DEFINITIONS

Term Definition

Accident Prevention Plan (APP)

A document prepared by the Contractor to explain how the Contractor will safely deliver best value services to the Government without any accidents or mishaps. Topics covered under this plan are delineated from the most recent version of the United States Army Corps of Engineers (USACE) Safety and Health Requirements Manual EM-385-1-1. The plan shall fully comply with the requirements and address the topics as detailed in EM-385- 1-1, and Spec Item 2.9.1 of this Annex 0200000.

Authorized Customer Any Command or activity that has obligated funds of sufficient amount to cover the cost of performance of services requested. Used interchangeably with the term Customer or Client.

Calibration The set of operations which establish, under specified conditions, the relationship between values indicated by a measuring instrument or measuring system, or values represented by a material measure, and the corresponding known values of a measurement.

Certify To affirm to be true or genuine specifically to authenticate by signing.

Compile To compose out of materials from other documents.

Confined Space Plan A written document developed and delivered by the Contractor to explain how its service employees will have safe access to a confined work space. The plan shall: (1) identify the competent person’s name, qualifications, training, and experiences; (2) delineate the competent person’s authority to direct work and stoppages in adverse conditions; (3) set forth air quality and ventilation system requirements; (4) include procedures to rescue contractor/subcontractor/vendor personnel in distress; and (5) provide for coordination with emergency responders. See relevant requirements in EM-385-1-1 and any other applicable law.

Confined Work Space A space that is large enough and so configured that a person may bodily enter a space (such as in tanks, vessels, silos, storage bins, hoppers, vaults, pits, and like spaces where there is limited means of entry) and is hindered or restricted from escaping during an emergency.

Contingency Plan A document describing actions to be taken during a contingent event.

Contingent Event A sudden pressing, and unforeseen occurrence in which life, health, property, or the environment are in immediate danger and require immediate action; e.g., an aircraft accident, natural disaster, explosion, or fire.

Contract A mutually binding legal relationship obligating the seller to furnish supplies or services, including construction, and the buyer to pay for them.

Contracting Officer

(KO)

The individual with the authority to enter into, administer, and/or terminate contracts and make related determinations and findings.

Contract Specialist

(CS)

The individual specialized in contracting, that performs pre-award functions of the proposed contract and performs day to day contract administration functions.

DEFINITIONS

Term Definition

Contracting Officer Representative (COR)

A designated Government representative authorized by the KO in writing to perform specified day-to-day oversight of contract administrative functions. When appointed, a COR has no authority to affect contractual term changes; that authority rests solely with the KO. The COR also serves as the Technical Representative performing Technical functions that include providing technical direction, inspecting, testing, approving samples, and other functions of a technical or administrative nature not involving a change in the scope, price, terms or conditions of the Contract or task/delivery order.

Contractor That entity or its representative responsible for the delivery of the services or materials specified in this contract, as designated by contract award. The term Contractor as used herein refers to both the prime Contractor and any subcontractors. The prime Contractor shall ensure that subcontractors comply with the provisions of this contract.

Contractor Safety Program

A program developed, implemented, and controlled by the Contractor as it plans, staffs, performs, and controls all safety practices while delivering best value services to the Government. Contractor’s safety practices shall comply with all safety standards identified in the USACE Safety and Health Requirements Manual, EM-385-1-1 and Public Law 91- 596, Occupational Safety and Health Act.

Customer Used interchangeably with Authorized Customer.

Corrective Maintenance

Maintenance required preventing further deterioration and providing restoration of GFP to such condition that it may be effectively used for its intended purpose. Corrective maintenance also includes work done to prevent damage that would be more costly to restore than to prevent.

Demilitarization

(DEMIL)

The act of destroying the military offensive or defensive advantages inherent in certain types of equipment or material.

Designated Government Representative (DGR)

The Designated Government Representative is a government employee who has cognizance, responsibility or authority over a process, procedure, or physical area. An acquisition DGR may be the KO, Contract Specialist, Project Manager, Contracting Officer Representative. Other non-acquisition DGRs include members of the Federal Fire Department, Command Duty Officer, Security Force, and Installation Environmental Office when acting in job-related assigned capacity. Some typical DGR duties include the following:

performance monitoring;

reviewing performance reports;

witnessing, testing, or certifying actions performed in accordance with requirements;

ordering, inspecting, accepting, and rejecting services, material, or equipment;

reviewing and approving requests;

performing liaising between operations and contracting office;

ensuring operations occur within the scope of rules, regulations, policy, and limitations of authority; and directing actions to ensure compliance with state, Federal, local statutes and regulations, and DOD policy.

