About this file
This Request for Proposal solicits landslide repair construction services for the Puerto Rico Highway and Transportation Authority. Certified small businesses are invited to submit technical and price proposals for repairing landslides and washouts caused by hurricanes on various roads in Puerto Rico municipalities. The work includes embankment restoration, retaining walls, drainage, pavement reconstruction, and traffic control. The project is split into multiple schedules with total costs estimated between $1 million to $5 million. A two-step evaluation will first assess technical qualifications like experience performing similar landslide projects, then rank price proposals from technically qualified firms. The contract is expected to be awarded in December 2021 with a 600-day performance period starting in January 2022 upon bond approval. Interested parties must register at SAM.gov to receive solicitation documents and updates issued on or around October 19th, with proposals due on the date specified in Block 13a of the solicitation form. This request is issued by the Eastern Federal Lands Highway Division of the Department of Transportation.

FEDERAL HIGHWAY ADMINISTRATION
EASTERN FEDERAL LANDS HIGHWAY DIVISION
PROJECT PR ER PRMNT RPR(9)
Landslide Repairs – West Region Contract 1
REQUEST FOR PROPOSALS
693C73-22-R-000006
Project Description: The project consists of repairing landslide and washout damaged by Hurricanes Irma and Maria on PR-2, PR-119, PR-123, PR-128 and PR-440. The work includes embankment restoration, gravity retaining walls, gabion basket walls, mechanically stabilized earth walls, traffic control, excavation, pavement reconstruction, erosion and sediment control, drainage repairs, and other miscellaneous work. The project is located in the Municipalities of San Sebastian, Las Marias, San German, Yauco, Utuado, Aguada, and Aguadilla in Puerto Rico.
The project will be split into multiple work schedules, with the cost of the entire project expected to fall between $1,000,0000 and $5,000,000.
Scope of Work: The detailed scope of work to be undertaken by the successful Offeror under the contract for this project is outlined in the Request for Proposal (RFP) solicitation documents.
These include the Plans, Special Contract Requirements (J Pages), and supplemental Government Furnished Information.
Procurement Overview of the Project: In accordance with Federal Acquisition Regulation (FAR) Subpart 14.5, the Eastern Federal Lands Highway Division (EFLHD) is conducting a Lowest Price Technically Acceptable Source Selection Process for this project. Under this Notice, the EFLHD (also referred to as “the Government”) is soliciting all eligible Contractor firms/teams (Offerors) to participate in a two-step RFP process. The two steps will include the submittal of two proposal packages; a Technical Proposal and a Price Proposal. A description of these proposals and their requirements can be found in the RFP’s Proposal Instructions (B Pages).
During step one, a selection evaluation board will review and evaluate the technical proposals submitted by all interested, responsive Offerors. The selection committee will select qualified Offerors based on the pass/fail (acceptable/unacceptable) evaluation criteria as stated in the RFP’s Proposal Instructions - Evaluation of Proposal Documents (B Pages). Offerors should submit technical proposals that are acceptable without additional explanation or information.
The Government may make a final determination regarding a technical proposal’s acceptability solely on the basis of the technical proposal as submitted. The Government may proceed with the second step (lowest price evaluation) without requesting further information from any Offeror; however, the Government may request additional information from any Offeror with a technical proposal considered reasonable and close to acceptable, and may discuss any technical proposal with any Offeror. Only one technical proposal may be submitted by each Offeror. The step one technical proposal shall not include any prices or pricing information.
During step two, only technical proposals determined to be acceptable, either initially or as a result of discussions, will be considered for award. The price proposals corresponding to the acceptable technical proposals will be opened and ranked according to price and the contract will be awarded to the lowest responsive, responsible Offeror as stated in the RFP’s Proposal Instructions - Basis of Award (B Pages). Only one price proposal may be submitted by each Offeror and the price proposal must be based upon the Offeror’s own technical proposal.
Contract award is anticipated to be no earlier than December 2021, with Notice to Proceed anticipated to be issued after the receipt of valid Performance and Payment Bonds (see Block 12a of the SF-1412 and FAR Clause 52.228-15), but no earlier than January 2022.
