PERFORMANCE WORK STATEMENT (PWS)

BUILDING UPGRADES at DLA STRATEGIC MATERIALS DEPOT, SCOTIA, NY

1 Objective: The objective of this PWS is to have upgrades performed to four (4) buildings at the Defense Logistics Agency Strategic Materials Depot located at Route 5, Amsterdam Road, Scotia, New York 12302. The upgrades include performance of an asbestos abatement, interior ceiling re-painting, interior floor covering replacement and interior/exterior wall & ceiling repairs and re-painting. These task(s) shall be performed in/on Buildings 12, 13, 14 and 22. The Contractor is strongly encouraged to perform an on-site visit to aid in the development of the Contractor’s Quality Control Plan, Work Plan and Work Schedule. This is a firm fixed-price performance based contract.

1.1 Scope of Work: The Contractor shall provide all labor, administrative support, transportation, supervision, coordination and control of all sub-contractors, equipment, materials, parts, supplies and task(s) performance associated with this PWS. The Contractor shall plan, schedule, coordinate and provide effective completion of all task(s) described herein. All task(s) identified herein shall be accomplished meeting safe operational standards as specified in related sections of the National Electric Code (NEC), Uniform Building Code (UBC), New York State Title Code 56 (Asbestos) and all other related national industry standards. See paragraph 5 of this PWS for a detailed description of all task(s). The Contractor shall perform the following task(s):

A) Building 12 Interior: At locations where task(s) will be performed, the Contractor shall disconnect electrically and temporarily remove all furniture/appliances currently installed, temporarily remove any other items/components currently installed that will interfere with task(s) performance, remove existing cove base, remove existing floor covering (carpet), remove the floor tiles (asbestos containing) installed under the removed floor covering (carpet), repair any damage to walls (including inside all storage areas/closets), prime & paint walls (including inside all storage areas/closets), prime & paint all window trim, door trim, doors (both sides) and any other trim (including inside all storage areas/closets), prepare the exposed floor and install new floor coverings (carpet), install new cove base, return all furniture/appliances temporarily removed back to their original location and re-connect electrically, return all other items/components that were temporarily removed back to their original location. Building 12 upgrades shall be competed in four (4) phases. Each phase shall encompass a defined area(s) that will be determined by the COR to ensure daily depot operations are not interrupted. Each upgrade phase shall be completed in its entirety before performing any task(s) on the next phase. Estimated 2,410 square feet total of floor coverings. Estimated 8,574 square feet total of wall surfaces.

B) Building 13 Interior: At locations where task(s) will be performed, the Contractor installed, temporarily remove any other items/components currently installed that will interfere with task(s) performance, remove existing cove base, remove existing floor covering (tile, non-asbestos containing), repair any damage to walls (including inside all storage areas/closets), prime & paint walls (including inside all storage areas/closets), prime & paint all window trim, door trim, doors (both sides) and any other trim (including inside all storage areas/closets), prepare the exposed floor and install new floor coverings (vinyl plank), install new cove base, return all furniture/appliances temporarily removed back to their original location, return all other items/components that were temporarily removed back to their original location. Estimated 318 square feet total of floor coverings. Estimated 944 square feet total of wall surfaces.

C) Building 13 Exterior: The Contractor shall replace all corroded/damaged metal siding/trim on the exterior of building-13 and then prime and paint the entire exterior of the building. Estimated 880 square feet total of wall surfaces.

D) Building 14 Interior: At locations where task(s) will be performed, the Contractor installed, temporarily remove any other items/components currently installed that will interfere with task(s) performance, remove existing cove base, remove existing floor tiles (non-asbestos containing), repair any damage to walls (including inside all storage areas/closets), prime & paint walls (including inside all storage areas/closets), prime & paint all window trim, door trim, doors (both sides) and any other trim (including inside all storage areas/closets), prepare the exposed floor and install new floor coverings (vinyl plank), install new cove base, return all furniture/appliances temporarily removed back to their original location and re-connect electrically, return all other items/components that were temporarily removed back to their original location. Some furniture will not be re-installed. Estimated 1,515 square feet total of floor coverings. Estimated 3,592 square feet total of wall surfaces.

E) Building 22 Interior: At locations where task(s) will be performed, the Contractor installed, temporarily remove any other items/components currently installed that will interfere with task(s) performance, remove existing cove base, remove existing floor covering (carpet) where installed, remove existing floor tiles (asbestos containing) where installed (some are installed under the installed carpet), repair any damage to walls and painted ceilings (including inside all storage areas/closets), prime & paint walls (including inside all storage areas/closets), prime & paint currently painted ceilings, prime & paint all window trim, door trim, doors (both sides) and any other trim (including inside all storage areas/closets), prepare the exposed floor and install new floor coverings (vinyl plank), install new cove base, return all furniture/appliances temporarily removed back to their original location and re-connect electrically, return all other items/components that were temporarily removed back to their original location. Estimated 1,116 square feet total of floor coverings.

