PRE-PROPOSAL QUESTIONS & ANSWERS
INDO-PACIFIC MULTIPLE AWARD CONSTRUCTION CONTRACT FOR PROJECTS IN
THE NAVFAC PACIFIC AREA OF OPERATIONS
NOTE: The following questions and answers are provided for INFORMATION ONLY. The RFP remains unchanged unless it is amended in writing on a Standard Form 30.
1. Document 00 22 00 Construction and Design Experience Due to the restrictions of the geographical location of relevant projects for consideration and rarity of the scope of work outside of the United States that meets the construction value of $500K within the past 7 years.
Will the Government consider extending the construction completion of the relevant experience from 7 years to 15 years?
ANSWER: Amendment no. 0001 revises the 7 years to 10 years.
2. Non-Price Evaluation Factors | Construction and Design Experience. This RFP requires all projects in Factor 1 Experience to be located outside of the United States. Please consider accepting some projects within the United States since this is highly restrictive to majority of US qualified contractors, designers, and engineers who have the capacity and qualification to perform task orders within the $500K - $20 million range, especially since majority of construction and design requirements conforms U.S., FARS and DFARS standards.
ANSWER: As stated in the SF1442, Block 10 Continuation, it is anticipated that this MACC may include projects in Caroline Islands, Philippines, Northern Territory Australia, Papua New Guinea, Timor Leste, Singapore, Malaysia, Thailand, Indonesia, Vietnam, Nepal, Sri Lanka, Fiji, Maldives and other areas under NAVFAC Pacific cognizance which formed the basis of the Factor 1 Experience. The design criteria to be used will be governed by UFC 1-201-01 and the local municipality design codes.
3. Non-Price Evaluation Factors | Construction and Design Experience. This RFP requires all projects in Factor 1 Experience to be located outside of the United States. Instead of all eight projects being located outside of the United States, can the government accept combination of projects inside and outside the United States. This will allow the contractors to show their experience internationally as well as knowledge and ability to follow U.S. FARS and DFARS standards.
ANSWER: See response to question no. 2.
4. Non-Price Evaluation Factors | Construction and Design Experience. This RFP requires all projects in Factor 1 Experience to be located outside of the United States. This RFP also requires US registered architects and engineers to be part of the team. Instead of all eight projects being located outside of the United States, can the government accept combination of projects inside and outside the United States. This will maximize participation from qualified US registered architects and engineers.
ANSWER: Document 00 73 00, Professional Registration for Designer-of-Record states “Professional Registration shall be recognized by the country where work will occur.”
5. Non-Price Evaluation Factors | Construction and Design Experience. This RFP requires all projects in Factor 1 Experience to have been completed or substantially completed within the past seven (7) years from the date of issuance of this solicitation. COVID-19 has disrupted many projects, limiting the majority of contractors to fully show relevant past performance for this MACC contract and limiting US-qualified contractors to openly compete.
ANSWER: See answer to question no. 1.
6. Non-Price Evaluation Factors | Construction and Design Experience. This RFP requires all projects in Factor 1 Experience to have been completed or substantially completed within the past seven (7) years from the date of issuance of this solicitation. This time period is too restrictive to maximize competition for U.S. qualified contractors.
ANSWER: See answer to question no. 1.
7. Non-Price Evaluation Factors | Construction and Design Experience. New construction or repair of cast-in-place reinforced concrete and/or masonry structures/buildings supporting Military Operations/Training in conformance with UFC 1-201-01 Non-Permanent DoD Facilities in Support of Military Operations. According to UFC 1-201-01 Non-Permanent DoD Facilities in Support of Military Operations, buildings and facilities that falls under the non-permanent category has a life expectancy of less than 10 years. The American Concrete Institute (ACI) recommends a minimum design life of 50 years for reinforced concrete structures, which disqualifies reinforced concrete as viable material for non-permanent facilities to meet UFC 1- 201-01’s intent. The American Concrete Institute (ACI) issues and maintains the ACI 318 Building Code Requirements for Structural Concrete, which is one of the applicable codes and standards on this MACC according to Part 3 Section 2.1 Applicable Codes and Standards (Part 3
- Page 2 of 16). Please clarify if it’s the government’s intent to require a past performance for cast-in-place reinforced concrete and/or masonry structures/buildings supporting Military Operations/Training only.