Term Definition

Direct Material Costs The actual vendor invoice charges for materials used for performance of work under this contract. Direct material costs shall include transportation charges when such charges are included on the invoice by the vendor, as well as any discounts allowed for prompt payment and discounts or rebates for core value or salvage value that accrue to the Contractor. When questions arise concerning the cost of materials, material costs will be based on the lowest of quotes provided by the Contractor from at least three (3) different commercial vendors for the direct material cost. The Government retains the right to obtain additional quotes in questionable situations.

Dispose To remove from Government property to an authorized facility.

Emergency An unforeseen combination of circumstances that require immediate action, including, but not limited to, threats to the health and/or well- being of personnel, the public at large, equipment and/or facilities, the environment, or wildlife.

Environmental Concerned with the effects, impacts, and consequences on, or relating to the nature, extent, and condition of all media (soil, air, and water), flora, and fauna.

Environmental Protection Agency

(EPA)

That Federal agency delegated authority to enforce environmental laws and promulgate environmental regulations.

Equipment A tangible asset that is functionally complete for its intended purpose, durable, nonexpendable, and needed for the performance of a contract.

Facility In addition to the regulatory definition, a facility also includes buildings and structures designed and created to serve a particular function.

Facility Response Plan

(FRP)

A plan of action for facility spill scenarios (coordinated with the local ACP) which identifies notification procedures, response, and cleanup capabilities, management information, environmentally sensitive areas, natural resource protection strategies, and measures to protect human health and safety.

Federal Holidays New Year’s Day, Martin Luther King Day, Washington’s Birthday, Memorial Day, Juneteenth National Independence Day, Independence Day, Labor Day, Columbus Day, Veterans Day, Thanksgiving Day, and Christmas Day.

Fiscal Year (FY) The period of 1 October through 30 September of the following Calendar Year (CY).

Term Definition

Frequency of Service Annual (A). Services performed once during each 12-month period of the contract at intervals of 335 to 395 days.

Biennial (B). Services performed once during each 24-month period of the contract at internals of 670 to 790 days.

Biweekly (BW). Services performed 24 times during each 12-month period of the contract at intervals of 14 to 16 calendar days.

Daily (D5). Services performed once each calendar day, Monday through Friday, including holidays unless otherwise noted.

Daily (D7). Services performed once each calendar day, seven (7) days per week, including weekends and holidays.

Monthly (M). Services performed 12 times during each 12-month period of the contract at intervals of 28 to 31 calendar days.

Quarterly (Q). Services performed four (4) times during each 12-month period of the contract at intervals of 80 to 100 calendar days.

Semimonthly (SM). Services performed 24 times during each 12-month period of the contract at intervals of 14 to 16 calendar days.

Three times weekly (3W). Services performed three (3) times a week, such as Monday, Wednesday, and Friday.

Triennial (TY). Service performed once every three (3) years.

Twice weekly (2W). Services performed twice a week, such as Monday and Thursday or Tuesday and Friday.

Weekly (W). Services performed 52 times during each 12-month period of the contract at intervals of six (6) to eight (8) calendar days.

General Industrial Waste (GIW)

Liquid wastes not meeting hazardous waste thresholds but potentially not meeting limits allowing discharge to sanitary sewer without treatment (e.g., wash racks, maintenance activities, contact cooling waters).

Government-Furnished Equipment (GFE)

Equipment furnished in an as-is condition by the government at no cost to the service provider for use solely in this contract.

Government-Furnished Facilities (GFF)

Facilities furnished in an as-is condition by the government at no cost to the service provider for use solely in this contract.

Government-Furnished Materials (GFM)

Materials furnished in an as-is condition by the government at no cost to the service provider for use solely in this contract.

Government-Furnished Property (GFP)

Property furnished by the government at no cost to the service provider for use solely in this contract. GFP includes GFE, GFF and GFM.

Government-Furnished Services (GFS)

Services provided by the government at no cost to the service provider under the terms of this contract.

