OFFICE OF EXPORT CONTROL COOPERATION (ISN/ECC)

EXBS SUPPORT SERVICES CONTRACT

Task Order Title: Curriculum Development: Controlling Intangible Technology Transfers

Task Order Number: Sample Task Order 1

Statement of Work Date: May 2, 2016

I. Background

1. ISN/ECC oversees the U.S. Government’s Export Control and Related Border Security (EXBS) Program. EXBS is designed to stem proliferation of weapons of mass destruction and their delivery systems, and irresponsible transfers of conventional weapons, by assisting countries in establishing effective export and border control systems meeting international standards.

2. A core EXBS initiative is training foreign government officials in internationally-accepted export control policies, processes, and practices. ISN/ECC has identified a requirement to provide partner country officials training on best practices in controlling intangible transfers of technology to strengthen their government’s ability to prevent proliferators from gaining access to technical information that could be employed in developing weapons of mass destruction (WMD) or their delivery systems.

II. Requirements

1. Objectives: The contractor shall develop a course that provides partner governments an understanding of the importance of controlling intangible transfers of strategic technologies to prevent their getting into the hands of proliferators, and useful approaches to implementing such controls.

The course has the following objectives:

a. Enable partner governments to identify intangible means of transferring strategic technologies that may be of proliferation concern.

b. Enhance partner governments’ appreciation for the risks posed by uncontrolled transfers of technical information regarding WMD dual-use commodities.

c. Improve partner governments’ understanding of different approaches that can be taken to effectively control the intangible transfer of strategic technologies.

d. Convey international best practices associated with controlling intangible transfers.

e. Prepare partner government officials to return to their capitals and improve how their countries control intangible transfers.

2. Parameters:

a. The course must be suitable for a class of eighteen (18) officials.

b. Total course duration shall not exceed two (2) days.

3. The Contractor shall rely on its own expertise to determine appropriate curriculum development methodologies and course content, within the following parameters:

a. The course shall satisfy the objectives outlined in Paragraph II.1 and II.2 above;

b. The course shall advocate international best practices in strategic trade controls;

c. The course should present a diverse array of viewpoints, incorporating effective standards adopted by the U.S. Government, EU, foreign governments (e.g., UK, Australia, Japan), and international organizations to the maximum extent practicable;

d. The course should convey best practices for controlling intangible transfers recommended by the multilateral nonproliferation regimes.

4. The course shall incorporate best practices in adult learning, including lecture, group discussion, interactive exercises, and case studies; and include reference resources for partner government officials to draw on, as they seek to improve their governments’ controls after the course.

5. Course Content: At a minimum, the course shall address the following topics:

· Proliferation networks and methodologies

· Importance of controlling intangible technology transfers (ITT) involving strategic commodities

· ITT Elements: technical data, technical assistance, deemed exports, etc.

· ITT Methods: Meetings, inspections, demonstrations, telephone calls, emails, fax, internet, etc.

· Critical importance of controlling ITT

· Establishing a legal basis

· National, International, and Multi-lateral best practices

· Implementing controls over ITT

· Licensing

· Outreach

· Enforcement

· Visa controls

6. Student Proficiency: The Contractor shall incorporate minimum subject matter proficiency standards into the course, and devise a method for evaluating student proficiency against those standards. Proficiency standards and evaluation must measure each individual student’s progress towards desired course outcomes. Proficiency evaluation could include such elements as student participation in class discussion, practical exercises and quizzes, and pre- and post-course knowledge assessment; or some combination thereof.

7. Proof of Concept Delivery: Once the Contractor has completed initial course development, and the materials have been approved by ISN/ECC [see Paragraph III.1. below], the Contractor shall conduct a proof of concept delivery in Tbilisi, Georgia:

a. The Contractor shall deliver the course to a total of 18 Georgian government officials.

b. Training shall be conducted in English with EXBS-Tbilisi arranging for translation into Georgian.

c. The Contractor shall solely be responsible for making arrangements for its instructors to travel to Tbilisi. EXBS-Tbilisi will make all other local logistical arrangements necessary for conduct of the course.

8. Final Course Refinement: The proof of concept pilot is intended to afford the Contractor an opportunity to test its developed course before a live audience consisting of Georgian officials. The Contractor shall develop a final version of the course, applying lessons learned and incorporating the feedback received during pilot delivery. The final version of the course must meet all Paragraph II requirements.

III. Deliverables

1. Initial Course Development:

a. Within three weeks of task order award, the Contractor shall furnish ISN/ECC with a comprehensive development schedule including concrete dates and milestones.

b. Within one (1) month of task order award, the contractor shall furnish ISN/ECC with electronic and paper copies of course outline and supporting examples/case studies.

c. Within four (4) months of task order award, the Contractor shall furnish ISN/ECC with electronic and paper copies of draft course materials, to include: PowerPoint slides, presenter notes, texts, illustrations and diagrams, student reference materials, student proficiency assessment plans, and any other developed materials. These materials may be provided to ISN/ECC on a rolling basis to facilitate timely review. Within four weeks of receiving draft course materials, ISN/ECC will furnish the Contractor with editorial comments.

d. The Contractor shall revise all course materials as necessary to address ISN/ECC’s editorial comments. Revised materials shall be furnished to ISN/ECC in electronic and paper copy within three weeks of receiving ISN/ECC’s editorial comments.

e. ISN/ECC will review the revised materials for acceptability, and the Contractor may be required to make additional minor modifications. Once the materials have been revised to ISN/ECC’s satisfaction, ISN/ECC will notify the Contractor of its approval.

f. Within five (5) months of task order award, the Contractor shall furnish ISN/ECC with electronic and paper copies of course completion certificate design.

