DESCRIPTION

This is a competitive procurement for Small Businesses (SB) for a Firm-Fixed Price (FFP), Indefinite Delivery Indefinite Quantity (IDIQ), Job Order Contract (JOC) under NAICS 237130 for power and communication line and related structures construction projects and NAICS 238210 for electrical and other wiring installation construction projects at various Government facilities within Marine Corps Base Camp Pendleton, California, under the Naval Facilities Engineering Systems Command Southwest Areas of Responsibility. Projects will be primarily design-bid-build (fully designed) task orders or task orders with minimal design effort (e.g. shop drawings). Projects may include, but are not limited to demolition, repair, and replacement of telecommunications outside plant and structured cabling.

This acquisition is being restricted to SB and 237130 and 238210 NAICS codes. All other small business concerns are deemed ineligible to submit offers. In order to qualify as a SB contractor, companies must meet the requirements and steps listed at the SBA’s webpage at https://www.sba.gov/federal-contracting/contracting-assistance-programs/women-owned-small-business-federal-contracting-program and have current registration in the System for Award Management (SAM) database.

This is a FFP/IDIQ solicitation notice to perform for labor, materials, equipment, testing, supervision, quality control, site safety, and management including training, issuing reports, field office administration, and other incidental work necessary to perform within the North American Industry Classification System (NAICS) code listed above.

The Contract term is for a base period of one (1) year and four one (1) year option periods, for a maximum total performance period of five (5) years. The North American Industry Classification System (NAICS) Code for this acquisition is 237130 – Power and Communication Line and Related Structures Construction Contractors, with a corresponding small business size standard of $39.5 million. The estimated maximum dollar value of this procurement, including the base year and all options is approximately $10,000,000. The only work authorized under this contract is work ordered by the Government through the issuance of a task order. The Government makes no representation as to the number of task orders or actual amount of work to be ordered. Task order range will be $2,000 to $1,500,000. A seed project (Proposed Task Order 0001) is expected to be awarded as a result of this solicitation; however, the Government reserves the right not to issue a Task Order and/or to issue a Task Order for the $2,000 minimum guarantee in lieu of the Planned Task Order (PTO) 0001, if it’s determined to be in the best interests of the Government.

This acquisition will utilize the best value lowest price technically acceptable (LPTA) source selection process with the intent to award one (1) contract to one (1) responsible proposer whose proposal, conforming to the Request for Proposal (RFP), is most advantageous to the Government. The Government intends to evaluate proposals and award without discussions if appropriate.

Selection for award will be based on evaluation of the following: FACTOR 1: RECENT, RELEVANT

EXPERIENCE OF FIRM; FACTOR 2: MANAGEMENT APPROACH; FACTOR 3: SAFETY; FACTOR 4:

PAST PERFORMANCE; and PRICE – Based on PTO #X001.

Proposals shall be submitted through the Department of Defense (DoD) Secure Access File Exchange (SAFE) service at https://safe.apps.mil. Instructions are provided in “Instructions to Proposers” section of RFP.

The Government must receive the Offeror’s proposal no later than the date and time stated in Block 13 of the SF1442. The Offeror should address all evaluation factors and shall submit the proposal electronically using DoD

SAFE.

DoD SAFE service is the only electronic commerce method authorized for the submission of proposals in response to this solicitation. Submissions outside of DoD SAFE will not be considered.

SOLICITATION INFORMATION

1. TYPE OF CONTRACT

This is an Indefinite Delivery/Indefinite Quantity (IDIQ) contract. Refer to FAR Clause 52.216-1, TYPE OF CONTRACT (APR 1984). The performance period will be for a one (1)-year base period and four (4) one (1)-year option periods. The Government will award a single contract. The anticipated base performance period will be from September 30, 2021 through September 29, 2022. Anticipated option periods will be:

September 30, 2022 through September 29, 2023 September 30, 2023 through September 29, 2024 September 30, 2024 through September 29, 2025 September 30, 2025 through September 29, 2026

2. SET-ASIDE DETERMINATION

In accordance with FAR Subpart 19.8, it has been determined that competition for this procurement will be limited to Small Businesses (100% set-aside) within the assigned NAICS code of 237130 Power and Communication Line and Related Structures Construction Contractors and NAICS code 238210 Electrical Contractors and Other Wiring

Installation Contractors from (https://www.census.gov/eos/www/naics/index.html) with a size standard of $39.5 million and $16.5 million respectively.

