1.1 REFERENCES

The publications listed below from a part of this specification to the extent referenced. The publications are referred to within the text by the basic designation only.

U.S. DEPARTMENT OF DEFENSE (DOD)

UFC 3-101-01 (2011; Change 3) Architecture

UFC 3-120-10 (2006; Change 1) Interior Design

FC 1-300-09N (2014; with Change 4, 2018) Navy and Marine

Corps Design

1.2 GENERAL REQUIREMENTS

Comply with UFC 3-101-01, UFC 3-120-10, and FC 1-300-09N.

Furnishings, Fixtures, and Equipment (FF&E) will include, but is not limited to, movable furniture systems, freestanding furniture, area/accent rugs, artwork, appliances, accessories, and other miscellaneous items to support facility functions.

Fixed furnishings (items that are fixed to the structure), such as drying cages, weapon racks, motorized projection screens, window coverings and lockers are not considered FF&E and are part of the construction contract, Structural Interior Design (SID).

FF&E will be fully integrated with the building systems and finishes.

FF&E is in the amount indicated in the PRICE PROPOSAL SCHEDULE. This amount does not include the Prime Contractor's Handling and Administration Rate

(HAR).

Refer to the Interior Design drawings for the FF&E layouts.

The Prime Contractor must provide the procurement and installation of all

Furnishings, Fixtures, and Equipment (FF&E) exactly as designed and specified using NAVSUP Blanket Purchase Agreements (BPAs), General Services

Administration (GSA) schedules, and other Federal contracts and complying with priorities found in FAR Part 8.404.

1.2.1 Authorization

The Government will provide separate funding for procurement and installation of the FF&E package. Construction funds will not be used. The

FF&E package provided will include shipping, freight, handling, and installation costs. Upon receipt of required funding, the Prime Contractor

Section 01 30 01.00 20 Page 2

Amendment No.0003 will be authorized by the Contracting Officer, as a planned modification to the construction contract, to procure and install all FF&E.

The FF&E planned modification will be awarded no later than nine months prior to the contract completion date. The Prime Contractor's schedule must include the award of the FF&E planned modification. If the Government does not award the FF&E planned modification within the stipulated time frame, the Prime Contractor may be entitled to a contract extension and extended field overhead.

Prime Contractor Handling and Administration Rate (HAR) can be up to, but not exceed, 5% for the handling and administration of the FF&E package. The

HAR will account for all administrative costs; overhead; bonding fees, if any; administration of subcontractors; profit; and any other costs associated with and related to the coordination and processing of the procurement and installation of the FF&E package.

1.3 PROCUREMENT AND INSTALLATION

The Prime Contractor must coordinate the FF&E installation with the building completion date.

The Prime Contractor may anticipate possible manufacturer price increases if order placement is delayed. It is recommended to order the FF&E product once the FF&E planned modification is awarded and funds are received to avoid incurring additional costs. Any costs incurred as a result of Prime

Contractor delay in order placement will be the burden of the Prime

Contractor.

1.3.1 Use of Blanket Purchase Agreements (BPA) and GSA Schedules

The Prime Contractor will receive a letter of authorization from the

Contracting Officer citing the name of the furniture dealer(s) and other information to use when accessing the Federal Government supply sources.

1.3.2 Deposits

The Prime Contractor will be responsible for paying a deposit for the FF&E package when placing their order.

1.3.3 Davis Bacon Act

The FF&E package is not considered construction; therefore, the Davis Bacon

Act is not applicable to the FF&E line item. The workforce for the FF&E installation and delivery is separate and distinct from the labor workforce performing the construction effort.

1.3.4 Taxes

Exemptions for certain State or Local taxes may be available to the Prime

Contractor or its subcontractors. The Prime Contractor must take maximum advantage of all exemptions, including obtaining a resale permit, from

State and Local taxation authorities whether available directly to the

Prime Contractor or based on an exemption afforded the Government. The responsibility for paying applicable taxes rests with the Prime

Contractor. State and local taxes to the FF&E line will be included with the subcontractor's quote, if applicable by the state.

