TECHNICAL EXHIBIT 2.1

GENERAL DEFINITIONS, ACRONYMS, AND ABBREVIATIONS

2.1

DEFINITIONS

Acceptable Performance Level (APL): The minimum performance of each requirement before the Government considers performance unsatisfactory.

Contractor-Generated Hazardous Waste: Waste resulting from or caused by Contractor operations (e.g., Contractor damaged or expired 3PL HM that no longer can be issued or redistributed and/or any HM item (regardless of ownership) spilled by the Contractor and the resultant clean-up material that has to be disposed of.

Contracting Officer (KO): The person with the authority to enter into, administer, and/or terminate a contract and make related determinations and findings.

Contracting Officer’s Representative (COR): An individual designated and authorized in writing by the KO to perform specific technical or administrative functions.

Contractor-Owned Third Party Logistics (3PL) Inventory: HM purchased by the Contractor but not yet sold to the Government.

Cost Avoidance (C/A)/Reuse: Previously Government paid for material that is received and re-issued at no charge to the customer.

Customer: Any person or activity authorized by AUL to be issued and receive HM from the Contractor.

Emergent Order: Refers to a high priority unplanned requirement that dictates expedited acquisition and distribution support by the Service Provider to meet or sustain mission readiness.

Excess Material: Material that has not had any demand within a pre-determined period of time, is approaching shelf-life expiration, or container degradation threatens disposal action. Includes any Contractor owned inventory that is not demand supported.

Government-Generated Waste: HW produced as a result of Government industrial process or Government-Owned HM which can no longer be shelf-life extended, redistributed, or used due to banned chemicals.

Government-Owned Inventory: Any HM or property bought with Government funds.

Hazardous Material (HM): Any item or chemical which is a “health hazard” or “physical hazard” IAW 49 CFR, Transportation, that identifies HM as a substance or material that the Secretary of Transportation has determined to be capable of posing an unreasonable risk to health, safety, and property when transported in commerce. This is expanded to include items of supply (substances or material) that, because of its quantity, concentration, physical, chemical, or infectious characteristics, may either cause or significantly contribute to serious, irreversible, incapacitating illness, or an increase in mortality. HM may also pose an environmental threat when improperly treated, stored, transported, disposed of, or otherwise managed.

Hazardous Material Information Resource System (HMIRS) Next Generation (H2): A DoD automated system developed and maintained by DLA. HMIRS (H2) is the central repository for Safety Data Sheets (SDS) for the US Government military services and civil agencies. It also contains value-added information input by the service/agency focal points. This value-added data includes HAZCOM warning labels and transportation information. HMIRS provides data for hazardous materials purchased by the Federal Government through the DoD and civil agencies. The system assists Federal Government personnel who handle, store, transport, use, or dispose of HM.

Hazardous Substance: Any substance designated under the Clean Water Act and the Comprehensive Conservation Recovery Act (CERCLA) as posing a threat to waterways and the environment when released (see 40 CFR, Environment, Volume I, Chapter I, Environmental Protection Agency, Part 302.4, Designation of Hazardous Substances).

Hazardous Waste (HW): An item that is regulated under Resource Conservation and Recovery Act (RCRA) or by state regulation as HW. HW is regulated by 40 CFR, Environment, Parts 260-265. From a practical standpoint, if an Environmental Protection Agency (EPA) or state HW code can be assigned, the item is HW.

Major Violation: A procedural or operational error discovered during an outside regulatory agency inspection or an internal inspection that would result in a Notice of Violation (NOV).

Minor Violation: A procedural or operational error discovered during an external or internal inspection that results in a Notice of Finding (NOF).

Not in Stock (NIS): A demand supported AUL item that is not available to satisfy a customer demand when it occurs.

Pharmacy/Issue Center: An approved location within the various complexes where hazardous materials required by the ALC in their maintenance, overhaul, and repair of various weapons systems are received and stored, and issued to authorized users. The term pharmacy and issue center are interchangeable.

Point of Sale: When material ownership and physical accountability transfers from the 3PL Service Provider’s storage facility, is physically delivered to an Issue Center or direct to the maintenance shop, and the receipt transaction is completed in EESOH-MIS.

Point of Use (POU) Cabinets: An approved location where hazardous materials are stored for use by an authorized user. The POU may be an approved storage cabinet, locker, storage area, storeroom, or conforming storage container.

Quality Assurance: The functions and associated actions performed by the Government to ensure that contract requirements are performed and that an appropriate level of Contractor quality control activities are in place and operational.

Quality Control: Those internal management functions that include, but are not limited to, training, documented procedures, inspections, and tests (taken at the point of performance) necessary to ensure that Contractor products and services conform to contract requirements, specifications, and APLs.

Reuse Inventory: Previously purchased chemical products that have been determined to be in excess of customer’s immediate need and returned to a consolidated inventory facility for management and redistribution. Reuse products must be serviceable material in good condition with shelf-life remaining and may consist of new unopened or partially used containers. Reuse is also known as Cost Avoidance inventory as it may be issued to fulfill customer orders to avoid paying full price for buying new products and helps avoid waste stream disposal costs through redistribution.

Shelf-Life Items: An item of supply possessing deteriorative or unstable characteristics to the degree that a storage time period must be assigned to ensure that it will perform satisfactorily in service. Examples of shelf-life items received are chemicals, packaged petroleum, personal safety items, etc.

Technical Point of Contact (TPOC): An individual designated and authorized in writing by the KO to perform specific technical or administrative functions.

Warehouse Refusal: See Not in Stock.