3. STANDARD EXECUTION PROCEDURES

Naval Facilities Engineering Systems Command Southwest (NAVFAC SW), Facilities, Engineering and Acquisition Division (FEAD) Camp Pendleton, California is the procuring office and is responsible for all contractual matters related to the basic contract. Individual task orders will be issued and administered by Contracting Officers at FEAD Camp Pendleton.

4. SOURCE SELECTION PROCESS

The Government intends to evaluate offers and award a contract without discussions (except for clarifications, as described in FAR 15.306(a)). Therefore, your initial offer should contain your best terms from a price and technical standpoint. The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary. If the Contracting Officer determines that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition, among the most highly rated proposals. Information regarding the source selection process, content of proposals, evaluation of proposals, and best value LPTA source selection evaluation criteria to be used as follows:

BASIS FOR AWARD

The Government reserves the right to eliminate from consideration for award any or all offers at any time prior to award of the contract; to negotiate with offerors in the competitive range; and to award the contract to the offeror submitting the lowest priced, technically acceptable offer.

As stated in the solicitation, the Government intends to evaluate proposals and award a contract without discussions with offerors (except clarifications as described in FAR 15.306(a)). The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary. In addition, if the Contracting Officer determines that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals.

The LPTA process is selected as appropriate for this acquisition because the best value is expected to result from selection of the technically acceptable proposal with the lowest evaluated price.

An overall non-price factors rating must be at least “ACCEPTABLE” in order to be eligible for award. An “UNACCEPTABLE” rating in any factor results in the overall non-price factors proposal being rated “UNACCEPTABLE” unless corrected through discussions. An overall non-price factors rating of “UNACCEPTABLE” makes a proposal ineligible for award.

SAFETY EVALUATION

Per NAVFAC Procedures, Guidance, and Information (NPGI) 15.304(3), solicitations utilizing source selection procedures for procurements within the 50 United States, the District of Columbia, and outlying areas (as defined in FAR 2.101), shall contain a standard “Safety” non-cost/price technical evaluation factor. This factor shall be included as a stand-alone evaluation factor and not as a sub-factor or an element of the Past Performance evaluation factor. This action will result in the selection of contractors that have consistently demonstrated a commitment to safety and the ability to properly manage and implement safety procedures for themselves and all tiers of subcontractors under their purview.

The evaluation will collectively consider the following:

a. OSHA Days Away from Work, Restricted Duty and Job Transfer (DART)

b. Total Recordable Case (TCR) Rates

c. Offeror Technical Approach to Safety

d. Other sources of information available to the Government

The evaluators should collectively consider all elements of safety when assigning an overall adjectival rating for this factor. Safety will be evaluated utilizing the ratings outlined in Table A.

ADJECTIVAL RATINGS/DESCRIPTIONS

Each offeror’s technical factors and past performance will be evaluated separately. Upon the conclusion of the evaluation of the technical factors, and past performance, an overall non-price factors rating of Acceptable (A) or Unacceptable (U) will be assigned to each offeror’s non-price factors proposal.

The following adjectival ratings and rating descriptions will be used to assign a rating to each technical factor. Use upper case letter ratings for major technical factor ratings. The addition of plus (+) or minus (-) to an adjective rating is not allowed.

Table A-1. Technical Acceptable/Unacceptable Rating Method

Adjectival Rating Description

Acceptable (A) Proposal meets the minimum requirements of the solicitation.

Unacceptable (U)

Proposal does not meet the minimum requirements of the solicitation.

The weaknesses and/or deficiencies (as defined below) of each proposal for each non-cost/price evaluation factor which influenced the assigned adjectival rating shall be identified.

Definitions Weakness A flaw in the proposal that increases the risk of unsuccessful contract performance.

Significant Weakness

A flaw that appreciably increases the risk of unsuccessful contract performance.

