About this file
This is a Justification and Approval (J&A) document for other than full and open competition submitted by the Department of Veterans Affairs, VISN 10, Network Contracting Office (NCO) 10, at Louis Stokes Cleveland Medical Center.
The document justifies a sole source procurement for the "Renovate Operating Rooms" project (Acquisition ID 36C250-26-AP-0948), which renovates 22,000 square feet of operating room space with new HVAC systems. The estimated material value is $10,500. The justification supports the exclusive use of the Tridium building automation system, specifically the proprietary Vykon JACE 8XXX software and programming/analytics components. Wade Park selected Tridium after extensive investigation and prior competitive evaluation through a separate energy program project. The system integrates electric meters, gas meters, steam meters, lighting controls, boiler and chiller plant controls, and HVAC controls through a single unified interface. While the software and programming require sole sourcing, the document clarifies that sensors, meters, and other devices tied to the Tridium system may be procured through full and open competition from open-source vendors. The statutory authority cited is 41 USC §3304(a)(1)—Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. The procurement will be competed and synopsized on SAM.gov as an Invitation for Bid with a brand name specification requirement. Market research reviewed 14 alternative building automation systems before selecting Tridium. The document was certified by Design COR Richard E. Clark on March 16, 2026, approved by Contracting Officer Stanley Burdine, and approved at the one-level-above requirement by Branch Chief Brian Kish, all from NCO 10.

DEPARTMENT OF VETERANS AFFAIRS
Justification and Approval (J&A) For
Other Than Full and Open Competition (>SAT)
Acquisition Plan Action ID: _36C250-26-AP-0948__
1. Contracting Activity: Department of Veterans Affairs, VISN 10, Network
Contracting Office (NCO) 10, Louis Stokes Cleveland Medical Center will enter into a construction contract that requires the procurement of this item which requires justification for other than full and open competition. The 0 Dollar 2237 purchase request number for the “Renovate Operating Rooms” Project is 541-26-1-5986- 0004.
2. Nature and/or Description of the Action Being Approved: This project is named “Renovate Operating Rooms” and this project renovates 22,000 square feet of current operating room suite providing new HVAC and addressing other identified condition gaps. FCA #124308, 124311.
3. Description of Supplies/Services Required to Meet the Agency’s Needs: Wade
Park is heavily invested in a centralized building automation system called Tridium.
Tridium was selected after extensive investigation of the facilities needs and products available. This extensive investigation was performed as a separate project with the sole focus on determining the best path forward for building automation without eliminating competition for installation and maintenance. A sole source justification was submitted previously which facilitated the initial purchase of the Tridium equipment through an energy program project which. The Tridium system is currently operational and requires that on each subsequent project where there is a need for HVAC control, Automation for Lighting, Power Monitoring, Energy Metering, etc. that Tridium will be the platform required in these contracts. The software, programming/analytics, Vykon JACE 8XXX are proprietary and are the only portion of the Tridium system that needs to be sole sourced currently. All the devices such as sensors, meters, etc. that are tied into the Tridium system that can be purchased with full and open competition by various open-source vendors. This system needs to remain strictly controlled single point of access for building automation for the main campus and all VA controlled properties that will eventually tie into the main campus. Engineering Services was impacted and would be again, if they had to procure, train, monitor and maintain several separate access control systems. The estimated value of materials for this project is $10,500.

(X) (1) Only One Responsible Source and No Other Supplies or Services Will
Satisfy Agency Requirements per 41 USC §3304(a)(1) as implemented by
RFO 6.103-1;
( ) (2) Unusual and Compelling Urgency per 41 USC §3304(a)(2) as implemented by RFO 6.103-2;
( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per 41 USC §3304(a)(3) as implemented by RFO 6.103-3;
( ) (4) International Agreement per 41 USC §3304(a)(4) as implemented by RFO 6.103-4

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): It was found that Tridium Niagara software allows for easy integration of our existing various, electric meters, gas meters, steam meters, flow meters, lighting control, boiler plant controls, chiller plant control, HVAC controls, etc. at Wade Park.
Tridium offers an overarching building automation system with one easy to use interface for engineering service, police service to monitor and control. For those reasons this system was purchased and installed in the facility and is continuing to be upgraded and expanded.
6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as possible (including whether a notice was or will be publicized as required by RFO Part 5 and, if not, which exception under RFO Part 5 applies): This procurement will be competed and synopsized on SAM.gov (https://sam.gov/) as an Invitation for Bid (IFB) and will indicate the requirement for brand name specification for the Tridium system. Since the construction contract is being awarded as a firm fixed price contract through competitive sealed bidding, the bidders are incentivized to locate the supplier that will provide the item at the most economical price.
7. Determination by the CO that the Anticipated Cost to the Government will be
Fair and Reasonable: The anticipated cost should be fair and reasonable to the government based on the overall project is being competed. Reference FAR 8.404 (d), “GSA has already determined the prices of items under schedule contracts to be fair and reasonable.”
8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: The building automation system we looked at were the following. Study is available upon request.