Term Definition

Hazard Communication Plan

A written plan developed and delivered by the Contractor to explain how it will identify hazardous substances at the service site. This plan shall address: (1) training (to include potential safety and health effects from exposure); (2) labeling of hazardous substances;

(3) maintaining an inventory listing of hazardous chemicals at the service site; and (4) location of a library of Material Safety Data Sheets (MSDS) in the office to satisfy 29 Code of Federal Regulations (CFR) 1910.1200 or 1926.59 requirements.

Hazardous Energy Control Plan (Lockout/Tagout)

A written plan developed and delivered by the Contractor to explain how it will control hazardous energy within an existing service environment. This plan shall address: (1) intended operations and procedures; (2) means to coordinate and communicate the control of hazardous energy; (3) procedural steps and responsibilities for shutting down, isolating, blocking, and securing systems to control hazardous energy; (4) steps and responsibilities for the placement, removal, and transfer of lockout and tagged out devices; (5) steps and responsibilities for placing and tagging, and moving or removing and un-tagging, protective grounds; (6) requirements for testing the system to verify the effectiveness of lockout and tag-out isolation devices; (7) courses of actions to implement during emergencies; (8) requirements when removing hazardous energy control devices must be transferred from one authorized person to another, and the name of the individuals qualified for receiving such a transfer; and (9) the means to enforce compliance with the procedures. This plan shall satisfy relevant topics of EM385-1-1, 29 CFR 1910/1926 and OPNAV 5100.23.

Hazardous Material

(HM)

Any material designated by the Department of Transportation (DOT) as posing a potential threat while being transported. Hazardous materials are listed in 49 CFR Part 172.

Hazardous Waste

(HW)

Any discarded solid waste (liquid, semi-solid, solid, or gaseous) that meets the definition of a hazardous waste by United States Environmental Protection Agency (USEPA), state authorities, or the Navy. In accordance with RCRA, a solid waste is a listed hazardous waste if it is specifically listed, or it is a characteristic hazardous waste if it exhibits the characteristics of ignitability, corrosivity, reactivity, or toxicity.

Hazardous Waste Management

Systematic control of the collection, source separation, storage, transportation, processing, treatment, recovery, and disposal of hazardous waste.

Hazardous Waste Generator

Any person, by site, whose act or process produces hazardous waste whose act first causes a hazardous waste to become subject to regulation.

Inspect Refers to actions the Contractor must take to insure compliance with applicable regulatory requirements of EPA, DOT, OSHA, State of California, local agencies, etc.

Installation 1) Initial processing and set-up of an item(s) such that it may be used for its intended purpose. Installation may also include modification to existing facilities or equipment to accommodate the item being installed.

2) A permanent military base.

Installation Environmental Program Office

The Government function on the Installation that has the authority to implement the Navy's environmental policies and decision-making regarding environmental compliance issues as well as environmental operational issues.

Installation Restoration

(IR)

The Navy program and procedures for cleaning up contaminated sites on Navy-owned properties.

Inventory Refers to counting by type, amount, or category

Term Definition

Job Order Number

(JON)

A twelve (12) digit number, established by the NAVFACSW Comptroller Department via funding documents. JONs are used to obtain services and supplies.

Maintain 1) Refers to filing documents, reports, logs and records (or however else named) that are up-to-date, safely stored to prevent deterioration, easily retrievable and readily available upon request of KO or DGR or Regulating Authority, or

2) Refers to the level of care (maintenance) that prevents or corrects (vehicle, equipment, material, or facility) unusual wear, shortened life span, poor performance, failure, or causes of out-of-control situations.

Maintenance and Repair

The preservation or restoration of a piece of equipment, system, or facility to such condition that it may be effectively used for its designated purposes. Maintenance/repair may include but is not limited to: inspection; testing; cleaning; adjustment; overhaul;

reprocessing; or replacement of constituent parts or materials that are missing or have deteriorated by action of the elements or usage, or replacement of the entire unit or system if beyond economical repair.

Material Property that may be incorporated into, attached to, or that is expected to consumed or expended in normal use. Material includes, but is not limited to, clothing, raw or processed supplies, parts, components, installed equipment, assemblies, small tools, or consumable supplies.

Navy Marine Corps Intranet (NMCI)

NMCI provides the Department of Navy (DoN) with a full range of network-based information services on a single, enterprise-wide intranet. Through NMCI, the Navy and Marine Corps gain secure, universal access to integrated voice, video and data communications. The common environment improves security across the enterprise, periodically integrates the most up-to-date commercial technologies and centralizes information technology budgeting and expenditures for the department.

