SECTION L - INSTRUCTIONS, CONDITIONS AND NOTICES TO BIDDERS
SOLICITATION PROVISIONS
PROPOSAL SUBMISSION REQUIREMENTS
IMPORTANT: Failure to follow the below proposal preparation instructions may cause a proposal to be deemed unacceptable by the Government and thus eliminated from the competition without further consideration.
A. Proposal Submittal and Inquiries.
1. Proposals shall be received electronically no later than 1:00 pm Central Time on 8 MARCH 2023 22 March 2023. No hard copies, Facsimile copies, and Compact Disc’s (CD) s will be accepted. NO HAND DELIVERY IS
ALLOWED.
2. Address all questions or concerns to the Contracting Officer (KO), Dianne K. Grimes at dianne.k.grimes.civ@army.mil and Contract Specialist (CS), Lesa Crockett at lesa.m.crockett.civ@army.mil. All questions regarding this solicitation shall be submitted in writing via email not later than 1:00 pm Central Time 08 February 2023
3. Questions submitted after the specified date/time will not be accepted by the Government. Responses to the questions will be incorporated into an amendment to the solicitation and posted to https://piee.eb.mil/ for viewing by all potential Offerors. Industry questions and answers may or may not have a bearing on the substantive content of the solicitation or the contract requirements, and it shall NOT be assumed that the date set for receipt of proposals will be extended.
a. Proposals shall be submitted via the PIEE Solicitation module, in accordance with the module procedures no later than 1:00 pm Central Time on 8 March 2023 22 March 2023. The Offeror shall submit each volume in electronic format, unclassified only. Attachments which are provided in support of a section shall be included in the electronic file for that section. The Offeror’s file name shall be “Company Name, Volume - Initial” for the first submission. File name of later submissions (if necessary), shall be “Company Name Volume - Revision X” with X indicating the number of the revision. A maximum size file of 1.95 GB is allowed and only files submitted in the following formats will be accepted: Adobe PDF, Microsoft Word, PowerPoint, and/or Excel.
b. The Solicitation module is a vendor portal for solicitation within the PIEE platform to automate and secure the process for capturing solicitations, attachments, and responses from industry. The Solicitation module allows vendors to retrieve and respond to solicitations and communicate directly with Solicitation Managers in a secure environment. Vendors choosing to submit an offer/proposal in the Solicitation module must register in PIEE, establish a “Proposal Manager” account, and submit a request for the “Proposal Manager” role.
mailto:ebonie.f.mcclintock-bennett.civ@army.mil mailto:lesa.m.crockett.civ@army.mil
c. Offerors are strongly encouraged to plan accordingly, submit proposals well in advance of the designated submission deadline, and ensure affirmative receipt of proposals. After successfully submitting the offer, a success message of the submission will be displayed in the Solicitation module and the offer display will collapse. The “message of submission”, a red lined box, will be your confirmation and should state e.g.
“The offer was submitted on 2022-09-22 10:51:07 AM EDT (2022-09-22 15:51:07 UTC) by Proposal Manager. Please print this page and maintain for your records.” The Solicitation module automatically tracks the date and time of all submissions. Proposals not received by the designated submission deadline will be regarded as “late” and will not be accepted by the Government, subject to the provisions of FAR 15.208.
d. Electronic Reference Documents. All referenced documents for this solicitation can be found on the PIEE Solicitation module at https://piee.eb.mil/. All vendors can view solicitations in the Solicitation module by selecting “SOLICITATION SEARCH” in the Award section or “Solicitation Search” under the SUPPORT section at the bottom of the page. -Search for W9115123R0024 postings. The SAM.gov website will reference back to this module.
e. It is the Offeror's responsibility to be fully knowledgeable and capable regarding PIEE. Offerors shall not rely on the Government to assist Offerors in understanding how to use PIEE or transmit proposals within PIEE. Offerors must fully familiarize themselves, far in advance of the proposal submission deadline, with the system: both for retrieving information and to enable them to submit their Offerors in a timely manner. Offerors may contact the Contacting Officer if they are unable to locate any of the referenced material, but it is the Offeror's responsibility to plan far ahead of the proposal submission deadline, anticipating potential PIEE connectivity delays.
1) In the event that the Solicitation Module within the PIEE system is not operational, or Offeror experiences technical difficulties, or Offeror is temporarily unable to access or use the system, then the Offeror shall utilize the Mailbox - usarmy.hood.acc-micc.mbx.micc-hood-asd@army.mil. The attachment size for acceptance by an email server would be a cumulative attachment size of 10 MB or less per email, not per individual file attached to a single email.
The Offeror is NOT to submit the proposal to both PIEE and the Mailbox. The Mailbox is ONLY to be used in situations where the Offeror cannot access PIEE.
2) The Contractor shall immediately notify the Contracting Officer if the use of the Mailbox is needed. The provisions of FAR 15.208 for electronic submission apply. The contractor’s notification shall be in writing, verbal notification alone shall not be sufficient. The Offeror shall obtain prior approval from the Contracting Officer to use the Mailbox for proposal submission. If the Contracting Officer approves the use of the Mailbox for proposal submission, Offerors are responsible for ensuring electronic copies are virus-free and shall run an anti-virus scan before submission. If proposals are not received by the designated submission deadline due to technical difficulties the provisions of FAR 15.208 determine acceptability.