Deficiency A material failure of a proposal to meet a Government requirement or a combination of significant weaknesses in a proposal that increases the risk of unsuccessful contract performance to an unacceptable level.

PAST PERFORMANCE EVALUATION

Table A. Safety Factors (Combined Technical/Risk Rating Method)

Rating Definitions

Acceptable (A)

Proposal meets requirements and indicates an adequate approach and understanding of the requirements, and risk of unsuccessful performance is no worse than moderate.

Unacceptable (U)

Proposal does not meet requirements of the solicitation, and thus, contains one or more deficiencies, and/or risk of unsuccessful performance is unacceptable. Proposal is un-awardable.

Past Performance shall be evaluated when using the LPTA process, unless waived by the PCO in accordance with FAR 15.101-2(b). Past performance will be rated on an “acceptable” or “unacceptable” basis using the ratings in the following table:

Table A-2. Past Performance Evaluation Rating Method

Adjectival Rating Description

Acceptable (A) Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown. (See note below.)

Unacceptable (U) Based on the offeror’s performance record, the Government does not have reasonable expectation that the offeror will be able to successfully perform the required effort.

Note: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305(a)(2)(iv)). Therefore, the offeror shall be determined to have unknown (or “neutral”) past performance. In the context of acceptability/unacceptability a neutral rating shall be considered “acceptable.”

Aspects of Past Performance Evaluation. The past performance evaluation results is an assessment of the offeror’s probability of meeting the minimum past performance solicitation requirements. This assessment is based on the offeror’s record of relevant and recent past performance information that pertain to the products and/or services outlined in the solicitation requirements. There are two aspects of the past performance evaluation:

a. The first is to evaluate whether the offeror’s present/past performance is relevant or not relevant to the effort to be acquired. The criteria to establish what is relevant is unique to each LPTA source selection. For this solicitation, a relevant project is further defined as projects or task orders that are at least 50% completed by the offeror within the last five (5) years prior to the solicitation original issue date. At least one (1) of the relevant projects submitted must have a total award value of $500,000 or more (at the date of contract award), and the reminder of the relevant projects submitted must have a total award value of $200,000 or more (at the date of contract award). The projects submitted must show the offeror’s experience in construction relating to the solicitation scope of work and as defined in NAICS of 237130 – Power and Communication Line and Related Structures Construction.

b. The second aspect of the past performance evaluation is to determine how well the contractor performed on the contracts. The past performance evaluation performed in support of a current source selection does not establish, create, or change the existing record and history of the offeror’s past performance on past contracts; rather, the past performance evaluation process gathers information from customers on how well the offeror performed those past contracts.

SSEB members will review past performance information to determine the quality and usefulness as it applies to the performance confidence assessment.

EVALUATION METHODOLOGY

Evaluation Methodology.

a. Price evaluation will be initially conducted for all proposals independently by the SSEB Price Evaluator to ensure fair and reasonable pricing and price proposals will be placed in order of price (lowest price to highest price). A written evaluation documenting the outcome of the analysis of price proposals will be prepared as part of the SSEB Report and will include a narrative determination of price reasonableness/unreasonableness explaining all aspects of price proposals supporting the determination.

b. Members of the SSEB will evaluate proposals in accordance with the criteria of acceptability set forth in the solicitation.

c. The Government will evaluate the non-price factors of the lowest priced proposal in accordance with the criteria of acceptability set forth in the solicitation. However, the Government, at its sole discretion, reserves the right to increase the number of proposal(s) it will review under this methodology. If the lowest priced proposal is technically acceptable, and if the price is determined to be reasonable in the price evaluation, the Government will make an award to the offeror with the lowest price. If the lowest price proposal is determined by the Government to be technically unacceptable and therefore, ineligible for award, the next lowest priced proposal will be evaluated in the order of lowest price to highest price until the Government has determined the LPTA best value proposal in accordance with the source selection criteria as outlined in the solicitation, is eligible for award. Accordingly, under this methodology, the non-cost/price factors of some proposals may not be evaluated by the Government. If discussions are deemed necessary by the Contracting Officer, all proposals will be evaluated (both non-cost/price and price factors) for the purpose of establishing a competitive range. In addition, if the Contracting Officer determines that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition.

d. The Government intends to award this procurement without discussions. However, the Government reserves the right to open discussions if the Government deems it to be in the best interest of the Government.

e. Upon conclusion of the SSEB proposal evaluation process, the SSEB will present its findings and documentation to the SSA for consideration.

