If the Contracting Officer determines that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition, among the most highly rated proposals. Information regarding the source selection process, content of proposals, evaluation of proposals, and best value source selection evaluation criteria to be used is located in Request for Proposal (RFP) Section 00 21 16.

MEANS Cost Data software to be consulted and used to identify pre-priced work items (as listed by preference below) are as follows:
Facilities Construction Cost Data Repair and Remodeling Cost Data Mechanical Cost Data Electrical Cost Data Plumbing Cost Data Building Construction Cost Data Heavy Construction Cost Data Site Work and Landscape Cost Data Interior Cost Data
As each new R. S. MEANS Cost Data software is released, it will be used for all pricing within that year, including quarterly updates. For example, if the base year occurs in 2023, the 2023 edition shall be used with the most up to date quarterly update. Once the 2024 edition is released, all subsequent work shall be priced using the 2024 edition (and current quarterly update), until the next edition is released. For purposes of Task Order negotiations, the R. S.
MEANS Cost Data software and current quarterly update in effect at the time the Task Order RFP is due will be used for negotiating purposes. Similarly, any modifications made to a contract Task Order will incorporate the R. S.
MEANS edition and quarterly update in effect at the time the modification RFP is due. The Offeror is responsible for purchasing and maintaining its own current edition of the R. S. MEANS Cost Data software products for this purpose, and installing quarterly updates as they become available.
The City Cost Index is a multiplier used to adjust construction costs to a particular geographic location. Bare costs in the Unit Price Book (UPB) represent the U.S. National average. To adjust costs to a particular geographic location, apply the Weighted Average CCI to the bare cost. The CCI for Oxnard, CA shall apply to all work under this contract. CCI rates are in the Reference Section of the R. S. MEANS Cost Data software.
Bare costs of line items/descriptions within the R. S. MEANS Cost Data software, by which the coefficient is multiplied to arrive at the Task Order proposal pricing, are “pre-priced”. Items not available with the R. S. MEANS Cost Data software, or identified below as such, are “non-pre-priced”. Line items within the MEANS Cost Data software, which are listed under different titles with similar descriptions, but with different unit prices, or work items that could be interpreted within the software to be included by more than one line item shall be negotiated to arrive at one of the pre-priced line items within the software.
Coefficients will not be adjusted for any other changes or circumstances encountered during the life of the contract – the coefficients will remain unchanged throughout any given contract or option year.
Report proposed coefficients within the Offeror’s proposal as follows: An offer of "net" would be represented by "1.0" (no cost above R. S. MEANS bare costs as described above). An example of a decrease from the bare prices listed in MEANS would be "0.90". An example of an increase above the bare prices in R. S. MEANS would be "1.10". Coefficients shall NOT exceed two decimal places to the right of the period (e.g. 0.XX, 1.XX).
3. NON-PRE-PRICED WORK
Only non-pre-priced work that is incidental to pre-priced work shall be considered to be within the scope of this contract. If the value of non-pre-priced work exceeds 40% of the total Task Order cost it will NOT be considered incidental, and the project will not be executed under this contract.
Incidental non-pre-priced work may include minor facilities engineering work items that are not specifically included in the MEANS Cost Data software but that are within the basic intent and general scope of the contract and are incidental to a pre-priced work item.
Incidental non-pre-priced work will be negotiated on a work item-by-work item basis. R. S. MEANS or its factor used for calculating the pre-priced items will not be used to compute the cost proposal of the non-pre-priced items.
For non-pre-priced items, the Contractor shall provide the following for each component or task required:
• Item Description
• Direct Labor Hours
• Labor Rate
• Crew size and description of personnel
• Hourly fringe benefit rate for trade performing task
• Description of proposed material
• Number of units of proposed material
• Cost per unit of material (direct bare costs only)
• Description of proposed equipment
• Time for which equipment will be required
• Rental rate for equipment (direct bare costs only) as provided in the latest version of the Army Corps of Engineers Manual EP 1110-1-8 Construction Equipment Ownership and Operating Expense applying to the location of the work (i.e. Region VII – California), unless renting new equipment, whereby vendor quotes are required.
