FAR 52.219-7 NOTICE OF PARTIAL SMALL BUSINESS SET-ASIDE (DEVIATION) is included in Section I. However, this deviation will be updated with DLA Energy’s one-time deviation in a later amendment.

6. FAR 52.219-7 NOTICE OF PARTIAL SMALL BUSINESS SET-ASIDE (OCT 2020)

7. FAR 52.219-7 NOTICE OF PARTIAL SMALL BUSINESS SET-ASIDE (NOV 2020)

(DLA DEVIATION FEB 2021) is hereby added as the following:

FAR 52.219-7 NOTICE OF PARTIAL SMALL BUSINESS SET-ASIDE (NOV 2020) (DLA

DEVIATION FEB 2021)

(a) Definition. “Small business concern,” as used in this clause, means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the size standards in this solicitation.

(b) Applicability. This clause applies only to contracts that have been partially set aside for small business concerns.

(c) General.

(1) A portion of this requirement, identified elsewhere in this solicitation, has been set aside for award to one or more small business concerns identified in 19.000(a)(3). Offers received from concerns that do not qualify as small business concerns will not be considered for any set-aside portion of this requirement unless no acceptable offers from responsible small business concerns are received, or the only offers received from small business concerns would be detrimental to the public interest (e.g., payment of more than a fair market price). If eligible small business concerns do not offer a quantity of product sufficient to meet a set-aside requirement, or the only offers received from small business concerns would be detrimental to the public interest (e.g., payment of more than a fair market price), the Government may make awards to the otherwise low offeror for all or any portion of the applicable set-aside quantities, without regard to the size of the offeror.

(2) Small business concerns shall submit offers in the same manner as though there were no set-aside. Quantities offered by qualified small business concerns will be evaluated for the non-set-aside and set-aside portions of the procurement.

(3) Offers on the non-set-aside portion will be evaluated first, and the evaluation will be conducted as though there were no set-aside. Negotiations for the set-aside portion will be conducted thereafter. The price for the set-aside portion will be negotiated by the contracting officer based on prices the Government would otherwise pay the successful offeror had there been no set-aside of the location under this solicitation, adjusted for transportation charges and other factors.

(4) The contractor(s) for the set-aside portion will be selected from among the small business concerns that submitted responsive offers on the non-set-aside portion. Except as provided below, negotiations will be conducted with the concern that submitted the lowest responsive offer on the non-set-aside portion. If the negotiations are not successful or if only part of the set-aside portion is awarded to that concern, negotiations will be conducted with the concern that submitted the second-lowest responsive offer on the non-set-aside portion. This process will continue until a contract or contracts are awarded for the entire set-aside portion, or set-aside negotiations have been unsuccessful with all small business concerns that submitted offers. In the case of a small business concern whose offer is determined by the evaluation process to provide the lowest overall cost to the Government for the solicited items as a whole, award of a set-aside portion will be made to that small business concern without further negotiation. A small business concern will not be awarded a set-aside portion at a price higher than its offer price under the non-set-aside portion.

(5) The total quantity that will be awarded to a small business concern on both the non-set-aside and set-aside portions will not exceed the total quantity offered under this solicitation by such small business concern. However, if insufficient product is offered by small business concerns to meet the quantity set aside for small business, small business concerns with which the Government has already commenced negotiations may be given an opportunity to offer additional product.

(6) Following the conclusion of negotiations and evaluation for the set-aside portion, final award quantities will be determined, accounting for the set-aside quantities to be awarded to small business concerns and any set-aside quantities remaining unawarded following set-aside negotiations.

(d) The Offeror shall—

_Submit a separate offer for each portion of the solicitation for which it wants to compete (i.e., set-aside portion, non-set-aside portion, or both); or

X Submit one offer to include all portions for which it wants to compete.

(e) Partial set-asides of multiple-award contracts.

(1) Small business concerns will not compete against other than small business concerns for any order issued under the part or parts of the multiple-award contract that are set aside.

(2) Small business concerns may compete for orders issued under the part or parts of the multiple-award contract that are not set aside, if the small business concern received a contract award for the non-set-aside portion.

(f) Agreement.

(1) For a contract or an order at or below the simplified acquisition threshold, a small business concern may provide the end item of any firm. For a contract or an order exceeding the simplified acquisition threshold, unless the Small Business Administration has waived the requirements of paragraphs (f)(1)(i) through (iii) of this clause in accordance with 13 CFR 121.1204, a small business concern that provides an end item it did not manufacture, process, or produce, shall—

(i) Provide an end item that a small business has manufactured, processed, or produced in the United States or its outlying areas;

(ii) Be primarily engaged in the retail or wholesale trade and normally sell the type of item being supplied; and

(iii) Take ownership or possession of the item(s) with its personnel, equipment, or facilities in a manner consistent with industry practice; for example, providing storage, transportation, or delivery.

(2) For contracts or orders for multiple end items, at least 50 percent of the total value of the contract or order shall be manufactured, processed, or produced in the United States or its outlying areas by small business concerns.

(3) Paragraphs (f)(1) through (2) of this clause do not apply to construction or service contracts.
