About this file
This document is a Public Record Declaration or Claim of Exemption form for the City of Tampa, addressing Florida's public records law requirements for proposers submitting documents. The form requires proposers to designate whether any portion of their proposal qualifies for exemption from public inspection and copying under Florida Statute Chapter 119. Proposers must choose between two options: (I) declaring no exemption from public records law, or (II) claiming specific exemptions and agreeing to indemnify and defend the City of Tampa against any claims arising from such exemptions.
By selecting Option II, a proposer agrees to protect, defend, and hold the City of Tampa harmless from any claims related to requested document inspections. This includes investigating and responding to claims, providing legal defense (including attorney fees, court costs, and expert witness expenses), and bearing all associated costs even if claims are groundless or false. The form emphasizes that proposers cannot modify the prescribed language and must fully understand their responsibilities under Florida's public records legislation.
