The purpose of this amendment is to formally respond to received Request for Information (RFI) from industry; the RFI period has now closed for the Solicitation. As a result of review ing and answ ering questions, the Government has opted to make small changes to Section C (PWS) and Section J (Attachments) of the Solicitation. Additionally, due to regulatory updates, the Solicitation is updated at Section I (Clauses) and Section K (Representations) for compliance. The delivery date for proposals has not changed as a result of this amendment.

AMENDMENT 0001
1. The following Request for Information (RFI) have been received, evaluated, and responses provided:
a. Given the resurgence of COVID-19 (Delta Variance) and many companies either restricting employees from working in the office or allowing them to work from home to mitigate the spread of the virus, will the Government consider allowing electronic proposal delivery to eliminate the need to work in close quarters to physically produce a printed proposal? (Section L) The Contractor shall submit digital and hard copies as specified in the RFP. The Government appreciates the Offerors’ commitment to safety during the continuing pandemic conditions. The Government does reiterate the request of four copies of proposal data in Compact Disc format, to accompany one original and four binder copies of double-sided paper.
b. The RFP references a 2-page limit for the Technical Approach to Safety. Please confirm that the (A. Dart Rate) and (B. TCR Rate) requirements are exempt from the page limit.
Calculations and/or supporting documentation of the DART and/or TCR Rate are exempt from the two page limit for Safety Narrative. However, any Safety Narrative beyond the two-page limit is not allowed for evaluation. The DART and TCR Rates submitted by the offeror should have supporting documentation of the calculations submitted.
c. Please confirm that offerors can adjust the format and spacing of the Attachment C Project Data Sheet as long as the content remains the same.
The content of Attachment C must remain unchanged. Offerors may re-create the Attachment contents, for the ease and benefit of making a proposal, but the Offeror must remain diligent to maintain all the categories and content of the original attachment to meet the Government’s Instructions (Section L).
d. The Attachment C – Project Data Sheet includes two (#10s). Should the required Data Sheet Items be renumbered? (Section L, Factor 1) The intent of having “Procuring Organization” numbered this way was to make clear that all names listed are from the same procuring agency or firm. Please do not re-number the Attachment C; thank you for your understanding.
e. Should the Attachment 1 reference within the file be changed to Attachment C to match the file name and other Attachment C references throughout the RFP? (Section L, Factor 1) This is a typographical error: “Attachment 1” should be “Attachment C” in the document title. This discrepancy will not affect evaluation of an Offeror in any way.
f. The Attachment C – Project Data Sheet contains all elements listed in the RFP on page 148 under the heading, “Project Data Sheets shall contain the following information:”, with the exception of (Contract Role). Please advise whether (Contract Role) should be a numbered item within Attachment C. And if not, where within the Project Data Sheet should Offerors include that information? (Section L, Factor 1) The Offeror should make clear their “Contract Role” within the “Description of Work Performed” (e.g.
“subcontractor”, “consultant”). The Government has opted to leave the Attachment C unchanged for use by Offerors.
g. Please confirm that if included in the front matter of both proposal volumes that Acronym Lists, Title Pages, and Lists of Figures will not count against stated page limits. (Section L, Factor 1) All pages count against the page limit, unless specifically indicated otherwise in the Solicitation.
h. Please confirm that Offerors can adjust the format and spacing of Attachment D and Attachment E Small Business Forms as long as the content remains the same. (Section L, Factor 3) The content of Attachments D/E must remain unchanged. Offerors may re-create the Attachment contents, for the ease and benefit of making a submittal, but the Offeror must remain diligent to maintain all the categories and content of the original.
i. Would the Government consider removing the page restrictions for responses to Provision 252.217-7026 in order to allow complete responses for Identification of Sources of Supply? (Section L, Factor 2) The page restrictions must stay in place, thank you for your understanding.
j. Please confirm that the reference to Provision 252.217-7024 on page 146 should be 252.237-7024 to match the references on page 149 and 150. ((Section L, Factor 2) Yes, there is a typo on Page 146. Section L requests the Offeror submit documentation for DFARS Clauses 252.217-7026 & 252.237-7024 for Factor 2 evaluation.
k. The RFP states: “The originals shall be clearly identified as the “ORIGINAL”, and bear the original signature(s) of the offeror.” Please confirm that electronic signatures are acceptable. (Section L) Electronic signatures are acceptable, so long as they meet the standards of SECNAV Instruction 5239.24 dated 22 Jul 2019 (e.g. Item #5c), which is the same eSignature standard used by the US Navy & Marine Corps. Offerors should assume all proposal documents may be printed by the Government for official use.
l. The RFP states: “Corporate Experience of the Offeror shall be limited to a total of 10 pages …” Based on the RFP, Corporate Experience includes both the Project Data Sheets and the Key Personnel Qualifications Sheets. Please confirm that the 10-page limit applies only to the Project Data Sheets.
