Section 00100 - Bidding Schedule/Instructions to Bidders

INSTRUCTIONS TO OFFERORS

These notes apply to the Planned Modification for Furniture, Fixtures and Equipment (FF&E):

1. The Estimated FF&E Budget for project Powertrain Facility - Machining has been identified to provide the Offerors with the projected magnitude of effort of FF&E. The total estimate amount for the FF&E includes the actual cost of the FF&E including freight and installation charges. The Government FF&E Estimate is only an estimated amount.

2. If awarded, FF&E line item will be issued as a planned modification and will be funded separately after completion of FF&E design package review, acceptance of the FF&E package, and receipt of appropriate funding by the Government. Requirements and details are provided in Specification Section 01 30 01.00 20

PROCUREMENT AND INSTALLATION OF FURNITURE, FIXTURES, AND EQUIPMENT.

3. Bonding is not required for the design, procurement and installation of FF&E.

4. Offerors may propose a Handling and Administration Rate (HAR) for FF&E not to exceed 5%. This fee will account for all administrative costs, overhead, bonding fees, administration of subcontracts, profit, and any other costs associated with and related to the coordination and processing of the procurement and installation of FF&E.

The proposed HAR percentage will be incorporated into the contract award and will not be adjusted regardless of fluctuations from the estimate amount for the FF&E. The proposed HAR is a fixed rate.

5. The Government is not obligated to award the Planned Modification FF&E line item. Should the Government choose to award the FF&E, the line item will be awarded as a negotiated modification to the contract. The contractor’s proposed HAR will be applied to all vendor/supplier costs for the FF&E.

6. If awarded, the FF&E modification will be awarded at least six (6) months prior to the contract completion date.

A minimum of six (6) months is required for the Contractor to purchase, deliver and install the FF&E without impacting the overall completion date of the project. The Contractor’s schedule must assume the award of the FF&E as a modification. No schedule extensions will be granted if the modification is awarded at least six (6) months prior to the contract completion date. If the Government decides to negotiate and award the furniture modification with less than the six (6) months prior to the contract completion date, the Contractor may be entitled to a contract extension and extended field overhead. A contract extension and extended field overhead will only be granted in those cases where the Contractor demonstrates that an accepted Final FF&E package was submitted within the approved schedule deadlines and sufficient lead time for the FF&E is not available and the Government’s award of the modification is in the last six (6) months of the contract.

5B – Small Business Participation and Commitment The distinction between experience and past performance is that experience pertains to the types of volume of work completed by a contractor that are comparable to the types of work covered by this requirement, in terms of size, scope, and complexity. Past performance pertains to both the relevance of recent efforts and how well a contractor has performed on the contracts.

2. The relative order of importance of the non-price evaluation factors and subfactors is the technical factors (Factors 1, 2, 4 and 5 and their respective subfactors) are of equal importance to each other respectively and, when combined are equal in importance to the past performance evaluation/performance confidence assessment factor (Factor 3). When the proposal is evaluated as a whole, the technical factors and past performance/performance confidence assessment factor combined (i.e., the non-price evaluation factors) are approximately equal to price.

The importance of price will increase if the Offerors’ non-price proposals are considered essentially equal in terms of overall quality, or if price is so high as to significantly diminish the value of a non-price proposal’s superiority to the Government. Award will be made to the responsible Offeror(s) whose offer conforms to the solicitation and represents the best value to the Government, price and non-price factors considered.

3. Basis of Evaluation and Submittal Requirements for Each Factor.

(2) Basis of Evaluation: The Government will evaluate price based on the total price. Total price consists of the basic requirements and all option items (see Section B of the solicitation). The Government intends to evaluate all options and has included the provision FAR 52.217-5, Evaluation of Options (JUL 1990) in Section M of the solicitation. In accordance with FAR 52.217-5, Evaluation of Options will not obligate the Government to exercise the option(s). Analysis will be performed by one or more of the following techniques to ensure a fair and reasonable price:

(i) Comparison of proposed prices received in response to the RFP.

