About this file

This Liquidation Damages Formulation Memo outlines the calculation of daily damages for delays in a federal contract (Solicitation Number: 36C24426R0017) related to correcting CFA Electrical Deficiencies. The document specifies liquidated damages of $582.98 per calendar day of inexcusable delay, broken down into two primary cost components: $323.28 for VISN 4 Contracting, Engineering, and Legal reviews, and $259.70 for Facility Engineering reviews. The damages are calculated using civilian wage rates from the General Schedule Locality Pay Table for the Rest of U.S., effective January 1, 2025, and are based on historical trends of additional contract administration time. The memo emphasizes that these damages are compensatory, and the government retains the right to seek additional actual damages separate from the contract completion delay.
