DEPARTMENT OF VETERANS AFFAIRS

Justification and Approval

For Other Than Full and Open Competition

Acquisition Plan Action ID: 36C250-20-AP-5174

1. Contracting Activity: Department of Veterans Affairs, VISN 10, Program Contracting Activity Central (PCAC), Louis Stokes Cleveland VAMC, will enter into a construction contract that requires the procurement of this item which requires justification for other than full and open competition. The 2237 number for the Renovate Radiation Therapy project is 541-21-1-5986-0005.

2. Nature and/or Description of the Action Being Processed: This project is named “Renovate Radiation Therapy” and its purpose is to renovate and reconfigure the Radiation Therapy department in the basement.

Project will create additional exam rooms and dressing areas by reconfiguring the existing suite as well as updating infrastructure. Existing fixtures and utilities will be relocated and reused where appropriate. While all work shall be designed in accordance with the most recent NFPA life safety manual, the renovation is similar in design and construction to the existing design. The renovation of Radiation Therapy will include extension of the existing security system.

3. Description of Supplies/Services Required to Meet the Agency’s Needs: Wade Park has been implementing a centralized access control/security system manufactured by Lenel which meets all of the Federal security guidelines. Lenel was selected after extensive investigation of the facility needs, and of the products available. A sole source justification was submitted previously which facilitated the initial purchase of the Lenel equipment through GSA federal supply schedule. The Lenel system is currently operational and requires Lenel licenses to be purchased on each subsequent project where there is a need for CCTV. This Lenel software is proprietary and is the only portion of the system that needs to be sole sourced. All of the devices such as servers, storage devices, and security cameras which tie into the Lenel system can be purchased with full and open competition. This system needs to remain a single access control/security system. Police Services was impacted and would be again if they had to monitor and maintain several separate security systems and their ability to protect veterans and employees would be significantly decreased. The estimated value of the Lenel materials is $31,000.00.

4. Statutory Authority Permitting Other than Full and Open Competition: The product is being procured under the authority of 41 U.S.C. 253 (c) (1), FAR Part 6.302-1 (a) (2).

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority. It was found that LENEL access control software allows for easy integration of our existing security cameras at Wade Park. The LENEL software makes these camera feeds capable of analytic controls, smart functions, (i.e. object left behind, door left open, traffic direction in a corridor). All of these features are offered through LENEL at one fifth the cost of comparable competitors. LENEL then offers one easy to use interface for police dispatchers to monitor with all systems displayed in one easy location. For those reasons this system has been purchased and installed in the facility.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: This procurement will be competed and synopsized through Fed Biz Ops (www.fbo.gov) as an Invitation for Bid (IFB) and will indicate the requirement for brand name specification regarding the Lenel system. Since the construction contract is being awarded as a firm fixed price contract through competitive sealed bidding, the bidders are incentivized to locate the supplier that will provide the item at the most economical price.

7. Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: It is anticipated that two (2) or more bids will be received through the sealed bidding process.

If two (2) or more bids are received the cost of the entire project will be considered fair and reasonable to the government based on competition.

8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted:

Verint by Nextiva Sales Rep: Larry Butsch (513) 759-2002 This is a primary competitor to Lenel in video and is the forefront leader in the technology of analytics.

This system is compatible with the Lenel access control software but is five times more expensive than the video software solution of Lenel. The facts that the product lacks local installers and is significantly more expensive than Lenel are the deciding factors in this decision.

NAVCO was also asked for information which is a supplier of the Verint solution.