Estimated 2,128 square feet total of wall surfaces. Estimated 491 square feet total of ceiling surfaces to be primed & painted.

1.1.1 Basic Services: The Contractor shall perform all task(s) associated with the performance of this PWS. All task(s) shall be performed at the Acceptable Quality Level (AQL) established in the Performance Requirements Summary Table (PRST) of this PWS. (See Attachment 1 to this PWS for a copy of the “Performance Requirements Summary Table (PRST”).

1.1.2 Work Schedule: The Contractor shall develop and submit a written Work Schedule for performance of all task(s) described in this PWS within ten (10) working days after contract award to the Contracting Officer and COR for review and approval. At a minimum, the Contractor shall schedule and perform all task(s) identified in the Performance Requirements Summary Table (PRST) at the frequency of task(s) listed in the table. (See Attachment 1 to this PWS for a copy of the “PRST”). The Work Schedule shall identify facilities by building number, task(s), and approximate time and date the task(s) will be performed. Once accepted by the Contracting Officer, this Work Schedule shall be known as the Approved Work Schedule (AWS). The Contractor shall provide a copy of the Approved Work Schedule (AWS) to the Contracting Officer’s Representative (COR) and not deviate from the Approved Work Schedule (AWS) without prior written approval from the Contracting Officer. Any changes to the Approved Work Schedule (AWS) must be submitted five (5) working days prior to implementation and be approved (in writing) by the Contracting Officer. This Approved Work Schedule (AWS) will be used in part by the COR to determine inspection points and times. Results of these inspections will be reflected in the “Government Inspection Report”. (See Attachment 3 to this PWS for a copy of the “Government Inspection Report”).

1.1.3 Work Plan: The Contractor shall develop and submit a written Work Plan for performance of all task(s) described in this PWS within ten (10) working days after contract award to the Contracting Officer and COR for review and approval. The Work Plan shall explain how all aspects of the task(s) identified in this PWS will be performed. Once approved by the Contracting Officer, this Work Plan shall be known as the Approved Work Plan (AWP). The Contractor shall provide a copy of the Approved Work Plan (AWP) to the Contracting Officer and the Contracting Officer’s Representative (COR). The Contractor may propose deviations from the Approved Work Plan (AWP), but must submit proposed deviations to the

Contracting Officer and the Contracting Officer’s Representative (COR) and obtain written approval from the Contracting Officer before implementing any deviations to the Approved Work Plan. This Approved Work Plan (AWP) will be used in part by the COR to determine inspection points and times. Results of these inspections will be reflected in the “Government Inspection Report”. (See Attachment 3 to this PWS for a copy of the “Government Inspection Report”).

1.2 Contractor Personnel: The Contractor shall maintain a fully trained staff throughout the life of the contract.

1.2.1 Project Management: The Contractor shall provide project management. The

Project Manager or an approved designated alternate shall be available at all times while contract work is in progress to receive notices, reports or request from either the Contracting Officer or the COR. The Project Manager shall have full authority to act for the Contractor on all matters relating to the performance of all task(s) identified in this PWS. The Project Manager must be able to read, write and speak English and shall have in-depth knowledge of the performance based and prescriptive quality processes, procedures and equipment required to accomplish all task(s) listed in this PWS. No later than five (5) working days after the start of contract performance, the Contractor shall provide the name(s), location and telephone number(s) of the designated Program Manager to the Contracting Officer and the COR.

1.2.2 Contractor Employees: The personnel employed by the Contractor shall be capable employees, trained and qualified in the performance of the task(s) associated with this PWS. The Contractor must not employ persons for work on this PWS if the employee is considered by the Contracting Officer to be a potential threat to the health, safety, security, general well-being or operational mission of the facility and its population employees. Contractor personnel shall present a neat appearance and be easily recognized as Contractor personnel. All Contractor employees must be able to read, write and speak English.

1.2.3 License Requirements: The Contractor shall ensure their employees and Sub- Contractor employees have current and valid professional licenses or certifications required by Federal, New York State and local law. The following professional licenses or certifications are required:

- A current driver’s license issued by any State

- An Electrician’s License (for employees performing work on electrical systems or components)

- An Asbestos License issued by New York State (for employees performing asbestos abatement)

- Any other professional license or certification required by Federal, State and local law related to work on a specific task(s).

1.2.4 Security Requirements: No weapons, alcohol, or other prohibited items will be permitted on-site. All items brought on-site are subject to search by security personnel. Contractor personnel access will be restricted to areas where task(s) associated with this PWS are being performed.

1.2.5 Contractor Employees Security Clearance: All Contractor employees may be required to submit to a background check prior to access to the government site.

The Contractor shall submit all requested personnel information for each of their employees upon request from the Government. This information will be used solely for the purpose of performing these background checks if required.

1.2.6 Employee Training: Contractor employees shall be trained to respond to emergency conditions (e.g. fire in building). The Contractor employees shall: 1) report fires and hazardous conditions identified during the performance of their assigned task(s) to the COR, 2) close doors and turn off lights that were opened or turned on in performance of their assigned task(s), 3) turn in all lost and found articles to the COR and 4) wear appropriate personal protective equipment identified and supplied by the Contractor.