Information submitted in support of non-pre-priced tasks shall include, at a minimum, the following:
• Complete specifications and technical data, including task content, support drawings, task cost data, quality control and inspection requirements.
• Work schedule.
• Costing data shall include a cost analysis report, establishing the basis for selecting the approach proposed for accomplishment of the requirements. Unless otherwise directed by the Contracting Officer, the Contractor shall submit costing data demonstrating that the Contractor sought and received three quotes. The Contractor shall provide an installed unit price (or demolition price if appropriate) that shall include all costs required to accomplish the non-pre- priced task.
• The total extended price for the non-pre-priced task will be determined by multiplying the unit price by the quantity required. The price offered in the proposal will be determined by multiplying the total extended price by Contractor’s non-pre-priced coefficient adjustment factor.
• After a non-pre-priced item is used on three separate Task Orders, the unit price for such item will be established, following approval by the Contracting Officer, and fixed as a permanent pre-priced task that will no longer require price justification.
• The Contracting Officer’s determination as to whether an item is a pre-priced task or a non-pre- priced task shall be final, binding and conclusive as to the Contractor.
The pre-priced coefficient is not applied to non-pre-priced items. After the bare costs of these items have been negotiated, the non-pre-priced coefficient will be applied to the agreed to bare costs of non-pre-priced items.
The non-pre-priced coefficient shall NOT exceed two decimal places to the right of the period (e.g. 0.XX, 1.XX).
4. BID GUARANTEE, PERFORMANCE AND PAYMENT BONDS, ADDITIONAL BONDING
REQUIREMENTS
Bonds are required for this contract. Refer to Section 00 73 01 CONTRACT TYPE/PERFORMANCE SPECIAL CONTRACT REQUIREMENTS and Section 00 70 00 CONDITIONS OF THE CONTRACT for FAR Clauses 52.228-1 BID GUARANTEE, 52.228-15 PERFORMANCE AND PAYMENT BONDSCONSTRUCTION, and
52.228-2 ADDITIONAL BOND SECURITY.
EVALUATION FACTORS FOR AWARD
SECTION 00 21 16 04 - EVALUATION FACTORS FOR AWARD
The RFP requires the evaluation of price and the following non-price factors:
Factor 1 – Ability to Manage Multiple Simultaneous Projects Factor 2 – Corporate Experience Factor 3 – Past Performance Factor 4 - Safety Factor 5 – Price - Based on Proposed Task Order 0001 (Exhibit M)
The distinction between corporate experience and past performance is corporate experience pertains to the types of work and volume of work completed by a Contractor that are comparable to the types of work covered by this requirement, in terms of size, scope, and complexity. Past performance pertains to both the relevance of recent efforts and how well a Contractor has performed on the contracts.
The relative order of importance of the non-price evaluation factors is as follows:
First, the Government will evaluate Factor 1 on an Acceptable or Unacceptable basis. If an Offeror is rated Unacceptable for Factor 1, they will not be eligible for award and the evaluation stops there. The Government will then evaluate all remaining non-price factors. Factors 2, 3, and 4 are of equal importance to each other and, when combined, are approximately equal to price. Factor 1 is not assigned a weight.
The importance of price will increase if the Offerors’ non-price proposals are essentially equal in terms of overall quality, or if price is so high, or low, as to significantly diminish the value of a non-price proposal’s superiority to the Government. The Government will award a contract to the responsible Offeror(s) whose offer conforms to the RFP and represents the best value to the Government, price and non-price factors considered.
DEFINITIONS:
100% COMPLETE: The facility is completely constructed and ready for the intended use.
ACCEPTABLE FEATURES: A proposed method or technique in the proposal that addresses RFP requirements such that no further explanation or documentation is necessary.
BEST VALUE: The expected outcome of an acquisition that, in the Government’s estimation, provides the greatest overall benefit in response to the requirement. See FAR 2.101.
CLARIFICATIONS: Are limited exchanges between the Government and Offerors that may occur when award without discussion is contemplated. See FAR 15.306(a)(1).
COMMUNICATIONS: Are exchanges between the Government and Offerors after receipt of proposals, leading to establishment of the competitive range. See FAR 15.306(b).