(Section L, Factor 1) Factor 1 of Section L is split into two separate but equal parts. The Offeror shall submit experience projects on the Attachment C provided with the RFP, not to exceed 10 pages total. Additionally, the Offeror shall submit Key Personnel Qualifications Sheets, but no more than two pages per individual and containing the minimum information at Section L (Page 149 of 155).
m. The instructions for the organizational chart state: “Individuals shall clearly display their employer.”
Please clarify “individuals.” Does this refer only to the named key personnel or to all labor categories?
(Section L, Factor 2) Key Personnel must have employer identified on the org chart. Personnel identified by name must also have the employer identified on the org chart. Key subcontractors should be also indicated on the org chart (unless impracticable, and explained in the Factor 2 narrative).
n. The RFP does not include a Government Furnished Facilities (GFF) table. Will the Government provide a list of GFF? (Section J) GFF are included in Government Furnished Property (GFP) tables.
o. Please confirm that maintenance of the following GFF items are outside of the contractor’s scope: roofs, gutters, doors, windows, awnings, interior and exterior lighting, interior and exterior wall painting, flooring outside secondary containments, parking lot and drive way striping, exterior wall and gate maintenance, pest control, fire suppression equipment and alarms, exit lights, toilets, and showers. (Section C, Annex 0200000, Spec Item 2.4.1) Yes, the maintenance listed in the RFI Question is not included in the maintenance of GFF intended in the PWS for Contractor occupation and daily use. Any maintenance on a listed asset (Section J) needed for meeting of the Performance Objectives of the PWS is to be done by the Contractor, at least up to the minor-repair threshold (e.g. IMP, PM Programs).
p. Will GFF that is damaged by pests be repaired or replaced by the Government / at the Government’s cost?
(Section C, Annex 0200000, Spec Item 2.4.1) Yes.
q. Please confirm that maintenance of the coatings in the secondary containments of the HW Facilities is outside of the contractor’s scope. (Section C, Annex 1800000, Spec Item 3.1.1) Maintenance of the coatings in the secondary containments of the HW Facilities to meet regulatory compliance is the responsibility of the contractor.
r. Does this Liability Limit apply to both PM and IMP? (Section C, Annex 1604000, Spec Item 2.3.3) Yes, the liability limit applies to both.
s. The RFP states: “If the Government-provided storage tanks or facilities are out of service for maintenance or for other reasons the Contractor must provide alternate means or storage tanks to ensure that service is uninterrupted to the customers.” Will the cost of alternate means or storage tanks be included in the $10,000 liability limit? (Section C, Annex 1604000, Spec Item 3.1.2) Yes, any cost incurred by the contractor that is associated with a repair is included in in the $10,000 liability limit. This includes costs incurred by the contractor that are associated with providing an alternate means of storage for the duration of a repair.
t. The RFP states: “IW/OW facilities shall be operated in accordance with the hours given in Attachment J-1604000-07.” This table does not align with the hours of operations shown on J-1800000-04 regarding NBC Amphibious Base. Please clarify the hours of operation for the Oily Waste Treatment Plant at NAB.
(Section J, Attachment J-1604000-07) Hours of operation for IW/OW facilities have been removed from J-1800000-04, and a note has been added to J-1604000-07 to clarify NAB hours of operation. Updated (Section) J Attachments have been uploaded to SAM.gov, marked with “Amendment 0001”.
u. Is there an upper limit to the volume of a spill that the contractor is responsible for? Is there a liability limit associated with spill cleanup? (Section C, Annex 1800000, Spec Item 3.2) No upper limit to the volume. Spill response is limited to spills that can be cleaned up without use of heavy or specialized equipment such as vac trucks.
v. Please confirm Normal Working Hours for Naval Base Point Loma IW/OW are 0730-1600 M-F as no other days are noted. (Section J, Attachment J-1800000-04) Hours of operation for IW/OW facilities have been removed from J-1800000-04, as unnecessary. Updated (Section) J Attachments have been uploaded to SAM.gov, marked with “Amendment 0001”.
w. Please confirm Normal Working Hours for Naval Amphibious Base IW/OW are 0730-1600 M-F as no other days are noted. Is it the Government’s intention that this facility be staffed during these hours?
