the two-phase DB source selection process for construction services, as outlined in Federal Acquisition Regulation (FAR) 36.3, Defense FAR Supplement (DFARS) Subpart 236.3, Army FAR Supplement (AFARS) Subpart 5136.3, and USACE Acquisition Instructions (UAI) Subpart 5136.3.
(b) Evaluation will be conducted as follows:
(i) All eligible Offerors are invited to submit Phase 1 proposals, which consists of non-price technical factors.
(ii) The Government will select the most highly qualified Offerors from Phase 1; these Offerors will be given the opportunity to submit Phase 2 proposals, which will consist of price and technical factors.
(iii) The Government will select the offer that represents the best value to the Government by using the tradeoff process described in FAR Part 15. This process permits tradeoffs between price and technical (“non-price”) factors and allows the Government to accept other than the lowest priced offer when determined to be in the best interest of the Government. The award decision will be based on a comparative analysis and an integrated assessment of proposals against all source selection criteria in the solicitation.
(c) In accordance with FAR 15.306, the Government does not intend to conduct discussions during either solicitation phase but reserves the right to do so if in the best interest of the Government.
XIII. BEST VALUE TRADEOFF PROCESS
(a) Offers will be evaluated using the subjective best value tradeoff (BVTO) procedures outlined in FAR Part 15
(Contracting by Negotiation), DFARS Part 215, DFARS Procedures, Guidance, and Information (PGI) Part 215, the Department of Defense (DoD) Source Selection Procedures (dated 31 March 2016), AFARS Part 5115, AFARS Appendix AA, the Army Source Selection Supplement (AS3), and UAI Part 5115.
(b) The BVTO process allows the Government to award to other than the lowest-priced offer and other than the highest-technically rated offer based on an integrated assessment and comparative analysis of proposals against all source selection criteria, including price and technical (“non-price”) factors.
XIV. EVALUATION FACTORS AND SIGNIFICANT SUBFACTORS
(a) Phase 1 proposals will be evaluated based on the following factors and subfactors:
Factor 1: Past Performance Subfactor 1: Past Experience Subfactor 2: Past Performance
Factor 2: Technical Experience and Capability
Subfactor 1: A&E Design Firm (or Teaming) Capability Subfactor 2: Design-Build Experience Subfactor 3: USACE Project Experience Subfactor 4: United States Air Force (USAF) or Navy Project Experience Subfactor 5: Concurrent Project Execution
(b) Phase 2 proposals will be evaluated based on the following factors and subfactors:
Factor 1: Cost / Price Factor 2: Technical Approach / Proposal (including risk)
Subfactor 1: Design Concept Subfactor 2: Technical Information Subfactor 3: Schedule Subfactor 4: Identified Challenges and Risk Mitigation
(c) All evaluation factors other than cost or price, when combined, are significantly more important than cost or price.
(d) Evaluation Factors are listed below in descending order of importance:
Phase-One Factor 1 – Past Performance Phase-One Factor 2 – Technical Experience and Capability Phase-Two Factor 2 – Technical Approach / Proposal Phase-Two Factor 1 – Cost/Price
(e) Each subfactor will be independently rated using the rating scale for the factor, and an overall rating will be generated for the factor using the same scale. All subfactors are approximately equal.
(f) The Government is concerned with striking the most advantageous balance between technical merit (i.e., quality) and cost to the Government (i.e., price). If competing technical proposals are determined to be essentially equal, price could become the controlling factor.
(g) The Source Selection Authority will consider only the Phase 1 proposals during Phase 1, however both the
Phase 1 and the Phase 2 proposals, and all relative strengths and weaknesses identified in both phases will be used in determining the best value to the Government in Phase 2.
(h) Approximately up to five (5) of the most highly qualified Offerors will be selected and invited to participate in Phase 2; the offers not selected will be excluded from Phase 2 competition.
XV. PHASE I, VOLUME I - NON-PRICE FACTORS
(a) This Volume will be reviewed to determine whether offers comply with the instructions and requirements of the solicitation; only proposals that conform to the solicitation are considered responsive, and therefore eligible for award.
(b) Failure to complete or provide any of the documentation required in this section may result in the offer being determined non-responsive and excluded from further evaluation.
XVI. PHASE I, EVALUATION FACTOR 1 – PAST PERFORMANCE
(a) The Government will evaluate the Past Performance factor to determine a Performance Confidence Assessment rating.
(b) The submitted material MUST be organized sequentially under tabs for each numbered section to facilitate evaluation. All narratives must contain sufficient detail to demonstrate recency and relevancy.
(c) The Offeror shall submit “example projects” (either commercial or institutional) that demonstrate the prime and key Subcontractor(s) experience that meets the evaluation criteria and demonstrates their ability to successfully perform under the resulting contract.
