L.1.0 INTRODUCTION

L.1.1 The requirement for Tactical Communication Tower Replacement at the Joint Readiness Training Center (JRTC) and Technology Refresh at Joint Multinational Readiness Center (JMRC) will be pursued as a Small Business set-aside to be competed among companies qualifying as small businesses under the 333318 NAICS code, size standard 1000 employees. The Tactical Communication Tower Replacement at the JRTC and Technology Refresh at JMRC (to be further known as “CTC Tower Efforts” for ease of use) source selection will involve Government evaluation of Offerors’ written proposals in accordance with (IAW) Sections L and M of this solicitation.

Proposal Volumes I, II, III, V, and VI are due by 4:00 P.M. EDT on 17 July 2020 to the POCs listed in paragraph L.2.1 below. Proposal Volume IV and the Past Performance Questionnaires (PPQ) shall be due by 4:00PM EDT on 13 July 2020 to the POCs listed in paragraph L.2.1 below. The contractor’s proposal must be submitted in compliance with Section L and M of this solicitation and must demonstrate a thorough understanding of the associated requirements stated in the Tactical Communication Tower Replacement at the Joint Readiness Training Center (JRTC) and Technology Refresh At Joint Multinational Readiness Center (JMRC), Performance Work Statement, PWS-2019- 031, Revision 1.0, dated 25 June 2020 (Attachment 01).

Offerors are hereby notified that non-Government participants will have access to the offerors’ proposals. The non-government participant is contracted employee on the Systems Engineering and Technical Assistance (SETA) contract W900KK-17-D-0002, Task Order W900KK-20-F-3001. The contractor will serve as technical advisor to the Government and will be authorized access to only the Offeror’s Factor 2/Volume II – JMRC, Management proposal, which is necessary to enable them to provide specific advice on the Tactical Communication Tower Replacement at the Joint Readiness Training Center (JRTC) and Technology Refresh at Joint Multinational Readiness Center (JMRC) management matters. All non-Government personnel have signed certificates of non-disclosure and financial interest, or their equivalent documents. Non-Government participants will participate in an advisory role only, and will not be included in any applicable consensus discussion or determination.

An offeror’s submission of a proposal in response to this solicitation constitutes approval for disclosure of proprietary information contained within the proposal to non-government participants involved in the source selection. If the contractor is not willing to provide this consent, written notification to the Procuring Contracting Officer (PCO) is required no later than 15 days prior to the proposal due date.

L.2.0 SUBMISSION

L.2.1 The anticipated award date for this contract is 31 August 2020. This information is provided for use as a basis for schedules and burden (labor, overheads, G&A, etc.) mid-point calculations.

The contractor is not entitled to an equitable adjustment in contract price in the event the Government awards this contract before or after the date above.

The POCs for this solicitation are Mrs. Shonna L. Ayers and Mr. Jason C. Graham:

Primary:

US Army Contracting Command – Orlando Attn: Shonna L. Ayers, Contract Specialist 12211 Science Drive Orlando, FL 32826-3224 Telephone: 407-208-3336 E-mail: shonna.l.ayers.civ@mail.mil

L.2.3 The contractor’s proposal must clearly demonstrate that the contractor has a thorough understanding of the requirements and associated risks, and is able, willing and competent to devote the resources and acumen in providing installation, documentation, training, and testing solutions necessary to meet the requirements set forth in this solicitation. Mere reiteration of the requirement or standard reference material is inadequate. It is your responsibility to present enough information to be meaningfully evaluated without discussions. In presenting material in this proposal, Offerors are advised that quality of information is more important than quantity. Furthermore, the Government considers statements that the prospective Offeror understands, can or will comply with the specifications, and/or statements paraphrasing the requirements or parts thereof to be inadequate and unsatisfactory. The Government further considers mere reiteration of the requirement or standard reference material to also be inadequate and unsatisfactory.

L.2.4 Any data previously submitted in response to another solicitation, whether submitted to ACC- ORL or Program Executive Office for Simulation, Training and Instrumentation (PEO STRI) or another agency, should be assumed to be unavailable during this proposal evaluation and source selection process. Proposal data shall not be incorporated into the proposal by referring to another proposal or other source.