Factor 1 – Technical Approach

(a) Solicitation Submittal Requirements:

A. Technical Approach to Significant Construction Features:

The Offerer shall submit the following information:

(1) Thickened, Cast-in-Place Concrete (ACRS) Industrial Production Floor

Describe the process for forming, isolating, reinforcing and accessing thickened areas of the cast-in-place concrete industrial floor. Include means and methods for: assuring proper preparation/ compaction of the subgrade; assuring, proper curing; assuring compliance with flatness/level tolerances; elimination of cracks; and maintaining smooth and consistent appearance.

The CIP Concrete narrative shall be limited to two pages.

(2) Stormwater Control and Stormwater Utility Systems:

Describe the plan the Offerer will implement to develop the pre-construction storm water control system(s), as required to facilitate the construction activities. The narrative shall include description of:

a) The development and use of the existing permanent stormwater retention areas and piped storm water discharge system;

Include pre-construction measures/coordination, and procedures for ensuring corrective action required to repair deficiencies.

The building systems coordination narrative shall be limited to two pages.

(b) Basis of Evaluation:

The Government will evaluate the information submitted for this factor to assess the Offeror’s capability to meet the requirements of the RFP and the Offeror’s approach and understanding of the specialized components of this project, especially with regards to how the prime contractor will manage specialized subcontractors or self-perform work. Narratives that provide higher levels of detail and specificity, especially with regard to quality control and subcontractor management, may be rated higher.

B. Technical Approach to Cost Control, Quality Control and Partnering

(a) Submittal Requirements:

In a four (4) page narrative describe the Offeror’s approach to Cost Control, Quality Control (Q.C.) and Partnering with the Owner (Government) and the Owner’s Design Agent (A/E) to minimize risk, cost and time impact. The narrative should demonstrate cooperativeness and teamwork with the Government at all levels (task managers, contracting officers, auditors, etc.), and an approach that ensures respect and intent towards the vigilant stewardship of Government funds.

The Contract Documents (Plans and Specs) for this project, with few exceptions, do not specify manufacturer specific products or systems. The Prime contractor will select various products and systems that meet the salient requirements indicated in the specs and the design intent as reflected in the drawings. No design drawing will show every possible nuance as the design documents must be generic enough to permit final selections to be made by the constructor team.

It is the General Contractor’s responsibility to determine all labor, documentation, services, materials, and/or equipment that may be reasonably inferred from the Contract Documents or from prevailing customary or typical trade usage, as required to produce the indicated result. This includes determination of fabricators, installers, manufacturers, and the manner in which the project is assembled on site. This responsibility relies on the Prime Contractor coordinating the entire project process and scope of construction, subcontractors, and systems. The successful Prime will work with the Government and AE team to deliver systems that fulfill the full design intent without adding cost to the project.

The narrative should address the Offeror’s approach and standard of care towards the construction management team, the Government client, and the AE/DOR team with regard to the measures your organization will put in place to reduce risk to the Government associated with the following (at a minimum):

1. Initial Lump Sum Fee Proposal Completeness Explain the preproposal construction administration measures your company, as the prime, will employ to ensure your lump sum fee proposal includes the full cost for complete and usable systems. Explain any measures employed to confirm the completeness of sub-contractor proposals, and the strategies employed to avoid the incorporation of scope or cost omissions by sub-contractors into the Prime Contractor’s formal proposal. The Prime contractor must demonstrate what measures they will utilize to accomplish the design intent of the contract documents while avoiding post award modifications for anything but the most significant unforeseens.

2. Cost Changes During Construction

Explain the post award construction administration measures your company, as the prime, will employ to ensure your pricing proposals for cost changes during construction, are submitted with complete cost information. Complete cost information includes at the minimum: itemized material lists, unit costs, quantity of material, itemized equipment costs with durations and itemized labor with unit cost and durations, so as to insure a proper and complete evaluation by the Government and AE team in a timely manner. Include an explanation of the cost management processes to be employed by your company to ensure that proper cost credits are applied to proposed changes as applicable.

3. Inspection Reports During Construction Explain the post-award construction administration measures your company, as the prime, will employ to ensure the timely submittal of all inspection reports required by the specifications. Include the processes your company will employ to log, track, and report the resolution of reported construction deficiencies.

