PROJECT OFFICER DAVID WENNERSTROM: We are going to 2 get started. Chester, can you check to see if there is anybody 3 walking around outside? 4

Okay, we are going to do a Question and Answer 5 session, but first, we are going to have Arby’s and their 6 architect talk about the work they are doing at Arby’s, and we 7 will go on, and then Chester will talk about the Small Business 8

Program, and then we will go into the Q&A. 9

All right, go ahead. 10

MR. KEVIN FLECKY: Thank you. 11

Hi. Good afternoon. I am Kevin Flecky. I am with 12 the Schemmer Associates. I am an architect representing Arby’s, 13

Alan D’Agosto and the panel, Panda Corporation, and we just 14 wanted to say a couple words about the scope of work and the 15 schedule involving the Arby’s which is just west of the dry 16 cleaner site. 17

What we are doing is essentially an image upgrade to 18 the exterior and the interior. It is the type of work that is 19 happening in quite a few locations, required of Arby’s, and if 20 you can picture the exterior, there is exterior insulation and 21 finish system there currently, and we will be going around and 22 replacing a certain amount of that. We will be replacing the 23 large canopy, wood-framed canopy you see. And coming in with 24 the new signage, new lighting, new colors, but it is 1 essentially new finishes on the exterior, and on the interior, 2 very similar. We will be refinishing the walls the ceilings and 3 the floors. And on the exterior also, we are going to be 4 replacing the concrete walks and the curbs and the aprons that 5 you see, in the immediate vicinity of the building itself. And 6 then, the dumpster enclosure, as well, will be part of our work 7 to remove. 8

The plan right now is to begin construction in the 9 middle of September, and Jason, I will let you talk a little bit 10 more about the timing, the schedule of construction. 11

MR. JASON MATELJAN: Good afternoon, everybody. 12

My name is Jason Mateljan. I am the General 13

Contractor of Panda, Inc. 14

I really don’t have much to add to that other than 15 the goal is to kind of be done with the exterior work on our 16 facility before anybody has to start digging on the front side 17 of our drive-thru over there. 18

We plan on replacing, on the east side, at least two 19 pieces of the concrete for the walkway right there, but not 20 fully up to where you guys will be doing your work, just to 21 avoid any problems with that as you are digging. As Kevin said, 22 the shed and the -- or the dumpsters will be removed on the east 23 side so none of that will be in the way. Other than that, 24 nothing we are doing should really affect anybody here. 1

I would be happy to leave some business cards if 2 anybody has any questions that they want answered in greater 3 detail, but the plan is just to be shutdown while you guys are 4 doing your thing and coincide that a little bit, save time for 5 everybody, so. If anybody has any simple questions, yeah. 6

AUDIENCE MEMBER: Yeah, just a real simple question. 7

I know how these schedules float around just a little bit. Will 8 the winning contractor -- will you guys notify the EPA so that 9 you can notify the winning contractor of the exact start date, 10 because there are some damages -- $20,000 is a pretty big -- 11

MR. MATELJAN: Sure. Yeah. 12

PROJECT OFFICER WENNERSTROM: I will answer that 13 question; Dave Wennerstrom, EPA. 14

Yes, when the winning contractor gets notified, I am 15 going to coordinate right with Alan D’Agosto, with Arby’s, and 16 myself and the winning contractors, so we can line up that work. 17

To clarify what they said is, the exterior work is 18 going to be done in September, and then they are going to move 19 to the interior, shut down Arby’s for a couple weeks while the 20 contractor, the EPA contractor is working on the outside -- 21

AUDIENCE MEMBER: Okay. 22

PROJECT OFFICER WENNERSTROM: -- for those two weeks. 23

The contract allows for fifteen days. 24

MR. MATELJAN: We will get started probably about a 1 month from -- before when your date is currently, about -- on or 2 about September 14th, we will get started on our exterior. 3

Anybody else? 4

Okay. All right. 5

PROJECT OFFICER WENNERSTROM: Thank you. 6

MR. MATELJAN: Thank you. 7

MS. AMBER KRUEGER: Hello again. My name is Amber 8

Krueger, and I am the Contracting Officer on this project. I 9 would like to welcome you to the Proposal Conference Site Visit 10 for 10th Street Remedial Action, Phase II, Columbus, Nebraska. 11