1.2.7 E-Verify Program Requirements: The Contractor shall comply with all requirements of the “E-Verify Program”. The Contractor shall prescreen all potential employees employed in the performance of task(s) of this PWS utilizing the E-Verify Program. Requirements of this program can be accessed at http://www.uscis.gov/e-verify. The Contractor shall ensure that employees have two (2) valid forms of government issued identification prior to enrollment to ensure the correct information is entered into the E-Verify system. An initial list of all potential employees that have been “verified eligible” shall be provided to the Contracting Officer no later than three (3) working days after contract award date.

1.3 Quality Control: The Contractor shall establish a comprehensive Quality Control

Plan to assure that the requirements of the PWS are satisfied. The basic tenet of the plan is that the Contractor is responsible for quality control. The methods of surveillance used by the Government will be 100% Inspection or Random Inspection for this PWS. Inspection methods and Acceptable Quality Levels are listed in the http://www.uscis.gov/e-verify

Performance Requirements Summary Table (PRST) (See Attachment 1 to this PWS for a copy of the “Performance Requirements Summary Table (PRST”).

1.3.1 Quality Control Plan: The Contractor shall develop and maintain a comprehensive Quality Control Plan to ensure all task(s) are performed in accordance with this Performance Work Statement (PWS). The Contractor shall develop, and implement procedures to identify, prevent, and ensure non-reoccurrence of defective/unacceptable task(s) performance. The Contractor shall perform quality control inspections using qualified personnel (i.e. personnel sufficiently knowledgeable of technical aspects covered under this PWS, which would allow identification/discovery of improperly performed task(s)).

1.3.2 Quality Control Plan Requirements: The Quality Control Plan shall include specifics as to the areas to be inspected on both a scheduled and unscheduled basis, frequency of inspections, submission of a Quality Control Inspection Schedule, and the title and organizational placement of the inspectors. The plan shall provide a description of the methods to be used to identify and prevent defects in the quality of task(s) performed and corrective actions to be taken to correct defects identified.

The plan shall also provide a description of the records to be kept to document inspections and corrective or preventative actions taken.

1.3.3 Quality Control Plan Records Requirements: A copy of the Contractor’s Quality Control Plan shall be provided to the Contracting Officer and the COR within ten (10) working days after contract award. The Contractor may implement changes to their Quality Control Plan subject to the Contracting Officer’s written approval. If changes are made to the Quality Control Plan, an updated copy of the plan must be provided to the Contracting Officer and the COR within five (5) working days after changes occur. Documentation of inspections and corrective actions taken shall be kept (and be made available to the Contracting Officer or COR upon request) throughout the contract performance period and for a period after contract completion until final settlement of any claims under this contract.

1.4 Quality Assurance: The Government will evaluate the Contractor’s performance by appointing a Contracting Officer’s Representative (COR) to monitor performance and ensure all task(s) are performed at the identified Acceptable Quality Level (AQL) in accordance with the Performance Requirements Summary Table (PRST ) of this PWS.

(See Attachment 1 to this PWS for a copy of the “Performance Requirements Summary Table (PRST”). The methods of surveillance used by the Government will be either 100% Inspection or Random Inspection for this PWS. The two rating factors used to complete the "Government Inspection Report" will be quality and timeliness. (See Attachment 3 to this PWS for a copy of the “Government Inspection Report”). The COR will utilize the Quality Assurance Surveillance Plan (QASP) developed (by the

Government) for this PWS to document the level of task(s) performed by the Contractor. (See Attachment 2 to this PWS for a copy of the “Quality Assurance Surveillance Plan”). The COR will at a minimum: 1) review the Contractor’s sign in sheet on a weekly basis in order to verify that the Contractor is correctly logging in their time on site, 2) randomly inspect work performed by the Contractor on a daily basis in order to ensure that the Contractor is achieving the required level of performance, and 3) prepare a “Government Inspection Report” bi-weekly that identifies areas inspected and all discrepancies/defects noted. DLA Strategic Materials will use the ratings documented in the “Government Inspection Report” as the basis for determining actual Contractor performance. A “pass” rating will be assigned to each task inspected that met or exceeded the established Acceptable Quality Level (AQL) for each “Performance Standard” evaluated. An “N/A” rating will be assigned when no work was required to be performed on a specific task. DLA Strategic Materials will not levy any monetary deductions against the Contractor for “pass” and “N/A” ratings documented in the “Government Inspection Report”. A “fail” rating will be assigned to each task inspected that fell below the established Acceptable Quality Level (AQL) for each “Performance Standard” evaluated. When a “fail” rating is assigned, all observed deficiencies must be documented on a “Government Inspection Report”. DLA Strategic Materials may (at the governments discretion) levy monetary deductions against the Contractor for “fail” ratings documented in the “Government Inspection Report” as listed in the Performance Requirements Summary Table (PRST) of this PWS for each “Performance Standard” evaluated. The COR will retain copies of each completed “Government Inspection Report” in the Contract COR File. The COR will upload copies of all completed “Government Inspection Reports” into the CORT Tool.