COMPETITIVE RANGE: Is all the most highly rated proposals (based on the rating of each proposal against all evaluation criteria), unless the range is further reduced for purposes of efficiency. FAR 15.306(c). The Government intends to limit the competitive range to the five (5) lowest priced proposals. If the five (5) lowest priced proposals are deemed unsatisfactory, the Government will then move on to the following three (3) lowest priced proposals and repeat the process in increments of three (3) until a selection has been made.
COMBINED PROJECT(S): Projects with multiple starting and ending points, performed under separate Task Orders, delivery orders, or multiple contracts combined in a single description. No credit will be given for work performed under MACC/IDIQ contracts in the aggregate or for multiple projects completed under more than one task/delivery order.
DEFICIENCY: A material failure of a proposal to meet a Government RFP requirement or a combination of significant weaknesses in a proposal that increases the risk of unsuccessful contract performance to an unacceptable level. See FAR 15.001.
DISCUSSIONS: Are exchanges (i.e., negotiations) in a competitive environment that are undertaken with the intent of allowing the Offeror to revise its proposal. Discussions take place after establishment of the competitive range.
EVALUATION NOTICE (EN): Is the PCO’s written notification to the Offeror for purposes of clarifications, communications, or discussions.
EXCESSES: Are elements of the proposal that have exceeded mandatory minimums (in ways that are not integral to the design) whose removal and corresponding price decrease may make an Offeror’s proposal more competitive.
See FAR 15.306(d)(4).
EXPERIENCE: Pertains to work performed by an Offeror and Offeror’s Team, within the prescribed timeframe, which is the same or similar to the work that may be ordered under this contract in terms of size, scope, and complexity. Experience is distinct from past performance (how well an Offeror has performed).
FIVE-YEAR PERIOD: The prescribed timeframe for this RFP that refers to the period of time for which projects may be submitted for experience or past performance. The five-year period is calculated by counting back five years from the initial RFP issuance date.
JOINT VENTURE (JV): A legal business entity formed between two or more companies (parties) to undertake the performance activities of a contract together. This does not include other arrangements such as “teaming agreement” or “strategic alliance,” which are not recognized as bona fide Joint Ventures for the purposes of this RFP.
KEY PERSONNEL: Offeror’s Project Manager, Project Superintendent, or personnel that are designated with the specific authorities of the foreman or superintendent.
OFFEROR: Refers to the Contractor submitting the proposal as Offeror, including Joint Ventures, whose name and address appears in Block 14 of Standard Form (SF) 1442 (RFP, Offer and Award). In the event of a conflict or inconsistency between the Offeror’s name and address cited on the SF 1442 and any other part of the proposal, the SF 1442 is the conclusive document in determining the Offeror who is submitting the proposal.
OFFEROR’S TEAM: Refers to the Offerors (see definition) and First - Tier Subcontractors
PAGE: Refers to one printed side of a piece of paper. (For example, 5 pieces of paper printed on both sides would result in 10 pages of narrative.)
PAST PERFORMANCE: Relates to how well an Offeror and Offeror’s Team has performed; e.g., the quality of work accomplished, schedule compliance, customer satisfaction.
PERFORMANCE CONFIDENCE ASSESSMENT: Is an evaluation of the likelihood (or Government’s confidence) that the Offeror will successfully perform the RFP’s requirements; the evaluation is based upon past performance information.
PROJECT: Refers to an individual Task Order, with a single starting point and a single ending point.
QUALITY: Is the composite of materiel attributes including performance features and characteristics of a production or service to satisfy a customer's given need.
RECENCY: As it pertains to past performance information, is a measure of the elapsed time since the past performance reference occurred. Recency is generally expressed as a time period during which past performance references are considered relevant.
RELEVANCY: As it pertains to past performance information, is a measure of the extent of similarity between the service/support effort, complexity, dollar value, contract type, and subcontract/ teaming or other comparable attributes of past performance examples and the RFP requirements; and a measure of the likelihood the past performance is an indicator of future performance.
RENOVATION AND REPAIR PROJECT TYPES: Refers to work that makes changes to an existing facility to meet new codes with the same facility function and structure when complete. Projects where the work restores a real property facility, system, or component.
