About this file

This is a Department of the Army Corps of Engineers permit verification letter issued by the Jacksonville District to the City of Cocoa for the Lee Wenner Park waterfront improvement project located at 401 River Edge Boulevard in Cocoa, Florida. The project authorizes the replacement of docking facilities and installation of shoreline protection measures within the Indian River Lagoon. The scope of work includes removal of existing structures, installation of 2,901 square feet of dock facilities comprising a west access pier (47.5 ft. x 6 ft.), east access pier (40 ft. x 6 ft.), fixed dock (171 ft. x 8 ft.), and six mooring access piers (28 ft. x 6 ft. each), plus installation of two revetments covering 5,492 square feet in front of an existing bulkhead. The permit was issued on July 11, 2025, and is valid until March 14, 2026, authorizing work under Nationwide Permits 13 (Bank Stabilization) and 28 (Modifications of Existing Marinas). Permittees must complete the authorized work within the validation period and submit a self-certification statement of compliance within 60 days of project completion.

The permit includes extensive special conditions requiring compliance with Jacksonville District Biological Opinion provisions, installation and maintenance of turbidity barriers, use of clean fill material free from contaminants, adherence to manatee protection standards including idle speed operations and shutdown procedures if manatees approach within 50 feet, and installation of protected species educational signage and monofilament recycling bins. Additional requirements mandate cultural resource and historic property protections, notification procedures for archaeological discoveries, compliance with North Atlantic right whale approach regulations (500-yard minimum distance), and coordination with the Florida Department of State Division of Historical Resources. The permit conditions address water quality certification, permit transferability with new owner signatures, Corps inspection rights, and notification that the authorization does not preclude obtaining other required federal, state, or local permits, including building permits related to National Flood Insurance Program compliance.

Summary Interpretations of the noise impact zones associated with the project shown in Table 80 are as follows:

• Potential injury for fish and sea turtles from single pile strikes (sSEL) is not measurable as the source levels do not exceed the threshold values for injury.

• Potential injury to fish from cumulative sound exposure (cSEL) each day is possible within

10 m from the pile. For the purpose of this example, fish includes sturgeon and smalltooth sawfish. Since threshold values for sea turtles are not currently known we assume the thresholds used for fish also apply to sea turtles. Therefore we assume the 10 m cumulative sound exposure injury zone also applies to sea turtles.

• Behavioral responses of sea turtles may occur up to 46 m (150 ft) from the project.

• Behavioral responses of fish may occur up to 215 m (705 ft) from the project.

Appendix C: North Atlantic Right Whale Information Form 16 Federal Regulations Governing the Approach to North Atlantic Right Whales

1. Federal regulations governing the approach to North Atlantic right whales can be found at 50 CFR 224.103(c). It is illegal to approach and remain within 500 yards of right whales; 500 yards is equal to the distance of 5 football fields.

Prohibitions on approaching right whales are as follows (Excerpts from 50 CFR 224.103(c), available at www.ecfr.gov): Unless otherwise lawfully allowed or unless doing so would create an imminent and serious threat to a person or vessel, it is unlawful to:

(i) Approach (including by interception) within 500 yards

(460 m) of a right whale by vessel

(ii) Fail to undertake required right whale avoidance measures. If underway, a vessel must steer a course away from the right whale and immediately leave the area at a slow safe speed.

STANDARD MANATEE CONDITIONS FOR IN-WATER WORK

The permittee shall comply with the following conditions intended to protect manatees from direct project effects:

a. All personnel associated with the project shall be instructed about the presence of manatees and manatee speed zones, and the need to avoid collisions with and injury to manatees. The permittee shall advise all construction personnel that there are civil and criminal penalties for harming, harassing, or killing manatees which are protected under the Marine Mammal Protection Act, the Endangered Species Act, and the Florida Manatee Sanctuary Act.

b. All vessels associated with the construction project shall operate at "Idle Speed/No Wake” at all times while in the immediate area and while in water where the draft of the vessel provides less than a four-foot clearance from the bottom. All vessels will follow routes of deep water whenever possible.

c. Siltation or turbidity barriers shall be made of material in which manatees cannot become entangled, shall be properly secured, and shall be regularly monitored to avoid manatee entanglement or entrapment. Barriers must not impede manatee movement.

d. All on-site project personnel are responsible for observing water-related activities for the presence of manatee(s). All in-water operations, including vessels, must be shutdown if a manatee(s) comes within 50 feet of the operation. Activities will not resume until the manatee(s) has moved beyond the 50-foot radius of the project operation, or until 30 minutes elapses if the manatee(s) has not reappeared within 50 feet of the operation.

Animals must not be herded away or harassed into leaving.

e. Any collision with or injury to a manatee shall be reported immediately to the Florida Fish and Wildlife Conservation Commission (FWC) Hotline at 1-888-404-3922. Collision and/ or injury should also be reported to the U.S. Fish and Wildlife Service in Gainesville (1-352-448-9151), and emailed to FWC at ImperiledSpecies@myFWC.com.

f. Temporary signs concerning manatees shall be posted prior to and during all in-water project activities. All signs are to be removed by the permittee upon completion of the project. Temporary signs that have already been approved for this use by the FWC must be used. One sign which reads Caution: Boaters must be posted. A second sign measuring at least 8½ " by 11" explaining the requirements for “Idle Speed/No Wake” and the shut down of in-water operations must be posted in a location prominently visible to all personnel engaged in water-related activities. These signs can be viewed at:

https://myfwc.com/wildlifehabitats/wildlife/manatee/education-for-marinas/. Questions concerning these signs can be forwarded to the email address listed above.
