The following items are applicable to this modification:

SUMMARY OF CHANGES (REVISED)

1) The purpose of the subject amendment is to provide the following Questions and Answers:

1. The Government’s response to Question 6 of Amendment 4 states that a DCMA approved purchasing system is required. This requirement may prove to be overly restrictive to small businesses who have yet to meet the minimum sales requirement in order for a Contractor Purchasing System Review (CPSR) to take place. Specifically – and per FAR 44.3 ‐ the DCMA will conduct a risk assessment to determine if a CPSR is necessary only if “sales to the Government (excluding competitively awarded firm‐fixed‐price and competitively awarded fixed‐price with economic price adjustment contracts and sales of commercial items pursuant to Part 12) are expected to exceed $25 million during the next 12 months”. Given that a small business may have not reached this sales threshold prior to contract award, there is no possibility of an adequate system determination. Would the government consider delaying this requirement until the task order component of the contract?

‐ No, there will be no delay granted in providing this information.

2. The Government’s requirement for a NAVSEA approved Quality Management Plan/Program may be restrictive for small businesses. Would the government consider allowing subcontractors with an ISO 9001:2015 approved quality management system utilize a teammate’s NAVSEA approved Quality Management Plan/Program to meet this requirement?

‐ No. Only NAVSEA 04 approved QMS is authorized for Modernization..

3. The Government’s requirement for a DCMA approved government property control procedures may be restrictive for small businesses. Would the government consider allowing the prime offeror to utilize a teammate’s DCMA approved government property control procedures to meet this requirement if the approach proposed includes the teaming partner be responsible for the procurement of any individual items that may be subject to the Government Property requirements?

‐ No, because any dispute on property control would be with subcontractors which the gov't cannot directly engage with. Additionally, contract policy places the burden for control of GFE to contractors on the prime and said control cannot be guaranteed with a sub.

4. Is Clause – 52.204‐4 pertaining to Section I ‐ Contract Performance or Section L ‐ Proposal submission purposes?

N64498-18-R-0003

‐ Per the definition of the clause its during submission of any document whenever practicable:

Printed or Copied Double-Sided on Postconsumer Fiber Content Paper (May 2011)

(a) Definitions. As used in this clause.

“Postconsumer fiber” means.

(1) Paper, paperboard, and fibrous materials from retail stores, office buildings, homes, and so forth, after they have passed through their end-usage as a consumer item, including: used corrugated boxes; old newspapers; old magazines; mixed waste paper; tabulating cards; and used cordage; or

(2) All paper, paperboard, and fibrous materials that enter and are collected from municipal solid waste; but not

(3) Fiber derived from printers’ over-runs, converters’ scrap, and over-issue publications.

(b) The Contractor is required to submit paper documents, such as offers, letters, or reports that are printed or copied double-sided on paper containing at least 30 percent postconsumer fiber, whenever practicable, when not using electronic commerce methods to submit information or data to the Government.

2) All other terms and conditions remain unchanged.
