N62470-17-R-6016 GLOBAL CONTINGENCY CONSTRUCTION CONTRACT, NAVFAC
ATLANTIC
AMENDMENT 0001
QUESTIONS AND ANSWERS
Question 1. Who are the incumbents on this contract?
Answer: The incumbents are:
N62470-13-D-6019: CH2M Hill Constructors, Inc.
N62470-13-D-6020: Environmental Chemical Corporation N62470-13-D-6021: Kellogg Brown & Root Services, Inc.
N62470-13-D-6022: URS Group, Inc.
Question 2. The RFP identifies several items that are excluded from the page count; however there are several other items that will be extremely difficult to fit within the page count if not excluded in Factor 4 Small Business Utilization. Would NAVFAC please consider specifically identifying the items in Factor 4 that are in the page count or at least exclude the following items that could take up a considerable number of pages:
* The ISRs
* Actual SB Plan required by Large Businesses only (Attachment LJ.11)
* Performance Recognition Documents
Answer: This amendment deletes the sentence on page 116 of the solicitation, in paragraph “Volume 1: Non-Cost (Technical Factors and Past Performance) which states:
Note that letters of commitment and Joint Venture/teaming/partnership agreements, resumes, CPAR evaluations, and past performance questionnaires are not applied against the overall page limit.
And replaces it with:
“Note that letters of commitment and Joint Venture/teaming/partnership agreements, resumes, CPAR evaluations, past performance questionnaires, ISRs, Attachments JL.9, JL.10 and JL.11 are not applied against the overall page limit.”
The Performance Recognition Documents are to be included in the page count.
In addition, Factor 5, Past Performance, third paragraph on page 121, Performance Recognition Documents is changed from:
Also include performance recognition documents received within the last three years such as awards, award fee determinations, customer letters of commendation, and any other forms of performance recognition.
To read:
Also include performance recognition documents received within the last three years such as awards, award fee determinations, customer letters of commendation, and any other forms of performance recognition. For performance recognition documents to be considered under this factor, they are required to be dated and contain the signature and position of the individual signing. Further, performance recognition documents solicited especially for the purposes of this factor may be considered less favorable than documents contemporaneously received for the work performed.
Question 3. Please confirm whether Attachment JL.9, Small Business Subcontracting Record is included in the page count or excluded from the page count.
Answer: See answer to Question #2 above.
Question 4. Please confirm whether Attachment JL.10, Small Business Participation and Commitment Strategy is included in the page count or excluded from the page count.
Answer: See answer to Question #2 above.
Question 5. RFP Item: Attachment JL.6 - Proposed, Historical, and Year to Date Indirect Rates
Offeror Comment: The RFP instructions state: For year-to-date rates, please indicate the “as of” date and provide the detailed (account level) pool and base information for each rate.
Offeror Comment: The Attachment JL.6 has columns for 2014, 2015, 2016, and 2017.
Question: Where should the offeror provide the “Year to date rates”?
Answer: See revised Attachment JL.6 (rev 1) attached to the amendment. Attachment JL.6 Rev 1, deleted the 2014 column and added a column for 2018-Year to Date rates.
Question 6. Would the Government allow header/footer text to be in no less than font size 8 point?
Answer: No Question 7. Would the Government please consider adding the Factor 4 Individual Subcontracting Reports (ISRs) to the list of items that are not applied against the overall page limit for Volume 1?
Answer: See answer to Question #2 above.
Question 8. Would the Government please consider adding the Factor 5 Performance Recognition Documents (awards, award fee determinations, customer letters of commendation, and any other forms of performance recognition) to the list of items that are not applied against the overall page limit for Volume 1?
Answer: See Answer to Question 2.
Question 9. When offerors respond to the requirement to "clearly demonstrate that the affiliate/subsidiary/parent firm will have meaningful involvement in the performance of the contract," is this information to be included on the Attachment JL.8? Or can this information be presented on a separate page and not applied against the 2 single-sided page limit for each Construction Experience Project Data Sheet?
Answer: This information is not to be included in Attachment JL.8; however, as the solicitation states the proposal shall clearly demonstrate that the affiliate/subsidiary/parent firm will have meaningful involvement in the performance of the contract. This demonstration is included in the 175 page count.
Question 10. Would the Government please consider exempting from the page limitation the subcontractor "signed letter of commitment and an explanation of the meaningful involvement that the subcontractor will have in performance of this contract"? We ask that the Government consider not apply this information against the 2 single-sided page limit for each Construction Experience Project Data Sheet.
In addition, is this information to be provided as part of Attachment JL.8 or on separate pages?
