Public Record Declaration or Claim of Exemption for City of Tampa RFQ
This is a Public Record Declaration or Claim of Exemption form issued by the City of Tampa for submission with proposals in response to the Professional Building Plan Review & Inspections Services RFQ. The form requires proposers to designate whether any portion of their submitted proposal qualifies for exemption from Florida's public records disclosure requirements under Chapter 119 of the Florida Statutes. Proposers must execute either Section I, declaring no exemption from public records law, or Section II, claiming exemption for specific proposal components with corresponding statutory citations. The form includes a non-mandatory option for proposers to claim exemptions while agreeing to indemnify and defend the City of Tampa against all claims arising from public records inspection requests, including covering all associated legal costs, court expenses, and expert witness fees regardless of claim validity.
The indemnification clause in Section II obligates proposers claiming exemptions to investigate, defend, and bear all costs related to any disputes over document disclosure at their sole expense through counsel selected by the City of Tampa. This requirement applies comprehensively to all claims, expenses, and appeals, even if such claims are determined to be groundless, false, or fraudulent. Proposers may not modify the form's language and must complete this declaration as part of their comprehensive compliance documentation package for the City of Tampa's RFQ process.