1.4.1 Performance Evaluation Meeting: The Contracting Officer may require the

Program Manager to meet with the Contracting Officer, the Facility Manager/COR and other government personnel as deemed necessary. The Contractor may also request a meeting with the Contracting Officer when the Contractor believes that such a meeting is necessary. Written minutes of all meetings shall be documented and signed by the Contracting Officer. Meeting minutes shall be distributed to all attending parties. If the Contractor does not concur with any portion of the minutes, such non-concurrence shall be provided in writing to the Contracting Officer within ten (10) working days following receipt of the minutes.

1.5 Physical Security: The Contractor shall be responsible for safeguarding all government owned/furnished property for Contractor use. At the end of each work period, all government owned/furnished property shall be secured.

1.5.1 Key Control: None required as no keys will be issued to the Contractor.

1.5.2 Lock Combinations: None required as no lock combinations will be given to the Contractor.

1.6 Hours of Operation:

1.6.1 Normal Hours of Operation: The Government’s primary hours of operation at

Scotia Depot are 6:00 am thru 4:30 pm, Monday through Friday, except Federal holidays or any other day(s) designated by Federal Statute, Executive Order, or Presidential Proclamation. The ten Federal holidays include; New Year’s Day, Martin Luther King Day, President’s Day, Memorial Day, Independence Day, Labor Day, Columbus Day, Veterans Day, Thanksgiving Day, and Christmas Day.

No task(s) will be performed on these holidays or other days designated by the COR (e.g. depot closed due to inclement weather). The Contractor shall schedule and arrange work to cause the least interference with the normal occurrence of Government operations. The Contractor shall perform all task(s) between 7:00 am and 2:30 pm, Monday through Friday. No task(s) will be performed on-site outside of Scotia’s primary hours of operation.

1.6.2 Emergency or Special Event: No emergency or special events are anticipated.

If an unanticipated event occurs, the need for the Contractor to perform task(s) will be evaluated on a case-by-case basis.

1.7 Conservation of Utilities: The Contractor shall ensure that their employees practice utilities conservation. The Contractor shall be responsible for operating under conditions that prevent the waste of utilities.

1.7.1 Lights: Lights shall only be used as necessary in areas where task(s) are actually being performed. Lights shall be turned off that were turned on to perform task(s) upon completion of task(s).

1.7.2 Mechanical Systems: Contractor employees shall adjust mechanical controls for heating, ventilation, and air conditioning only as required to perform task(s).

1.7.3 Water: Water faucets or valves shall be turned off when not in use by the

Contractor.

1.8 ENVIRONMENTAL AND SAFETY: The Contractor shall comply with all applicable Federal, New York State, and local laws and regulations.

1.8.1 Hazardous Materials: Use of hazardous materials shall be minimized.

Hazardous materials may only be used in the event that a suitable non-hazardous material alternative does not exist. If required, hazardous materials shall be handled and disposed of as listed on the container(s) labeling. The Contractor shall provide a copy of the Safety Data Sheet (SDS) to the COR for all on-site Contractor furnished material that requires a SDS. Copies of all SDS's will be maintained on-site by the designated site safety monitor (a designated government employee) for quick reference.

1.8.2 Green Procurement: Conservation of energy and material resources are national policies embedded in Federal Law. Consideration of environmental factors in procurement is required. In order to comply with federally mandated environmental preference programs and the Department of Defense (DoD) “Green Procurement Program” (GPP) policy, DLA requires the use of environmentally preferable products and services. Program elements include the use of recovered material products, recycled contents, energy and water efficient products, alternative fuels, bio-based products, non-ozone depleting substances, non-flammable propellants, priority chemicals, biodegradable, and environmentally friendly products to the maximum extent possible. The Contractor shall use environmentally friendly (green products) to the maximum extent possible in performance of the task(s) of this PWS.

1.8.3 Clean Up/Disposal of Waste Materials: Upon completion of task(s), the Contractor and sub-contractor employees shall be required to clean-up the workspace and remove and dispose of any parts and debris from the government property. This shall be required after each work period. The Contractor shall dispose of all hazardous waste in a manner that complies with applicable Federal, New York State and local laws and regulations. The Contractor and sub-contractor shall ensure that all “hazardous” waste is transported by a “Qualified Transporter” listed and qualified by DLA Disposition Services. The Contractor shall also ensure that all “hazardous” waste is disposed of at a “Qualified Facility” listed and qualified by DLA Disposition Services. A listing of “Qualified Transporters and Qualified Facilities” may be viewed online at http://dispositionservices.dla.mil/newenv/hwdisposal.shtml. These lists change and are updated frequently. The Contractor and sub-contractor shall provide a copy of all documents related to disposal and transfer of hazardous waste to the COR, including waste handler licenses and disposal facility certifications.