The Solicitation Number is SLL-R7-15-0012. 12

I would like to summarize a bit on how this 13 conference is going to go. 14

I would like to introduce my fellow EPA co-workers, 15 and also, I would like for you to introduce yourself eventually, 16 and kind of -- and allow, you know, time to explain who you are, 17 what company you are from, and if you are a prime or sub, then I 18 would like to go into Chester Stovall -- he is our Small 19

Business Specialist, and he will be talking about, you know, our 20 philosophy pertaining to the small business, and we appreciate 21 your business, of course. 22

First of all, I would like to introduce my fellow EPA 23 co-workers; David Wennerstrom, he is the COR. Bill Gresham, 24 where are you, Bill? There he is back there. He is the COR 1

Alternate. Chester Stovall, of course. He is the Small 2

Business Specialist. Marie Noel; she is the Lead Contracting 3

Officer, Amber Krueger, obviously. Don Denno; he is the 4

Regional Acquisitions Manager, he is back there. And Kate 5

Clever, the EPA Contracts Attorney. She is -- there she is in 6 the back. 7

PROJECT OFFICER WENNERSTROM: And Nebraska MDE2 just 8 left, Tom Buell and Sarah Jeffries, they are our counterparts on 9 this state, working alongside this contract with the EPA. 10

MS. KRUEGER: Okay, now, I would like for the vendors 11 to introduce yourselves, please. Just kind of starting left to 12 right. 13

PROJECT OFFICER WENNERSTROM: We would you like you 14 to stand. The purpose of this is so that other people will know 15 that you are here. We would like you to give your name, the 16 name of your company, where you are from, and whether you are 17 looking to be either a prime or a sub. 18

Okay, if you would please stand up, please. 19

(Introduction of Vendors) 20

MS. KRUEGER: Very good. Thank you. 21

Chester, would you like to come up here and say a few 22 words? 23

MR. CHESTER STOVALL: Thank you, Amber. 24

Hello folks. I am glad you could make it in to see 1 how we do contracts in our Region. It is very important that 2 you realize a couple things. Number one, that we are going to 3 treat you fair and honest. You may not believe it, but we will. 4

Take my word for it. 5

The contract you are looking at is one of several we 6 are doing this week and next week. In order to find more -- we 7 have a couple contracts on the street that will be doing -- 8 people are going to their conferences next week. Check with me 9 after and I will give you that information. 10

As you go through this particular solicitation, 11 please make sure that you understand everything that we are 12 asking. If you are not quite sure about it, now is the time to 13 ask the questions for it. Especially, look at the background 14 requirements and the experience requirements for your firm and 15 other folks, to make sure you really know what we are asking the 16 prime to be able to do. It is important when you are putting 17 your proposal together. 18

We strongly believe in small business, we really do, 19 because in our experience, it has worked out very, very well. 20

The reason why we have the people to conferences is to ask -- to 21 give you a chance to ask your questions and get them answered, 22 either here or -- or with an Amendment, to enable you to give us 23 a good bid with a good price, something maybe we can award to 24 with no problem. 1

This is the place to ask your questions. I hope you 2 appreciate all of the hard work that some folks have put in to 3 make this a possibility for you to take a look at today. 4

One last thing; this is a sign-in sheet. What my 5 plan is is to be able to give -- this will be listed online with 6 the transcript. However, because you made it this far, what we 7 would like you to do is give you a copy of this before you leave 8 so you can do the prime and subcontractor relationship building, 9 to get that process underway. Once it is -- I will hold my hand 10 up, and if anybody has a sign-in sheet, I would like you to get 11 it to me, and I will wave my hand which means I am leaving the 12 building. If you have not signed in, stop me; otherwise I am 13 going to run down the street and get copies and bring them back 14 for you at no charge to take home with you. 15

With that, back to our Hostess of Ceremony. 16

MS. KRUEGER: Thank you, Chester. 17

Now, I would like to introduce David Wennerstrom. He 18 is the COR, and he may have a few words to say. 19

PROJECT OFFICER WENNERSTROM: Yeah, David 20

Wennerstrom. I will be on-site after the contract is awarded. 21

I will be the Project Manager and the Quality Assurance 22

Representative from the Government, and I will see who ever gets 23 the contract on-site for the duration of the contract. 24

