2.10 TECHNICAL EVALUATION FACTORS

(a) Criteria. The technical proposal must address the following evaluation factors.

(1) Factor 1, Project experience. The offeror must demonstrate relevant experience by providing information for no more than three projects that are similar in size, scope, and complexity to the subject project. This project requires a vertical expansion of the existing precast concrete parking ramp, including building a new stair / vertical transportation tower and supporting foundation system. It also requires phasing of work on an active medical center campus that is operational 24 hours per day, 7 days a week.

Each example project submitted must 1) be successfully completed by the offeror* as the prime contractor, 2) have a minimum contract value of $10 million, and 3) have a period of performance of at least 365 calendar days. In the aggregate, example projects must demonstrate experience that involves, at a minimum, the following elements:

• Construction of precast concrete structures that are multiple levels (ground plus two or more levels) high, rated to support multiple simultaneous stationary and moving vehicles

(e.g., two-axle, 8,000 pounds gross vehicle weight), and that includes structural foundations, stair, and elevator towers; AND

• Construction performed on an active medical center campus in an open area close to non-construction related pedestrians, vehicles, and adjacent buildings, using multiple phases where access to portions of the construction site was periodically limited to specific days or times.

The offeror must provide the following information for each example project submitted:

(i) Title and location

(ii) Contract/task order number (if applicable)

(iii) Start and completion dates

(iv) Total contract dollar value

(v) Offeror’s* role in the project (prime or teaming partner)

(vi) Prime contractor (if not offeror*) and major subcontractors

(vii) Relevant services provided, including the type of work performed by the offeror

*When evaluating an offer from a joint venture, the Government will consider work done individually by each partner to the joint venture, as well as any work done by the joint venture itself.

(2) Factor 2, Personnel qualifications. The offeror must provide qualifications of the key personnel proposed to perform as the Project Manager and the Site Superintendent for this project. Each individual must 1) meet the qualification requirements as detailed in the specifications, 2) have a minimum of 5 years of construction supervision experience, and

3) have relevant experience completing a project similar in size and scope to the subject project.

The offeror must provide the following information for each proposed individual:

(i) Name

(ii) Position title

(iv) Years of construction supervision experience

(v) Education background

The offeror must provide information for one or more projects demonstrating relevant experience for each individual. Each example project submitted must 1) be successfully completed, 2) have a minimum contract value of $10 million, and 3) involve, at a minimum:

• Construction of a vertical structure or expansion involving precast elements; AND

• Phased construction work on an active medical center campus or similar situation with active construction in an area where buildings and grounds directly adjacent to active construction must remain open.

The offeror must provide the following information for each example project submitted:

(i) Title and location

(ii) Total contract dollar value

(iii) Relevance to the subject project

(iv) Role/position of the proposed individual(s)

(b) Methodology. Information submitted will be reviewed to determine if the offeror’s technical rating is Acceptable or Unacceptable. All elements will be considered in the overall evaluation for each factor.

Areas within the evaluation factors are not subfactors and will not be individually rated. To receive consideration for award, a rating of Acceptable must be achieved for both technical factors using the following methodology.

Acceptable is defined as: the offeror met the Government’s minimum requirements as identified in the solicitation.

Unacceptable is defined as: the offeror failed to meet the Government’s minimum requirements as identified in the solicitation.

(1) Factor 1, Project experience. The purpose of this evaluation factor is to determine whether the offeror has experience successfully completing similar projects. The minimum requirements for an Acceptable rating are as follows:

(i) All projects submitted met the three requirements listed in the criteria. The three requirements are:

1) be successfully completed by the offeror* as the prime contractor, 2) have a minimum contract value of $10 million, and 3) have a period of performance of at least 365 calendar days

(ii) In the aggregate, no more than three submitted projects demonstrated relevant experience that met the requirements for both elements listed in the criteria. Both elements are:

• Construction of precast concrete structures that are multiple levels (ground plus two or more levels) high, rated to support multiple simultaneous stationary and moving vehicles (e.g., two-axle, 8,000 pounds gross vehicle weight), and that includes structural foundations, stair, and elevator towers; AND

(iii) The offeror provided all required information for each example project submitted.

(2) Factor 2, Personnel qualifications. The purpose of this evaluation factor is to determine whether the offeror can assign personnel with the required qualifications to this project. The minimum requirements for an Acceptable rating are as follows:

(i) Each proposed individual met the three requirements listed in the criteria. The three requirements are:

1) meet the qualification requirements as detailed in the specifications, 2) have a minimum of 5 years of construction supervision experience, and 3) have relevant experience completing a project similar in size and scope to the subject project.

(ii) The offeror provided all required information for each proposed individual.