1.8.4 Spill Responsibility: The Contractor is solely responsible for any and all spills or leaks during the performance of this PWS, which occurs as a result of, or is contributed to, the actions of its agents or employees. The Contractor shall clean up such spills or leaks to the satisfaction of the Government in a manner that complies with a l l applicable Federal, New York State and local laws and regulations. The cleanup shall be at no cost to the Government. The Contractor shall report all such spills or leaks, regardless of their quantity, to the Contracting Officer and COR immediately upon discovery. A written follow-up report shall http://dispositionservices.dla.mil/newenv/hwdisposal.shtml be submitted to the Contracting Officer and COR not later than twenty-four (24) hours after the initial report. The written report shall be in narrative form and at a minimum shall include the following: 1) description of item spilled (including identity, quantity, etc.), 2) whether amount spilled is EPA/State reportable and if so, whether it was reported, 3) exact time and location of spill including a description of the area involved, 4) containment procedures initiated, 5) summary of any communications the Contractor has with press or Government officials other than the Contracting Officer or COR and 6) description of clean-up procedures employed or to be employed at the site including disposal location of spill residue.

1.8.5 Safety: The Contractor shall require all Contractor employees to read the

“Scotia Depot ESOHMS Orientation Guide for Contractors and Visitors.” (See Attachment 4 to this PWS for a copy of the “Scotia Depot ESOHMS Orientation Guide for Contractors”). All Contractor employees shall sign and date a copy of the guide to document their understanding of the guide's contents. The Contractor shall provide copies of all signed "Scotia Depot ESOHMS Orientation Guide for Contractors" to the COR. The Contractor shall ensure that all employees will comply with the requirements of this guide. The Contractor shall determine the need for, and supply all, personal protective equipment required by their employees and sub-contractor employees to perform the task(s) of this PWS.

1.8.6 Mishap Reporting: The Contractor shall report in writing to the COR all injuries, property damage, equipment damage or vehicle mishap that occurs during the performance of task(s) of this PWS within two (2) hours of occurrence.

The Contractor shall complete and submit any documentation determined to be appropriate by the COR to document the mishap.

1.9 Records: The Contractor shall be responsible for creating, maintaining and disposing of only those government-required records that are specifically cited in this PWS or the resulting contract. The Contractor shall maintain these records throughout the contract performance period and for a period after contract completion until final settlement of any claims under this contract. If requested by the government, the Contractor shall provide the original record(s) or a reproducible copy and an electronic copy of any such record(s), within five (5) working days of receipt of the request to the requestor.

1.9.1 Invoice/Quotes: The Contractor shall itemize all invoices/quotes submitted to the Government for review. In the event a "fail" rating is assigned i n t h e “Government Inspection Report” (See Attachment 3 to this PWS for a copy of the “Government Inspection Report”) as a result of inspections, invoices may not be processed for payment until re-performance is completed and confirmed in writing by the COR based on the standards listed in the Quality Assurance Surveillance Plan (See attachment 2 to this PWS for a copy of the “Quality Assurance Surveillance Plan”).

1.9.2 Manpower Reporting for Service Contracts: In accordance with DLAD 37.103-90(e), the following Contractor manpower-reporting requirement is included in this Performance Work Statement (PWS). The Contractor shall report all Contractor labor hours required for performance of task(s) performed under this PWS for the Defense Logistics Agency via a secure data collection site. The Contractor is required to completely fill in all required data fields using the following web address: http://www.ecmra.mil/.

Reporting inputs will be for the labor executed during the period of performance during each Government fiscal year (FY), which runs October 1 through September 30. While inputs may be reported any time during the FY, all data shall be reported no later than October 31 of each calendar year, beginning with 2014. Contractors may direct questions to the help desk at http://www.ecmra.mil.

2 Definitions: As used throughout this PWS, the following terms shall have the meaning set forth below and specified as applicable to this PWS. Words/Terms listed in “Definitions” are italicized in the body of this PWS.

2.1 General Definitions:

A. Acceptable Quality Level (AQL): The standard at which task(s) performance is considered satisfactory as agreed upon by the Contractor and Government.

B. Approved Work Plan (AWP): A written work plan that is developed by the Contractor and approved by the Contracting Officer that explains how all aspects of the task(s) identified in this PWS will be performed.

C. Approved Work Schedule (AWS): The schedule for task(s) performance developed by the Contractor and approved by the Contracting Officer that identifies facilities by building number, task(s), and approximate time and date the task(s) will be performed.

D. Contractor: The term Contractor as used herein refers to both the prime Contractor and any sub-contractors. The prime Contractor shall ensure that their sub-contractors comply with the provisions of this PWS.

E. Contracting Officer: One with the authority to enter into, administer, and/or terminate contracts and make related determinations.

F. Contracting Officer’s Representative (COR): One who is designated and authorized in writing by the Contracting Officer to be responsible for surveillance/monitoring of the Contractor’s performance.

G. Contractor Owned/Furnished Property: All property used during the performance of this PWS that is owned or furnished by the Contractor.