L.2.5. Elaborate brochures or other presentations beyond that sufficient to present a complete and effective proposal are neither necessary nor desired.

L.2.6 The Government request that the contractor’s proposal be valid for at least 180 calendars days from the proposal due date. Files shall not contain classified information. The contractor shall make a clear statement that the proposal is valid until such date in the Administrative Volume IV of the proposal and revise it if in the event a change to the proposal is necessary and warranted by the PCO.

L.2.7 In accordance with FAR Subpart 52.215-1, Instructions to Offerors – Competitive Acquisition, the Government intends to make award without discussions to a single awardee. However, the Government reserves the right to conduct discussions at the sole discretion of the Contracting Officer. The Government will evaluate all proposals in accordance with FAR Subpart 15.305(a), and if discussions are to be conducted, establish a competitive range comprised of all of the most highly rated proposals, based upon the ratings of each proposal against all evaluation factors. The decision to establish a competitive range will be made at the sole discretion of the Contracting Officer. The offeror’s proposal should contain the offeror’s best terms from a cost or price and technical standpoint.

L.2.8 Questions regarding this solicitation shall be submitted by electronic mail to the POC identified in paragraph L.2.1.

L.2.9 The Government will answer all questions submitted electronically by 1600 EDT, 18 June 2020. The Government may issue one or more solicitation amendment(s) prior to the deadline for final proposal submissions based on the questions received. Questions received after the deadline may not be answered prior to proposal submission. The Government does not anticipate extending the closing date for receipt of offers. Accordingly, contractors are encouraged to carefully review all solicitation requirements and submit questions to the Government early in the proposal preparation cycle.

L.2.10 Contractors are cautioned that in order for their proposal to be eligible for award, the proposal shall be in compliance with the terms and conditions set forth in the RFP.

L.2.11 Contractors are advised that proposals shall be accepted only from those proposing as prime contractors. Such offerors shall be responsible for submitting complete proposal packages containing all components of the proposal inclusive of any team member or subcontractor proposal information.

Pricing data, or other information which may be considered proprietary to team members or subcontractors. The subcontractor may submit their data directly to the government should that subcontractor not desire to disclose proprietary data to the prime contractor IAW Section L.3.2, Electronic File Submission.

L.2.12 A company with multiple Divisions is permitted to submit a separate proposal by Division for award consideration. However, contractors are cautioned that if one company submits separate proposals from multiple Divisions, each Division’s proposal should address the full RFP requirements uniquely based on their particular Division’s capabilities. For example, technical processes, small business participation plans, and/or past performance submissions of a different Division may not be used in support of the Division submitting the proposal. The proposal must be specific to the Division submitting the proposal.

L.2.13 If a contractor believes that the requirements and/or instructions in the RFP contain an error, omission, or are otherwise unsound, the offeror should notify the Contracting Officer in writing with supporting rationale no later than ten (10) days after the release of the RFP.

L.2.14 Offerors shall not make any changes to the solicitation. Any objections to the terms and conditions of the solicitation should be addressed to the Procuring Contracting Officer (PCO). If the proposal takes exceptions to the terms and conditions of the solicitation, all exceptions shall be denoted in a cover letter to the proposal; however, exceptions to the solicitation taken in the proposal may result in the PCO rejecting the offer as noncompliant.

L.2.15 OFFERORS ARE HEREBY ON NOTICE THAT A FAILURE TO SUBMIT ALL

THE REQUIRED DOCUMENTATION IN EXACTLY THE MANNER (TIMELINESS

AND FORMAT) SPECIFIED IN THE SOLICITATION MAY CONSTITUTE A BASIS

FOR THE GOVERNMENT TO REJECT A PROPOSAL AS NON-COMPLIANT AND

THEREFORE UNACCEPTABLE AT THE SOLE DISCRETION OF THE SOURCE

SELECTION AUTHORITY.

Furthermore, should an contractor indicate in its proposal that it cannot or will not meet any contract requirement; provide an approach that clearly does not meet any contract requirement; or, include data which prompts the Government to question the Offeror's compliance with any contract requirement, the Government may determine at its discretion that the Offeror's proposal is non-compliant and therefore ineligible for award.

