About this file

This is a Scope of Work Verification form for the Orange County Transportation Authority (OCTA) related to a Request for Quote (RFQ) for Miscellaneous Signs and Banners on an as-needed basis with no guaranteed usage. The project, identified as Requisition No. R001067, establishes general procurement rules requiring clear and concise scopes of work that meet the Authority's requirements and avoid unreasonable restrictions or vendor favoritism. The SOW must identify all characteristics, specific tasks, functions, and expected quality of services or performance specifications. When brand name specifications are used, they must be accompanied by explanations that the specification is not restrictive, with salient characteristics identified to allow evaluation of "or equal" alternatives. Questions or clarifications must be submitted in writing no later than 4:00 p.m. on August 21, 2026, with written responses to be issued by addendum no later than August 25, 2026.

The budget allocated for this effort is $30,000.00 for a three-year term, with award to be made to the lowest, responsive, responsible firm on a lump sum basis. The successful firm must comply with all applicable Equal Employment Opportunity Laws and Regulations and certify that it is not subject to any Ukraine/Russia-related economic sanctions imposed by the State of California or the United States Government, including Presidential Executive Orders 13660, 13661, 13662, 13685, and 14065. The SOW Verification form must be signed by the Project Manager and either the Department Manager, Director, or Executive Director, certifying that the SOW was independently prepared to invite competition or that brand name references were determined to be impractical or uneconomical with salient characteristics clearly stated in accordance with FTA Circular 4220.1F.

The following general rules shall apply when preparing scopes of work and specifications:

a) Provide a clear and concise Scope of Work (SOW) and not impose unreasonable requirements.

b) Specifications and Scopes of Work shall identify all characteristics and specific tasks and functions of the items or services to be procured, and meet the Authority’s requirements.

c) Whenever possible, the expected quality of services to be provided or the performance characteristics of the item shall be specified.

d) The requestor shall identify all optional items, and the solicitation documents shall set forth the expected needs and the manner in which the related bid prices will be considered.

e) Brand name specifications must be accompanied by an explanation that clearly indicates that the specification is not intended to be restrictive.

f) The salient characteristics represented by the brand names shall be identified to allow for evaluation of possible “or equal” material.

g) Because standard specifications and requirements allow for more efficient operations and result in lower prices, they shall be used wherever suitable.

h) Industry, federal, state and local government specifications and requirements can be used.

Consultants are prohibited from writing the Scope of Work or assisting in the development or writing the Scope of Work in which they may bid.
