About this file
This is a Federal Acquisition Regulation (FAR) provision template for the Buy American Certificate (October 2022 version), prescribed under 25.601(a)(2).
The provision requires offerors to certify that all end products are domestic end products unless otherwise listed, and to identify any domestic end products containing critical components. Offerors must separately list as foreign end products any items manufactured in the United States that do not qualify as domestic products. For foreign end products that do not consist wholly or predominantly of iron or steel or a combination thereof, offerors must indicate whether these items exceed 55 percent domestic content, with an exception for commercially available off-the-shelf (COTS) items. If domestic content percentages are unknown, offerors must select "no." The provision includes a table for documenting foreign end products by line item number, country of origin, and domestic content percentage, and a separate section for listing line item numbers of domestic end products containing critical components. The Government will evaluate offers in accordance with Federal Acquisition Regulation Part 25 policies and procedures. Key terms including "COTS item," "critical component," "domestic end product," "end product," and "foreign end product" are defined in the accompanying "Buy American-Supplies" clause referenced in the solicitation.
