Environmental Protection Agency (EPA) under this Contract.
1.1.3 Contracting Officer (CO) - The EPA Representative for contract administration.
1.1.4 Contracting Officer’s Representative (COR) - The EPA Representative for field oversight.
1.1.5 Government - The Government, for purposes of the work herein, is EPA Region 7.
1.1.6 Project Officer (PO) - The EPA Representative for project management and the technical aspects of the project.
1.1.7 Performance Work Statement (PWS) - Statement of work for performance-based acquisitions that describes the required results in clear, specific and objective terms with measurable outcomes.
1.2 SITE LOCATION AND DESCRIPTION
1.2.1 The 10th Street Superfund Site (Site) is assigned Comprehensive Environmental Response, Compensation, and Liability Information System (CERCLIS) identification number NED981713837 and is located in Columbus, Platte County, in east-central Nebraska. The Site is located in the south central portion of the City of Columbus in Platte County, Nebraska and is composed of two operable units (OUs).
OU1 includes an area generally south of the Union Pacific (UP) rail line that crosses the central portion of the city and includes the southern municipal well field where contamination was originally identified and the former Jackson Services and Liberty Cleaners source areas. OU2 includes the area north of the UP rail line to the former One Hour Martinizing (OHM) dry cleaning facility, now Prestige Dry Cleaning, located over ½ mile north of OU1. Although OHM became Prestige Dry Cleaning in 2009, it will be referred to as OHM for consistency with previous documents.
1.2.2 The amended remedy as described in the 2012 Amendment to the Record of Decision (ROD) (EPA 2012) is intended to be the final response action to address all contamination associated with the principal threats posed by the three source areas. The three source areas are the former OHM, located at 2262 25th Avenue; the former Jackson Services, located at 960 24th Avenue; and the former Liberty Cleaners, located at 1061 25th Avenue.
1.2.3 Specifically, the amended remedy addresses the source contamination in the unsaturated soils and residual groundwater contamination located at the source areas. The amended remedy for the source area soils is building demolition, excavation of contaminated soil and off-site disposal at all three source areas including demolition of the former warehouse at 1059 25th Avenue, which is adjacent to the former Liberty Cleaners. The alternatives will include placement of a chemical oxidant in the excavation prior to backfilling.
10ST_SEC_01 10 00.docx 01 10 00-2
1.2.4 The amended remedy will permanently and significantly reduce the toxicity, mobility and volume of Site contaminants of concern (COCs) through above mentioned actions as well as in situ chemical oxidant (ISCO) and/or biological remediation of residual groundwater.
1.3 BASIS OF DESIGN
As described in the amended remedy, this remedial design (RD) includes the following elements:
Building demolition, excavation and off-site disposal of contaminated soil at all three source areas. A chemical oxidant will be placed in the excavation prior to backfilling to address residual contaminants of concerns (COCs) in the vadose zone/capillary fringe.
ISCO application to address contaminated direct-push technology (DPT) at all three source areas.
1.4 WORK COVERED BY CONTRACT DOCUMENTS
The work specified by the Contract Documents (Performance Work Statement, Quality Assurance Surveillance Plan, Specifications and Contract Drawings) shall include, but is not limited to: building demolition, excavation and off-site disposal of contaminated soil at all three source areas; placement of a chemical oxidant in the excavation prior to backfilling to address residual COCs in the vadose zone/capillary fringe; backfilling of excavations; restoration of disturbed areas, groundwater treatment using in situ chemical oxidation (ISCO) and groundwater monitoring well installation.

Submittals requiring Government approval shall be scheduled and received prior to the acquisition of the material or equipment covered thereby. Samples remaining upon completion of the work shall be picked up and disposed of in accordance with manufacturers Material Safety Data Sheets (MSDS) and in compliance with existing laws and regulations.
3.1.2 The submittals shall be promptly made in accordance with the procedures described in the Special Clauses of these Specifications. The submission requirements, review process, and the final distribution of the submittals shall be as specified herein.
3.2 SUBMITTAL REGISTER
At the end of this Section is one set of Submittal Registers listing items of equipment and materials for which submittals are required by the Specifications. This list may not be all-inclusive and additional submittals may be required. The Contractor will also be given the Submittal Register files, containing the computerized Submittal Registers and instructions on the use of the files. These Submittal Register files will be furnished on a separate diskette. Columns “d” through “r” have been completed by the Government. The Contractor shall complete columns “a” and “s” through “u” and submit the forms (hard copy plus associated electronic file) to the COR and/or the PO for approval within 5 calendar days after Notice to Proceed. The Contractor shall keep this diskette up-to-date and shall submit it to the COR and/or the PO together with the monthly payment request. The approved Submittal Register will become the scheduling document and will be used to control submittals throughout the life of the contract. The Submittal Register and the progress schedules shall be coordinated.
3.3 SCHEDULING
3.3.1 Submittals covering component items forming a system or items that are interrelated shall be scheduled to be coordinated and submitted concurrently. Certifications to be submitted with the pertinent drawings shall be scheduled accordingly. Adequate time (a minimum of 5 calendar days exclusive of mailing time) shall be allowed and shown on the register for review and approval. No delays, damages, or time extensions will be allowed for time lost in late submittals.
3.3.2 The COR and/or the PO will review the Submittal Register for approval action.
3.3.3 The approved register will become a part of the contract, and the Contractor shall be subject to the requirements thereof. The Contractor shall revise and/or update the register monthly to take into account all changes in the contract. Each such revised addition and/or revision to the register shall be submitted to the COR and/or the PO for approval. This register and the progress schedules shall be coordinated.
3.4 TRANSMITTAL FORM
The sample transmittal form attached to this Section shall be used for submitting both Government approved and information only submittals. These forms will be furnished to the Contractor. The Contractor shall submit 2 copies, each with separate transmittal, to the COR and/or the PO in accordance with the Submittal Register.
3.5.2 Deviations
For submittals that include proposed deviations requested by the Contractor, the column “variation requested” of the transmittal form shall be checked. The Contractor shall set forth in writing the reason for any deviations and annotate such deviations on the submittal. The Government reserves the right to rescind approval of submittals containing unnoted deviations.
3.6 CONTROL OF SUBMITTALS
The Contractor shall carefully control his/her procurement operations to ensure that each individual submittal is made on or before the Contractor scheduled submittal date shown on the approved Submittal Register.
3.7 GOVERNMENT APPROVED SUBMITTALS
Upon completion of review of submittals requiring Government approval, the submittals will be identified as having received approval by being stamped and dated. The COR and/or the PO will retain six copies of the submittal, and four copies of the submittal will be returned to the Contractor.
3.8 FOR INFORMATION ONLY SUBMITTALS
Normally submittals for information only will not be returned. Approval of the COR and/or the PO is not required on information only submittals. The Government reserves the right to require the Contractor to resubmit any item found not to comply with the contract. This shall not relieve the Contractor from the obligation to furnish material conforming to the Contract Documents and will not prevent the COR and/or the PO from requiring removal and replacement of nonconforming material that has been incorporated into the work. This shall not relieve the Contractor of the requirement to furnish samples for testing by the Government laboratory or for check testing by the Government in those instances where the technical Specifications so prescribe.
3.9 RESUBMISSION REQUIREMENTS
3.9.1 Make any corrections or changes in the submittals required by the COR and/or the PO and resubmit until approved.
3.9.2 Revise initial drawings or data and resubmit as specified for the initial submittal.
3.9.3 Indicate any changes that have been made other than those requested by the COR and/or the PO.
3.9.4 Samples: Submit new samples as required for initial submittal.