According to FAR 15.304, the evaluation factors that apply to this acquisition are a part of this SP and are evaluated individually. The applicable evaluation f n requirements that establish the requirements of acceptability are identified below.

EVALUATION FACTORS FOR AWARD

The solicitation requires the evaluation of price and the following non-cost/price factors:

a. Factor 1 – Recent, Relevant Experience of Firm

b. Factor 2 – Management Approach

c. Factor 3 – Safety

d. Factor 4 – Past Performance

The distinction between recent, relevant experience of firm and past performance is recent, relevant experience of firm pertains to the types of work and volume of work completed by a contractor that are comparable to the types of work covered by this requirement, in terms of size, scope, and complexity. Past performance pertains to both the relevance of recent efforts and how well a contractor has performed on the contracts.

Basis of Evaluation and Submittal Requirements for Each Factor.

(2) Basis of Evaluation: The Government will evaluate price based on the total price for the basic contract. Total price consists of the basic requirements and all option items for the basic contract. The Government intends to evaluate all options and has included the provision FAR 52.217-5, Evaluation of Options (JUL 1990) in Section M of the solicitation. In accordance with FAR 52.217-5, Evaluation of Options will not obligate the Government to exercise the option(s). Analysis will be performed utilizing one (1) or more of the following techniques to ensure a fair and reasonable price:

i. Comparison of proposed prices received in response to the RFP.

ii. Comparison of proposed prices with the IGCE.

iii. Comparison of proposed prices with available historical information.

iv. Comparison of market survey results.

A price that is found to be unreasonably high in relation to the proposed work may result in the overall proposal being considered unacceptable. The burden of proof of price reasonableness rests solely with the offeror.

All proposed unit prices may be evaluated for unbalanced pricing in accordance with FAR 15.404- 1(g). Unbalanced pricing exists when, despite an acceptable total price, the price of one or more ELINs appear to be significantly overstated or understated as indicated by the application of price analysis techniques. An Offeror’s proposal may be rejected if the Contracting Officer determines the lack of balance poses an unacceptable risk to the Government in accordance with FAR 15.404-1(g)(3).

b. Technical/Non-Cost/Price Factors:

(1) RFP Submittal Requirements: Submit an original electronic Technical Proposal with all documents provided in Microsoft Word. The Technical proposal shall be submitted separately from the Price proposal and clearly marked “Technical Proposal.” The Technical Proposal shall address each evaluation factor in accordance with the criteria shown below under Factors 1 through 4. Provide a separate file within the Technical Proposal document for each factor shown below:

i. Factor 1 – Recent, Relevant Experience of Firm

ii. Factor 2 – Management Approach

iii. Factor 3 – Safety

iv. Factor 4 – Past Performance

Failure to acknowledge any "material" amendments to the solicitation may cause an offeror's proposal to be rejected as unacceptable.

i. Factor 1 - Recent, Relevant Experience of Firm:

Solicitation Submittal Requirements: The offeror shall provide the following for evaluation of the Technical Proposal on Exhibit B for each project. The attached offeror Recent, Relevant Experience of Firm Project Data Sheets, Exhibit B, is MANDATORY and SHALL be used to submit project information. The Government will not consider information submitted in addition to this form. Individual blocks on this form may be expanded; however, total page limit for each project data sheet shall not exceed three single-sided pages.

NOTE: Projects submitted under Factor 1 - Recent, Relevant Experience of the Firm must be the same projects submitted for Factor 4 - Past Performance on Recent, Relevant Projects.

Submit a minimum of three (3) and a maximum of four (4) relevant projects performed by the offeror as the Prime Contractor that best describes the offeror’s experience on projects that are similar in size, scope, and complexity to the projects that may be ordered under the solicited contract.