It is not the intent of EFLHD to receive project specific design or engineering recommendations as part of the step one technical proposal other than what is necessary to support the technical proposal. Offerors should limit their technical proposal to the information required by this Notice, and other information that may be relevant to the qualifications and experience of the Offeror. No reimbursement will be made for any expenses associated with the preparation of a step one technical proposal or a step two price proposal.
Obligation to Keep Team Intact: In connection with the services covered by this procurement process, any in-house personnel, subcontractors, and outside associates will be limited to the individuals or firms that are specifically identified during the step one technical proposal. The Contractor shall obtain the Contracting Officer’s written consent before making any substitution for these designated in-house personnel, subcontractors, or outside associates.
Supplemental Work: Offerors are expected to provide qualified and experienced staff to develop appropriate pre-construction or construction protocols as designated by Federal, state, and local regulations/guidelines, including but not limited to the following:
• Work Plan.
• Accident Prevention Plan.
• Health and Safety Plan.
• Environmental Management Plan.
• Waste Management Plan.
• Recycling Plan.
Submittals: Each Offeror must provide the required number of Technical and Price Proposals as described below to EFLHD in separate, sealed envelopes/boxes clearly addressed and identified for “Project No: PR ER PRMNT RPR(9) - Solicitation No. 693C73-22-R-000006.”
Submit three (3) bound paper copies, one (1) unbound copy, and one (1) CD-ROM copy of the Technical Proposal. Submit the Technical Proposal copies separately from the Price Proposal in a sealed envelope/box and clearly labeled as the “Technical Proposal.”
Submit two (2) unbound paper copies and one (1) CD-ROM copy of the Price Proposal. Submit the Price Proposal separately from the Technical Proposal in a sealed envelope and clearly labeled as the “Price Proposal.”

PROPOSAL INSTRUCTIONS
PROJECT: PR ER PRMNT RPR(9)
OFFERORS PLEASE NOTE: Before preparing the proposal, carefully read the Instructions to Offerors. While preparing the proposal, comply with the following:
The Government will award the project to the lowest priced/technically acceptable responsible Offeror. The Contracting Officer intends to evaluate all proposals from all eligible Contractor firms/teams (Offerors) for technical acceptability. After all of the technical proposals have been evaluated, the Offerors that are found technically acceptable will be ranked according to price and the lowest priced Offeror will be awarded the contract.
Each Offeror must provide the required number of Technical and Price Proposals as described below to the Eastern Federal Land Highway Division (EFLHD) in separate, sealed envelopes/boxes clearly addressed and identified for “Project No: PR ER PRMNT RPR(9) - Solicitation No. 693C73-22-R-000006.” Submit all proposals so that they will arrive at the address shown in Block 7 of the SF-1442 on the due date specified in Block 13 of the SF-1442.
Send proposals directly to the attention of the person listed in Block 9 of the SF-1442.
It is the Offeror’s sole responsibility to see that its proposal is received. Proposals received after the time due will be rejected without consideration or further evaluation. In addition, it is the Offeror’s responsibility to ensure all requirements of both the Technical Proposal and Price Proposal are included in their respective envelopes/boxes.
EVALUATION OF PROPOSAL DOCUMENTS
STEP 1 - TECHNICAL ACCEPTABILITY - Experience and Past Performance Performing Landslide Repairs, Proposed Project Team, and Capacity.
1.A. TECHNICAL ACCEPTABILITY EVALUATION DESCRIPTION
Competing Technical Proposals will be evaluated against the solicitation requirements; they are not compared with each other. Each of the technical evaluation factors described below will be rated on a pass/fail (acceptable/unacceptable) basis and must receive a passing score for an Offeror's proposal to receive further consideration. Failure to receive a passing score for any single technical evaluation factor will result in rejection of an Offeror's proposal notwithstanding passing scores for the other technical evaluation factors. Proposals which satisfy the technical requirements of the solicitation, in light of the evaluation criteria, will be determined technically acceptable.
Offerors will be evaluated on past performance, experience, and capacity to repair landslides in roadways including performing roadway excavation and backfill, restoring roadway embankments, constructing earth retaining structures including gravity walls, reinforced concrete walls, gabion walls, mechanically stabilized earth walls, reinforced soil slope structures, implementing temporary traffic control measures per MUTCD, performing pavement reconstruction and paving, implementing erosion and sediment control, and constructing culverts and other storm drain system installations and repairs.