(Section J, Attachment J-1800000-04) Hours of operation for IW/OW facilities have been removed from J-1800000-04, and a note has been added to J-1604000-07 to clarify NAB hours of operation. Updated (Section) J Attachments have been uploaded to SAM.gov, marked with “Amendment 0001”.
x. DBIDS is an optional alternative for contractor employees that are ineligible for a CAC. Please confirm that all employees requiring access to Government systems must obtain a CAC card (2.8.9). (Section C, Annex 0200000, Spec Item 2.4.5.2) Yes, all employees requiring access to Government IT/OT/FRCS and/or NMCI systems must obtain and maintain a CAC for the required access.
y. The RFP states: “The Contractor shall establish and maintain a secure website for posting an electronic copy of all deliverables listed in Section F.” Please define what constitutes an acceptable secure website.
(Section C, Annex 0200000, Spec Item 2.6.5) The Government has opted to update this Spec Item of Annex 0200000; details are within this Amendment to the Solicitation. In summary, the Contractor shall be required to post electronic copies of all deliverables to the Navy’s Network shared drive folder that will be provided by the Navy upon contract award.
z. The RFP states: “The Contractor shall provide all required data for NAVFAC MAXIMO as identified below: … The Contractor shall provide data using the method detailed below … DIRECT ENTRY: The Contractor shall manually enter required work order and asset data directly into NAVFAC MAXIMO.
NAVFAC MAXIMO System Access Procedures are provided in J-0200000-05. The Contractor shall ensure all information is updated by the end of each workday for all work performed.” Will the Contractor be required to generate reports out of Navy MAXIMO for maintenance performed? Will the Government provide a template for those reports? (Section C, Annex 0200000, Spec Item 2.6.8) Yes, the contractor will be required to generate reports out of Navy MAXIMO for maintenance performed.
The Government will provide an example / template when reports are requested during contract performance.
aa. Please clarify if all Contractor employees are required to obtain both a DBIDS and CAC card. (Section C, Annex 0200000) Only a CAC or DBIDS is required for Installation access, not both. However, some employees may need CAC for access to Government IT/OT/FRCS systems; refer to Annex 0200000, Spec Item 2.8.9 for details on CAC-required systems.
bb. The RFP states: “The small business participation and commitment strategy must be in agreement with any required small business subcontracting plan and will be made a part of the contract upon award.” Please confirm that a Small Business Subcontracting Plan is not required as part of the proposal submission.
(Section L, Factor 3) Please refer to RFP Clause 52.219-9 for terms of FAR Subpart 19.7 compliance. The Offeror is expected to submit a Small Business Subcontracting Plan with initial proposals as provided for in FAR §§ 19.705-2(d).
cc. Attachment B states: “IDIQ Indirect Rate (%) This additive rate will be applied to Direct Labor and Direct Materials. Instruction to Offerors: please utilize percentage to two decimal places. Offerors with accounting systems that have segmentation of Overhead and G&A costs shall offer one percentage rate for coverage of orders.” It appears from this statement that a single rate incorporating both OH and G&A should be applied to Labor and Materials costs. Please advise whether this interpretation of the statement is correct. (Section L, Attachment B [i.e. J-0200000-07]) For the convenience of future ordering, the Government is requesting for all indirect cost rates to be consolidated into a single rate. The IDIQ Indirect Rate should not affect ELIN pricing for the recurring work of either Annex 1604000 or Annex 1800000.
dd. The RFP [Annex 0200000] Spec Item 2.4.5.6 states: “Contractor shall make reasonable arrangements for janitorial services, recyclables, and bins for non-hazardous waste.” This appears to conflict with [Annex 0200000] Spec Item 2.4.5.5. Please confirm that the contractor is to provide bins for recyclables such as the cardboard bins and scrap metal bins. (Section C, Annex 0200000, Spec Items 2.4.5.5 & 2.4.5.6) The Government provides the facilities with dumpster bins for non-hazardous trash, recyclables, and scrap metal bins. The Contractor shall be responsible for all other janitorial services.
ee. The RFP states that Offerors are to “Provide a list of office locations for the Prime/Offeror and any Joint Venture Member (if applicable) and or Subcontractors (if applicable).” Would the Government consider changing this requirement to list of local California offices? Or, alternatively, exempting this requirement from the page limitation? A complete list could take up a significant portion of the five pages allowed, and potentially put larger firms at a disadvantage in completely responding to the Factor requirements.