L.3.0 PROPOSAL SUBMITTAL:

L.3.1 The Government does not authorize submission of telegraphic, paper copies, DVD/CD-ROM or facsimile offer for this solicitation. The contractor shall include the solicitation number (W900KK-20-R-0058) and Factor/Volume number on all information submitted in response to this solicitation.

L.3.2. Electronic File Submission Only: The required method of CTC Tower Replacement proposal delivery is via the DoD Secure Access File Exchange (SAFE) located at https://safe.apps.mil/. Hard copy proposals will not be accepted. Offerors shall ensure the recipients receiving the proposal submitted via DoD SAFE are the CTC Tower Replacement Primary Point of Contact (POC) and Alternate POC, identified in Section L.2.1.

Offerors are encouraged to test the DoD SAFE proposal exchange methodology by sending a copy of the CTC Tower Replacement PWS-2019-031, Attachment 1, to the aforementioned POCs at least 72 hours prior to the proposal due date/time.

The Government will confirm receipt, via email, within one business day. If confirmation email is not received, please coordinate directly with the PCO to resolve issue.

If there are any technical difficulties with DoD SAFE, the Offeror shall coordinate an alternate method of CTC Tower Replacement proposal submittal with the Primary POC, no less than 24 hours prior to the due date and time. It is the Offeror’s responsibility to ensure that the entire proposal is received by the Government prior to the proposal due date and time. SECTION M - EVALUATION FACTORS FOR AWARD

EVALUATION CRITERIA

SECTION M EVALUATION FACTORS FOR AWARD

M.1.0 BASIS FOR AWARD

M.1.1 The award will be made utilizing the Lowest Price Technically Acceptable (LPTA) Source Selection Process in accordance with FAR Subpart 15.101-2. Award will be made in accordance with the evaluation criteria set forth in in this Attachment 2, Requirements Matrix, of the solicitation. The Government will evaluate each proposal strictly in accordance with its content. The Government will not assume that the performance will include areas not specified in the offeror’s proposal.

M.1.2 The Government will evaluate proposals to determine compliance with all requirements of the solicitation, including any attachments and exhibits. The Government will evaluate each proposal strictly in accordance with its content. The Government will not assume that the performance will include areas not specified in the Offeror’s proposal. The Government will evaluate the Offeror's proposal against the minimum requirements set out in Attachment 2, Requirements Matrix, to determine whether the proposal is "Acceptable" or "Unacceptable" utilizing the rating and descriptions provided below. An Offeror's technical proposal will not be found Acceptable unless all the requirements are found Acceptable. A rating of Unacceptable for any requirement will cause the entire technical proposal to be found Unacceptable and may cause the Offeror not be considered for award.

M.1.3 The Government intends to evaluate proposal and award a contract without discussions with offerors. Therefore, each initial offer should contain the offeror’s best terms from a technical and price standpoint. The Government, however, reserves the right to conduct discussions and request proposal revisions, if necessary. NOTE: The Government intends to start with the lowest price proposal for evaluation. If that proposal is found to be acceptable in accordance with Section M and each section of the Requirement Matrix, no further evaluations will be conducted. If that proposal is found to be unacceptable the Government will go to the next lowest proposal.

M.1.4 The Government may judge a proposal to be unacceptable if the proposal contains statements that do not clearly reveal the Offeror’s response or contains statements such as “we will use best commercial practices,” “we will use standard procedures,” or “we will employ well-known techniques,” if used without definition or explanation.

M.1.5 Government initiated exchanges with Offerors after receipt of a proposal do not constitute a rejection or counteroffer.

M.1.6 Trade-offs between price and non-price factors are not permitted. An unbalanced, or incomplete price submission may be grounds for eliminating a submission from competition. The Government will evaluate proposed prices for fair and reasonableness using price analysis. Proposed prices evaluated as unreasonable may be grounds for eliminating a submission from competition.

Award will be made on all or none basis to a single Offeror. Offers must include prices for each item listed in order that offers may be properly evaluated. Failure to do so shall be cause for the Offeror to be not considered for award.

