Question 1: 52.203-2 “CERTIFICATE OF INDEPENDENT PRICE DETERMINATION” – do we have to fill in the blanks and return the full clause or could we make a statement of compliance?
Answer 1: Yes, you must fill in the blanks. The full text for 52.203-2 does need to be included in your proposal.
Question 2: 52.209-5 and 52.209-7 – I plan to provide a statement on company letterhead that our SAM registration is complete and current. Will this suffice? Does my SAM certification address this?
a. There are other sections of this solicitation that are like this as well (i.e. 52.222-22 and 52.222-25). If your answer to the above question is yes, I will apply the logic that they don’t need to be addressed individually as well.
Answer 2: 52.209-5, 52.209-7, 52.222-22, and 52.222-25 must be filled in. A vendor’s SAM information will support the information in the fill-ins; therefore, vendors must ensure their information in SAM is up-to-date and complete.
Question 3: 52.212-1 (k) – Is a statement on company letterhead providing that our SAM registration is complete and current sufficient?
a. This also applies to Page 656 Submission of Proposals third bullet point regarding SAMS/reps and certs
Answer 3: Yes, as long as the vendor can certify all information in SAM database is complete and current. If the Representations and Certifications section in SAM is not complete, the offeror must complete the section in the solicitation.
Question 4: Government Surplus Material p. 639 – Can we just provide a statement confirming the clause does not apply to us? There’s no option in this section to note that the clause doesn’t apply.
Answer 4: Yes
Question 5: Under Compliance with Specifications - Reasonableness of Pricing p. 696 – Is this section required? The language in the solicitation says the vendors “cooperation is requested”, not required
a. If so, in section (e), are we required to submit three examples for each line item being quoted?
Answer 5: The supporting documentation is not required but the Government highly encourages the vendor’s cooperation in providing the requested information. The three (3) examples shall be for three (3) separate items. An offeror may provide more than three (3) but no less than three (3) examples.
Question 6: Is the government required to purchase all material forecasted? In other words, if individual releases are not placed against the given delivery order that sum to the total the full DO amount (both in quantity and dollar amount), is the respective shipyard obligated to create a release for the remaining material?
Answer 6: Per Amendment 0003 the following information has been inserted under Statement of Work and Specifications:
“Forecasts Delivery orders providing the forecasted demand per quarter are strictly forecasts. In the event the forecasted demand is not purchased in full by the end of the year, the Government is not required to purchase the remaining balance. It is the Contractor's responsibility to exercise efficient inventory management in order to support the just in time delivery requirements. See reference FAR 252.216-7010 REQUIREMENTS--BASIC (APR 2014).”
Question 7: Supply of individual components comprising a pre-tested two component kit
a. Two-Component Products p. 705 – “Only batches of parts that have been pre-tested and approved by the Government for use together shall be delivered.”
b. Sampling of Material for Conformance p. 706 – “For delivery of kits consisting of multiple parts, only batches of parts that have been pre-tested and approved for use together shall be delivered.”
c. Vendor Question: Can the requirement as its written be changed and updated to reflect the current process – one that was agreed upon by each individual shipyard as well as NAVSEA. This of course would only apply to CLINS that apply to critical areas.
Answer 7: Receipt inspect coating systems in accordance with applicable coating specification requirements (e.g. MIL-PRF-24647) and NAVSEA-reviewed ASTM F718. Receipt inspect mixed coating for dry hard time, sag resistance, and color of dry film. Receipt inspection testing is not required for those characteristics provided on the manufacturer's certificate of compliance or conformance test data forms, or another shipyard's receipt inspection test data forms that meet the applicable coating specification requirements. With that said dual component coatings are required to be tested and supplied together. Note: these are the requirements however; shipyards are allowed to waive these requirements on a case by case basis as needed to support the mission.
Question 8: Can you provide a list of the CAS numbers for the target chemicals?
Answer 8: CAS numbers for the target chemicals are listed in the Naval Sea Systems Command (NAVSEA) Prohibited and Controlled Chemical List (PCCL) ltr dtd 26 November 2008.
Question 9: Is there a way for us to do tiered pricing? For instance if we want to quote different prices for certain quantity thresholds for a given CLIN, can we do that? If so, how?
Answer 9: Yes, Tiered pricing should be indicated in the “Vendor Comments” column of the items list spreadsheet to be included in Volume II of the proposal package.
