About this file
This is Amendment 0006 to Solicitation W50S8326BA001, issued by the W7NC USPFO on July 9, 2026, for a construction project with solicitation number W50S8326BA001 dated April 30, 2026. The amendment is administered by the W7NC USPFO Activity in Bangor, Maine (contact: Daniel Boone, 207-404-7419). The project number is FKNN159044. The amendment removes previous language regarding a mandatory Project Labor Agreement (PLA) from Section 00 22 13 (Supplementary Instructions to Bidders), replacing it with updated requirements under the Revolutionary FAR Overhaul (RFO) FAR 36.002 and RFO FAR subpart 22.5.
Under the revised requirements, the resulting contract mandates a Project Labor Agreement. Only the apparent successful offeror must submit an executed PLA and Letter of Assent prior to contract award upon notification of intent to award. Failure to provide an acceptable PLA meeting all mandatory elements results in the offeror being deemed non-responsible and ineligible for award. The six mandatory PLA elements are: binding applicability to all contractors and subcontractors; open competition without regard to collective bargaining status; strict disruption guarantees against strikes and lockouts; effective and prompt dispute resolution procedures; labor-management cooperation mechanisms on productivity, quality, safety, and health; and inclusion of any additional agency requirements for mission success. Offerors are encouraged to begin preliminary coordination with the Maine State Building & Construction Trades Council (President Jason J. Shedlock, P.O. Box 8261, Portland, ME 04104, 207-613-0584, jshedlock@unionsbuildmaine.org) to ensure timely submission if selected as the apparent successful offeror.