Project experience is defined as a project performed under a single contract or task order. For multiple award contracts and IDIQ type contracts, the contract as a whole shall not be submitted as a project; rather the offeror shall submit the work performed under a task order project.

For the purposes of this evaluation, a relevant project is further defined as follows:

o A government or commercial contract, project or task order o that was at least 51% self-performed by the offeror as the prime Contractor. “Self- performed” is defined as the Offeror who performs relevant work that is the same or similar in size, scope and complexity of the work requirements in the solicitation, by in-house workforce and not by sub-contractor(s). This does not include administrative or management functions;

o At least 50% complete within the last five (5) years prior to the original solicitation issuance date;

o At least one (1) of the relevant projects submitted must have a total award value of $500,000 or more (at the date of contract award), and the reminder of the relevant projects submitted must have a total award value of $200,000 or more (at the date of contract award). The projects submitted must show the offeror’s experience in construction relating to the solicitation scope of work and as defined in NAICS of 237130 – Power and Communication Line and Related Structures Construction.

o Demonstrates experience, at a minimum, as described below:

The contractor shall explain its ability to perform live outside plant campus cutovers on facilities providing 5,000 or more active voice and data circuits from a central office, area distribution node, or telecommunications hub. The contractor shall explain their work performance and project completion by describing the sequence of events, the location of the technicians and required to transition 5,000 active voice and data circuits from one central office to another without significant down time.

The contractor must have licensing effective and active, on or before the date of original solicitation issuance date, and must include a C-7 Low Voltage Systems Contractors License, Building Industry Consulting Services International (BICSI) Registered Communications Distribution Designer (RCDD), and BISCI RCDD Outside Plant Designer (OSP) Specialist Certification.

The Government will not consider any project submitted for experience that was performed by a firm other than the offeror, except if the offeror is a Joint Venture (JV), relevant project experience should be submitted for projects completed by the JV entity. If the JV does not have shared experience, relevant projects shall be submitted for each JV member. Offerors are still limited to a total of four (4) projects;

The Government will consider otherwise relevant projects that were performed by the offeror’s proposed key personnel; however, experience of proposed subcontractor employees, key or otherwise, will not be considered; and, The Government will consider otherwise relevant projects performed by parent or subsidiary companies, predecessor companies, or satellite offices (i.e. any office(s) of the offeror other than the one submitting the current proposal) of the offeror, provided the offeror’s proposal clearly explains how the offered experience will be effectively utilized in the performance of the solicited contract. Notwithstanding any of the foregoing, if it is unclear how experience gained under a particular project will be utilized in or benefit the performance of the proposed contract, that project experience may not be considered in the evaluation. The Government will not consider the experience of proposed subcontractors.

Exhibit B, Offeror Recent, Relevant Experience of Firm Project Data Sheets submitted that exceed the maximum, three (3) single-sided 8.5” x 11” page limit will be removed prior to evaluation. Project Data Sheets submitted that exceed the maximum four (4) projects allowed for consideration will be removed prior to evaluation. Exhibit B, Project Data Sheets submitted for entire multiple award contracts and/or Indefinite Delivery/Indefinite Quantity (IDIQ) type contracts as a whole will be removed prior to evaluation. Exhibit B, Project Data Sheets submitted for projects that are not at least 50% complete within five (5) years prior to the solicitation issuance date will be removed prior to evaluation.

Exhibit B, Project Data Sheets submitted for evaluation that are not for services similar to the services described in the solicitation technical annexes and sub-annexes in paragraph three (3) above will be removed prior to evaluation.

Basis of Evaluation: The basis of evaluation will include the offeror’s demonstrated experience and depth of experience in performing relevant projects as defined in the solicitation submittal requirements. The assessment of the offeror’s relevant experience will be used as a means of evaluating the ability of the offeror to successfully meet the requirements of the solicitation.

The offer may be rated “Acceptable” for this factor if the offeror submits a minimum of three

(3) and a maximum of four (4) relevant projects that all comply with the following:

Are at least 51% self-performed as the Prime Contractor in terms of the cost of contract performance;
