No. Subject Question/Comment Response RFP Related Questions
1. Intentionally left blank.
2. Intentionally left blank.
3. RFP Confirm that existing CPARs and/or PPQs can be used for past performance references.
Use of CPARS/PIPRS may be used for the list of three (3) contracts, however, each reference submitted must be accompanied with its own Past Performance Questionnaire (PPQ).
4. RFP The PWS does not state if this is a prevailing wage project for both CLIN 0001 and/or 0002, though Attachment J did contain wage rates. Are we required to use Appendix J wages for both CLIN 0001 and 0002 or, since this is a services project, are private sector rates acceptable?
By Federal law, workers in any classification listed on the Wage Determination must be paid minimum wages in accordance with FAR 52.222‐41 (c), or higher, listed for the place of performance;
Professionals are to be paid competitive private sector rated determined by the contractor and the employee’s contract.
5. RFP PWS Section 7.1 Project experience only refers to Bulk Fuel facilities. Will other types of petroleum projects such as Petroleum Refineries or Underground fuel lines be considered as relevant project experience because they are similar in contaminants of concern and remedial complexity?
Only experience at bulk fuel storage facilities (BFSF) will be considered, and that BFSF experience could be located at a refinery.
However, experience must demonstrate relevancy to work in this solicitation.
6. RFP The solicitation (SPE600‐17‐R‐0505), under ADDENDUM TO
52.212‐1 – INSTRUCTIONS TO OFFERS – COMMERCIAL
ITEMS (APR 2014), Proposal Organization, Subfactor 5 of the Volume I, states “The maximum time offered by the contractor for the contractor’s approved project manager to be on the site of an incident located within a 125‐mile radius of DFSP Point Loma Bldg 604 within 8 hours of a telephonic notification by the Contracting Officer.” Is the response time 8 hours stated here or 12 hours as indicated in the PWS? Is the response time based upon notification by the Contracting Officer or DLA – as in someone other than the CO?
The response is within 8 hours, not 12 hours. The PWS has been revised to 8 hours. The PWS section states at 5.6.1.2 project manager must arrive as soon as practical but not later than 8 hours after notification by DLA. In these cases contractor will receive written notification from CO or alternate contacts that will be established after contract award.
PWS Related Questions
7. CLIN
Ref Items
To verify, are the quantities for CLIN 0002 maximum quantities iaw 52.216‐22 – Indefinite Quantity (sections (b) and (c)) and therefore no more than those estimated amounts can or will be ordered during the life of the contract? If so, are the hours sufficient to perform off‐site spill or release response efforts and to perform other extraordinary support efforts? Some labor categories seem low (for instance, only two hours for H&S Officer over a five‐year period and only 32 hours for the PM – responsible for 8‐ or 12‐hour response time and evaluations to releases or spills)?
The quantities in CLIN 0002 are not maximum quantities IAW 52.216‐22 and 52.216‐19, and the government is not obligated to order these amounts. The quantities are estimates and as indicated in the price worksheet will be used as the basis for evaluating Offerors’ pricing responses and do not commit the government to awarding the amount shown. Actual awards will be based on need.
8. PWS In section 5.6.1.2 of the PWS it states the Project Manager must arrive as soon as practical but not later than 12 hours after notification by DLA, to assess a petroleum spill or release. Can someone other than the PM, an alternate or representative, respond to evaluate a spill or release, especially in those instances when the PM is on travel, leave, or otherwise indisposed?
DLA expects the PM is reachable and readily available. That said, the Contractor shall arrange for alternate POC(s) that are fully‐trained, fully‐capable and have sufficient experience to respond appropriately to releases/spills. Offerors will identify primary POC in the technical proposal, including alternate POCs if available.
Awarded Contractor will confirm primary and alternate POCs upon award. If PM will be unavailable (e.g. travel, leave, or otherwise indisposed), Contractor will notify the CO and COR in writing any alternate POCs, their contact information, and pertinent arrangements established to eliminate and reduce impacts of the PM’s absence.
Additionally, the response is 8 hours, not 12 hours. There is a discrepancy between the PWS and the INSTRUCTIONS TO OFFERS – COMMERCIAL ITEMS (APR 2014), Proposal Organization, Subfactor 5 of the Volume I. Volume I states “The maximum time offered by the Contractor for the Contractor’s approved project manager to be on the site of an incident located within a 125‐mile radius of DFSP Point Loma Building 604 within 8 hours of a telephonic notification by the Contracting Officer.” The PWS has been revised to reflect 8 hours as part of this Amendment 5.
