A. This amendment is hereby issued to address the following:

1. Section M of the RFP is revised to add a preliminary evaluation factor as follows:

PRELIMINARY EVALUATION FACTOR – NO COST

Any resultant contract will be at no cost to the Government. Therefore, as a preliminary evaluation factor, the proposal will be evaluated for whether it includes a fee, cost, or any charge to the Government for the proposed work. The proposal must clearly demonstrate an understanding that the Government will not pay the offeror for the proposed work before, during, or after the period of performance. Such understanding must be demonstrated by (i) no fee, cost, or any other charge to the Government for the proposed work being present in the offer, and (ii) offeror’s inclusion of the following certification in the proposal: ‘This is an offer for a contract at no cost to the Government. The offeror certifies that the proposal does not contain any fees, costs, or charges to the Government.’

This preliminary evaluation factor will be evaluated on an acceptable/unacceptable basis as follows:

Acceptable: The proposal contains no fee, cost, or any other charge to the Government for the proposed work, and it includes the following certification:

‘This is an offer for a contract at no cost to the Government. The offeror certifies that the proposal does not contain any fees, costs, or charges to the Government.’

Unacceptable: The proposal contains a fee, cost, or other charge to the Government for the proposed work, or the proposal lacks the following certification: ‘This is an offer for a contract at no cost to the Government. The offeror certifies that the proposal does not contain any fees, costs, or charges to the Government.’

If an offeror is rated “Acceptable” under the preliminary evaluation factor, the offeror may be considered for award on a trade-off basis under the Weighted Evaluation Factors (Factors 1 through 6, to include subfactors). If an offeror is rated “Unacceptable” under the preliminary evaluation factor, the offeror will not be eligible for award; if such an unacceptable offer has not already been removed from the competition as of the deadline to submit final offers, the offer will not be evaluated under the Weighted Evaluation Factors and will be eliminated from the competition.

2. The first paragraph of Clause FAR 52.212-2 -- EVALUATION -- COMMERCIAL ITEMS (OCT 2014) is revised as follows:

To be considered for an award, an offeror must meet or exceed all non-price factors. There is one (1) preliminary evaluation factor evaluated on an acceptable/unacceptable basis, and there are six (6) weighted evaluation factors evaluated on a tradeoff basis.

The preliminary evaluation factor is “No Cost,” and the offeror must receive an “Acceptable” rating under the preliminary evaluation factor to be considered for award.

The six (6) weighted evaluation factors are 1) Technical Approach, 2) Management Approach, 3) SEA Card® Electronic Access System (EAS), 4) Merchant Acceptance with Level III Data Plan, 5) Past Performance and 6) Price. To be considered for an award, an offeror must meet or exceed all non-price factors of the six (6) weighted evaluation factors. For the six (6) weighted evaluation factors: when combined, the non-price factors of Technical Acceptability, Management Approach, SEA Card® Electronic Access System (EAS), Merchant Acceptance with Level III Data Plan, and Past Performance are significantly more important than Price.

3. The Period of Performance is revised as follows:

PEFORMANCE PERIOD (Base and Option Periods): The period of performance for contract(s) awarded under this solicitation will be July 1, 2022 through June 30, 2025. The transition period for the contract(s) awarded under this solicitation will be from January 1, 2022 through June 30, 2022.

The first option year for the contract(s) award under this solicitation will be July 1, 2025 through June 30, 2026; and the second option year will be July 1, 2026 through June 30, 2027.

TO:

PEFORMANCE PERIOD (Base and Option Periods): The period of performance for contract(s) awarded under this solicitation will be January 1, 2023 through December 31, 2025. The transition period for the contract(s) awarded under this solicitation will be from July 1, 2022 through December 31, 2022. The first option year for the contract(s) award under this solicitation will be January 1, 2026 through December 31, 2026; and the second option year will be January 1, 2027 through December 31, 2027.

B. All other terms and conditions for this solicitation SPE608-21-R-0202 remain unchanged.