(iii) Submitted project(s) demonstrated relevant experience for each individual that met the three requirements listed in the criteria.

(iv) The offeror provided all required information for each example project submitted.

2.11 EVALUATION OF OFFERS

(a) General.

(1) All proposals will be subject to evaluation by a team of Government personnel. Proposals will be evaluated based on the factors described herein. The technical evaluation and rating of proposals will be conducted in strict confidence without knowledge of the price offered.

(2) It is the intent of the Government to award without negotiations; however, the Government reserves the right to conduct negotiations if necessary. The evaluation will be based on the content of the proposal and any subsequent negotiations.

(3) Proposals which merely restate the requirements or state that the requirements will be met, without providing supporting rationale, are not sufficient. Offerors who fail to meet the minimum requirements of the solicitation will be determined unacceptable and thus, ineligible for award.

(4) The offeror must not include remarks that take exception to the Government’s solicitation documents or pricing requirements, preclude the Government from evaluating the offer, or render the offer as nonconforming or unacceptable. If the offeror communicates in its proposal any qualifications, exceptions, exclusions, or conditions to the proposed prices or terms of the solicitation, the Contracting Officer may reject the proposal and exclude the offeror from negotiations.

(b) Evaluation process. The full evaluation process will be conducted independently at each tier.

During the evaluation at a given tier, only the proposals from offerors within that tier will be considered.

The evaluation will be made as follows—

(1) The Contracting Officer will determine the lowest priced offeror following the process outlined in section 2.12 below.

(2) The Government will subsequently evaluate the offers for the non-price factors.

(i) All offerors are advised that, in the interest of efficiency, the Government reserves the right to conduct the evaluation in the most effective manner. Specifically, the Government may first evaluate the total proposed price of all offerors, then evaluate the technical proposal of the lowest priced offeror only.

(A) If the lowest priced offeror’s technical proposal is determined to be Acceptable, the Government may make award to that offeror without further evaluation of the remaining offerors’ technical proposals, provided its price is determined to be fair and reasonable.

(B) If the lowest priced offeror’s technical proposal is determined to be Unacceptable, then the Government may evaluate the next lowest priced technical proposal, and so forth and so on, until the Government reaches the lowest priced proposal that is determined to be Acceptable with fair and reasonable pricing.

(ii) However, the Government reserves the right to evaluate all offerors’ technical proposals should it desire to conduct negotiations or otherwise determine it to be in the Government’s best interest.

(3) If required, negotiations will be conducted at a given tier prior to evaluating proposals from the next tier. For example, if proposals from the SDVOSB tier are being evaluated, and the Contracting Officer determines negotiations are necessary, such negotiations will occur prior to evaluating proposals from the VOSB tier. If negotiations are deemed necessary, the Contracting Officer will establish a competitive range and proposal revisions will be requested.

(4) If the Contracting Officer determines that no contract award can be made at a given tier (e.g., SDVOSB), the set-aside for that tier will be withdrawn and evaluations will proceed with the next tier (e.g., VOSB).

2.12 NOTICE TO OFFERORS - DEDUCTIVE LINE ITEMS

(a) The lowest priced offeror and the items to be awarded will be determined as follows—

(1) Prior to the opening of proposals, the Government will determine the amount of funds available for the project.

(2) The lowest price will be the offeror that—

(i) Is otherwise eligible for award; and

(ii) Offers the lowest aggregate amount for the first or base line item, minus (in the order of priority stated in the price schedule) those deductive line items that provide the most features within the funds determined available. This amount will be the total evaluated price.

(3) All offers will be evaluated on the basis of the same deductive line items.

(b) The Contracting Officer will use the list of priorities in the price schedule only to determine the lowest price. After determining the lowest price, an award may be made on any combination of items if—

(1) It is in the best interest of the Government;

(2) Funds are available at the time of award; and

(3) The low offeror’s price for the combination to be awarded is less than the price offered by any other responsive, responsible offeror.

2.13 SYSTEM FOR AWARD MANAGEMENT

The FAR requires that federal contractors register in the System for Award Management (SAM) at https://sam.gov/ and enter all mandatory information into the system. In compliance with FAR 52.204-7, an offeror must have an active registration in SAM at the time an offer is submitted and at the time of award.

2.14 DEVIATION NOTICE (FEB 2025)

System updates may lag policy updates. The System for Award Management (SAM) may continue to require entities to complete representations based on provisions that are not included in agency solicitations, including 52.222-25, Affirmative Action Compliance, 52.223-22, Public Disclosure of Greenhouse Gas Emissions and Reduction Goals—Representation, and paragraphs (d) and (t) of 52.212-3, Offeror Representations and Certifications—Commercial Products and Commercial Services.