That’s all I have. 1

MS. KRUEGER: I believe we are going to go right into 2 questions and answers now. 3

Question 1: “Is this a total Small Business Set-4

Aside for the performance of the demo, excavation, etc.?” 5

PROJECT OFFICER WENNERSTROM: And the answer is, the 6 contract is a Small Business Set-Aside. 7

MS. KRUEGER: “I see on the Disposal section, the 8 estimate tonnage which possibly be hazardous is slated for 9 disposal at Kimberly, Nebraska. Would you perhaps be referring 10 instead to the Kimball, Nebraska RCRA Incineration Facility?” 11

PROJECT OFFICER WENNERSTROM: The answer is, 12 correction, it is Kimball, Nebraska, K-i-m-b-a-l-l. 13

MS. KRUEGER: Question 3: “Does an incumbent exist 14 for the 10th Street Remedial Action Phase II in Columbus, 15

Nebraska requirement, and if so, could you please provide the 16 vendor and the corresponding contract number?” 17

PROJECT OFFICER WENNERSTROM: The answer is no, an 18 incumbent does not exist. 19

MS. KRUEGER: Question 4: “Section M-2, Fact to 20

Land, includes a requirement that the prime contractor 21 demonstrate experience with three separate projects which 22 include using Direct Push Technology, DPT, and Insitu Chemical 23

Oxidation, ISCO, ISCO injections to a depth of at least sixty 24 feet Below Ground Surface, BGS, to be considered technically 1 acceptable. We ask for your consideration of an alternative 2 qualification on the DPT/ISCO portion of this factor. We 3 believe that this factor’s new criteria reduces competition but 4 does not improve the evaluation of prime contractor’s 5 demonstrated performance. We ask for your consideration for an 6 alternative procedure where a prime contractor may qualify under 7 this factor for the DPT/ISCO portion.” 8

PROJECT OFFICER WENNERSTROM: The answer is, we will 9 be issuing an Amendment to make the changes to the evaluation 10 factors. 11

AUDIENCE MEMBER: Can you tell us what the changes 12 will be? 13

PROJECT OFFICER WENNERSTROM: Can I? 14

MS. MARIE NOEL: We wrote it down. 15

PROJECT OFFICER WENNERSTROM: We wrote it -- I can 16 say generally what it is. 17

Generally, that requirement will be the contractor 18 will show experience -- the contractor to show experience 19 performing at least fifteen DPT/ISCO injections, one of which is 20 at least sixty feet BGS. 21

MS. KRUEGER: Question 5: “Please accept this e-mail 22 as our formal request to receive all notifications for this Pre-23 solicitation/solicitation.” 24

PROJECT OFFICER WENNERSTROM: The answer is, all 1 notifications, amendments, etc., shall be posted on the 2

FedConnect to all vendors. 3

MS. KRUEGER: Question 6: I am paraphrasing the 4 question, “Are bid bonds required?” 5

PROJECT OFFICER WENNERSTROM: The answer is, this is 6 not a construction contract, and thus, no bid bond is required. 7

MS. KRUEGER: Question 7: “Will EPA consider 8 revision of Factor 1, Corporate Experience, Item C, to include 9 evaluation of Subcontractor qualification for DPT work since 10

ISCO injection activities are primarily completed by a key 11 subcontractor?” 12

PROJECT OFFICER WENNERSTROM: The answer to that 13 question is, no. However, a revision to the Corporate 14

Experience sub-factor is being issued in the Amendment as 15 discussed earlier at this conference. 16

AUDIENCE MEMBER: You said it was going to be posted 17 on FedConnect. Is this going to be posted on the FBO website, 18 as well, the actual solicitation for that? 19

MS. KRUEGER: It will be posted on FedConnect. FBO 20 will just refer you to FedConnect. 21

AUDIENCE MEMBER: All right. 22

MS. KRUEGER: Question 8: “Please expand on the 23

MS. KRUEGER: Question 12: “Are other EPA Regions 16 posting similar opportunities? If so, how do I contact them?” 17

PROJECT OFFICER WENNERSTROM: The answer is, to find 18 such information, please check FedConnect and/or Fedbiz Ops. 19

MS. KRUEGER: Question 13: “Will we be provided the 20

Questions and Answers via e-mail?” 21

PROJECT OFFICER WENNERSTROM: The answer is, all 22

Questions and Answers will be provided in the transcript within 23 the Amendment, to be issued early next week. 24