M.2.0 FACTORS TO BE EVALUATED: The Government’s evaluation of proposals will be based below:

Factor 1 – TECHNICAL (Volume I) Factor 2 – MANAGEMENT (Volume II) Factor 3 – LOGISTICS (Volume III) Factor 4 - PAST PERFORMANCE (Volume IV) Factor 5 – COST/PRICE (Volume V)

Note: Failure to meet a Government stated requirement in Volumes I through V: may deem the Offeror ineligible for award.

M.3.0 EVALUATION APPROACH: All proposals shall be subject to evaluation by a team of Government and non-Government advisors.

M.3.1 EVALUATION APPROACH:

The Government will evaluate proposals to determine compliance with all requirements of the solicitation, including any attachments and exhibits. The Government will evaluate each proposal strictly in accordance with its content. The Government will not assume that the performance will include areas not specified in the Offeror’s proposal. The Government will evaluate the Offeror's proposal against the requirements set out in Attachment 2 "Requirements Matrix" to determine whether the proposal is "Acceptable" or "Unacceptable" using the rating and descriptions provided below. An Offeror's technical proposal will not be found Acceptable unless all of the requirements are found Acceptable. A rating of Unacceptable for any requirement will cause the entire technical proposal to be found Unacceptable and may cause the Offeror not to be considered for award.

RATING SCHEME:

The factors will be rated utilizing the ratings and descriptions provided below.

Rating Description

Acceptable Proposal meets the requirements of the solicitation.

Unacceptable Proposal does not meet the requirements of the solicitation.

M.3.1.2 FACTOR 1 (Technical),FACTOR 2 (Management) and FACTOR 3 (Logistics)

For evaluation purpose, the Offeror shall complete the Requirements Matrix (Attachment 2) by identifying in the reference section of the Requirements Matrix, the page number and section number (if applicable) of the proposal that clearly demonstrates how their product(s) meets the Government requirement. Failure to meet a Government stated requirement may deem the Offeror's proposal unacceptable; which may render an Offeror ineligible for award. It is incumbent upon each Offeror to provide documentation that clearly supports the Offeror’s ability to meet the requirements of the PWS and the requirement matrix.

M.3.1.3 FACTOR 4 - PAST PERFORMANCE

The Past Performance evaluation will assess the relative risks associated with an offeror’s likelihood of success in performing the solicitation requirements as indicated by that offeror’s record of past performance in the Past Performance Questionnaire, Past Performance Information Retrieval System (PPIRS), past performance proposal submission, and any other information available to the Government.

a. The Government will conduct a past performance assessment based on the recency and relevancy, of the offeror’s past performance, as it relates to the probability of successful accomplishment of the

Tactical Tower Replacement at JRTC and the Technology Refresh at JMRC. The areas of recency include past performance that has occurred not longer than 3 years in the past. The areas of relevancy include past performance that is similar in cost, schedule, and performance/experience on programs in the context in Attachment 1, PWS-2019-031 and Attachment 2, Requirement Matrix.

b. Offerors are cautioned that in conducting the past performance assessment, the Government may use data provided in the offeror’s proposal and data obtained from other sources. Since the Government may not necessarily interview all of the sources provided by the offerors, it is incumbent upon the offerors to explain the relevance of the data provided. Offerors are reminded that while the Government may elect to consider data obtained from other sources, the opportunity to identify relevant past performance risk rests with the offerors. In the case of offerors for which there is no information on past contract performance or where past contract performance is not available, the offeror may not be evaluated favorably or unfavorably on the Factor of Past Performance. The Government, however, may consider an offeror that does have a record of recent/relevant performance is worth more to the Government than an offeror that does not.

M.3.1.4 Past Performance Factor Rating Definitions

The following Relevancy Rating Method will be utilized in the evaluation Relevance:

RATING DEFINITION AND CRITERIA

Very Relevant Present/past performance effort involved essentially the same scope and magnitude of effort and complexities this solicitation requires.

Relevant Present/past performance effort involved similar scope and magnitude of effort and complexities this solicitation requires.

Somewhat Relevant Present/past performance effort involved some of the scope and magnitude of effort and complexities this solicitation requires.

Not Relevant Present/past performance effort involved little or none of the scope and magnitude of effort and complexities this solicitation requires.