(d) The Offeror must provide a narrative to explain how the past experience shown by the example projects is relevant to this project and shows the Contractor’s and key Subcontractor’s understanding of the risks, work requirements, and approach necessary to successfully complete this project.
(e) The Offeror shall submit a minimum of three (3) up to six (6) example projects that are individually or collectively demonstrate the recent and relevant capabilities of the prime Contractor and key Subcontractors.
(f) Recent projects are those that have been substantially completed within the past five (5) years.
(g) Relevant projects are of similar scope, square footage, and complexity as this project.
Scope - projects that include similar work tasks, deliverables, deadlines, and project cost.
Square Footage - projects completed with an approximate size of 23,000 square feet.
Complexity - the degree of complexity that determines the overall approach to a project, including required resources as well as tools and techniques.
(h) Each project narrative shall:
1) Explain the Offeror’s experience as a prime Contractor that demonstrates their ability to successfully perform this contract.
2) Explain how the experience shown by the example projects is relevant to this project and show the Contractor possesses an understanding of the risks and requirements necessary to successfully act as the prime Contractor for this project.
3) Explain how the experience shown by the example projects are relevant to this project and demonstrates that the Contractor’s and/or key Subcontractors possess an understanding of the risks, and requirements necessary to successfully manage the design-build elements of this project.
4) Explain how the experience shown by the lead designer is relevant to this project and show the Contractor and/or the key Subcontractor possesses an understanding of the risks and requirements necessary to successfully act as the lead designer for this design-build project.
(i) Offeror should submit project experience data using the format in Attachment 4, Contractors Project
Experience. Failure to provide all information requested in this format (except the BGSD and DART Rate fields, which are not required) may result in the proposal being determined unacceptable for award. The project information submitted in this section shall be the same projects as those submitted in Factor 2.
(j) Offeror must validate performance ratings of the presented projects by providing a completed Contractor Performance Assessment Reporting System (CPARS - https://cpars.cpars.gov/) evaluation or Past Performance Questionnaire (PPQ, Solicitation Attachment 6, PPQ-0, PPQ Form) for each submitted project.
(k) Offerors must organize all Past Performance Information in the same project number order in which the projects are submitted.
(l) PPQs must be completed by a Project Client POC that can provide an opinion of the Offeror's performance on the project. Contact information for POCs must be current.
(m) Offerors should submit completed PPQs with their proposal. If the Offeror is unable to obtain a completed PPQ from a Client POC before the proposal closing date, the Offeror should complete and submit the first page of the PPQ with the proposal, which will provide contract and contact information for the respective project(s). At the Client’s discretion, PPQs may be submitted directly to the Contract Specialist.
(n) Previously completed PPQs may be submitted if they do not reference any other solicitation number.
(o) Offerors must provide reports or questionnaires for all DUNS number(s) and CAGE code(s) whose experience is relevant to the project. While the Government may consider data from other sources, the burden of providing detailed, current, accurate, and complete past performance information rests with the Offeror.
(p) The Government plans to contact and interview Client POCs and may interview other individuals acting for Clients or any other sources.
(q) Past performance information may be obtained from any other sources available to the Government including, but not limited to, CPARS, Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), or any other databases; interviews with Owners, Program Managers, Contracting Officers, Fee Determining Officials, and/or the Defense Contract Management Agency
(DCMA).
(r) Projects that are not recent or relevant in terms of project size, scope, complexity, dollar value, or that demonstrate low past performance evaluation ratings will be interpreted as indicators of no confidence that the Offeror can successfully perform the work. More recent and relevant projects reflecting high past performance evaluations are typically a stronger predictor of future success and have more influence on the past performance confidence assessment than past performance of lesser relevance. Higher confidence assessments will be given for higher past performance evaluation ratings.
(s) In the case of Offerors for which no recent and relevant performance record is available or the Offeror’s performance report is so sparse that no meaningful confidence assessment rating can be reasonably assigned, an Offeror will not be evaluated favorably or unfavorably; the Offeror’s past performance is unknown and will be assigned a rating of Neutral Confidence.
(t) Past Performance will be evaluated using the following rating scales:
Past Performance Relevancy Ratings:
Rating Definition Very Relevant Present/past performance effort involved essentially the same scope and magnitude of effort and complexities this solicitation requires.
Relevant Present/past performance effort involved similar scope and magnitude of effort and complexities this solicitation requires.
Somewhat Relevant Present/past performance effort involved some of the scope and magnitude of effort and complexities this solicitation requires.
Not Relevant Present/past performance effort involved little or none of the scope and magnitude of effort and complexities this solicitation requires.
Performance Confidence Assessments:
Rating Definition
Substantial Confidence Based on the Offeror’s recent/relevant performance record, the Government has a high expectation that the Offeror will successfully perform the required effort.