(Section L, Factor 2) The Government intends to receive a list of offices that are planned for direct support of an awarded contract by the Contractor and Subcontractors. The Offeror is not required to provide an exhaustive list of office locations worldwide.
ff. Will the Government provide a list of required deliverables? (Section F) Please refer to Annex 0200000, Spec Item 2.6.5, for instructions on Contract Deliverables.
[Informational Note: deliverables for IDIQ Orders will depend on unique details of the Orders, which the Government does not have available at this time.]
gg. The RFP states: “Current regulations require accumulated rainwater to be removed within 24 hours after a rain event. The contractor shall ensure that all berms and secondary containments related to the IW/OW facilities comply with the current regulatory requirements. On the piers, at certain installations, there are different agreements in place with various Navy departments regarding a revolving schedule.” Would the Government please clarify the number and types of berms and containments, as well as the different agreements in place with various Navy departments? (Section 1604000, Spec Item 3.1.1) Annex 1604000, Spec Item 3.1.1, has been revised herein as a result of reviews of this question.
hh. Does the Navy have any major projects programmed for system upgrades (pipeline, pumps, lift stations, leak detection, etc)?
The Navy has no information available to release about this question. The information in Section J about facilities and assets is what Offerors should propose upon.
ii. Will the Government provide textiles (rags or shop towels) to issue to NAVFAC SW customers that request them? (Section C, Annex 0200000, Spec Item 2.4.3) Please reference J-1800000-10, Container Purchase Historical Data.
jj. The RFP on page 76 states: “The contractor shall prepare and sign documents associated with the management of Hazardous and Non-Hazardous Waste under this contract.” This appears to conflict with page 79, which states “The contractor is not obligated to sign Non Hazardous Waste Manifests…” Please clarify. (Section C, Annex 1800000, Spec Item 3.1) The contractor is not obligated to sign Non Hazardous Waste Manifests.
2. Section C, at Annex 0200000, Spec Item 2.6.5, Related Information, is hereby updated as follows:
“…Current regulations require accumulated rainwater to be removed within 24 hours after a rain event. The contractor shall ensure that all berms and secondary containments related to the IW/OW facilities comply with the current regulatory requirements by utilizing all resources at their disposal. Available resources should include scheduling services on the DLA Bulk Pumping contract, and/or utilizing contractor’s in-house labor and vacuum trailers. On the piers, at certain installations, there are different agreements in place with various Navy departments regarding a revolving schedule. Historically, approximately 30 training classes are provided annually to ship and shore activities, although actual numbers may vary.”
3. Section C, at Annex 1604000, Spec Item 3.1.1, Related Information, is hereby updated as follows:
“…Government acceptance of deliverables will not relieve the Contractor of the responsibility for any error or omission which may exist in the deliverable, as the Contractor is responsible for all requirements of this contract. The Contractor shall post an electronic copy of all deliverables listed in Section F to the Navy’s Network shared drive folder. The Government will provide access and location the shared drive folder upon contract award. The Contractor’s personnel responsible for posting deliverables will require a CAC and NCMI (Navy Marine Corps Intranet) account for Government system access. The Contractor shall establish and maintain a secure website for posting an electronic copy of all deliverables listed in Section F. The Contractor shall allow only authorized Government and Contractor personnel to access the website. Government personnel access shall be limited to viewing and downloading of deliverables, but restricted from posting to the website.
The Contractor shall notify the Government by email whenever there are new or updated deliverables posted to the website shared drive. Each deliverable posting on the website shared drive and each email notification shall include the title of the deliverable, the spec item requiring the deliverable, and the date and time the deliverable was posted. All deliverables shall be available to authorized Government personnel 24 hours/day and 365 days/ year for the duration of the contract.”
4. Section J is updated by this amendment, as a result of answers to RFI. The Amendment’s update to Section J Attachments are related to questions and clarifications regarding Hours of Operation.