4. Construction Submittal Quality Control

Explain the construction administration measures (both the pre-submittal coordination and QC actions) your company as the prime, will have in place to limit the Construction submittals to 10% or less for resubmittals due to incomplete information and/or non- adherence to requirements.

5. BIM Model Benefits to the Government

The Government requires a BIM model only as final deliverable for this project. The specifications require the Prime contractor to maintain paper red lines to track changes during construction. If your company as Prime, will use modeling to record changes during construction (a means and methods decision), describe how the model will be used to the cost advantage of the Government.

The Cost Control, Quality Control and Partnering narrative shall be limited to four pages.

The Government will evaluate the information submitted for this factor to assess the Offeror’s capability, willingness and intent to mitigating risk and issues that could impact the progress of the project. In particular, the Government will evaluate how the prime contractor/Offerer will approach Cost Control, Quality Control and subcontractor management and their approach to conflict resolution and avoidance. Narratives that provide higher levels of detail and specificity, and demonstrate conscientious stewardship of Government funds especially with regard to conflict resolution, construction schedule and subcontractor management may be rated higher.

Factor 2 - Experience

The Offeror shall submit the following information:

(1) Construction Experience:

Submit a minimum of two (2) and a maximum of five (5) relevant construction projects for the Offeror that best demonstrates the Offeror’s experience on projects that are similar in size, scope, and complexity to the RFP. At least one of the projects submitted must be Design-Bid–Build. For purposes of this evaluation, a relevant project is further defined as completed projects:

a. With an approximate value of $50 Million or greater.

b. Projects submitted shall also demonstrate the following:

(1) Approximately 125,000 SF total;

(2) Managing simultaneous construction locations;

(3) Managing multiple trades;

(4) Experience with extensive construction within a confined area/site; and,

(5) include multi-phased construction to maintain existing operations and short construction timelines to meet operational need dates.

A project is further defined as a construction project performed under a single task order or contract. For multiple award and indefinite delivery/indefinite quantity type contracts, the contract as a whole shall not be submitted as a project; rather Offerors shall submit the work performed under a task order as a project.

To be considered complete, a project must be 100% complete as defined by the construction dollar value invoiced and executing agency accepted.

The attached Construction & Design Experience Project Data Sheet (Attachment C) is MANDATORY and SHALL be used to submit project information. Except as specifically requested, the Government will not consider information submitted in addition to this form. Individual blocks on this form may be expanded; however, total length for each project data sheet shall not exceed one (1) double-sided page (or two (2) single-sided pages).

For all submitted projects, the description of the project shall clearly describe the scope of work performed and the relevancy to the project requirements of this RFP (i.e., unique features, area, construction methods).

If the Offeror is a Joint Venture (JV), relevant project experience should be submitted for projects completed by the Joint Venture entity. If the Joint Venture does not have shared experience, projects may be submitted for the Joint Venture members. Offerors who fail to submit experience for all Joint Venture members may be rated lower.

Offerors are still limited to a total of five (5) projects combined.

If an Offeror is utilizing experience information of affiliates/subsidiaries/parent/LLC/LTD member companies (name is not exactly as stated on the SF1442), the proposal shall clearly demonstrate that the affiliate/subsidiary/parent firm will have meaningful involvement in the performance of the contract.

The basis of evaluation will include the Offeror’s demonstrated experience and depth of experience in performing relevant construction and design projects as defined in the solicitation submittal requirements. The assessment of the Offeror’s relevant experience will be used as a means of evaluating the capability of the Offeror to successfully meet the requirements of the RFP. The Government will only review five (5) projects for construction.

Any projects submitted in excess of five (5) will not be considered.