9. PWS Please provide the last 12‐months of Contractor’s Progress, Status, and Management Reports (CPSMRs). These reports contain information that is necessary to scope and price O&M of the remediation system. The current contractor will have an unfair competitive advantage (and could be conflicted out) having access to these reports since they were not provided to the other bidders. If the reports cannot be provided we respectfully request answers to the following O&M information:
a) Type, number of and frequency bag filter replacement
b) Sand media frequency of backwash and replacement
c) Frequency of RO membrane replacement
d) Clay and liquid GAC replacement
e) Vapor phase GAC replacement / if applicable
f) Frequency of extraction and horizontal well redevelopment
g) OWS cleaning and coalescent material replacement
h) List of any major equipment that has been replaced in 2017 or is planned to be replaced in 2017‐2018.
There are no CPSMRs. Refer to the O&M manual and Solicitation ATT 7 O&M SERVICES & EQUIPMENT LIST. Material replacement will be as necessary. These efforts will be on an as needed basis and specific to time and need.
10. PWS Are the recovery systems operating well or are there frequent issues that operators must address? What is the current and expected response time when systems go down?
A description and history of the system has been provided in the PWS. Systems currently run continuously 24/7 at approximately 98% efficiency rates, including “down time” where pumps may be maintained, etc. There are multiple tanks and redundancy in processes to allow continued efficient operations 24/7.
11. PWS Is the DLA currently handling the NAPL waste handling and transport themselves or is this subcontracted to a waste hauler or third party?
Contractor is responsible for nonaqueous phase liquid (NAPL) and other waste hauling, recycling or reuse.
12. PWS Please provide a current list of permits and/or easements and their respective annual fees.
Pertinent permits and associated fees for the Site are identified in the PWS. Utility fees are under Section 3.3. Currently, Permits are located in various parts of the PWS. Contractor is responsible for tracking and providing applicable information to the NBPL Environmental Office (EO). They oversee the permits. There are no easement fees for the Site at this time.
The Off‐Site locations are unknown, so lists of permits and easements will not be provided. Off‐site permits and or/easements are under PWS section 5.6.1.1. These are CLIN 0002 items and will be addressed at time of Task Order issuance.
13. PWS Please provide historic costs and usage rates for all required utilities as well as any applicable regulatory fees.
See description of onsite utilities and regulatory oversight fees in sections 3.3 and 7.6 of the PWS, Section 5.6 explains how off‐site work will be managed. Additional historical costs will not be provided.
14. PWS The requirements for supporting NBPL RAB Meetings (public meetings, notices, comment periods – providing agendas, meeting materials, and meeting summaries seems open ended. Please clarify current requirements for public meetings/engagement.
These efforts will be on an as needed basis and specific to time and need.
15. PWS Regarding RAB meetings “it will be ordered on an as needed basis”. Please clarify if this is part of the CLIN 2 scope? If so please provide the number of meetings that will be required during the POP for this contract.
RAB meeting support will be ordered on an as needed basis in accordance with NBPL’s RAB schedule, under Support Meetings from CLIN 0001. RAB support for Off‐Site locations would be considered
CLIN 0002.
16. PWS The Industrial User Discharge Permit (IUD) is scheduled to expire on Dec 1, 2017. Will the permit be renewed before expiring? Will the discharge requirement remain the same?
Typically permits are renewed before expiration. Permits will be in accordance with local, state and federal regulations. The NBPL holds the Industrial User Discharge Permit, and it will be made available to the awarded Contractor.
17. PWS Section 7.1 project experience ‐it discusses requirements for past project experience but it is unclear what parameters define a project. Please provide clarification regarding what constitutes a project (i.e. can individual components at a site location such as dissolved phase treatment, free product recovery, permitting, etc. be presented as separate projects?).
A project is a series of tasks that need to be completed in order to reach a specific outcome. Project experience for the purposes of this solicitation means projects that are at bulk petroleum storage facilities with the same or related purposes that are similar in size to work described.
18. PWS Is San Clemente Island within the 125 mile radius for this project?
San Clemente Island (SCI) is within the 125‐mile radius. If work is required at SCI, it would be considered extraordinary work off‐site.
The Contractor will be advised of the requirements when ordered by the Contracting Officer. See PWS Section 5.6.1.