5. The following changes are made to Section I in accordance with updates to the Federal Acquisition Regulation:

a. Clause 52.219-9 Alt. II (Small Business Subcontracting Plan) is updated to the September 2021 version, and incorporated by reference.
b. Clause 52.219-16 (Liquidated Damages – Subcontracting Plan) is updated to the September 2021 version, and incorporated by reference.
c. Clause 52.219-28 (Post-Award Small Business Program Representation) is updated to the September 2021 version, and incorporated by reference.
d. Clause 52.245-1 (Government Property) is updated to the September 2021 version, and incorporated by reference.
6. The following Solicitation changes are made to Section K in accordance with updates to the Federal Acquisition Regulation: (previous provision versions are replaced in their entirety, and refer to 52.252-2 for full text details)
a. Provision 52.204-8 (Annual Representations And Certificatiosn) is updated to the September 2021 version, and incorporated by full text within this Amendment to Section K (see below).
b. Provision 52.219-4 (Deviation 2020-O0008, Notice of Price Evaluation Preference for HUBZone Small
Business Concerns) is updated to the September 2021 version, and incorporated by reference rather than full text in Section K.
7. Unless addressed herein this amendment with changes, all other terms and conditions of the Solicitation remain the same. The due date for Offeror Proposals remains fixed at September 28, 2021, per SF33 instructions.

252.225-7050 DISCLOSURE OF OWNERSHIP OR CONTROL BY THE GOVERNMENT OF A COUNTRY
THAT IS A STATE SPONSOR OF TERRORISM (DEVIATION 2021-O0006) (JUNE 2021)
(a) Definitions. As used in this provision— “Government of a country that is a state sponsor of terrorism” includes the state and the government of a country that is a state sponsor of terrorism, as well as any political subdivision, agency, or instrumentality thereof.
“Significant interest” means—
(i) Ownership of or beneficial interest in 5 percent or more of the firm’s or subsidiary’s securities. Beneficial interest includes holding 5 percent or more of any class of the firm’s securities in “nominee shares,” “street names,” or some other method of holding securities that does not disclose the beneficial owner;
(ii) Holding a management position in the firm, such as a director or officer;
(iii) Ability to control or influence the election, appointment, or tenure ofdirectors or officers in the firm;
(iv) Ownership of 10 percent or more of the assets of a firm such as equipment, buildings, real estate, or other tangible assets of the firm; or
(v) Holding 50 percent or more of the indebtedness of a firm.
“State sponsor of terrorism” means a country determined by the Secretary of State, under section 1754(c)(1)(A)(i) of the Export Control Reform Act of 2018 (Title XVII, Subtitle B, of the National Defense Authorization Act for Fiscal Year 2019, Pub. L. 115- 232), to be a country the government of which has repeatedly provided support for acts of international terrorism. As of the date of this provision, state sponsors of terrorism include: Iran, North Korea, and Syria.
(b) Prohibition on award. In accordance with 10 U.S.C. 2327, unless a waiver is granted by the Secretary of Defense, no contract may be awarded to a firm if the government of a country that is a state sponsor of terrorism owns or controls a significant interest in—
(1) The firm;
(2) A subsidiary of the firm; or
(3) Any other firm that owns or controls the firm.
(c) Representation. Unless the Offeror submits with its offer the disclosure required in paragraph (d) of this provision, the Offeror represents, by submission of its offer, that the government of a country that is a state sponsor of terrorism does not own or control a significant interest in—
(1) The Offeror;
(2) A subsidiary of the Offeror; or
(3) Any other firm that owns or controls the Offeror.
(d) Disclosure.
(1) The Offeror shall disclose in an attachment to its offer if the government of a country that is a state sponsor of terrorism owns or controls a significant interest in the Offeror; a subsidiary of the Offeror; or any other firm that owns or controls the Offeror.
(2) The disclosure shall include—
(i) Identification of each government holding a significant interest; and
(ii) A description of the significant interest held by each government. (End of provision)

Annual Representations and Certifications
(a) (1) The North American Industry Classification System (NAICS) code for this acquisition is 562211.
(2) The small business size standard is $41.5 Million.
(3) The small business size standard for a concern that submits an offer, other than on a construction or service acquisition, but proposes to furnish an end item that it did not itself manufacture, process, or produce is 500 employees if the acquisition—
(i)Is set aside for small business and has a value above the simplified acquisition threshold;