H. Defect: A task(s) output that does not meet the performance standard associated with the requirements of this PWS.

I. Government Inspection Report: A written report that documents the actual level of task(s) performance by the Contractor. This report is completed by the COR.

J. Government Owned/Furnished Property: All property used during performance of this PWS that is owned or furnished by the Government.

K. Performance Requirements: Task(s) to be performed by the Contractor.

L. Performance Standard: The desired results, expressed by the Government, expected during performance of PWS task(s), to satisfy the requirement.

M. Performance Requirements Summary Table (PRST): An outline of PWS requirements that identifies the key task(s) outputs of the PWS that will be inspected or surveyed by the Government, and related performance standards, method(s) of performance assessment and surveillance. Identifies the minimum frequency the Contractor shall perform specified task(s) and the associated Acceptable Quality Level.

N. Project Manager: the person(s) assigned by the Contractor to manage the overall performance of all task(s) identified in this PWS.

O. Quality Assurance: Those actions taken by the Government to assure task(s) performed meet the Acceptable Quality Level established in this PWS.

P. Quality Assurance Surveillance Plan: An organized written, “living”, document outlining the Government’s methodology for monitoring Contractor performance.

Q. Quality Control Plan: An organized written, “living”, document (developed by the Contractor) outlining the Contractor’s methodology for measuring and ensuring acceptable performance of task(s). This document also outlines the Contractor’s methodology for addressing defects identified during performance of task(s).

3 Government Furnished Property and Services: The Government will provide the Contractor with (see 3.1 thru 3.3 below) Government owned property, materials and services for official Government business only in performance of work under this contract. The use of Government furnished property and services for other purposes are prohibited. The Contractor shall be responsible for safeguarding all Government property provided for Contractor use. No alterations to Government provided property shall be made without specific written permission from the Contracting Officer. The Contractor shall return all Government provided property to the

Government upon completion of this contract in the same condition as received (minus fair wear and tear and approved modifications).

3.1 Government Furnished Property: The Government will make storage space(s) available to the Contractor for storage of removed furniture/appliances and any other items removed as part of task(s) performance associated with this PWS. The Contractor shall be responsible for maintaining order and cleanliness in the storage space(s). The Contractor shall refrain from storing any items in locations other than those identified by the COR. The Government will not be responsible in any way for damage to, or loss of, the Contractor’s stored supplies, materials, replacement parts, equipment, furniture/appliances or any other item removed by the Contractor as part of performance of any task(s) of this PWS.

3.2 Government Furnished Materials: None

3.3 Government Furnished Services/Utilities: The Government will furnish to the Contractor at no cost, hot and cold water, access to bathroom facilities, electricity, and heating and air conditioning as necessary.

4 Contractor Furnished Items and Services: Except for the property and services referenced in Section 3 of this PWS, the Contractor shall provide all equipment, materials, and services necessary to perform the requirements of this contract. The Contractor shall provide a means of communication with the COR. The Contractor shall not use any material which would be unsuitable for its purpose or harmful to the surface to which applied. All supplies and materials used for the performance of this PWS shall be of good quality and shall comply with State, Federal, and local guidelines for safety and environment.

5 Specific Task(s): The Contractor shall provide all labor, administrative support, transportation, supervision, coordination and control of all Sub-Contractors, equipment, materials, parts, supplies and services associated with the performance of all task(s) listed in this PWS at the DLA Strategic Materials Scotia Depot located in Scotia, New York unless otherwise specified in this PWS. The Contractor shall plan, schedule, coordinate and provide effective completion of all task(s) described herein. All task(s) identified herein shall be accomplished and maintained to meet safe operational standards as specified in related sections of the National Electric Code (NEC), Uniform Building Code (UBC), New York State Title Code 56 (Asbestos) and all other related national industry standards. The Contractor shall not use any material which would be unsuitable for its purpose or harmful to the surface to which applied. All supplies and materials used for the performance of this PWS shall be of good quality and shall comply with Federal, New York State and local guidelines for safety and environment. The Contractor shall submit a list of all floor coverings (carpet & vinyl plank), floor levelers/adhesives, transition products, cove base products, exterior metal siding/trim products and primers & paints used for the performance of this PWS for review and approval by the Contracting Officer prior to their use. Additionally task(s) shall be performed as required to meet prevailing Federal, New York State and local codes. DLA Strategic Materials may (at the governments discretion) levy monetary deductions against the Contractor for “fail” ratings documented in the “Government Inspection Report” as listed in the Performance

Requirements Summary Table (PRST) of this PWS for each “Performance Standard” evaluated.

Reference the Performance Requirements Summary Table (PRST) for frequency of task(s) performance requirements and the associated Acceptable Quality Level(s) (AQL). (See Attachment 1 to this PWS for a copy of the “PRST”). (See Attachment 3 to this PWS for a copy of the “Government Inspection Report”).

5.1 Building 12 Interior: The Contractor shall perform upgrades to the interior of Building-12 that include performance of an asbestos abatement, interior floor covering replacement and interior wall repairs and repainting. Estimated 2,410 square feet total of floor coverings.

