About this file
This is a Contractor Non-Disclosure Agreement for employees of contractors providing support services to the Defense Logistics Agency (DLA) under two specific contracts: RFP SP4705-25-R-000X (BCS/UCS DLA Lifecycle Management Services) and Task Order Solicitation SP4705-25-Q-XXXX (BCS/UCS Fort Belvoir, Virginia). The agreement establishes mandatory confidentiality obligations for contractor employees who have access to nonpublic information during contract performance.
The recipient agrees to limit information access to only what is necessary for contract performance, disclose their contractor status when accessing information from government employees, and refrain from using or disclosing nonpublic information for any purpose other than providing contracted support services. Nonpublic information covered includes Planning, Programming, Budgeting and Execution (PPBE) information, Controlled Unclassified Information (CUI), source selection information, proprietary information, advance procurement information, trade secrets, Privacy Act-protected information, and other sensitive data exempt from Freedom of Information Act disclosure. The recipient must report any improper disclosures to the Contracting Officer's Representative in writing, return all nonpublic information and transcriptions upon contract departure, and acknowledge that violations may result in administrative, civil, or criminal penalties. The agreement preserves employee rights under existing statutes and Executive orders regarding classified information, congressional communications, Inspector General reporting, and whistleblower protections.