B. General Instructions:
1. The selection of a source for award purposes will be conducted utilizing source selection procedures as delineated in FAR Subpart 15.3 Source Selection. Offers will be evaluated using the criteria under Section M, Evaluation Factors for Award. Noncompliance with Section L may cause the Offeror’s proposal to be determined nonresponsive and may result in elimination of the proposal from further consideration for the contract award.
2. The submission of the documentation specified below will constitute the Offeror's acceptance of the terms and conditions of the Request for Proposal (RFP), concurrence with the Performance Work Statement, and contract type.
The proposal shall remain valid for at least 270 365 days from the closing date specified in the solicitation.
3. It is the Government’s intention to award without discussions. Offerors are encouraged to present their best technical proposal and costs in their initial proposal submission. However, in accordance with (IAW) FAR 15.306, https://piee.eb.mil/ should discussions become necessary, the Government reserves the right to hold discussions. If this occurs, a competitive range will be determined, and Offerors notified. The competitive range may be limited for purposes of efficiency IAW FAR 15.306(c)(2). If discussions become necessary, correspondence will take place using Acquisition Source Selection Interactive Support Tool (ASSIST).
a. The Acquisition Source Selection Interactive Support Tool (ASSIST):
1) During the conduct of this acquisition, the Acquisition Source Selection Interactive Support Tool (ASSIST) will be used by the Government to support the proposal evaluation and source selection process. A separate tool, the ASSIST2Industry, will be used in conjunction with ASSIST to accomplish all exchanges with Offerors after receipt of proposals pursuant to Federal Acquisition Regulation (FAR) 15.306. ASSIST2Industry provides the ability for the Government to issue, and the Offerors to receive and respond to, all Evaluation Notices (ENs) in a secure online environment. ASSIST2Industry also provides the ability for the Government to issue, and the Offerors to receive letter correspondence. Contractors cannot respond to letter correspondence; but, can acknowledge receipt of the letter(s).
2) In order to initiate the use of ASSIST2Industry, the Government requires the names, company titles, telephone numbers, and email addresses of two (2) individuals that the Offeror has designated as responsible for receiving and responding to Government ENs through ASSIST2Industry. The designation of two (2) individuals is for the purpose of insuring availability of one individual if the other individual is not available. The required information regarding these two (2) individuals must be submitted with the Offeror’s proposal and included in the cover letter. Those two (2) individuals, if selected in ASSIST, will also be the Contractor POCs to receive letter correspondence from the Government. Therefore, it is the Contractor’s responsibility to ensure that the information provided at proposal submission is accurate and up to date throughout the source selection process. If letter correspondence is sent by the Government via ASSIST, Contractor POCs will receive email notification informing them that they have correspondence, and that they must login to ASSIST2Industry and acknowledge receipt of the correspondence.
3) After the solicitation’s closing date, the Government will establish an account in ASSIST2Industry for each individual identified by the Offeror that has submitted a proposal in response to this solicitation. The two individuals named by the Offeror will be authorized access to that account. Two (2) separate system generated emails will be sent to each individual. One of the emails will contain the individual’s ASSIST2Industry username. The other email will contain the individual’s temporary password. Using the provided username and temporary password, each individual can then go to https://ASSIST2Industry.army.mil to access the account. NOTE: The first time a user logs in, the user will be required to change the temporary password before the user can proceed to use the site.
4) Whenever the Government issues ENs to the Offeror through ASSIST2Industry, the Government’s Contracting Officer will notify the Offeror through either ASSIST2Industry or a medium independent of ASSIST2Industry (e.g., e-mail) that the Offeror has ENs in ASSIST2Industry waiting for a response. There will be no ENs in ASSIST2Industry until such notice is issued by the Contracting Officer.
5) All Offerors are advised that ASSIST2Industry has been updated and it is now the responsibility of PRIME Contractors to establish accounts for their SUBCONTRACTORS to respond to Government ENs. A separate area within ASSIST2Industry has been created to allow authorized subcontractor POCs to upload proposal files only. Subcontractors will not be able to access any other information on the ASSIST2Industry website (e.g. Questions/Evaluation Notices, Responses, etc.). Once a subcontractor has been added, they will receive a user ID (e.g.
subcontractor0001) and password (an initial password) that will be sent via two separate system generated e-mails. A subcontractor will have one user ID for all PRIMES and solicitation https://assist2industry.army.mil/ responses, i.e. if you are a subcontractor to multiple Prime Contractors and multiple solicitation responses, you will only have one user ID. Once an account has been established for the subcontractor, go to https://ASSIST2Industry.army.mil to access the account. Prime Contractors will only be able to see the number of files submitted by their subcontractors; but, will be UNABLE TO VIEW the subcontractor’s files.
b. Accessing ASSIST2INDUSTRY Prime/Subcontractors
1) Access to ASSIST2Industry will require a two factor authentication for each Prime and subcontractor user. All ASSIST2Industry users are required to have a username/password (first authentication) and may select one of the following three methods for implementing the second authentication to access the site:
1. Use an authenticator application on your cell phone (e.g. Google or Microsoft Authenticator) to receive a QR Code;
2. Receive a code via an SMS Text Message to your cell phone; or
3. Receive a code via e-mail.
2) If you have any other problems accessing your account, contact the Army Enterprise Service Desk (AESD) at the number listed below:
