About this file

This is Amendment 0003 to Request for Proposal (RFP) W519TC-25-R-0009 for EAGLE Fort Irwin (FICA), issued by the Army Contracting Command – Rock Island on February 24, 2026. The amendment was issued as a Memorandum for Record due to a system outage with the Government's contract writing system (PADDS) and is distributed to all 8(a) Small Business EAGLE BOA holders. The amendment incorporates responses to industry questions 18-57 via Attachment 0034 (Q&A Template, dated February 24, 2026) and updates four Section J attachments: the Cost Price Matrix (Attachment 0005, dated February 23, 2026), Contract Reference Spreadsheet (Attachment 0011, dated February 6, 2026), CBS-SCA Crosswalk (Attachment 0016, dated February 9, 2026), and the Q&A Template (Attachment 0034, dated February 24, 2026).

The amendment modifies RFP Section C, Paragraph C.2(c) regarding contractor fixed fee assessments for validated negative Performance Management Reviews (PMRs) and unresolved Corrective Action Requests (CARs). The fee reduction schedule distinguishes between critical nonconformance (10% and above monthly), major nonconformance (7-10% daily), and minor nonconformance (5-7% daily). Additionally, Amendment 0003 updates RFP Section L, Paragraph L.5.4.2.12(a)(2) to clarify direct labor rate compliance with the Service Contract Act and Collective Bargaining Agreement (CBA) rates, specifying that offerors should assume a June 22, 2026 Notice to Proceed date and detailing CBA expiration dates: June 22, 2027 for the International Association of Machinists and Aerospace Workers (IAMAW) and December 31, 2026 for Teamsters Union Local 166. The proposal submission deadline has been extended from March 3, 2026 at 1200 Central Time to March 6, 2026 at 1600 Central Time. All other RFP terms and conditions remain in effect, and submission is limited to 8(a) Small Business EAGLE BOA holders interested in the requirement.

FROM:

C.2.c. Contractor's Fixed Fee will be assessed for validated negative PMRs, unresolved CARs or as determined by the PCO IAW FAR 52.246‐5 using the following schedule:

Critical Nonconformance ‐ Contractor's fee will be assessed not less than 10% of the monthly fixed fee in which the critical nonconformance occurred. PCO determination will address the exact fee decrement based on severity, impact to the effort, contractor willingness to resolve and any other factors as deemed relevant by the PCO.

Unresolved CARs ‐ Contractor's fee will be assessed not less than 5% of the daily fixed fee starting with first day of delinquency in resolution. Fee reduction percentages are assigned as follows; however, the PCO has the discretion to apply whatever percentage it deems reasonable based on severity, impact to the effort, contractor willingness to resolve and any other factors as deemed relevant by the PCO.

Percentage of Fee:

Critical: 10% and above (monthly)

Major: 710% (daily)

Minor: 57% (daily)

The Contractor will be given the opportunity to comment and respond to issued CARs during the PMR prior to the Government executing a fee decrement.

Definitions:

Critical nonconformance - a nonconformance that is likely to result in hazardous or unsafe conditions for individuals using, maintaining, or depending upon the supplies or services; or is likely to prevent performance of a vital agency mission. Repeated or unresolved major nonconformance will result in re-designation as critical nonconformance.

Major nonconformance - a nonconformance, other than critical, that is likely to result in failure of the supplies or services, or to materially reduce the usability of the supplies or services for their intended purpose. Repeated or unresolved minor nonconformance will result in re-designation as major nonconformance.

Minor nonconformance - a nonconformance that is not likely to materially reduce the usability of the supplies or services for their intended purpose, or is a departure from established standards having little bearing on the effective use or operation of the supplies or services.

Unresolved CAR- a CAR remaining unresolved, or unacknowledged, past the PCO established suspense date. May be re-designated as minor, major or critical based on the PCO independent determination.

Daily Fee - The yearly fixed fee amount divided by 12 months divided by 30 days.
