L.2.5 Organizational Conflict of Interest
L.2.5.1 The provisions of FAR 9.5, Organizational Conflict of Interest (OCI), apply to any award under this RFP.
Potential Offerors should review their current and planned participation in any other Government contracts, subcontracts, consulting, or teaming arrangements where they may be in a position of actual or perceived bias or unfair competitive advantage. A common example with the potential for OCI is where an entity performs work both as a system contractor/subcontractor and as a Government support contractor for Government offices involved in this solicitation effort.
L.2.5.2 Offerors should disclose any potential OCI situations to the PCO as soon as identified including prior to proposal submission.
The disclosure should include the facts and an analysis of the actual or perceived conflict and a recommended approach to neutralize or mitigate the potential conflict. The preferred approach to potential conflicts is to negate/obviate the conflict. Mitigation is considered only if it is not practical to negate/obviate the conflict. The PCO will promptly respond to resolve any potential conflicts.
L.2.6 Single Proposal Submission: Offerors are limited to submitting one proposal with one approach to meeting the requirements of this solicitation. An Offeror is defined as an entity competing independently that does not share a common parent, does not have a parent/subsidiary relationship with any other Offeror, and is not affiliated with any other Offeror (as defined in Federal Acquisition
Regulation (FAR) 19.101).
L.3 All or None: Offers in response to this solicitation must be submitted for all the requirements identified in the solicitation.

L.5 RESERVED.
L.6 Specific Proposal Instructions: Offerors are responsible for including sufficient details (i.e. drawings, test data) to permit a complete and accurate evaluation strictly from a technical standpoint. The Technical Volume(s) shall have a separate index, which contains narrative titles that are cross-referenced to both the applicable Statement of Work (SOW) paragraph and page number. These indices shall not count against the Page limitations for the Technical Volume(s). The narrative discussions shall also be related to the applicable SOW paragraph by placing the appropriate SOW number at the beginning of the discussion text. The proposal shall be detailed and clearly stated to allow an assessment by the Government without the need for additional clarifications. In the response to the
Request for Proposal, the Offeror must address the following Factors and Subfactors:
L.6.1 Volume 2 Factor 1: Technical (maximum of 25 pages)
The Technical Factor includes the following two (2) Subfactors:
(1) Manufacturing Approach
(2) Qualification Test Panels
The Technical Volume must be subdivided to address each ASF ISO Technical Subfactor.
L.6.1.1 Subfactor 1: Manufacturing Approach. Offerors shall describe their step-by-step approach to manufacturing the ASF ISO shelter _____________________________________ models from purchase of raw materials, panel lay-up and bonding through final painting, including the general layout of the production line that will be utilized under this contract and equipment that will be used for the production and quality control of the ASF ISO shelters in order to meet the required delivery up to 10 shelters per month.
As part of this description, the Offeror shall also include their approach for the overall development, manufacturing and testing of the
First Article Units, including all subcontractors and Government testing facilities that will be utilized during First Article Testing, to include a listing of what tests detailed in ASTM E1977-11, ASTM E1978-11 and cited in Section C and where they will be performed.
The Offeror may propose allocating tests between ASF ISO shelter models, validating requirements by similarity between models, or combining testing of shelter models in order for the proposed test strategy to be more cost and schedule effective.
L.6.1.2 Subfactor 2: Qualification Test Panels. Offerors shall fabricate test panels and test specimens in accordance with ________________________________________ specifications ASTM E865 and ASTM E874. Offerors shall perform all testing on the fabricated sample test panels and test specimens required by ASTM E865 Section 6 Test Methods per paragraph 6.1 through paragraph 6.13 (excluding paragraph 6.10 Dead Load Stress
Durability Test which is not required for this proposal). Upon completion of all testing, the Offeror shall submit to the Government all test specimens and test panels that were subjected to testing per ASTM E865, a certified copy of the laboratory test report, and a copy of the process specification covering fabrication of the metallic-faced, structural non-metallic honeycomb core sandwich panels that the
Offeror proposes to use in the construction of the end item. In addition, one (1) untested bonded sample panel, 4 in. x 4in. minimum, 24
in. x 24 in. maximum shall be provided by the Offeror. Submit the panels to U.S. Army Natick Soldier RDEC, Expeditionary Command
Platforms Branch, MacGillivary Hall R240, Attn: Mark Albano, General Greene Ave, Natick, MA 01760. Test panels, specimens, and test report must arrive at the U.S. Army Natick Soldier Center at the address above, two days prior to the close of the RFP. Upon request of the Offeror, the Government will return the sample test panels and test specimens to each Offeror after the contract award decision has been made. (Not counted towards page limit).
L.6.2 Volume 3 Factor 2: Past Performance
L.6.2.1 For the Past Performance Factor, provide information for a total of up to three recent and relevant contracts performed by the offeror as the prime contractor and not more than one recent and relevant contract performed by a significant sub-contractor. These may include foreign, federal, state, local and private industry contracts. The Government will not consider the past performance of any individuals or key personnel; only corporate past performance will be considered. For purposes of this Past Performance Factor, if a joint venture (JV) entity is the offeror, the JV members will be considered the offeror, regardless of how the JV is legally structured.
Recent contracts are those performed within five years of the date of issuance of this RFP.
