RESPONSES TO QUESTIONS FOR SOLICITATION NO.: N6852022R0004 05 AUGUST 2022

1. Reference: 52.219-14 Limitations on Subcontracting (SEP 2021), page 45 Discussion: For non-multiple award contracts, 52.219-14 (f) (1) requires the Contracting

Officer to select as appropriate the manner of prime contractor compliance;

either “By the end of the base term of the contract and then by the end of each subsequent ordering period”; or “By the end of the performance period for each order under the contract.”

FAR 19.505 (b) (2) (i) states that “For a contract that has been set aside, either by the end of the base term and then by the end of each subsequent option period, or by the end of the performance period for each order issued under the contract, at the contracting officer's discretion “

Question: Due to the administrative burden of monitoring compliance at the task order level, would the Government please provide clarification that self-performance will be monitored for compliance at the end of the base year and each subsequent option period?

Answer: Clause 52.219-14 Limitations on Subcontracting (SEP 2021) will be filled-in with the correct compliance. Please see Amendment 1.

2. Reference: ATCH P6 Proposal Cost Summary, Instructions

Discussion: Instruction #6 states “Labor categories with more than one person providing the service shall be listed individually for each person performing work. For example, if the offeror proposes two people to perform one Logistician, Senior position, then the labor category Logistician, Senior shall be listed twice along with their applicable rates, hours, and any other information. Same goes for labor categories where there are multiple full-time equivalents.”

Question: If the Offeror is not providing “Employee Name”, but there are more hours than 1 FTE could possibly work, does that labor category have to be split onto 2 lines if it has the same fully-burdened labor rate (FBLR)? For example, the Computer Programmer, Junior (Gov) at North Island has 4,000 hours. If we are not naming an individual for that position, does the 4,000 hour need to be split onto 3 lines (1920, 1920, and 160 hours) even if they have the same FBLR?

Answer: Yes, please use multiple lines per the instruction.

ATCH P6 Proposal Cost Summary;

RFP 52.216-18 Ordering, page 47 ATCH 18 LOE and Ordering Rates, Composite Rates worksheet

Discussion: The P6 and 52.216-8 contain a Period of Performance (PoP) 15 June 2023-14 June 2028. The Composite Rates worksheet reflects a PoP of 3 June 2023-2 June 2028.

Question: Please clarify.

Answer: Please see Amendment 1. ATCH 18 was updated to reflect the correct

Ordering PoP of 15 June 23- 14 June 28.

4. Reference: ATCH 08 Statement of Work, page 22 Discussion: Between Sections 4.5.10.1 and 4.5.11, there are no qualifications listed for the

Program/Project Manager.

Question: Would the government please provide the qualifications for this labor category?

Answer: Please see Amendment 1. The Program / Project Manager labor category title was inadvertently included – it is not a valid category for this RFP and will be removed. Please see Labor Category “4.5.9 Manager (BLS/SOC 11-1021)” instead.

5. Reference: ATCH P6 Proposal Cost Summary, FFP Pages-5yr worksheet Exhibit B FFP CLINs

Discussion: We assume the quantities in columns I, M, Q, U, and Y on Exhibit B should be copied over to the P6.

Question: Please confirm.

Answer: Please see Amendment 1. ATCH P6 Tab FFP Pages-5yr is updated to reflect quantities in columns I, M, Q, U, and Y from Exhibit B.

6. Reference: ATCH 08 Statement of Work, Section 4.6.4, page 24 ATCH 18 LOE and Ordering Rates

Discussion: The SOW and Estimated LOE have 3 levels of Drafter/CAD Operator, but contract performance could necessitate occasional use of a Drafter/CAD Operator IV.

Question: Would the Government add minimal hours in ATCH 18 for 30064 Drafter/CAD Operator IV to mitigate the need to add this category after award?

Answer: Based on the history of predecessor contracts, and anticipating future requirements, the Government does not require the Drafter/CAD Operator IV labor catagory.

7. Reference: ATCH 08 Statement of Work, Section 4.6.4, page 24

Discussion: The Drafter/CAD Operator is identified with an Occupational Code 30461, which is a Technical Writer.

Question: Would the Government change the Drafter/CAD Operator to 30061, 30062, and 30063?

Answer: Please See Amendment 1. The Occupational Code for the Drafter/CAD Operator labor category have been updated to the correct codes.

8. Reference: DD254

Discussion:

Question: To ensure we understand the security requirements, will NATO and

SIPRnet access be required on this contract?