1.B. TECHNICAL PROPOSAL EVALUATION FACTORS
Submit the following qualifications and information, and label as the Technical Proposal.
(a) Relevant experience and past performance
The Offeror must have a minimum of five years of experience performing landslide repair and roadway reconstruction work, as shown in Section 1.A above, that was similar in scope, cost, and difficulty to the work required by the contract resulting from this RFP.
(1) Provide a statement indicating the Offeror’s experience and technical competence performing work in environmentally and culturally sensitive locations, as well as experience with implementing and maintaining temporary traffic control in state owned roadways or roadways where maintaining traffic access at all times was paramount.
(2) Provide a list of three to five projects, successfully performed (completed or currently more than 80% completed) within the past 5 calendar years showing the relevant experience. Describe the project scope and how it is similar in scope, cost, and difficulty to the work required in the contract. Provide customer/owner point of contact, phone number, and email address for each relevant project. Include project performance details regarding project cost (original cost vs. final cost) and scheduled (original completion date vs. actual completion date). List any relevant experience working with the Eastern Federal Lands Highway Division (EFLHD) and the Puerto Rico Highway and Transportation Authority (PRHTA).
Prepare the information for these sample landslide repair projects in Times New Roman 12-point font, in no more than five 8-1/2” x 11” sheets, and incorporate the information listed below in bullet points. Keep the discussion for any one project within one 8-1/2” x 11” page.
• Project Name;
• Project Location;
• Project Owner and Contact Information including phone number and email address;
• Schedule Performance (Award of Contract and Completion Date);
• Name of Contractor Project Manager or Resident Engineer;
• Name of Contractor Superintendent;
• Cost Performance - Initial Bid (Contract Award Amount), Final Construction
Cost, Reasons for Change; and
• Discussion of project scope and how it is similar in scope, cost, and difficulty to the work required in the contract.
(b) Proposed Project Team
(1) Provide an organizational chart and submit resumes of the Offeror’s key personnel selected to deliver this project. At a minimum, include the Project Manager, Construction Superintendent, Traffic Safety Supervisor, and the Construction QA/QC Manager, each having experience within the past 5 years performing technically the same or similar work.
(2) Provide a table summarizing each key personnel’s specific experience. Limit your table to one 11” x 17” sheet.
(3) Provide a table listing any subcontractors whom the Offeror proposes to provide services in the project and indicate their experience performing similar work to the one they will be performing for this project. Limit your table to one 11” x 17” sheet.
(c) Capacity
(1) Provide a brief statement indicating the Offeror’s capability to ensure work will be completed on time and within budget. Limit your statement to no more than two 8 ½” x 11” sheets.
(2) Provide information on current project workload, including customer, total cost, percent completed, and projected completion date for each active project listed.
1.C. TECHNICAL PROPOSAL SUMMITTAL
Submit three (3) bound paper copies, one (1) unbound copy, and one (1) CD-ROM copy of the Technical Proposal. Submit the Technical Proposal copies separately from the Price Proposal in a sealed envelope/box and clearly labeled as the “Technical Proposal.”
STEP 2 - LOWEST PRICE - Cost to Perform the Proposed Work
2.A. LOWEST PRICE EVALUATION DESCRIPTION
Only Cost Proposals from Offerors that passed the technical acceptability phase will be evaluated. Cost Proposals from Offerors that did not pass the technical acceptability phase will be returned unopened. All acceptable Cost Proposals will be reviewed and evaluated for completeness and reasonableness.
2.B. COMPLETING THE BID SCHEDULE
Complete the Bid Schedule(s) by handwriting in ink or typing. Specify a Unit Bid Price, in figures with cents to only two decimal places, for each pay item in the Unit Bid Price column for which a quantity is given. Do not enter or tender a Unit Bid Price for any pay item for which no estimated quantity appears in the Bid Schedule. Determine the products of the respective unit prices and quantities, and show them, in figures, in the Amount Bid column. If a Unit Bid Price and Amount Bid have been inserted by the Government for a pay item, do not change the Unit
Bid Price and Amount Bid for the pay item. Determine the Bid Total for each specific individual Schedule of Work by adding the amounts of the listed items, and show in the block provided for that individual Schedule of Work. In case of multiplication errors, the Amount Bid for the item will be based on the Unit Bid Price.