Estimated 8,574 square feet total of wall surfaces. Building 12 upgrades shall be competed in four (4) phases. Each phase shall encompass a defined area(s) that will be determined by the COR to ensure daily depot operations are not interrupted. Each upgrade phase shall be completed in its entirety before performing any task(s) on the next phase. The Contractor shall perform the following task(s) at a minimum inside of building 12:

5.1.1 The Contractor shall identify and document in writing any pre-existing damage to furniture and appliances that are installed at locations where task(s) will be performed. The Contractor shall provide a copy of this pre-existing damage documentation to the COR for review and concurrence prior to performing the task(s) listed below in this PWS paragraph. The Contractor shall disconnect electrically and temporarily remove all furniture (e.g.

modular office furniture, bookcases, file cabinets etc.) and appliances (e.g.

refrigerators, stoves, microwave ovens etc.) that are installed at locations where task(s) will be performed. The modular office furniture may require partial disassembly to permit movement. Contents of the office furniture shall not be removed or damaged. The Contractor shall be responsible for any and all damage to furniture, appliances or materials contained within these as a result of this disconnection and movement. The Government will make storage space(s) available to the Contractor for storage of furniture/appliances removed as part of task(s) performance associated with this PWS. The Contractor shall be responsible for maintaining order and cleanliness in the storage space(s). The Contractor shall refrain from storing any items in locations other than those identified by the COR. The Government will not be responsible in any way for damage to, or loss of, the Contractor’s stored supplies, materials, replacement parts, equipment, furniture/appliances or any other item removed by the Contractor as part of performance of any task(s) of this PWS.

5.1.2 The Contractor shall identify and document in writing any pre-existing damage to any other items/components currently installed that will interfere with task(s) performance that are installed at locations where task(s) will be performed. The Contractor shall provide a copy of this pre-existing damage documentation to the COR for review and concurrence prior to performing the task(s) listed below in this PWS paragraph. The Contractor shall temporarily remove any other items/components currently installed (e.g. wall art, clocks, signs, posters, white boards, corkboards, curtains, blinds etc.) that will interfere with task(s) performance that are installed at locations where task(s) will be performed. The Contractor shall be responsible for any and all damage to any other items/components as a result of this movement. The Government will make storage space(s) available to the Contractor for storage of removed items/components as part of task(s) performance associated with this PWS. The Contractor shall be responsible for maintaining order and cleanliness in the storage space(s). The Contractor shall refrain from storing any items in locations other than those identified by the COR. The Government will not be responsible in any way for damage to, or loss of, the Contractor’s stored supplies, materials, replacement parts, equipment, furniture/appliances or any other item removed by the Contractor as part of performance of any task(s) of this PWS.

5.1.3 The Contractor shall remove the existing cove base at locations where task(s) will be performed.

5.1.4 The Contractor shall remove the existing floor covering (carpet) at locations where task(s) will be performed. The removed carpet shall be disposed of in accordance with all Federal, New York State and local laws and regulations at the Contractor’s expense.

5.1.5 The Contractor shall co-ordinate performance of all task(s) of this PWS paragraph with the Contracting Officer’s Representative (COR) to minimize adverse effects on daily depot operations. The Contractor shall remove the floor tiles (asbestos containing) installed under the removed floor covering (carpet) at locations where task(s) will be performed. The Contractor shall comply with all related requirements listed in New York State Title Code 56 (Asbestos). All Contractor personnel performing removal of these (asbestos containing) tiles shall have a current and valid Asbestos License issued by New York State. The removed asbestos containing tiles shall be disposed of in accordance with all Federal, New York State and local laws and regulations at the Contractor’s expense. The Contractor shall provide a copy of all documents related to disposal and transfer of the removed floor tiles (asbestos containing) to the COR, including waste handler licenses and disposal facility certifications.

5.1.6 The Contractor shall repair any damage to walls (including inside all storage areas/closets) at locations where task(s) will be performed.

5.1.7 The Contractor shall prime and paint walls (including inside all storage areas/closets) at locations where task(s) will be performed. Surface preparation, priming and painting shall comply with the product(s) manufacture’s requirements listed on the product(s) container(s). All products used shall have a limited lifetime commercial warranty. The primer and paint used are subject to review and per-approval by the Contracting Officer. The Contracting Officer’s Representative (COR) will select the color(s) and finish(s) of all paint applied in each location where task(s) will be performed.

The Contractor shall dispose of all unused primer and paint in accordance with all Federal, New York State and local laws and regulations at the Contractor’s expense. No unused paint or primer will remain on-site upon completion and acceptance by the Contracting Officer’s Representative (COR) of priming and painting.