Answer: NATO and SIPRnet access may be required at the Task Order Level dependent on the requirement of the said TO. The DD254 revision approval is being processed and will be attached to the solicitation via Amendment 2 once approved.

9. Reference: RFP Section L.3.1(a), page 83 Discussion: The RFP states “subcontractors shall provide the same price/cost proposal data required for the prime contractor, unless otherwise noted below.” There is no indication of items not required from the subcontractors, but several items are indicated as “prime only” submissions, such as ATCH P7, 4.1 Offeror Summary Table, and Section B in Excel.

Question: Due to the administrative burden on minor subcontractors and the evaluation team, would the government consider limiting the submission of ATCH P6 and a Narrative to only principal subcontractors?

Answer: Submission of ATCH P6 and a Narrative is required by all proposed first-tier subcontractors.

In confirming this answer, the Government noticed the tab on ATCH P7 said “prime,” which has now been removed. The ATCH P7 submission is expected to be from the Prime, but covers all burdened labor rates (prime and subcontractor). Please see Amendment 1 for the revised ATCH P7.

10.

Discussion: Due to solicitation requirements, the Offeror will be required to submit Controlled Unclassified Information (CUI) documents with our proposal.

Question: Is PIEE authorized to transmit CUI documents?

Answer CUI is permitted to be submitted through PIEE.

11.

Reference: Section 2.1 (page 82) of the N6852022R0004 RFP states “For contract references that contain delivery/task orders, additionally provide the work description(s) for each specific delivery/task order deemed relevant by the Offeror to this solicitation’s requirements. For contract references where the Offeror performed as a subcontractor, the Offeror shall clearly identify the applicable portion of the contract requirements that they performed.”

Discussion:

Question: Does a subcontractor’s past performance reference, performed under the prime's overarching IDIQ, have to include one, and only one, task order?

Or can it include a collection of task orders under that overarching IDIQ?

Answer Please see Amendment 1. Offerors may submit more than one order under a single ordering contract to meet the relevancy criteria.

12. Reference: RFP, Streamlined Ordering Procedures, page 3, bullet (3)(ii)

Discussion: The RFP states “If the contractor does not agree with the TO package, the contractor shall provide a proposal to the contracting officer addressing only the specific areas of difference in the SOW, labor categories and/or hours in the IGCE.”

Question: a) Would the Government add the language “or estimated composite labor rates” after “labor categories and/or hours”?

b) If no, will the Government allow for an increase in the TO value to account for higher actuals in execution?

Answer: The answer to both questions is no. The competitively proposed order estimating rates is to ensure orders are priced without requiring order-level certified cost or price data. The competitively proposed rates will be utilized to estimate order CPFF. The only intended composite order estimate rate adjustment would be as a result of SCA Wage Determination Adjustments pursuant to FAR Clause 52.222-43.

13. Reference: General

Discussion: The Department of Labor released memorandum 239 increasing the H&W rate effective 6/23/22. The new H&W rate for contracts requiring sick leave for this contract will be $4.41.

Question: Will the Government incorporate the new wage determinations prior to the submittal due date?

Answer: Please see Amendment 1. The new Wage Determinations now apply.

14. Reference: ATCH P6 Cost Summary, Instructions, #13(g)

Discussion: The instructions on the P6 state fully burdened labor rates are to be entered beginning with cell G339. There are no instructions for subcontractors to submit a P6 directly to the government.

Question: a) Are subcontractors required to submit a build-up of their rates directly to the government in a Subcontractor P6?

b) If so, will subcontractors utilize the Prime section (line 7-335) to calculate their build-up?

c) Are subcontractors allowed to submit proprietary data directly to the government?

Answer: a) Yes, first-tier subcontractors are required to submit their rate details directly to the Government utilizing ATCH P6.

b) Yes, the ATCH P6 file instruction tab (blue font) has been updated to note subcontractor direct ATCH P6 submittals shall utilize lines 7-335.

Please see Amendment 1.

c) Yes, subcontractors are allowed to submit their proprietary rate data directly to the Government. Please see Section 4.2 under proposal submission in the solicitation UCF Section L.

15. Reference: In Section L, under 1.0 Volume 1: Technical, section 1.2 Workforce – Key Personnel Resumes (page 78) states:

Discussion:

Question: Would the Government please clarify that a letter of intent is only required for

Key Personnel that are considered “contingent hires” (i.e., a “prospective hire” presented in our response does not require a letter of intent)?

Answer: The Government only requires a letter of intent for contingent hire employee(s). Please see Amendment 1 for clarification.
