About this file

This modification amends Request for Proposal W52P1J-17-R-0141 for the production of small caliber ammunition and operation of the Lake City Army Ammunition Plant. Key changes include revising the consideration calculation methodology to use a weighted average unit price for delinquent quantities, updating price matrices and removing an item, and allowing contractor input for currency fluctuation factors. The contract will cover Fiscal Years 2020 through 2029 with a transition period in 2030 and include a base period with five one-year ordering periods, two evaluated one-year option periods, and a three-year award term. The Army Contracting Command-Rock Island will conduct a best value evaluation for a firm-fixed-price contract to maintain and modernize the government-owned, contractor-operated Lake City facility in Independence, Missouri and produce small caliber ammunition.

SECTION F - DELIVERIES OR PERFORMANCE

ORDERING/REQUIRED DELIVERY SCHEDULE___________________________________

(a) Ordering: Ordering periods correspond to the Government's fiscal year, with the exception of the first and the last periods. The

Government's fiscal year runs from October 1st to September 30th.

(b) Required Delivery Schedule: Prior to issuance of a production award, the Government and contractor will negotiate a contract delivery schedule for the quantity to be awarded, in six-month increments known as delivery periods. Any previously established contract delivery schedule for quantity already on contract will remain unchanged unless approved by the Contracting Officer. This negotiated contract delivery schedule will be at the DODIC level, with the Government determining production priority at the MILSTRIP level. Upon execution of a delivery order, the Contractor is obligated to deliver the DODICs and associated quantities outlined in the contract during the established six-month delivery periods.

Six month delivery periods will coincide with the Government Fiscal Year (GFY) as follows: October 1st - March 31st and April 1st -

September 30th. Delivery dates negotiated for issuance of a production award shall not exceed September 30th of the subsequent GFY, unless approved by the Contracting Officer.

Example:_______

DO 0001_______

Ordering Period: October 1, 2019 - September 30, 2020

Delivery Schedule Not-to-Exceed (NTE): September 30, 2021 regardless of when the order is placed during the ordering period

DO 0002_______

Ordering Period: October 1, 2020 - September 30, 2021

Delivery Schedule NTE: September 30, 2022 regardless of when the order is placed during the ordering period

The contractor shall provide a monthly forecast for ammunition deliveries on the contract delivery schedule on a per DODIC basis. The monthly forecast shall be provided for the entire delivery period at time of award for new orders, and shall clearly articulate the contractor's monthly forecast for ammunition deliveries. While not contractually binding, a timely and accurate monthly forecast is necessary in order for the Government to communicate expected ammunition deliveries to stakeholders and ensure readiness for all customers.

If the actual delivery quantity varies from the six month contract delivery schedule, the contractor shall propose a re-baselined schedule, to include a monthly forecast, no later than the 5th working day after the delivery period. The re-baselined schedule shall include all undelivered quantity on contract as of the last day of the previous six-month delivery period, and shall represent a contract delivery schedule that is realistically achievable. No variances from the previous six months will be continued into the rebaseline, and the contract delivery schedule will start over with each six-month period. The previous contract delivery schedule will no longer be valid once the rebaseline is incorporated into the contract. The Government reserves the right to unilaterally incorporate a contract delivery schedule if the parties cannot reach an agreement.

At the end of the six-month delivery period, consideration may be assessed for all delinquent DODICs in accordance with the formula and table below. The Government may also pursue further remedies to offset any harm caused as a result of the late delivery.

Consideration will be based on actual performance for the prior six-month delivery period and will not take into account when the delinquency is scheduled to be made up. Consideration will be calculated for each DODIC and summed to determine the total consideration owed. The value of delinquent quantity will be calculated utilizing a weighted average unit price of all delivery orders with undelivered quantity, multiplied by the number of units undelivered.

Percent Delivered Consideration Charge_________________ ____________________

93% or greater No Penalty

75% - 92.9% Value of delinquent quantity x 25% of prompt payment rate

50% - 74.9% Value of delinquent quantity x 50% of prompt payment rate

49.9% or below Value of delinquent quantity x 100% of prompt payment rate

The Prompt Payment rate is be defined as the current rate published by the U.S. Department of the Treasury. Current rates can be found at: https://www.fiscal.treasury.gov/fsservices/gov/pmt/promptPayment/rates.htm

In addition to consideration, the Government reserves the right to rescind commercial use as outlined in Narrative H0003, Facility Use

Requirements.

The Government reserves the right to change priorities at the MILSTRIP level at no additional cost to the Government as long as the total contract quantity per DODIC does not change within the six-month delivery periods.

In the event of a national emergency, including engagement in conflict or declaration of war, the Government reserves the right to

establish monthly contractual delivery schedules at no cost to the Government, and shall not be held liable for any effects resulting from this change. In addition, the Government can establish monthly contract delivery schedules if there is a readiness issue on a specific DODIC(s).

The contractual cutoff date for submittal of Receiving Reports for acceptance is 1200 CST on the second to last business day of each month, unless otherwise agreed to by the LCAAP Chief, Production and Ballistics. Upon acceptance, the Contractor is required to ship lots within 30 days unless an extension to this timeframe is granted in advance by the Contracting Officer.

Any delinquencies or delays in delivery caused by the contractor's failure to submit an adequate FAT waiver request will be deemed contractor fault. This failure does not constitute an excusable delay. Government-denial of the Contractor's waiver request is also not excusable for any delinquencies or delays in delivery.

Disputes and controversies of any nature whatsoever between the Government and contractor regarding this narrative will be settled via determination by the Contracting Officer. The Contracting Officer's determination shall be final and binding on the Government and contractor.