To be eligible for award, Offerors must submit prices for each pay item.
Review Subsection 109.05 of the FP (standard specifications book) regarding scope of payment for direct and indirect payment work.
Fill in the Bid Total(s) for each individual Schedule of Work as directed on the Price Proposal Summary page (B-14). Fill in the Evaluation Total Price of Project in the space provided on the Price Proposal Summary page (B-14).
The completed Bid Schedule, pages B-1 through B-14, is considered the Offeror's Price Proposal.
The amount in Block 17 of the SF 1442 should be completed as follows:
Schedule A - $ .
Schedule B - $ .
Schedule C - $ .
2.C. SCHEDULES OF WORK
The Bid Schedule is comprised of the following separate schedules and options of work:
Schedule A - Pages B-1 thru B-6 Schedule B - Pages B-7 thru B-10 Schedule C - Pages B-11 thru B-13
The Government intends to award all the schedules.
2.D. COMPLETION OF WORK
The Government has estimated the number of calendar days necessary to complete all contract work from the effective date of the Notice to Proceed to contract completion. The maximum number of calendar days allowed (i.e., the contact performance period) is shown in Block 11 of the SF-1442 and described below.
The performance period to complete all Schedules A+B+C work will be 600 calendar days and will start on the effective date of Schedule A+B+C’s Notice to Proceed.
In developing a construction schedule to determine the number of calendar days, the Government considered and included the work limitations shown in Sections 108 and 156 of the FP and Special Contract Requirements (SCR’s). Specific work limitations may be (but are not limited to): National legal holidays, weekends, rush hours, night work, specified no work periods, work or traffic control phasing, etc. The Government also considered those work items that are weather sensitive and when those work items will be performed. Specific work items are (but not limited to): those that require a minimum ambient air temperature (asphalt paving and surface treatment, pavement striping, stone masonry, etc); those that require maintaining a minimum surface temperature (concrete pavement, structural concrete, painting, etc); and those that have specific planting seasons (turf establishment, sod, trees, plants, etc). The Government also considered time required for preparing material and drawing submittals, and the allowable Government review times for those submittals (Subsection 104.03 of the FP and SCR’s).
Offerors are to assume that the award of the contract and approval of the Contractor’s Performance and Payment Bonds (see Block 12a of the SF-1442 and FAR Clause 52.228-
15) may result in the start of construction activities to be no earlier than January 2022. See Subsection 108.01 of the SCR’s for additional details.
2.E. PRICE PROPOSAL SUBMITTAL
Submit two (2) unbound paper copies and one (1) CD-ROM copy of the Price Proposal. As stated above, the completed Bid Schedule, pages B-1 through B-14, is considered the Offeror’s Price Proposal. Submit the Price Proposal copies separately from the Technical Proposal in a sealed envelope and clearly labeled as the “Price Proposal”.
BASIS FOR AWARD
The Government will award the project to the lowest priced/technically acceptable responsible Offeror. The Contracting Officer intends to evaluate all proposals for technical acceptability.
After all of the technical proposals have been evaluated, the Offerors that were found technically acceptable will be ranked according to price and the contract will be awarded to the responsive, responsible Offeror with the lowest Evaluation Total Price of Project, which is defined as:
Schedule A Bid Total + Schedule B Bid Total + Schedule C Bid Total.
Bidder/Offeror please note: Before preparing the bid, carefully read the Solicitation Provisions. Insert a unit bid price, in figures, for each pay item for which a quantity appears in the bid schedule. Multiply the unit price by the quantity for each pay item and show the amount bid. Should any mathematical check made by the Government show a mistake in the amount bid, the corrected unit price extension shall govern. When the word "LPSM" (Lump Sum) appears as a unit bid price, insert an amount for each lump sum pay item. When a sum based on a fixed rate appears for any pay item in the amount bid column, include the Government inserted amount bid for the item in the total bid amount. Total all of the amounts bid for each pay item and show the total bid amount.