Answer: Page 116 states the signed letters of commitment are not included in the overall page count. Page 117 of the solicitation states an explanation of the meaningful involvement that the subcontractor will have in performance of this contract is required and is included in the page count (which is now 175 pages). Also see answer to Question #9.
Question 11. Would the Government consider changing the corporate experience requirement for "Completed construction projects" to "construction projects at least 80% complete"?
Answer: No Question 12. The Volume 1 instructions state: "Offerors may submit a one page organizational chart as required under Technical Factor 2 in 11x17 format, font size 10. Each 11x17 page submitted will count as one (1) page."
Please confirm that offerors are permitted to use 11x17 format for other large graphics, in addition to the organizational chart.
Answer: No
Question 13. Would the Government please clarify the definition of team member vs. subcontractor?
Answer: See solicitation page 123, Joint Venture and Team Arrangements Question 14. Can subcontractors who are not cost-reimbursable still be considered team partners?
Answer: The solicitation does not use the term "team partner" and it is unclear what information is sought with this question.
Question 15. For Corporate Experience: If an offeror has completed the construction scope of a project and has only administrative tasks ongoing, would the Government accept this as a "completed" project?
Answer: No Question 16. For Corporate Experience: If an offeror is performing a multi-year standalone contract with base and option years, and the offeror has completed at least the base year, would the Government accept this as a "completed" project?
Answer: No Question 17. The instructions state that offerors are to not alter the font size on Attachment JL.8, and that individual blocks on the firm may be expanded. May offerors also reduce the size of some individual blocks to make more room in others?
Answer: Yes, provided the 10 pt. font is not altered by the Offeror and the total length of the does not exceed one
(1) double-sided page (or two (2) single-sided pages), except as specifically requested as stated on page 117 of the solicitation.
Question 18. Attachment JL.7 lists two positions - Accounting Technician II and III - with zero hours. Is this correct?
Answer: See revised Attachment 7 (rev1) attached to this amendment.
Question 19. Please confirm that the requirement for EMR, DART, and TRC Rates is for FY2014, 2015, and 2016. Should offerors also include 2017 rates if they are available?
Answer: This amendment changes the complete calendar years' worth of data for the EMR, DART, and TRC Rates from FY2014, 2015, and 2016 to FY2015, 2016, and 2017.
Question 20: Please confirm that the 20% Small Business subcontracting goal only applies to CONUS task orders.
Answer: The small business participation rate of 20% only applies to work performed within the continental U.S.
or its territories.
Question 21: Please clarify how the small business participation rate of 20% of contract value and the NAVFAC command-wide small business targets align. The RFP states that the small business participation rate is 20% of contract value; however, the NAVFAC command-wide subset goals are set up as focused on total subcontact value.
For example, the Small Business goal is stated as 65%; however, if this is based on total contract value, wouldn’t the Small Business goal instead be 100% of the 20% total contract value?
As an example, if a contractor wins $1M of contract value, how do the SDB, HUBZone and other categories apply? Would the goal for SDB be $150,000, HUBZone $60,000, and so on? Since the small business participation rate goal is 20% of contract award goal, how does the 65% Small Business goal apply?
Answer: The small business participation rate of 20% is the minimum expectation for subcontracting with the various SB categories and shall be expressed as a percentage of total contract value.
You are correct that the NAVFAC SB target of 65% is expressed as a percentage of subcontracting (not total contract value).
As an example, if the total contract value is $10 million dollars (assuming the prime is LB) and intends to self-perform $7 million, then the prime is planning to perform 70% of the total contract value. Of the 30% planned for subcontracting, $500K is to LB and $2.5M is for SB. The $2.5M for SB, means that the SB participation rate is 25%, but is 83.3% of the total subcontracted value. Of the $2.5M for SB, 400K (16%) was designated for SDB, $150K (6%) was designated for HUBZone, $375K was designated for WOSB/EDWOSB,$150K (6%) was designated for VSOB and $125K (5%) for SDVSOB. In this example, the offeror meets or exceed the small business participation rate and all of the NAVFAC subcontracting targets.
It is important to understand that each offeror is responsible for determining the maximum practicable opportunities that exist for subcontracting with small business. Ultimately, each firm has an obligation to propose goals that are challenging, but realistic. In some cases the subcontracting goals you propose may fall above NAVFAC subcontracting targets and in some situations, your proposed goals may fall below the targets. Your obligation is always to support the proposed goals and provide rationale for any goals that fall lower than the proposed targets.
The key is to adequately support all of the proposed goals.
For evaluation purposes of the small business participation and commitment strategy, NAVFAC has no minimum participation rate for the various socio-economic categories.