19. RFP What is the current number of full time and part‐time staff onsite at DFSP Point Loma?
This information will not be provided. Offerors will provide their own staffing levels depending on their labor mix and staff capabilities.
This is proprietary information.
20. PWS Are the personnel listed in section of the PWS 1.6.6 expected to be on site during normal working hours?
DLA does not define the labor mix or personnel assigned to be on site during normal working hours
21. PWS Are the personnel assigned to labor category descriptions listed in table 1 expected to only fill one role or can a properly credentialed person be assigned dual roles? Can a site manager with advanced remediation systems training also serve as the site maintenance engineer at the same time?
Contractor may assign an individual multiple roles if properly credentialed and if they meet requirements for both roles. Offerors are advised that DFSP Point Loma’s remediation systems are complex, and successful operations are dependent on regular adjustments for optimal product removal. Contractor must have personnel available and capable to handle a variety of scenarios. It is the Contractor’s responsibility to ensure remediation systems operate effectively, project requirements are executed successfully, and performance objectives are met. As such, DLA has not defined the labor or personnel mix.
Contractor shall not “double bill” for two separate labor categories for performance of same task or time worked.
22. PWS Section 5.1.9, page 20 ‐ Regulatory Support meetings and Public support meetings. How many meetings should be budgeted per year? It is unclear in the text and on spreadsheet CLIN 001 cells C14 and C13?
The number of meetings is not defined. Restoration Advisory Board (RAB) meetings are typically scheduled in advance, announced with published notices, and open to the public. Although DLA does not host RAB meetings, it may be necessary at times to support NBPL environmental staff in their RAB meetings (if needed). This Site work at NBPL is considered CLIN 0001.
At Off‐Site locations, it is possible that the Contractor may have work or remedial activities that require public notifications or community involvement. If extraordinary work is ordered, DLA and Contractor would identify requirements beforehand and agree to pricing based on combination of reference items. Off‐Site meeting support is considered in CLIN 0002.
Contractor is responsible for supporting all community involvement requirements to meet CERCLA, RCRA, and other regulatory requirements.
23. PWS Section 5.1.13 ‐ It is unclear if the contractor is paying this line item. Please explain "The site operator currently has arranged with NAVFAC SW a job order number with a "positive balance" to dispose of any hazardous waste" Is this a financial "positive balance" or other and if financial, what is the average value in the fund each year?
The Contractor is responsible for paying for hazardous waste disposal.
The Contractor must comply with applicable federal, state, local, base and DLA requirements for any task involving the storage, transportation, and disposal of hazardous wastes or contaminated materials.
The Contractor must comply with NBPL’s policies for waste disposal and reporting requirements for wastes generated. The sentence “The site operator currently has arranged with NAVFAC SW…to dispose of any hazardous waste” was included to advise potential Offerors how we currently handle our hazardous waste stream.
The Contractor may use their discretion on the positive balance amount to maintain in their account in order to appropriately dispose of wastes (if any) generated from work conducted under this contract.
24. PWS What is the annual average volume for waste disposal? It is not included in the annual reporting data in Geotracker for this site.
What is the annual average volume for waste disposal? It is not included in the annual reporting data in Geotracker for this site.
The Site’s remediation system is expected to generate little or no hazardous waste quantities.
25. PWS 7.1 Document Familiarization, 3rd bullet ‐ the contractor is advised to the National Pipeline Mapping System for DLA‐ capitalized fuel sites. This site requires registration with an operator ID, something contractors don't typically have.
The publicly available viewer does not identify who is the owner of the pipelines posted. Will the DLA provide additional information on potential other sites outside the PLNB so contractors can gauge the level of effort associated with outside facilities? How is a contractor able to fulfill this requirement without anything but public access?
No, any sites in the 125 mile radius cannot be predicted within the current map but will be identified in the request for proposal under CLIN 0002 if extraordinary work is required. A map of DLA‐capitalized pipelines or sites will not be released as part of this solicitation due to potential security concerns.
If DLA requires extraordinary work off‐site, the Contractor will be advised of location, access, and requirements when ordered by the Contracting Officer as required IAW PWS Section 5.6.1. At that time, the Contractor would be expected to become familiar with the documents associated with the off‐site location or available for that effort.
26. PWS Attachment 7 ‐ 8 September Add. 4. OM Services & Equipment list. It is unclear where the pricing for these items is expected to fall? Are these equipment replacement and gac change out services etc expected to integrated into the monthly OM charge rate?
