Basis of Evaluation-Commercial Products and Commercial Services
(a) The Government intends to award to the responsible Quoter whose quote, conforming to the solicitation, is the lowest-priced technically acceptable quote. To be eligible for award, a quote must be rated as "Technically Acceptable" to be considered. The following factors will be used to evaluate quotes:
(i) Technical Capability
(ii) Price
Initially, quotes shall be listed in order of price from lowest to highest. Technical Capability will be evaluated, and rated acceptable or unacceptable.
Technical Capability: The technical rating reflects the degree to which the quote meets or does not meet the minimum performance or capability requirements. For a quote to be found technically acceptable, the quote must clearly meet the minimum requirements of the solicitation. Failure to provide the following will result in an unacceptable rating: Quoters shall demonstrate an understanding of the solicitation requirements by providing the following:
FACTOR 1: STAFFING PLAN
Acceptable (A) The quote clearly demonstrates an understanding of section 1.3.6 of PWS in its entirety including all sub-paragraphs.
Unacceptable (U) The quote does not clearly demonstrate an understanding of section 1.3.6 of PWS.
FACTOR 2 KEY PERSONNEL
Acceptable (A) The quote clearly demonstrates an understanding of section 1.3.6 of PWS in its entirety including all sub-paragraphs.
Unacceptable (U) The quote does not clearly demonstrate an understanding of section 1.3.6 of PWS.
If the quote is found to be "Unacceptable", then the Quoter will be removed from further consideration of the award.
(b) Options. The Government will evaluate quotes for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that a quote is unacceptable if the option prices are significantly unbalanced. The evaluation of options does not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of a quote furnished to the successful Quoter within the time for acceptance specified in the quote, shall result in a binding contract without further action by either party. Before the quoter's specified expiration time, the Government may accept a quote (or part of a quote), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
Price - The Government may evaluate any and all information submitted by the quoter to support the reasonableness of the prices quoted. The method of evaluation used is solely within the discretion of the Contracting Officer. The type of source selection utilized in this procurement is Lowest Price Technically Acceptable (LPTA). The Government reserves the right to make award solely on initial quote received. Initially, quotes shall be listed in order of price from lowest to highest. Technical Capability will be evaluated, and rated acceptable or unacceptable.
A quoter's prices will be determined by multiplying the quantities identified in the Schedule by the proposed unit price for each Contract Line-Item Number (CLIN) to confirm the extended amount for each. Pricing within the 1449 CLIN structure will take precedence over all submitted documentation for evaluation and award. Quoters shall ensure each CLIN is priced.
The Government will evaluate price to determine the following:
Completeness: All price information/data required in the RFP has been submitted. For all items in the schedule, the unit price will be multiplied by the quantity for each line item for the base and all option years. All CLINs as stated in the solicitation shall be priced.
Reasonableness: Price is fully justified and supported and is considered fair under current market conditions, reasonable to the Quoter and reasonable to the Government. Reasonableness may also be determined by comparison with the Government estimated and/or other quotes received. Unbalanced pricing exists when, despite an acceptable total evaluated price, the price of one or more contract line items is significantly over or understated as indicated by the application of cost or price analysis techniques. A quote may be rejected if the Contracting Officer determines that the lack of balance poses an unacceptable risk to the Government. In accordance with FAR 15.404-6 price analysis will be conducted on the individual CLIN to determine whether unbalanced pricing occurred.
Note: Quotes that do not quote all items or which quote only partial CLIN pricing will be considered nonresponsive. Failure to furnish the price in accordance with the instructions above may render the quote unacceptable. Also, CLIN totals shall match company letterhead, if providing company letterhead quote. If totals do not match the SF1449 CLIN price(s) takes precedence.
(End of provision)
To be eligible for award of a contract hereunder, the Quoter must be determined by the Contracting Officer to be a responsible prospective Contractor in accordance with FAR 9.1.