REQUIREMENTS DOCUMENTS: Are all aspects of the RFP that convey the needs of the Government to Offerors, including the SOO, SOW, PWS, technical requirement documents, and system requirement documents.
REQUIREMENTS OWNER: Is the entity (for example, a program management office or other organizational entity) responsible for providing requirements documents within the RFP that communicate those requirements to Offerors.
RISK: As it pertains to source selection, is the potential for unsuccessful contract performance. The consideration of risk assesses the degree to which an Offeror’s proposed approach to achieving the technical factor or subfactor may involve risk of disruption of schedule, increased cost or degradation of performance, the need for increased Government oversight, and the likelihood of unsuccessful contract performance.
SELF-PERFORM: Refers to performing relevant and minor construction trade work in-house without Subcontractors. This does not include project administration or management functions (such as quality control or safety program) and miscellaneous work (such as housekeeping or cleanup). Relevant and minor construction trade work is that which is the same or similar to the work that may be ordered under this contract.
SIGNIFICANT STRENGTH: An aspect of an Offeror’s proposal with appreciable merit or will exceed specified performance or capability requirements to the considerable advantage of the Government during contract performance.
SIGNIFICANT WEAKNESS: A flaw in the proposal that appreciably increases the risk of unsuccessful contract performance. See FAR 15.001.
STRENGTH: An aspect of an Offeror's proposal with merit or will exceed specified performance or capability requirements to the advantage of the Government during contract performance.
UNCERTAINTY: Is any aspect of a non-cost/price factor proposal for which the intent of the offer is unclear (e.g.,more than one way to interpret the offer or inconsistencies in the proposal indicating that there may have been an error, omission, or mistake).
WEAKNESS: A flaw in the proposal that increases the risk of unsuccessful contract performance. See FAR 15.001.
FACTOR 1: ABILITY TO MANAGE MULTIPLE SIMULTANEOUS PROJECTS
a. RFP Submittal Requirements:
The current composition and proposed staffing of the firm to manage multiple simultaneous projects will be evaluated in this factor (multiple meaning 3 or more).
The Offeror shall submit the following information:
(1) Using Exhibit “A” (Current Composition and Proposed Staffing) provide a narrative describing the current Offeror composition and the proposed staffing if awarded the single contract. Provide the role, responsibilities, and contractual relationships between the various firms (see FAR Subpart 9.6). On a separate sheet, include a simple organizational chart that clearly identifies the lines of authority between the entities. If the experience of an entity is being claimed in Factor 2, that entity must be named in the above narrative and organizational chart.
(2) In addition to the narrative, the Offeror shall submit a signed copy of a Joint Venture agreement, partnership agreement, teaming agreement, approved MPA, or letter of commitment for each member of the Offeror’s team identified above (e.g., Joint Venture member, partner, team member, parent company, design Subcontractor, subsidiary, or other affiliated company, etc.), and for any Subcontractors that will be proposed as completing work under the technical approach, submit a letter of commitment. If the Offeror is proposing as a Mentor-Protégé Joint Venture, the Offeror shall submit the SBA approved Mentor Protégé Joint Venture agreement with the SBA approval letter of the MPA (see definition) and any subsequent extensions.
b. Basis of Evaluation:

Ratings for Factor 1 Rating Description Acceptable Based on the Offeror’s Ability to Manage Multiple Simultaneous Projects, the
Government has a reasonable expectation that the Offeror will successfully perform the required effort.
Unacceptable Based on the Offeror’s Ability to Manage Multiple Simultaneous Projects, the Government does not have a reasonable expectation that the Offeror will be able to successfully perform the required effort.
FACTOR 2: CORPORATE EXPERIENCE (See definition)
a. RFP Submittal Requirements:
Submit Exhibit “B” (Construction Experience Project Data Sheet):
Construction Experience:
Submit a minimum of three (3) and maximum of five (5) recent and relevant self-performed Government or commercial construction contracts/projects for the Offeror that best demonstrate your experience on projects that are similar in size, scope, and complexity to the projects that may be ordered under this contract.
