QUESTION ANSWER

Does the Government intend to release the Draft L&M sections of the RFP and if so, can the Government please provide a timeline on when this is expected to occur?

The Government has posted the Draft RFP with Sections L&M in FBO.

If the Prime contractor does not hold a current FCL can they subcontract the receiving, viewing, housing and safeguarding of SECRET materials to a small business that holds a FCL? Would the government view this as a compliant proposal?

No, Government would not find this proposal compliant. For the classified components of this requirement, both the Prime and Sub Contractors who will handle classified data are required to have an FCL and the ability to receive, view, house, and safeguard SECRET materials and Classified data.

The requirements for both Prime and subcontractors (only those subcontractors who will handle classified data) to have FCLs is driven by Army Regulation 380-49 Chapter 7 which states: "Prime contractor FSOs are responsible for ensuring their subcontractors are knowledgeable of and comply with relevant law, policy, and other security requirements (see DOD 5220.22–M, DA regulations, or installation requirement) as identified in the contract, DD Form 254, and/or other contracting documents"; also see: " Prime contractors have a responsibility to provide oversight of their subcontracts in accordance with the DOD 5220.22-M, and must identify and report to DSS, and the COR any security measures or requirements that are found either to be inadequate or excessive, and request a revision to the DD Form 254."; see also: "Subcontract FCLs cannot be at a level higher than the FCL of the prime contract."

As we understand the requirements, the only classified portion of this program would be the Annex that is part of the transparent armor ATPD. Therefore, if our transparent armor supplier has the appropriated FCL, would we as the prime contractor have to have one, too? Also, has the government considered restricting this potential solicitation to HUB Zone companies only?

The Prime Contractor is required to have a valid FCL and the ability to receive, view, house, and safeguard SECRET materials and Classified data.

For classified components, both the Prime and the Subcontractor are required to have FCL prior to having access to or reviewing Classified Material. The requirement for both prime and subcontractors to have FCLs is driven by AR 380-49. See Question 2 for specific citations Based on the results of the Government Sources Sought/Market Research, the Government does not intend to compete the FMTV Protection Kit effort as a Hub Zone set aside.

4 When do you plan to post Section L and M for this draft solicitation? The Government has posted the Draft RFP with Sections L&M in FBO.

Will TACOM in the Source Selection Process eliminate all proposals that don't have Personnel / Facility Clearance presently or will TACOM accept the proposal and support the sponsorship if awarded the contract?

Interested Contractors could not meaningfully respond to the Request for Proposal without access to classified information. The Government does not intend to sponsor interested Contractors to obtain an FCL.

If the proposal is submitted by a Non Security Cleared Personnel and Facility and the ballistics glass manufacturer or supporting vendor has a Personnel / Facility Clearance presently will the proposal be eliminate or considered?

Prime Contractors responding to this RFP should have a valid/active FCL and the ability to receive, view, house, and safeguard SECRET materials and Classified data. At the same time, Sub Contractors to the Prime who deal with Classified Information should also possess an FCL and have and the ability to receive, view, house, and safeguard SECRET materials and Classified data. The requirement for both prime and subs to handle classified information is driven by Army Regulation 380-49. See Question 2 for specific information.

I had a question regarding the security clearance. In the solicitation, it notes that the offeror must require a SECRET security clearance upon submission.

The Government will release the formal Request for Proposal when the RFP package is fully approved. Please continue to monitor FBO. Please note that Offerors must have a copy of the classified specification, prior to proposal submission, in order to meaningfully respond to this RFP. In order to receive the classified specification, offerors must possess appropriate FCL (Secret) and the ability to receive, view, house, and safeguard SECRET materials and Classified data.

As an interested party who has already received the TDP CD, we would like to know if the Gov’t has a timeframe in mind for release of the formal RFP and anticipated due date?

The Government will release the formal Request for Proposal when the RFP package is fully approved, currently targeted for mid-to-late October. This target is SUBJECT TO CHANGE. Please continue to monitor FBO.

How do I obtain information to process an Facility Clearance (FCL)? DSS is the processing and approving organization for FCLs. Please review the Defense Security Service (DSS) FCL Handbook (http://www.dss.mil/documents/facility-clearances/FCL_Orientation_Handbook_18FEB15.pdf) and/or visit www.dss.mil for ALL inquiries regarding the FCL process.
