About this file

This is a Justification and Approval (J&A) document for other than full and open competition for a federal procurement.

The Naval Facilities Engineering Systems Command (NAVFAC), Hawaii is requesting approval to procure a STAR-ELT Software Defined Radio Alarm Transmitter and antenna manufactured exclusively by Kingfisher Company (81 Old Ferry Road, Lowell, Massachusetts 01854) for Military Construction Project P-2001, a C-40 Aircraft Maintenance Hangar and Parking Apron at Marine Corps Base Hawaii, Kaneohe Bay. The procurement is justified under Federal Acquisition Regulation (FAR) 6.302-1 and Title 10 U.S.C. 3204(a)(1) based on a single responsible source determination. The justification cites technical and regulatory requirements mandating that all fire alarm equipment comply with National Fire Protection Association (NFPA) 72 standards and be listed by Underwriters Laboratory (UL) or Factory Mutual (FM) Global. Only Kingfisher fire alarm components tested and approved as a complete integrated system by FM Global are acceptable; mixing manufacturers creates an unacceptable safety risk that could endanger life and property. Alternative non-Kingfisher transmitters would require procuring two new compatible radio receivers (approximately five times the cost of each Kingfisher transmitter), obtaining additional frequency assignments (potentially requiring six months to one year for approval), upgrading the Regional Dispatch Center dispatch computer system, and providing new radio repeater infrastructure. Additionally, MCBH maintenance personnel are trained specifically on Kingfisher equipment; using alternative systems would necessitate costly additional training and create unnecessary operational overhead. A Sources Sought Notice posted October 2, 2024 on SAM.gov received one response proposing an AES IntelliNet 2.0 transmitter, which was rejected as incompatible with existing Kingfisher receiving equipment. The Contracting Officer has certified that the anticipated cost is fair and reasonable, and the document is controlled by the U.S. Department of the Navy with restricted distribution.

JUSTIFICATION AND APPROVAL

FOR OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity.

Naval Facilities Systems Engineering Command (NAVFAC), Hawaii (HI), Construction Contracts Branch, Joint Base Pearl Harbor-Hickam (JBPHH), HI.

2. Description of the Action Being Approved.

Request approval for the use of STAR-ELT Software Defined Radio Alarm Transmitter and antenna manufactured by Kingfisher Company, 81 Old Ferry Road, Lowell, Massachusetts (MA) 01854 for construction project FY23 Military Construction (MCON) Project P-2001 C-40 Aircraft Maintenance Hangar & Parking Apron, Marine Corps Base Hawaii (MCBH), Kaneohe Bay, HI (Work Order No.

3. Description of Supplies/Services.

The general scope of work for P-2001 is to construct a high-bay aircraft maintenance hangar with low-rise space for administration, maintenance and aircraft/spares storage to provide a weather protected shelter for inspection, service and maintenance for the C-40 aircraft. Work includes a low-level fire protection system for the hangar bay, fire sprinkler systems, and a fire alarm and mass notification system.

In the event of a fire, the required equipment will transmit fire alarm signals from the hangar to the JBPHH Regional Dispatch Center (RDC) for automatic notification to dispatch the Federal Fire Department.

The estimated procurement cost is $ which is % of the estimated cost of construction of $ for P-2001.

4. Statutory Authority Permitting Other Than Full and Open Competition.

This request is pursuant to the authority of FAR 6.302-1 and Title 10 U.S.C. 3204(a)(1) – Only one responsible source and no other supplies or services will satisfy the agency requirements.

5. Rationale Justifying Use of Cited Statutory Authority.

a. UFC 3-600-01 Fire Protection Engineering for Facilities requires the Fire Alarm Reporting System to comply with National Fire Protection Association (NFPA) 72. NFPA 72 National Fire Alarm and Signaling Code requires all fire alarm equipment to be listed for the purpose which it is used. The purpose of the Underwriters Laboratory (UL) listing or Factory Mutual (FM) approval requirements is to ensure quality, suitability, and reliability of equipment. FM Global approval is based on testing a complete fire alarm system comprised of a fire alarm receiver and transmitter. A fire alarm system of mixed manufacturer equipment is unacceptable because no mixed system has been approved to date. Only Kingfisher fire alarm components in a Kingfisher fire alarm system are FM Global approved, and therefore, Kingfisher transmitters are required to operate with a Kingfisher receiver. The possibility of using a non-Kingfisher transmitter with a Kingfisher receiver will diminish fire protection capabilities, and therefore, endanger life and property. The requirement for the Kingfisher transmitter ensures reliable fire alarm protection for the building.

b. Installation of a non-Kingfisher transmitter may endanger life and property until the system is proven reliable by an approval from FM Global or a listing from UL.

c. Installation of a non-Kingfisher transmitter would require purchasing two new and compatible radio receivers (primary and backup). The cost of the new radio receivers is approximately $ or five times the cost of procuring each Kingfisher transmitter. In addition, this would require requesting an additional frequency assignment for the new system, providing new active radio repeater for the new frequency, and upgrading the RDC dispatch computer system to interface with the non-Kingfisher receivers. An additional frequency assignment may require between six months to one year for approval.

d. The non-Kingfisher system will also have costs implications for maintenance and manpower that will exceed the Government’s minimum needs. MCBH maintenance personnel are trained to maintain and repair the Kingfisher transmitters. Using a Kingfisher transmitter will avoid the significant burden and cost of additional training for maintenance personnel to maintain and repair the non-Kingfisher transmitter. Having to maintain a Kingfisher and non-Kingfisher transmitter at MCBH will create unnecessary work and overhead that would increase the total operational costs.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

A Sources Sought Notice (No. N62478CON33FY2422) was posted on 2 October 2024 on the System for Award Management (SAM.gov) website and received one response from Media Plumbing & Heating Inc. DBA Kinetix. However, the AES IntelliNet 2.0 transmitter that was proposed does not meet the following criteria: “Equipment must operate, and be listed, as a system with the existing Kingfisher receiving equipment at the JBPHH RDC and MCBH.”

7. Determination of Fair and Reasonable Cost.

The Contracting Officer has determined the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable.

8. Actions taken to remove barriers to competition.

For the reasons set forth in Paragraph (5), NAVFAC HI has no plans at this time to compete future contracts for the types of supplies/services covered by this document. Should another potential source emerge, NAVFAC HI will assess whether competition for future requirements is feasible.