Contracting officers will not consider these representations when making award decisions or enforce requirements. Entities are not required to, nor are they able to, update their entity registration to remove these representations in SAM.

2.15 DETERMINATION OF ACCEPTABILITY

Proposals received in response to this solicitation will be reviewed for acceptability. Failure to provide documentation as outlined in the solicitation by the date and time set for receipt of offers may result in the offer being deemed unacceptable and ineligible for evaluation and award.

2.16 RESPONSIBILITY DETERMINATION

In accordance with FAR subpart 9.1, Responsible Prospective Contractors, a responsibility determination will be made for the apparent successful offeror prior to processing the award. The Contracting Officer reserves the right to obtain information to assist the Government in determining the apparent successful offeror responsible, including information regarding the offeror’s previous experience (including points of contact), organization (including company officers), technical qualifications, financial resources, and other information deemed necessary. The Government may request additional information from all offerors after receipt of proposals solely for the purpose of making a responsibility determination. These requests for information do not constitute negotiations.

Any information received by the Government that would be cause for a determination of nonresponsibility may deem the offeror ineligible for award.

2.17 VETS 4212

Title 38 U.S.C. 4212(d), codified at 41 CFR 61-300, requires that federal contractors report, at least annually, the number and category of veterans who are within their workforce. Submission of the VETS-4212 reporting information can be done electronically at https://www.dol.gov/agencies/vets/programs/vets4212. Award cannot be made unless the awardee has filed their VETS-4212 report. Therefore, all offerors are encouraged to file every year. The Contracting Officer may request a copy of the confirmation email prior to awarding the contract.

https://www.dol.gov/agencies/vets/programs/vets4212

2.18 SUBCONTRACTING PLAN

Small business subcontracting plan. Upon request by the CO, the apparent successful offeror (if a large business) must submit and negotiate a small business subcontracting plan. The subcontracting plan must contain all the elements required by FAR 52.219-9. If the large business does not have an approved master subcontracting plan or approved commercial plan, then an individual subcontracting plan must be submitted that includes an assurance that small businesses will be given the maximum practicable opportunity to participate in contract performance. The subcontracting plan is not a requirement for evaluation in source selection, but rather, a requirement for award to a large business.

The plan, as negotiated, will be incorporated into any resultant contract. Plans are NOT to be submitted with initial proposals.

2.19 CONTRACTOR PERFORMANCE ASSESSMENT REPORTING SYSTEM

(a) As prescribed in FAR 42.1102(e), the VA evaluates contractor past performance on all construction contracts that exceed $900,000 and shares those evaluations with other Federal Government contract specialists and procurement officials. The FAR requires that the contractor be provided an opportunity to comment on past performance evaluations prior to each report closing. To fulfill this requirement, VA uses an online database, Contractor Performance Assessment Reporting System (CPARS), which is maintained by the Naval Sea Logistics Center in Portsmouth, New Hampshire. CPARS is available to all Federal agencies and is the system used to collect and retrieve performance assessment reports used in source selection determinations. CPARS also includes access to the federal awardee performance and integrity information system (FAPIIS). FAPIIS is a web-enabled application accessed via CPARS for contractor responsibility determination information.

(b) Each contractor whose contract award is estimated to exceed $900,000 is required to register with CPARS at http://www.cpars.gov/. Help in registering can be obtained by contacting the Customer Service Desk at cpars-helpdesk@us.navy.mil. Registration should occur no later than 30 days after contract award and must be kept current should there be any change to the contractor’s registered representative.

(c) For contracts with a period of one year or less, the Contracting Officer will perform a single evaluation when the contract is complete. For contracts exceeding one year, the Contracting Officer will evaluate the contractor’s performance annually. Interim reports will be filed each year until the last year of the contract, when the final report will be completed. The report will be assigned in CPARS to the contractor’s designated representative for comment. The contractor representative will have 30 days to submit any comments and re-assign the report to the VA Contracting Officer.

(d) Failure to have a current registration in CPARS or to re-assign the report to the VA Contracting Officer within those 30 days will result in the Government’s evaluation being placed on file in the database with a statement that the contractor failed to respond.

2.20 BACKGROUND INVESTIGATIONS AND SPECIAL AGREEMENT CHECKS

All contractor employees are subject to the same level of investigation as VA employees who have access to VA sensitive information. The level of background investigation is commensurate with the level of access needed to perform all work as identified in the solicitation documents. This requirement is applicable to all subcontractor personnel requiring the same access. As per VA Directive 0710, costs of background investigations will be borne by the contractor. The awardee will need to coordinate with http://www.cpars.gov/ mailto:cpars-helpdesk@us.navy.mil the VA Medical Center concerning badging requirements. If the site requires an investigation, the contractor must follow VA Directive 0710.