Factor 3 - Past Performance

(a) Solicitation Submittal Requirements

If a completed Contractor Performance Assessment Reporting System (CPARS) evaluation is available, it shall be submitted with the proposal for each project included in Factor 2 for construction experience. If a completed AE Contractor Performance Assessment Reporting System (CPARS) evaluation is available, it shall be submitted with the proposal for each project included in Factor 2 for design experience. If there is not a completed CPARS evaluation, then the offeror shall submit Past Performance Questionnaires (Attachment H) for each project included in Factor 2 for both Construction Experience and Design Experience. The Offeror should provide completed Past Performance Questionnaires (PPQ) in the proposal. Offerors shall not incorporate by reference into their proposal PPQs previously submitted for other RFPs. However, this does not preclude the Government from utilizing previously submitted PPQ information in the past performance evaluation. If the Offeror is unable to obtain a completed PPQ from a client for a project(s) before proposal closing date, the Offeror shall complete and submit with the proposal the first page of the PPQ, which will provide contract and client information for the respective project(s). The Government may make reasonable attempts to contact the client noted for that project(s) to obtain the PPQ information. However, Offerors should follow-up with clients/references to help ensure timely submittal of questionnaires. If the client requests, questionnaires may be submitted directly to the Government’s point of contact, Deborah Torrence via email at deborah.torrence@navy.mil.

Offerors may provide any information on problems encountered and the corrective actions taken on projects submitted under Factor 2 – Experience. Offerors may also address any adverse past performance issues.

Explanations shall not exceed two (2) double-sided pages (or four (4) single-sided pages) in total.

The Government reserves the right to contact references for verification or additional information. The Government’s inability to contact any of the Offeror’s references or the references unwillingness to provide the information requested may affect the Government’s evaluation of this factor.

Performance award or additional information submitted will not be considered.

This evaluation will consider how well the Offeror’s team performed on relevant projects submitted under Factor 2 – Experience and may also consider past performance on other projects currently documented in known sources.

The Government will consider the recency and relevance of the information, the source of the information, context of the data, and general trends in the Contractor’s performance. This evaluation is separate and distinct from the Contracting Officer’s responsibility determination. The assessment of the Offeror’s team’s past performance will be used as a means of evaluating the Offeror’s team’s probability to successfully meet the requirements of the

RFP.

Offerors lacking relevant past performance history will receive a NEUTRAL Confidence rating.

Past performance ratings of “Substantial Confidence” or “Satisfactory Confidence” hold more value than a “Neutral Confidence” rating and will be considered more favorably in the evaluation of past performance.

Factor 4 - Safety

The Offeror shall submit a narrative that fully describes the safety management system that they will use to oversee the safety compliance and performance of self-performed and sub-contractor performed work and the Offeror’s method for qualifying, evaluating, selecting all tiers of sub-contractors (For a partnership or joint venture, the following submittal requirements are required for each contractor who is part of the partnership or joint venture;

however, only one safety narrative is required. EMR, DART and TRC Rates shall not be submitted for subcontractors.)

(1) Experience Modification Rate (EMR): Include three previous complete calendar years’(2019, 2018, 2017) worth of data. This rate compares company’s annual losses in insurance claims against its policy premiums. The offeror may submit an insurance company-provided equivalent rate if no EMR exists. If the offeror has no EMR or premium, for any year, affirmatively state so and explain why. Any extenuating circumstances that affect the EMR and negative trends should be addressed as part of the factor submission.

(2) OSHA Days Away from Work, Restricted Duty, or Job Transfer (DART) Rate and Total Recordable Case (TRC) Rate: Submit three previous complete calendar years’ (2019, 2018, 2017) worth of data. If an offeror cannot submit an OSHA DART and TRC rates, for any year, affirmatively state so and an explanation must be provided. Any extenuating circumstances that affected the OSHA, DART, and TRC rate data negatively must be addressed as part of this factor submission.

(3) Technical Approach for Safety: Describe the plan for safety that will be implemented to evaluate safety performance of potential subcontractors as part of the selection process for all levels of subcontractors. The offeror shall submit a narrative that fully describes the safety management system that they will use to oversee the safety compliance and performance of self-performed and subcontractor performed work. The offeror will describe any innovative methods that will be employed to ensure and monitor safe work practices at self-performed and/or all subcontractor levels. Additionally, the contactor will describe their methodology to execute an effective program that facilitates sound mishap prevention techniques and processes, employee reporting of unsafe conditions, unsafe activities, and near-miss mishaps. The technical approach to safety narrative shall be limited to two pages.