(a) Definition of Contract for the Past Performance Factor: The purpose of this Factor is to evaluate the contractors past performance on recent and relevant prior contract actions. Therefore, a broader contract instrument(s) (e.g. Indefinite Delivery contracts, Federal
Supply Schedules, Blanket Ordering/Purchasing Agreements) that doesnt authorize contract performance, and involves separate contract instrument(s) (e.g. task/delivery order, work directive) to authorize contract performance does not constitute a contract under this
Factor and will not be considered, if submitted. Where prior past performance is under a broader instrument, the offeror can only propose the specific individual contract instrument (e.g. task/delivery order, work directive), which will be considered a contract for this Factor. This definition will apply to the term contract used throughout this Factor. The following are examples of a contract:
(1) a single task or delivery order placed under a single-award or multiple-award Indefinite-Delivery contract (FAR 16.501-1) that does not contain multiple work directives or similar instruments which contain separate statements of work; or,
(2) a single work directive or similar instrument which contains a separate statement of work issued under a broader contract; or, 20 31
Name of Offeror or Contractor:
PIIN/SIIN MOD/AMD
(3) a single order placed under a basic ordering agreement (BOA) (FAR 16.703); or,
(4) a single order issued under a federal supply schedule (FSS) (FAR 8.405-2); or,
(5) a single order issued under a single-award or multiple-award blanket purchase agreement (BPA) (FAR 8.405-3 or FAR 13.303
(6) a stand-alone Government or private industry contract which that is not a broader instrument.
(b) Relevant Past Performance will consider the extent to which the submitted contract efforts are comparable in scope and magnitude of effort and complexity to the following statement of work requirements:
i. Similar or relevant efforts are defined as those contracts encompassing in scope the design and production requirements involving shelters or components of a nature similar to the effort required by this contract. The contract effort must have involved the fabrication of Army Standard Family (ASF) ISO shelters or similar items that meet the requirements of ASTM's E1977-11 and E1978-11 or;
ii. Have been involved in the modification of shelters that were produced to meet the requirements of ASTM's E1977-11 and E1978-11.
Modifications include but are not limited to the installation, repair, removal, replacement, attachments and the integration of systems totaling at least 33% of the unit cost.
L.6.2.1.1 Significant subcontractors are defined as team members or first or second tier subcontractors performing 25% or more of the total value of the Offeror's proposal.
(a) With respect to the prime, submit the L.6.2.1 specified information on at least three recent/current contracts that you consider most relevant to that portion of this RFP that you propose to perform.
(b) With respect to each significant subcontractor, submit the L.6.2.1 specified information on no more than two recent/current contracts performed by the subcontractor that are relevant to that portion of this RFP that you propose for performance by that subcontractor.
L.6.2.2 Contract Information: For each of the contracts submitted, provide the following information:
(a) Contractor name and address who performed the contract;
(b) Contract Number (and delivery/task order number if applicable);
(c) Contract Type;
(d) Total Value of the Contract (beginning & ending value);
(e) Delivery or Performance Schedule;
(f) Government or private industry contracting activity address, telephone number and e-mail;
(g) Procuring Contracting Officers (PCO) and/or Contract Specialists name, or point of contact for private industry entity responsible for signing or administering the contract, telephone number and e-mail;
(h) Government (DCMA) or commercial administrative contracting officer (ACO), contracting officers representative (COR), performance certifier, and/or quality assurance representative (QAR), name, telephone number and email;
(i) Specify the Government or Contractor Point of Contact(s) for which the Questionnaire sent, and provide the date(s) it was sent.
(j) A description of work performed by the offeror, and a discussion of the similarities of the work performed between the cited contract scope (referencing specific locations within the scope, such as paragraph number, etc) to each of the statement of work requirements identified above in L.6.2.1 (b) that the offeror believes demonstrates relevance. In its description, the offeror should specify the location in the proposal (to include filename or document reference with page and paragraph of the past contract information) that substantiates the relevance;
(k) Contract period of performance;
(l) Provide a brief self-assessment of contract performance. The self-assessment must address performance to meet Technical and Schedule requirements; and
(m) Copies of the Statements of Work from each of the submitted contracts to substantiate comparable scope, magnitude and complexity to the contract. If the Statement of Work is not available, the offeror may submit additional information to substantiate relevance to the statement of work activities listed in L.6.2.1 (b) above.
L.6.2.2.1 Note: Regarding L.6.2.2 (l) above, and in evaluating each Offeror's performance history, the Government will look at the
Offeror's delivery performance against the contract's original delivery schedule unless the delay was caused by circumstances outside of the Contractors control. Schedule extensions that were the fault of the Offeror, even if consideration was provided, may be counted against the Offeror.
L.6.2.3 Past Performance Questionnaire. A past performance questionnaire is provided in Attachment 019. For each contract submitted by the Offeror, the Offeror shall send a copy of the past performance questionnaire directly to the appropriate PCO, COR or other appropriate technical and contracting individuals. The Offeror shall request that these individuals complete the questionnaire and forward it electronically directly to the Government at "mailto:Jacob.a.silcox2.civ@mail.mil " as soon as possible and prior to the
RFP closing date (See Block #9 of the SF33) cover page to this solicitation) with the subject heading PAST PERFORMANCE INFORMATION FOR
[Offeror name].
L.6.2.4 Interorganizational Entities. If any contract submitted as part of the Past Performance Factor was performed by an interorganizational entity other than the Offeror but who would perform work under this RFP, please identify the interorganizational entity explain the related to the Offeror, and explain how the resources of the other entity will be utilized in the performance of this effort.
L.6.2.5 Predecessor Companies. If you only have recent and relevant performance history as a part of a predecessor company, the
Government may consider that past performance in the evaluation of past performance. Please provide the information for those recent and relevant contracts of that predecessor company and explain how…