Amendment No.0003

1.3.5 Bonds

FAR 28.102-1(a) requires that performance and payment bonds be included in all construction contracts exceeding $150,000, except under the conditions listed. In addition, FAR 28.102-2(d) requires the Government to secure additional bond from the Prime Contractor for any contract price increases. Since the FF&E planned modification is not part of the original contract award, the Prime Contractor will not be required to secure bond for the FF&E package at the time the basic contract is awarded. Additional bonding may be required for the award of the FF&E line item at the time of the planned modification (see below).

In accordance with FAR 28.103, the contracting officer may determine that performance and payment bonds for other than construction are warranted and seek additional bond for the FF&E package. Should performance and payment bonds be determined necessary, the Contracting Officer will include this requirement in the solicitation, and is funded as part of the FF&E

1.3.6 Unique Item Identification (IUID) and Valuation

Unique item identification and valuation is a system of marking and valuing items delivered to DoD that enhances logistics, contracting, and financial business transactions. The IUID policy is mandatory for all DoD contracts that require the delivery of items. An item is a single article or a single unit formed by a grouping of subassemblies, components or constituent parts. The Prime Contractor must provide DoD Unique item identification, valuation and delivery of data for all required FF&E items for which the Government's unit acquisition cost is $5,000 or more.

1.3.7 Installation

The FF&E package includes the installation of all furniture and furnishings as specified in the project. The installation dealer(s) specified in the

FF&E package must receive, store as required, transport to the project site, off load, inside deliver, unpack, assemble, place/install, connect to utilities (including electrical, voice, data and plumbing connections where applicable), test, adjust for proper operation, clean, and dispose of all the trash for all furniture and furnishings. The installation dealer must obtain services of equipment specialists to install the electrical equipment, to include but not limited to televisions, Video Teleconference

Equipment, ceiling mounted projectors and mission essential electronic equipment included in the FF&E package. It is the Prime Contractor's responsibility to coordinate the building completion, occupancy, and furniture installation dates with the installation dealer(s) specified in the FF&E package. Any costs associated with or delaying furniture

Section 01 30 01.00 20 Page 4

Amendment No.0003 shipments is the responsibility of the Prime Contractor.

The Prime Contractor must provide and coordinate all Building Systems with the furniture plans and furniture installation.

1.3.8 Installation Warranty

All movable furnishings will be installed in accordance with the manufacturer's instructions and warranty requirements. All movable furnishings must be level and aligned. All doors, drawers and accessories must be level and aligned to open, close and otherwise operate smoothly and securely.

The Prime Contractor must repair any damages to facility finish that is a result of the furniture installation. Prime Contractor must correct all punch list items for the furniture/furnishings.

1.3.9 Ordering Documentation

At a minimum, two copies of all ordering documents prepared or obtained by the Prime Contractor or the furniture dealer must be provided to the

Contracting Officer. Including, but not limited to Purchase Orders, Factory Orders and warranty information. One copy will be submitted to the client representative and one copy will be retained with the contract files.

1.3.10 Post Award Changes

After award of the FF&E planned modification, any requests to change the

FF&E items must be submitted to the Contracting Officer.

1.4 PUNCH LIST AND COORDINATION

The Contractor must provide scheduling and coordination updates as required to the Contracting Officer.

The Contractor and other specialty consultants and equipment specialists involved in the installation of FF&E (such as electrical and telecommunications) must attend two punch list site visits with the installation dealer(s). Notify the Contracting Officer at least 14 calendar days prior to the date of each punch list site visit inspection, to facilitate attendance by the NAVFAC Interior Designer and the Base

Representative/Activity Contact. The first site visit must identify all punch list items (at installation dealer's 98 percent completion), and the second (at 100 percent completion) will confirm that all punch list items have been resolved.