5.1.8 The Contractor shall prime and paint all window trim, door trim, doors (both sides) and any other trim (including inside all storage areas/closets) at locations where task(s) will be performed. Surface preparation, priming and painting shall comply with the product(s) manufacture’s requirements listed on the product(s) container(s). All products used shall have limited lifetime commercial warranty. The primer and paint used are subject to review and pre-approval by the Contracting Officer. The Contracting Officer’s Representative (COR) will select the color(s) and finish(s) of all paint applied in each location where task(s) will be performed. The Contractor shall dispose of all unused primer and paint in accordance with all Federal, New York State and local laws and regulations at the Contractor’s expense. No unused paint or primer will remain on-site upon completion and acceptance by the Contracting Officer’s Representative (COR) of priming and painting.

5.1.9 The Contractor shall prepare the exposed floor and install new floor coverings

(carpet) at locations where task(s) will be performed. Surface preparation, shall comply with the carpet and floor levelers/adhesives product(s) manufacture’s requirements listed for the product(s) used. All products used shall be commercial grade and have a lifetime commercial warranty. The carpet, floor leveler, floor adhesive and transition products used are subject to review and pre-approval by the Contracting Officer. The Contracting Officer’s Representative (COR) will select the color(s) of all transition products to be installed in each location where task(s) will be performed. The Contracting Officer’s Representative (COR) will select the carpet to be installed in each location where task(s) will be performed. Commercial carpet tiles measuring 24 inch by 24 inch (e.g. Shaw High Voltage carpet tiles) shall be installed. The Contractor shall provide (a minimum of 10% of the total square footage of each type/color of carpet tile installed) additional (uninstalled) carpet tiles to the Government for future use. The Contractor shall dispose of all unused floor leveler(s) and adhesive(s) in accordance with all Federal, New York State and local laws and regulations at the Contractor’s expense. No unused floor leveler or adhesive will remain on-site upon completion and acceptance by the Contracting Officer’s Representative (COR) of carpet installation.

5.1.10 The Contractor shall install new cove base at locations where task(s) will be performed. The cove base products used are subject to review and pre-approval by the Contracting Officer. The Contracting Officer’s Representative (COR) will select the cove base color(s) to be installed in each location where task(s) will be performed.

5.1.11 The Contractor shall return all furniture/appliances temporarily removed back to their original location (e.g. modular office furniture, bookcases, file cabinets etc.) and appliances (e.g. refrigerators, stoves, microwave ovens etc.)

that were removed from locations where task(s) were performed and reconnect electrically. The modular office furniture may require some reassembly (if partially disassembled as part of task(s) performance of paragraph 5.1.1 of this PWS to permit movement). Contents of the office furniture shall not be removed or damaged. The Contractor shall be responsible for any and all damage to furniture, appliances or materials contained within these as a result of this return back to their original location.

The Contractor and the Contracting Officer’s Representative (COR) will jointly perform a post return inspection of all returned furniture/appliances to verify that no furniture/appliances were damaged during the relocation processes. If any damage is identified during this post return inspection, the Contractor shall repair all damage identified (to the satisfaction of the Contracting Officer’s Representative (COR)) at the Contractor’s expense.

The results of this post return inspection will be documented in writing and signed by the Contractor and the Contracting Officer’s Representative (COR). The Contractor shall ensure that all furniture/appliances removed and then returned to their original location(s) are fully operational upon completion of this PWS paragraph.

5.1.12 The Contractor shall return any other items/components temporarily removed back to their original location (e.g. wall art, clocks, signs, posters, white boards, corkboards, curtains, blinds etc.) that were removed from locations where task(s) were performed. The Contractor shall be responsible for any and all damage to any other items/components as a result of this return back to their original location. The Contractor and the Contracting Officer’s Representative (COR) will jointly perform a post return inspection of all returned other items/components to verify that no other items/components were damaged during the relocation processes. If any damage is identified during this post return inspection, the Contractor shall repair all damage identified (to the satisfaction of the Contracting Officer’s Representative (COR)) at the Contractor’s expense. The results of this post return inspection will be documented in writing and signed by the Contractor and the

Contracting Officer’s Representative (COR). The Contractor shall ensure that all other items/components removed and then returned to their original location(s) are fully operational upon completion of this PWS paragraph.

5.2 Building 13 Interior: The Contractor shall perform upgrades to the interior of Building-13 that include performance of an interior floor covering replacement and interior wall repairs and repainting. Estimated 318 square feet total of floor coverings. Estimated 944 square feet total of wall surfaces. The Contractor shall perform the following task(s) at a minimum inside of building 13:

5.2.1 The Contractor shall identify and document in writing any pre-existing damage to furniture and appliances that are installed at locations where task(s) will be performed. The Contractor shall provide a copy of this pre-existing damage documentation to the COR for review and concurrence prior to performing the task(s) listed below in this PWS paragraph. The Contractor shall disconnect electrically and temporarily remove all furniture (e.g. desks, bookcases, file cabinets etc.) and appliances (e.g. refrigerators, microwave ovens etc.) that are installed at locations where task(s) will be performed.

Contents of the office furniture shall not be removed or damaged. The Contractor shall be responsible for any and all damage to furniture, appliances or materials contained within these as a result of this movement.