ANSWER: Per UFC 1-201-01, Semi-Permanent construction level facilities life expectancy can be extended to 25 years with maintenance and upkeep of critical building systems. Per UFC 1- 201-01, Structural design must be in accordance with the International Building Code (IBC) Chapters 16, 17, 18, 19, 20, 21, 22, and 23, and UFC 3-301-01 Structural Engineering.
8. Non-Price Evaluation Factors | Construction and Design Experience. New construction or repair of an airfield (aircraft runway, taxiway, or apron) asphalt concrete pavements of at least 1,000 square meters with a minimum asphalt concrete thickness of 50 mm located on a military base or commercial airport in a country outside the United States. 50mm thickness for asphalt concrete thickness for airfield is too thin, please verify thickness size.
ANSWER: Amendment no. 0001 revises the evaluation criteria.
9. Non-Price Evaluation Factors | Construction and Design Experience. New construction or repair of Humanitarian Assistance/Disaster Response Multi-Purpose industrial facilities (warehouses or maintenance facility) in a country outside the United States.
Humanitarian Assistance/ Disaster Response Facilities falls under UFC 1-201-01 Non- Permanent DoD Facilities in Support of Military Operations. Since the requirements in the RFP reflects the typical task orders that can be expected from the life of this MACC, is it safe to assume that government only intend to design and construct non-permanent or temporary facilities with life expectancy of five to ten years?
ANSWER: It is anticipated that the US Government will construct the facilities and turnover facility to Host nation when project is completed. Host nation will be responsible for maintenance/sustainment of the facility.
Please consider simplifying requirements to Warehouse and Maintenance facility in accordance with applicable Unified Facilities Criteria to maximize competition to US-qualified contractors as well as give flexibility for the government to design and build facilities that may exceed life expectancy of 10 years.
ANSWER: See response to question no. 9.
11. UFC 1-201-01 Non-Permanent DoD Facilities. Relevant projects under Factor 1 Experience for this RFP seem to only require non-permanent facilities. Is it the intention of the government to only build non-permanent type facilities in the life of this MACC contract in Indopacific region? If this is the case, the seed project for this MACC requires the design and construction of a reinforced concrete single-story building (Section 4.2 Building Requirements, Part 3 - Page 4 of 16) that conforms to ACI 318-14 Building Code Requirements for Structural
Concrete (Appliable Code Standard, Part 3 - Page 2 of 16) conflicts with the intent of non-permanent facilities according to UFC 1-201-01 Non-Permanent DoD Facilities. Please consider removing requirements for UFC 1-201-01 Non-Permanent DoD Facilities including Humanitarian Assistance/Disaster Response Multi-Purpose facilities to better reflect the relevant projects in Factor 1 Experience in comparison to expected projects that may result from this MACC, such as the seed project.
ANSWER: See answer to question nos. 7 and 9.
12. Definition of United States in Factor 1 Experience. United States means the 50 States, the District of Columbia, Puerto Rico, the Northern Marianas Islands, American Samoa, Guam, the U.S. Virgin Islands, and Wake Island. Please consider accepting projects from Guam and Northern Marianas Islands, considering it highly favorable, due to its close proximity to the locations anticipated under this MACC (Caroline Islands, Philippines, Northern Territory Australia, Papua New Guinea, Timor Leste, Singapore, Malaysia, Thailand, Indonesia, Vietnam, Nepal, Sri Lanka, Fiji, Maldives) or other tropical locations within NAVFAC Pacific AOR, making it easier for U.S. qualified contractors from Guam and Northern Mariana Islands to deploy staff who are highly experienced and knowledgeable of U.S., NAVFAC, DFARS and FARS requirements and standards.
