About this file

This is a contract agreement between Ada County Highway District (ACHD) and a contractor (TBD) for the Eckert Road Bridges 2147 and 2148 project in Boise, Idaho. The project encompasses major infrastructure work including demolition of existing bridge structures, construction of new bridges over the Boise River and Ridenbaugh Canal, and construction of a single-lane roundabout at the intersection of Eckert Road and Boise Avenue. Additional scope includes reconstruction of roadway approaches, a multi-use pathway along the west side of Eckert Road, a Greenbelt underpass beneath Eckert Road, and modifications to Barber Park driveway access. The project further incorporates roadway excavation and embankment, pavement construction, curb and gutter work, sidewalks, retaining walls, drainage improvements, irrigation and utility adjustments, traffic control, signing, pavement markings, illumination, landscaping, and erosion and sediment control measures. Work involving irrigation and bridge construction shall be completed in accordance with the NMID Approval Letter dated July 16, 2026. The contractor shall commence work within five calendar days of receiving the Notice to Proceed, with an anticipated issuance date of October 1, 2026. Substantial completion is required by June 21, 2028, with the completion date extending one calendar day for each calendar day of delay in issuing the Notice to Proceed.

The contract amount is to be determined (TBD) and will be based on actual quantities of work performed at unit prices proposed by the contractor. The final contract amount is subject to adjustments resulting from approved change orders. Liquidated damages are assessed at $12,000 per calendar day for failure to complete work within the contract timeline. The contractor must furnish a Performance Bond and a Labor and Material Payment Bond, each in an amount equal to the full contract price. The contractor is required to comply with Idaho tax requirements, including payment or securing of all state and local taxes, excises, and license fees, with submission of a Final Billing Certification affidavit and a Public Works Tax Release from the Idaho Tax Commission required as conditions precedent to final payment. The contractor must also indemnify and hold harmless both ACHD and the Local Highway Technical Assistance Council (LHTAC), naming both as additional insureds under all required insurance policies. Final payment is contingent upon completion certificate issuance by the Engineer following final acceptance and inspection of the work.

The Contractor shall indemnify, defend, and hold the Local Highway Technical Assistance Council (“LHTAC”) harmless to the same extent that the Contractor is required under this Agreement to indemnify, defend, and hold the ACHD harmless. The Contractor shall further name LHTAC as an additional insured under all insurance policies required by this Agreement to the same extent that the Contractor is required to name the ACHD as an additional insured.

2. AMOUNT OF CONTRACT

For the performance of, and the provision of materials and equipment for, the work described herein, ACHD agrees to pay the Contractor the estimated amount of TBD (TBD). This estimate is based upon the estimated quantities of work to be performed as provided in ACHD’s bid documents and the unit prices proposed by the Contractor.

3. FINAL CONTRACT AMOUNT

The final total amount payable to the Contractor will be based upon actual quantities of work performed or the contract quantities, as applicable, at the contract unit prices proposed by the Contractor and incorporated herein, together with adjustments to costs or work resulting from approved contract change orders.

4. TIME OF COMPLETION

The entire work to be performed under this contract shall commence within five calendar days after date of Notice to Proceed; the project shall be substantially complete on or about Thursday, June 21, 2028. This completion date is predicated on the Owner's intent to issue a Notice to Proceed to the Contractor on or about October 1, 2026. Should the Owner fail to issue the Notice to proceed on or about October 1, 2026, the required completion date shall be extended one calendar day for each calendar day of delay elapsing between the date the Notice to Proceed is actually issued by the Owner.

Work must begin and be completed as stipulated in this Agreement. Once begun, the Contractor shall diligently continue operations to bring the project to completion without interruption or delay.

5. LIQUIDATED DAMAGES

Failure to complete the work within the contract time stated in the Agreement, including extensions granted thereto, shall entitle the Owner to deduct from the monies due to the Contractor as "Liquidated Damages" of $12,000.00 for each calendar day of delay in completion of all contract work. Liquidated damage assessments shall be cumulative and concurrent. Delays affecting one portion of the Work shall not constitute justification for, nor entitle the Contractor to, an extension of time or delay in the completion of any other portion of the Work.

6. CONTRACTOR FOR PUBLIC WORKS TO PAY OR SECURE TAXES - AGREEMENT

The Contractor, in consideration of securing the business of erecting or constructing public works in this State, recognizing that the business in which he is engaged is of a transitory character, and that in the pursuit thereof, his property used therein may be located outside the State when taxes, excises, or license fees to which he is liable become payable, agrees:

A. To pay promptly, when due, all taxes (other than on real property), excises and license fees due the State, its subdivisions, and municipal and quasi-municipal corporations therein, accrued or accruing under the terms of this contract, whether or not the same shall be payable at the end of such term and to provide a written affidavit with the final construction payment request certifying to said payment;

B. That if said taxes, excises, and license fees are not payable at the end of said term, but liability for the payment thereof exists, even though the same constitute liens upon the Contractor's property, to secure the same to the satisfaction of the respective officers charged with the collection thereof and to provide a written affidavit with the final construction payment request certifying to said security;

and

C. That, if in the event of default in payment of securing of such taxes, excises, and license fees, Ada County Highway District may withhold from any payment due the Contractor hereunder the estimated amount of such accrued and accruing taxes, excises, and license fees for the benefit of all taxing units to which said Contractor is liable; and

D. That Contractor’s submission of a completed Final Billing Certification affidavit to ACHD and ACHD’s receipt of a Public Works Tax Release issued by the Idaho Tax Commission shall each be conditions precedent to final payment.