2. Proof of Concept Delivery:

a. Within six (6) months of task order award, the Contractor shall conduct a proof of concept delivery in Georgia.

b. The Contractor shall coordinate with ISN/ECC to draft an “invitation cable.” This formal correspondence will be used to gain the local diplomatic post’s permission to conduct an in-country training event. A final draft invitation cable shall be provided to ISN/ECC at least six (6) weeks prior to the scheduled pilot commencement date.

c. Upon pilot conclusion, the Contractor shall provide each Georgian student successfully meeting minimum proficiency standards with a course completion certificate including the course title, course dates, course location, and the participant’s name. Certificates shall be issued under the auspices of the Department of State and the EXBS Program.

d. The Contractor shall furnish ISN/ECC with a draft report within two (2) weeks of pilot conclusion. At a minimum, the draft cable shall provide:

i). Day-by-day summary of pilot activities;

ii). Lessons learned and recommended course adjustments;

iii). Discussion of any topics of particular interest to pilot participants;

iv). Discussion of any noteworthy occurrences;

v). List of pilot participants;

vi). Assessment of pilot participants’ comprehension and acceptance of course teachings (i.e. did the target audience both understand and buy-in to the Contractor’s message? If not, why not?); and vii). Number of pilot participants meeting minimum proficiency standards and number of students failing to meet minimum proficiency standards. Reasons for each failure (e.g. failure to satisfy attendance requirements, failure to successfully complete practical exercise, etc.) shall be provided with accompanying commentary and assessment as appropriate.

ISN/ECC will provide the Contractor with editorial comments on the draft report within five (5) business days of receipt. The Contractor shall revise the report to address ISN/ECC’s editorial comments, and shall provide a final report to ISN/ECC within five (5) business days of receiving ISN/ECC’s comments.

3. Final Course Refinement:

a. Within three weeks of pilot conclusion, the Contractor shall furnish ISN/ECC with a course revision plan, discussing all aspects of the course it intends to refine with supporting rationale.

b. ISN/ECC will review the plan for acceptability, and the Contractor may be required to make modifications. Once the plan has been altered to ISN/ECC’s satisfaction, ISN/ECC will notify the Contractor of its approval.

c. Within four (4) weeks of ISN/ECC’s approval, the Contractor shall furnish ISN/ECC with revised course materials in electronic and paper copy. Within two (2) weeks of receiving the materials, ISN/ECC will furnish the Contractor with editorial comments.

d. The Contractor shall revise all course materials as necessary to address ISN/ECC’s editorial comments. Revised materials shall be furnished to ISN/ECC within two (2) weeks of receiving ISN/ECC’s editorial comments.

e. ISN/ECC will review the revised materials for acceptability, and the Contractor may be required to make additional minor modifications. Once the materials have been revised to ISN/ECC’s satisfaction, ISN/ECC will notify the Contractor of its approval.

f. Within one (1) week of ISN/ECC’s approval, the Contractor shall furnish ISN/ECC with a final draft of all course materials, including PowerPoint slides, instructor notes, texts, illustrations and diagrams, exercise guides, student reference materials, student proficiency assessment plans, course completion certificate, and any other developed materials. One (1) complete set of materials shall be furnished in paper copy and one (1) complete set of materials shall be furnished on CD.

IV. Other Special Considerations

1. The training deliveries are ISN/ECC internal training events. As such, the Contractor may not recommend follow-on activities to event participants without express authorization from the GTM, nor advertise its services to participants. Examples of prohibited activities include, but are not limited to: placing the Contractor’s logo on event materials; advertising Contractor services or touting Contractor past performance in presentations to, or conversations with, EXBS Advisors; and initiating conversations with EXBS Advisors s to promote Contractor services. However, individual instructors are encouraged to discuss relevant personal experiences as they relate to course content.

1. As a condition of award of this task order, all materials produced pursuant to the task order, including training materials, materials for recipients or materials to communicate or promote with foreign audiences a program, event, project, or some other activity under this agreement, including but not limited to invitations to events, press materials, event backdrops, podium signs, etc. must be marked appropriately with the standard U.S. flag in a size and prominence equal to (or greater than) any other logo or identity. Subcontractors are subject to the marking requirements and the Contractor shall include a provision in the subcontract indicating that the standard, rectangular U.S. flag is a requirement. In the event the Contractor does not comply with the marking requirements as established in the approved Task Order, the Contracting Officer Representative and the Contracting Officer must initiate corrective action.

V. Place of Performance

1. Initial Course Development: All development work shall take place at the Contractor’s own facilities. Access may be granted to Government facilities from time to time as approved by the COR or GTM to facilitate planning and coordination.

2. Proof of Concept Pilot: The pilot course shall be delivered in Tbilisi, Georgia.

3. Final Course Refinement: All work shall take place at the Contractor’s own facilities. Access may be granted to Government facilities from time to time as approved by the COR or GTM to facilitate planning and coordination.

VI. Period of Performance

All course work on this task order, to include course development, proof of concept delivery and final refinement, shall be completed within twelve (12) months of award. Final scheduling of the proof of concept course will be dependent upon EXBS-Tbilisi slating the course with the government of Georgia. Consequently, the Contractor shall not undertake workshop delivery without close coordination through, and express authorization from, ISN/ECC.

VII. Security Requirements

There are no special security requirements beyond those specified in the base contract.

VIII. Government Furnished Information or Property

The Government will not furnish any information or property to the Contractor pursuant to this task order.

X. Invoicing

All invoices shall be submitted in accordance with the terms and conditions specified in the base contract and task order award document.

XI. General Provision

All terms and conditions contained in the base contract (as last modified) flow down to this solicitation and any resultant task order. If any term or condition of this solicitation/task order conflicts with the terms and conditions of the base contract, those specified in the base contract shall control.
