About this file

This is a Non-Small Business Determination document issued by the Arizona State Procurement Office on January 9, 2025, for Request for Quotation (RFQ) BPM006714 covering pipette calibrations, maintenance, repair, and service for the Arizona State Public Health Laboratory (ASPHL) and the Radiation Measurement Laboratory (RML). The determination authorizes the procurement to proceed as a non-small business solicitation rather than restricting bidding to small businesses. The decision was made based on two findings: fewer than three small businesses are registered on the prospective suppliers list for these services, and restricting the procurement to small businesses would not be practical under the circumstances. A prior RFQ (BPM006045) closed on February 21, 2024, was distributed to 497 registered suppliers on the Arizona Procurement Portal, but received only one response from a non-small business vendor, demonstrating insufficient small business participation in this specialized service market.

The determination was made by Karla Varela, Procurement Specialist, and approved by Gina Corwin, Chief Procurement Officer, both of whom digitally signed the document on January 9, 2025. This procurement is authorized under A.R.S. 41-2535 and A.A.C. R2-7-D302, which govern solicitations for amounts not exceeding a prescribed limit. The document indicates that the State determined it would not be advantageous to limit competition to small businesses given the lack of qualified small business respondents in prior solicitation efforts, thereby opening the opportunity to all qualified vendors capable of providing the specialized pipette calibration and maintenance services required for CLIA, ISO/IEC 17025, and EPA compliance standards.

PROCUREMENT DETERMINATION

Non-Small Business Solicitation

RFQ SOLICITATION

Description: Request for Quotation (RFQ) BPM006714, Pipette Calibrations, Maintenance, Repair and Service

AUTHORITY

A.R.S. § 41-2535 Procurements not exceeding a Prescribed Amount; small businesses and A.A.C. R2- 7-D302 Solicitation - Request for Quotation

DETERMINATION

In accordance with A.A.C. R2-7-D302(C)(2) or (3), the agency chief procurement officer has made the following determination:

[X] Less than three small businesses are registered on the prospective suppliers list; or

[X] Restricting the procurement to small business is not practical under the circumstances.

RATIONALE

Under R2-7-D302, Solicitation – Request for Quotation (RFQ), C., 3. and due to the need to find a supplier that can provide the requested services, restricting the procurement to a small business may be impracticable under the circumstances.

The State previously solicited the services through an RFQ, Solicitation BPM006045 that closed on February 21, 2024. The solicitation was sent to 497 Arizona Procurement Portal (APP) registered suppliers. There was only one (1) response, and it was from a non-small business. Therefore, it is not advantageous to the State to limit this RFQ to small businesses based on the Suppliers that can provide the services.