Satisfactory Confidence Based on the Offeror’s recent/relevant performance record, the Government has a reasonable expectation that the Offeror will successfully perform the required effort.
Neutral Confidence No recent/relevant performance record is available or the Offeror’s performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned. The Offeror may not be evaluated favorably or unfavorably on the factor of past performance.
Limited Confidence Based on the Offeror’s recent/relevant performance record, the Government has a low expectation that the Offeror will successfully perform the required effort.

Marginal Proposal has not demonstrated an adequate approach and understanding of the requirements, and/or risk of unsuccessful performance is high.
Unacceptable Proposal does not meet requirements of the solicitation, and thus, contains one or more deficiencies, and/or risk of unsuccessful performance is unacceptable. Proposal is unawardable.
(g) This Factor is limited to twenty-five (25) pages.
XVIII. PHASE II, EVALUATION FACTOR 1 - COST / PRICE
(a) The Government will evaluate Offeror pricing to determine whether the project will be awarded at a fair and reasonable price.
(b) Proposed prices will be evaluated using price analysis, in accordance with FAR Part 15, which typically includes examining and evaluating an Offeror’s proposed price without evaluating separate cost elements and proposed profit/fee. Price analysis may involve comparison with other proposed prices received in response to this solicitation, comparison of proposed prices to historical prices paid, comparison of proposed prices to the independent Government estimate, analysis of data other than certified cost or pricing data provided by the Offeror, or any other techniques mentioned in FAR 15.401-1(b)(2).
(c) Price analysis, cost analysis, and/or cost realism analysis techniques may be used to ensure that the Offeror’s cost/price proposal is fair and reasonable.
(d) Offeror strengths, weaknesses, and the cost/price of the competing proposals will be comparatively assessed to determine which proposal represents the best value to the Government.
Response to this Factor MUST include the following tabs and documentation:

The Contractor shall not be entitled to an equitable adjustment of the contract price or extension of the performance schedule based on any stop work order issued under this authority.
WORK DAYS AND HOURS
a. Federal law (5 U.S.C. 6103) establishes the following public holidays for Federal employees. When a holiday falls on a Saturday, the holiday is generally observed on the preceding Friday. When a holiday falls on a Sunday, the holiday is generally observed on the following Monday.
b. The normal work days and hours for this project will be Monday through Friday, excluding the observation of federal holidays, from 07:30 a.m. to 4:00 p.m. Access to the work site may be restricted to these hours and days. Work during other than normal hours and days must be coordinated in advance with the Administrative Contracting Officer.
This work may require multiple crews, multiple shifts, and working weekends and holidays. The Government recognizes the short duration of the time allowed to complete the work and relies upon the Contractor’s experience and expertise to properly plan, staff, and execute the work. In addition, the Contractor may be called upon to provide emergency construction services in the event of unusually severe weather, high river stages, or other circumstances that could threaten life or property.
ALTERNATE STRUCTURED APPROACH TO WEIGHTED GUIDELINE METHOD
The following alternate structured approach shall be used.
Factor Rate Weight Value
Degree of risk 20 Relative difficulty of work 15 Size of job 15 Period of performance 15 Contractor's investment 5 Assistance by Government 5 Subcontracting 25
Total 100%
Based on the circumstances of the procurement action, each of the above factors shall be weighted from .03 to .12 as indicated below. “Value” shall be obtained by multiplying the rate by the weight. The Value column when totaled indicates the fair and reasonable profit percentage under the circumstances of the particular procurement. The profit percentage should be multiplied by the total contract costs, including general and administrative costs.
(1) Degree of risk. Where the work involves no risk or the degree of risk is very small, the weighting should be .03; as the degree of risk increases, the weighting should be increased up to a maximum of .12. Lump sum items shall generally have a higher weight than unit price items; other things to consider include the nature of the work and where it is to be performed. Consider the portion of the work to be done by Subcontractors, amount and type of labor included in costs, whether the negotiation is before or after performance of the work, etc. Modifications settled before the fact have much greater risk than those settled after the fact. A weight of .03 is appropriate for after the fact equitable adjustments and/or settlements.
(2) Relative Difficulty of Work: If the work is difficult and complex, the weight should be .12 and should be proportionately reduced to .03 on the simplest of jobs. This factor is tied in to some extent with the degree of risk.
Some other things to consider are the nature of the work, by whom it is to be done (i.e., Subcontractors, consultants), what is the time schedule.
(3) Size of Job. Work of $100,000 or less shall be weighted at .12. Work estimated between $100,000 and $5,000,000 shall be proportionately weighted from .12 to .05. Work from $5,000,000 to $10,000,000 shall be weighted at .04. Work in excess of $10,000,000 shall be weighted at .03.