Question 22: JL10 Small Business Commitment Strategy requires (a) estimated dollar value of all planned subcontracting, (b) estimated dollar value of work to be self-performed, and (c) the scope and dollar value of each subcontract. Based upon the IDIQ nature of this contract, the underdetermined scope of awarded task orders and the place of performance, such detailed information at this level is not available. Will the Navy consider removing the requirements of JL.10?
Answer: No, we will not remove this requirement. The same statement could be made of any IDIQ. It is acceptable to complete the form with "to be determined" where necessary and provide further explanation in the supplemental narrative. It is anticipated that in reviewing the overall scope of the work, that each offeror can identify some products and services that are appropriate for subcontracting and in some cases, binding commitments with specific firms may exist.
Question 23. Please confirm that, in accordance with FAR requirements, Small Business subcontracting goals pertain only to Task Orders for work performed within the continental U.S. or its territories.
Answer: Small Business subcontracting goals pertain only to Task Orders for work performed within the continental U.S. or its territories.
Question 24. The Small Business Participation and Commitment Strategy form JL.10 requires the Offeror to list the value of subcontracts for specific companies. While we can commit an anticipated percentage goal to the different categories of companies (i.e. Large, Small, SDB, WOSB, HUBZone, VOSB, SDVOSB), we do not see how it is possible to commit to specific companies when the exact scope and locations of task orders are unknown. Please consider allowing contractors to list a percentage and dollar goal for each category, and to provide a list of potential subcontractors to whom these dollars may go, including "others - to be determined by task order."
Answer: This approach is acceptable. The form specifically states that "If unknown/to be determined, so indicate".
It is acceptable to provide a dollar and percentage and not necessarily have a specific firm (subcontractor) identified.
It should be noted however, that in accordance with Section M, offerors will be evaluated on the degree of commitment to use named sources.
Question 25. It appears that in the paragraph that begins with "NAVFAC's command-wide small business subcontracting targets are shown below.", the next sentence may be a combination of two sentences in which one or more words are missing. Please clarify.
Answer: See revised Factor 4, Small Business Utilization, attached to this Amendment.
Question 26: Are construction management projects considered relevant to this effort?
Answer: Refer to Solicitation, page 117, Factor 1 Corporate Experience, subparagraph (i)- Solicitation Submittal Requirement.
Question 27: If the Small Business goals apply only to CONUS and outlying areas, for consistency purposes, please provide a baseline $ amount for Offerors to assume as an estimated value of this potential work.
Answer: See revised Factor 4, Small Business Utilization, attached to this Amendment.
Question 28: RFP Factor 4 – Small Business Utilization, paragraph 2.c. states, the anticipated prime and first tier overall small business participation rate is 20% of the contract value. It is anticipated that performance of this contract will include OCONUS tasks. Pursuant to FAR 19.000(b), the Small Business Program applies only in the United States or its outlying areas. For the Small Business Plan preparation, shall the offeror anticipate a ceiling amount for CONUS work to apply the 20% against?
Answer: See revised Factor 4, Small Business Utilization, attached to this Amendment.

VOLUME 1: NON-COST PROPOSAL
NON-COST EVALUATION FACTORS
(a) Non-cost/price Factors:
(1) Factor 1, Corporate Experience :
(i) Solicitation Submittal Requirements:
Offerors (Prime/JVs) shall provide a maximum of five (5) projects similar in size, scope and complexity to the work anticipated under this contract and completed within the past ten (10) years of the date of issuance of this RFP.
Each project must be valued at $10 million or more. The project descriptions should explain the relevance of each project, including the extent to which the project demonstrates experience in planning, team-forming, managing, coordinating and executing construction emergency/contingency recovery work requiring rapid mobilization and/or new construction, renovations, and repairs in a wide array of geographical locations world-wide (continental United States, overseas, and remote locations); federal cost contracting experience; and incidental services experience.
Incidental services are those in support of the construction effort that may be required to provide initial Base Operating Support (BOS) Services, i.e., set up of base operating office/camp to provide services for military and contractor staff as necessary at a disaster or remote location.
At least one project must have been completed for an overseas location.
A project is defined as a completed construction project performed under a single task order or standalone contract.
For multiple award and indefinite delivery/indefinite quantity type contracts, the contract as a whole should not be submitted as a project; rather, Offerors should submit work performed under a task order as a project.
The attached Construction Experience Project Data Sheet (Attachment JL.8) is MANDATORY and SHALL be used to submit project information. This form is set at 10 pt font and the font size shall not be altered by the Offeror.