PROJECT OFFICER WENNERSTROM: The answer is, see 5

Specification Section 022419. The report is listed in the 6

Specifications for all of the buildings. 7

MS. KRUEGER: Question 21: “The very limited 8 requirements for the prime in regard to experience stipulations 9 will make for limited competition. 10

A) Can a team show the required experience?” Answer: 11

A team’s subcontractor experience will not be evaluated. 12

“B) Was there a source or spot that provides the 13 names of the technically acceptable firms?” The answer is, no. 14

Are there any other questions from the field? Okay, 22 if you have a question, please come up to the microphone. State 23 your name, your company -- 24

MS. KRUEGER: Wait, wait. 1

If you have any further -- we are going to take a 2 break here, 15 to 20 minute break. 3

So, if you have any more questions, please write them 4 down and send them up front to me, please, and we will get them 5 answered. 6

So, about 1:45, let’s reconvene. 7

[Off the record - Break] 8

MS. KRUEGER: We are going to finish off the rest of 9 the questions and answers. 10

Excuse me, can we all sit down, please? 11

Okay, I will go ahead and start off with what I have 12 here. 13

Question: “How do you know you will get enough 14 competition with such a narrow description of a technically 15 acceptable firm? Is the language following, ‘five years of 16 multiple building demolition projects and experience with three 17 separate projects, which including using DPT and ISCO to be 18 interpreted as a three-separate ISCO project within the same 19 five years as the demolition project?’” 20

The answer to that is, we are amending the language, 21 as follows: Under the sub-factor for Corporate Experience, 22 requirements will be amended to read, as follows: “To be deemed 23 technically acceptable, offers submitted shall demonstrate that 24 the prime contractor meets all minimum technical requirements 1 on its own merits. Capabilities of proposed subcontractors will 2 not be evaluated, and therefore will not be taken into 3 consideration during technical acceptance determinations. 4

A) Offer will demonstrate and describe the 5 environmental corporate experience, at least five years of 6 environmental corporate experience that includes the handling 7 and disposal of hazardous and contaminated material is 8 considered technically acceptable. 9

B) Offer will demonstrate and describe its 10 experience using direct push technology and insitu chemical 11 oxidation injection. Experience performing fifty or more direct 12 push technology and insitu chemical oxidation injections, at 13 least one injection to a depth of at least sixty feet below 14 ground surface, is considered technically acceptable.” 15

Furthermore, under the factor for Key Personnel, the 16 requirements for superintendent will be amended to read as 17 follows: “The site superintendent is the on-site point person 18 overseeing all project work and is required to be on-site 19 throughout the project while work is occurring. The SS must 20 demonstrate and describe at least five combined years’ 21 experience as a site superintendent in a combination of the 22 following features: earth moving, demolition, managing and 23 supervising hazardous clean-up personnel. The site 24 superintendent must have experience in all multiple areas to 1 qualify for the position. Years’ experience can occur 2 concurrently. Site superintendent shall also have three years’ 3 experience out of the last ten years managing or supervising DPT 4 with ISCO injections. If an offer proposes, a site 5 superintendent who is otherwise qualified, the injection 6 experience requirement may be met by proposing a second 7 individual as an injection superintendent. The site 8 superintendent and injection superintendent, if one is proposed, 9 must have OSHA 10-Hour Construction Outreach training, and 40-10

Hours OSHA HAZWOPER training, and be up to date on HAZWOPER 11 training and be up to date on HAZWOPER 8-Hour annual 12 refreshers.” 13

The next question that I received, “Does the prime 14 have to demonstrate self perform of demo, DPT, ISCO or all three 15 on each project?” Basically, refer to the revised language I 16 just now provided, and of course, that will be in the Amendment 17 that I send out, as well. 18

PROJECT OFFICER WENNERSTROM: Okay, I have a couple 19 more questions here. 20

“Is the general contractor required to complete 21 confirmation soil sampling at floor and sidewalls, and of the 22 clean over-burden?” The answer is, yes. 23

The next question is, “Can the general contractor de-24 water prior to or during excavation?” The answer is, yes. 1