Non-RCRA Hazardous Waste

Solid waste that is not EPA listed or that does not exhibit the characteristics of a hazardous waste, but that is designated as hazardous waste by the State of California.

Performance Assessment

A method used by the Government to monitor and evaluate contractor performance against a predetermined set of criteria.

Performance-Based Acquisition

A technique for structuring all aspects of an acquisition around the purpose and outcome desired as opposed to the process by which the work is to be performed.

Performance Evaluation

Performance evaluation measures a series of indicators, expressed in qualitative, quantitative, or other tangible terms, that indicate whether current performance is reasonable and cost effective. Performance measures may include workload, output-to-cost ratios, transaction ratios, error rates, consumption rates, timeliness measures, completion rates, responsiveness rates, user satisfaction rates, etc.

Performance Standard A performance standard reflects the minimum requirement for the performance of an activity. It may incorporate one or more factors, such as quality, cost, timeliness, regulatory compliance, safety, etc.

Performance Work Statement (PWS)

The document that identifies performance requirements and establishes performance standards. The PWS is the framework around which a service contract is prepared.

Polychlorinated Biphenyls (PCBs)

A member of a class of chlorinated aromatic compounds which have been determined to be hazardous to health and the environment, and are regulated under the Toxic Substances Control Act by 40 CFR 761.

Prevent Stop or hinder something from happening, especially by advance planning or action.

Preventive Maintenance

The care and servicing by personnel for the purpose of maintaining equipment and facilities in satisfactory operating condition by providing for systematic inspection, detection, and correction of incipient failures either before they occur or before they develop into major defects. This includes such services as lubrication, replacement of filters and oil, adjustments, etc. Preventive maintenance also includes replacement of parts, assemblies, or subassemblies that are easily accessible and do not require special tools or test equipment

Quality Control (QC) A method used by the Contractor to control the quality of goods and services produced.

Quality Manual A document stating the quality policy, quality system, and quality practices of an organization.

Quality System The organizational structure, responsibilities, procedures, processes, and resources for implementing Quality Management

Release Any spillage, leaking, pumping, pouring, emitting, emptying, discharging, injecting, escaping, leaching, dumping or disposing of oil or hazardous substances into the environment (air, water, or land). Includes the abandonment or discarding of barrels, containers, and other receptacles containing any hazardous substance or pollutant or contaminant.

Requirement A translation of needs into specifications for work.

Response Time The time allowed the Contractor after initial notification and/or identification of a work requirement to be physically on the premises at the work site with appropriate personnel, tools, equipment, and materials ready to perform the work required.

Responsible Party The unit, organization, or activity with primary command, control, oversight, or other direct responsibility, for the operation or equipment from which a spill or release occurs, or the area where the release occurred.

Sampling Plan Plan and procedures to conduct sampling, field testing, and laboratory analysis for a well-defined testing objective.

Schedule A procedural plan that indicates the time and sequence of each operation to satisfy customer needs

Segregate 1) Placing as assigned by permit or regulation in an area that prevents reactions due to incompatibilities or cross-contamination during transport or storage of hazardous materials or wastes, or

2) To separate recyclable materials from non-recyclable materials

Service Call A request for action, usually in the form of some type of labor or effort, from the Customer to the Contractor.

Term Definition

Surveillance Inspections or surveys, either before or after work or service, made by the service provider, contracting officer, or designated government representative. Surveillance is used to determine factors such as quality, customer satisfaction, and timeliness of work or service.

Transport Refers to all actions in the movement of items such as equipment, materials, or wastes, and includes coordination, loading, segregating, storing, transporting, and off-loading.

Treatment, Storage and Disposal Facility

(TSDF)

Facilities that are permitted by RCRA regulations to provide treatment, storage and disposal services for hazardous wastes.

Validate/Validation To support or corroborate on an authoritative basis by testing, confirming and certifying results. Confirmation by examination, and the provision of objective evidence that the particular requirements for a specific intended use are fulfilled.

Waste Analysis Plan

(WAP)

A WAP serves to standardize and optimize the required testing of wastes so that all wastes at a site are properly characterized prior to disposal in a simple and efficient manner. A waste analysis plan establishes the characterization frequency and analytical requirements to be satisfied for waste at the installation and provides guidance for handling new wastes.
