Provision 52.212-1, ITO, Paragraph 2.a.(5)

Regarding “Responsibility Determination,”

Volume 1, Section E. What amount of funds would constitute “adequate financial resources?”

The government will not define an amount of funds that constitute “adequate financial resources.” Amendment 0003, Addendum to FAR Provision 52.212-1, ITO, Paragraph

2.a.(5), states the following, “Adequate financial resources are defined as the funds available to a business for spending in the form of cash, liquid securities and credit lines necessary to acquire needed facilities, equipment, or materials necessary for the successful completion of the contract. “

#24 68 Addendum to FAR

Provision 52.212-1, ITO, Paragraph 2.a.(5)

If there is sufficient “evidence of availability” of “adequate financial resources” are

“affirmative responsibility determination” or a

“Certificate of Competency” from the SBA still required?

Pursuant to FAR Subpart 9.104-1, “adequate financial resources” is one of seven elements that define contractor responsibility. The contracting officer is required to make an affirmative determination of responsibility on all the elements. #25 68 Addendum to FAR

Provision 52.212-1, ITO, Paragraph 2.a.(5)

The same paragraph says “The Offeror shall explain how they plan to have or obtain adequate financial resources.” If only a “plan” is needed, why is “evidence of availability” a

“must?”

The referenced Paragraph 2.a.(5) was revised in Amendment 0003, Addendum to FAR

Provision 52.212-1, ITO, as follows:

(5) Responsibility Determination. To assist in determining offeror/contractor responsibility IAW FAR Part 9, the offeror shall provide evidence of adequate financial resources or of its ability to obtain required financial resources (see FAR subpart 9.14-1(a)). Acceptable evidence consists of a commitment or explicit arrangement that will be in existence at the time of contract award. Acceptable evidence may include financial statements (balance sheet and income statements for the current period and prior fiscal year) or financial arrangements (resources to be used in support of contract performance such as internally generated funds, outside financing, or a combination of both). Adequate financial resources are defined as the funds available to a business for spending in the form of cash, liquid securities and credit lines necessary to acquire needed facilities, equipment, or materials necessary for the successful completion of the contract.