Note: Past Performance Relevancy Rating: If an Offeror Relevancy Rating is Very Relevant, Relevant and Somewhat Relevant it shall be considered Acceptable. If an Offeror Relevancy Rating is considered Not Relevant it maybe deemed Unacceptable.

The following Acceptance/Unacceptable Rating Method will be utilized within Attachment 2, Requirement Matrix:

Rating Description

Acceptable Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort and meets the requirements of the solicitation.

Unacceptable Based on the offeror’s performance record, the Government does not have a reasonable expectation that the offeror will be able to successfully perform the required effort.

M.3.2 FACTOR 5 - COST/PRICE EVALUATION APPROACH.

NOTE: No Cost/Price information shall be included in any volume other than the Pricing volume.

M.3.2.1 Total Evaluated Price For evaluation purposes, the total evaluated price (TEP) will be the sum of the Offeror’s Proposed Price for each Section B line item. CLINs designated as “NSP” will not be included in the TEP. The Government will evaluate the Offeror’s TEP for fair and reasonableness using one or more of the techniques defined in FAR 15.404-1. Offers found to be unreasonably high may be considered unacceptable and may be excluded from further consideration for award.

Under the LPTA evaluation, submissions received will be reviewed to determine lowest price proposed; if among the submissions received the lowest price is determined to be technically acceptable, no further evaluations will be performed. If the lowest priced submission is determined to be not-technically acceptable, or not fair and reasonable, then the next lowest price submission will then be evaluated for technical acceptability, and so forth.

The award will be made to the responsible Offeror whose submission is evaluated, determined and conforms to the solicitation requirements, and whose submission, judged by an overall assessment of the evaluation criteria and other considerations specified in this solicitation, represents the “Lowest Price Technically Acceptable” offer. Submissions will be reviewed first for submission compliance.

If the submission is not administratively compliant with the solicitation instructions, it will be deemed “not compliant” and “not awardable”, and will not be evaluated.

Technically acceptable offerors will be determined based on the Offeror’s ability to fulfill the requirements set forth in the enclosed PWS.

Price Reasonableness: Only those proposals determined to be Technically Acceptable with a reasonable Total Evaluated Price (TEP) will be eligible for award. Adequate price competition is expected in response to this solicitation, normally resulting in a fair and reasonable price. Based on this premise, the Offeror is not required to provide certified cost or pricing data with its proposal. If, after receipt of proposals, the Contracting Officer determines that adequate price competition does not exist in accordance with FAR 15.403-1, the Offeror shall provide certified cost or pricing data as requested by the Contracting Officer.

Compliance and Completeness: The Government will evaluate proposal for compliance and completeness with all requirements of the solicitation, including any attachments and exhibits.

The Government will evaluate each proposal strictly in accordance with its content. Proposals that do not conform to the requirements of the solicitation may be rejected without further evaluation, deliberation or discussion.

Unbalanced Pricing: The Government will evaluate the pricing for the presence of unbalanced pricing. Offerors are cautioned that a proposal may be rejected if unbalanced pricing exists and the Contract Officer determines that the lack of balance poses an unacceptable risk to the Government.

The Government may determine that a proposal is unacceptable, despite an acceptable TEP, if the price of one or more contract line items is significantly overstated or understated within a pricing period, or between contract line items for the initial year and any out-year periods, as indicated by the application of the analysis techniques. Proposals with unbalanced pricing will be eliminated from further consideration if the Contracting Officer determines that the lack of balances poses an unacceptable risk to the Government. If rejected, the next lowest-priced proposal will be submitted for technical evaluation. Offerors are cautioned that a proposal may be rejected if unbalanced pricing exists and the Contracting Officer determines that the lack of balance poses an unacceptable risk to the Government.

Offerors are cautioned to present their best price submission up-front. The Offeror’s price submission shall represent the Offeror’s best effort to respond to the solicitation. In instances where an Offeror’s submission receives an “Acceptable” technical rating, yet proposed prices appear exceptionally low, Offerors may be requested to address this disparity, providing evidence of their capability and/or experience providing similar service(s) at similar price(s).

M.3.2.2 Financial Responsibility

DCAA will be requested to perform a Financial Capability Risk Assessment for the Prime offeror.

The Prime offeror must be deemed financially responsible by the Contracting Officer based on the Financial Capability Risk Assessment.