ANSWER: See answer to question no. 2.
13. Referring to Block 13B of the SF1442, we note that an offer guarantee is not required for the Seed Project, as well as Item 1.73 of RFP Document 00 70 00 notes “1.73 FAR 52.228-1, BID GUARANTEE (SEP 1996) [if required by task order]”. Furthermore we do not see a bonding capacity requirement noted within RFP Documents 00 21 16 and 00 22 00. Given the $990 million-capacity of the contract, please kindly advise if the government desires and requires that Offeror’s provide as part of the Price Proposal a letter of commitment from their insurance company or surety, signed by an authorized agent of that firm that identifies their surety and minimum single contract/task order and aggregate bonding capacity.
ANSWER: A letter of commitment from the insurance company or surety is not desired or required.
14. Please confirm that no performance and payment bonds are required for the Seed Project at Camp Melchor Dela Cruz, Isabela Philippines.
ANSWER: Confirmed.
15. Can we use experience of a subcontractor to meet requirements under the Construction Experience (Section 00 22 00, Factor 1, (a) (1))? We will include a Teaming Agreement for the subcontractor per the requirement stated in the RFP.
ANSWER: Yes. Comply with RFP Document 00 22 00, Factor 1, Experience, Note 6.
16. Non-Price Evaluation Factors | Construction and Design Experience. Factor 1 Experience requires new construction or repair of Humanitarian Assistance/Disaster Response Multi- Purpose industrial facilities (warehouse and maintenance facility). The Federal Facility Criteria in the Whole Building Design Guide and Unified Facilities Criteria does not have explicit definition of a Humanitarian Assistance/Disaster Response Multi-Purpose industrial facility.
Please define how the government intends to evaluate how a project meets the requirement of a Humanitarian Assistance/Disaster Response Multi-Purpose industrial facility.
ANSWER: See amendment no. 0001 for revision to relevant project description.
17. Factor 1 Experience Basis of Evaluation. According to the RFP, NAVFAC Pacific AOR that are outside the United States with similar manpower/logistical challenges may be considered more favorably. Can the government consider including Guam as one of the preferred locations since it meets many of the characteristics of preferred location as described in this MACC. Guam is within NAVFAC Pacific’s area of responsibility, unique location in the Pacific Ocean, which is in close proximity to the locations anticipated under this MACC, and its unique tropical climate similar to many of the countries within this MACC.
ANSWER: The RFP remains unchanged.
18. FAR 52.228-1, BID GUARANTEE (SEP 1996) [if required by task order]. According to Document 00 70 00, Section 1.73 FAR 52.228-1 Bid Guarantee [if required by task order], a bid guarantee may or may not be required depending on the task order. Please confirm if the seed project requires a bid guarantee to be submitted with the price proposal.
ANSWER: Part 7, Seed Project, Document 00 41 00, page 1, states “A BID GUARANTEE IS
NOT REQUIRED.”
19. FAR 52.228-15, PERFORMANCE AND PAYMENT BONDS--CONSTRUCTION (JUN
2020) (DEVIATION 2020-O0016) [if required by task order]. According to Document 00 70 00, Section 1.81 FAR 52.228-15 Performance and Payment Bonds – Construction [if required by task order], a performance or payment bond may or may not be required depending on the task order. Please confirm if the seed project will require a performance or payment bond.
ANSWER: See amendment no. 0001. Performance and payment bonds are not required for the seed project.
20. Factor 1 – Experience (2) Design Experience; Page 5 – Document 00 22 00. Can we submit design projects from multiple (different) DORs as long as we have a teaming agreement/letter of commitment in place? Or are we limited to only one (1) DOR?
ANSWER: The RFP does not prohibit proposing more than one DOR. Document 00 22 00, Factor 1, Experience, Design Experience, Note 3, states “provides a fully executed teaming agreement or contractual agreement between the Offeror and the designer of record(s).