“Can water be treated on-site and discharged to 2 sanitary sewer?” Yes, and contractor to submit their plan for 3 their treatment and disposal into the sanitary sewer for COR 4 approval. 5

Next question is, “Does the contractor determine how 6 the excavation is dug?” The answer is, yes. The contractor is 7 to submit their excavation and shoring plan for COR approval. 8

Note to the shoring plan, it must be approved by a Professional 9

Engineer prior to submitting. 10

All right, the next question is, “Regarding your 11 response to the question about leaving the expendable tip in the 12 ground, the answer assumes there is no equivalent horizontal 13 injection tool which would require an expendable tip to remain 14 in the ground. If our horizontal injection tool is equivalent, 15 can the tip remain in the ground?” The answer is, if the 16 horizontal injection tool is shown to be equivalent, the tip can 17 remain pending COR approval. 18

Next question: “For the hazardous waste disposables, 19 specified to be disposed of at the Kimball, Nebraska 20 incinerator, will a permitted treatment alternate be allowed to 21 permit disposal at another facility?” The answer is, yes. 22

The second question is, “Under what criteria could 23 treated contaminated soil be returned to the site as backfilled 24 in the excavation?” The answer is, backfill sampling 1 requirements are found in Section 312323, as well as the VOC 2 clean-up levels are in 026113. 3

All right, the next question is, “Please revisit 4

Question 44. The directional arrows on Sheet C-05 do not match 5 the profiles on Sheet C-06.” The answer is, the sheet will be 6 amended and then included in the Amendment. 7

Thanks for bringing that up. 8

Are there any more questions? 9

MS. KRUEGER: If there are any more questions, now is 10 the time to come up and orally ask them. And just speak right 11 there. Please be sure to state your name and company. 12

AUDIENCE MEMBER REENER: Jackie Reener with GPAC out 13 of Kearney. 14

Some of the guys told me that the sampling following 15

ISCO has -- might be taken out, but instead I was going to 16 sample three months and six months after injection, and I didn’t 17 understand how that would fit in my 270 days. 18

PROJECT OFFICER WENNERSTROM: Correct. I will answer 19 that question. 20

David Wennerstrom. 21

Yes, the confirmation sampling after the three and 22 six months sampling after ISCO injections will be removed from 23 the contract. We are considering doing an option, however that 24 will be -- that will be revised and included in the Amendment. 1

It is not going to be in the Scope of Work right now. 2

MS. KRUEGER: Anyone else? This is your big time. 3

AUDIENCE MEMBER: To clarify your response on the -- 4

I’m sorry? 5

MS. KRUEGER: Name and company. 6

AUDIENCE MEMBER SCHNEIDER: Mark Schneider, Prudent 7

Technologies, Incorporated. 8

Now I lost my question. 9

The response you gave on the key personnel, the ISCO 10 person still has to be from the prime; is that correct? 11

MS. KRUEGER: That's correct. 12

AUDIENCE MEMBER SCHNEIDER: They have to be on their 13 staff? All of the key personnel have to be from the prime’s 14 staff, employees? 15

MS. KRUEGER: Yes. 16

AUDIENCE MEMBER SCHNEIDER: Okay, thank you. 17

AUDIENCE MEMBER: Letter of Intent? 18

MS. KRUEGER: You must also have a Letter of Intent 19 on that, as well. Or a Letter of Intent signed by the 20 individual and notarized. 21

AUDIENCE MEMBER GERBER: Brandon Gerber with IUT. 22

What kind of security is recommended for storing the 23 oxidant on-site, on each of the sites? 24

PROJECT OFFICER WENNERSTROM: I will answer that 1 question. The contractor is to submit their own security and 2 plan for Government approval. It is your choice whether you 3 want to secure the -- your equipment or not. 4

MS. KRUEGER: This is the time, one last time. 5

Anyone have any questions? 6

Okay. I would like to go ahead and close this 7 conference. 8

MR. FLECKY: Chester is not back yet. If anyone 9 wants to hang around for the copy of the sign-in roster, they 10 can do so after we are done. 11

MS. KRUEGER: Okay, did everyone hear that? Chester 12 is not here yet with the signed -- the sign-in sheets, so if you 13 would like to stick around, he will be back soon. 14

Thank you all for coming, and please have your 15 proposals to me by July 20th, 2015, at 12:00 p.m. Central 16

Daylight Time. 17
