AMENDMENT 0007

The purpose of this amendment is to disseminate the below information.

1. Section J – Amendment 0007 - Pre-award inquiries responses are provided.

Amendment 0007- Pre-Award Inquiries

BASE OPERATIONS SUPPORT (BOS) SERVICES

NAVAL SUPPORT FACILITY (NSF) DEVESELU, ROMANIA

REFERENCE QUESTION GOVERNMENT

RESPONSE Page Section Para.

39 2.7.4.1 1 It is generally known that the current subcontractor providing labor services utilizes Romanian employees employed through a UK firm.

Therefore, none of the Romanian employees are correctly contributing to their country social programs, retirement, and insurance obligations.

The upcoming separation of the UK from the rest of the EU may put this current program in jeapordy. Is it the Government's intention that the new (up to eight year) contract utilize a labor subcontractor or have the prime direct hire the Romanian employees and pay the appropriate social contributions and taxes as per Romanian law?

Please refer to the solicitation, the solicitation clauses, and any and all appropriate laws.

78 Section C - Annex 0403000 Emergency Management Services Spec Item 2.2.2

2.2.2 Please confirm that all contract

personnel shall be U.S. citizens and shall hold a Secret security clearance through the adjudication process.

All Annex 0403000 personnel shall be US Citizens and hold a secret security clearance.

General Question Part A: Considering the Armed Services' Board of Contract Appeals' opinion in King's Bay Support Services, ASBCA 59213, 59232, does the Navy require IMP or Service Order work for equipment not listed on the J Tables?

Question Part B: Does the Navy intend to require any work on unnamed "components" that are not on the J Tables and were not considered by the Contractors in formulating their FFP bids?

Refer to the PWS for information regarding service orders, maintenance obligations and other requirements..

274 F.2 F.2 The RFP States, "Pricing shall include applicable Phase-in of up to but no more than 90 days and up to but no more than 30 days for Phase-out.".

Can the client clarify if the Phase-out Period is exclusive of the Option Period Seven (7) (i.e., Option Period Seven (7) Services of 12 Months, Phase-out of 1 Month) or inclusive (i.e., Option Period Seven (7) Services of 11 Months, Phase-Out of 1 Month)?

Phase out period is exclusive of the option period.

274 F.3 F.3 The RFP States, "The contract term shall be for a base period of twelve (12) months with seven (7) option periods (Twelve (12) months each), commencing within 90 days after notice of award". Can the client clarify if the Phase-in Period is exclusive of the Base Period (i.e., Phase-in of 3 Months, Base Period Services of 12 Months) or inclusive (i.e., Phase-In of 3 Months, Base Period Services of 9 Months)?

Phase-in period is exclusive of the base period.

3.5.10 and 3.6.3

The Table of Contents lists "VTE" twice on page 153 - Spec Items 3.5.10 and 3.6.3. The specifications are also duplicated in the paragraphs 3.5.10 on page 183 and 3.6.3 on page 186. Please clarify.

One occurrence is for recurring maintenance and the other is for test and certification.

Annex 10, Materials Management / Supply Services

There is currently no ELIN/Sub ELIN for any Labor and/or materials required for Annex 10, Materials Management / Supply Services. Was this an oversight?

Annex 1001000 Material Management and 1002000 Supply Services ELINS/SubELINS are listed under Naval Supply Command.

PWS Annex 0402000 – Fire and Emergency Services, Spec Item 2.4 Contractor Provided Personal Protective Equipment

The Contractor shall provide employees all required protective clothing and ensembles as directed by the departments SoS. All personal protective clothing and equipment shall comply with standards specified by NFPA, DoD 6055.6, DoD Occupational Safety and Health Programs and Health Programs, and Code of Federal Regulations (CFR) Section 1910.134. All PPE shall be assigned to the employee in the Navy’s prescribed data system.”

Question: Will the Government provide the current Fire Department SoS so the offerors can provide continuity of service to the government? The reference states “All PPE shall be assigned to the employee in the Navy’s prescribed data system”. Should this be interpreted to mean the Navy will provide the required PPE via its supply system or are offerors required to provide all PPE and enter that equipment into a Navy data base?

The Contractor is required to provide all PPE and enter that equipment into a Navy data base.

Annex 04020000

Section 2.5, “Governmen t Furnished Equipment” the PWS states “The Government will provide Structural, and Specialized Vehicles to support he department’s Scope of Services. The Government will provide all vehicle manuals to the contractor. All maintenance for these vehicles will be provided by the contractor in accordance with the manufacturer directives. A list of Government furnished equipment is provided in J-0200000-0X”

Question:

Does the government intend to issue an amendment including the relevant Section J to describe all Fire and Emergency Services specific equipment, or are the offerors expected to developed and bid the equipment necessary to satisfy the PWS? If so, will the government provide the appropriate work load data to the offerors?

No.

332 L.6(b) Non-Price Factors (Volume II)

The RFP states that the "Non-Price proposal shall not exceed (5) single-sided or (25) double sided pages".

Can the Government confirm that this 50 page limit included only Tab C.

Non-Price Factors and that Tab A and Tab B of the Non-Price Proposal are excluded from the page limitations?

Per L.6(b), The page limit count does not include the following: Blank tab dividers and cover pages, Attachment G Full-Time Equivalent (FTE) worksheets, (Solicitation Attachment J.3), commitment letters from team members or Joint Venture agreements, Past Performance Questionnaires (PPQs), CPARS, and Performance Recognition Documents.

24 0200000 - Management and Administratio n

2.3.2 CONTEXT: Spec Item 2.3.2 states:

"When construction, renovation, or repair work is performed by means other than this contract, the Contractor shall attend Government provided training, as applicable, for maintenance and operation of new and replacement systems and equipment at no additional cost to the Government."

QUESTION:

1A. Will the Government provided training be located on the Romania Deveselu site?

1B. If not located at the site, can the Government an esitimated listing of projected future training events, number of personnel required to attend and training locations?

1A. Normally the training will occur at the NSF Deveselu site.

1B. Unknown.

332 L.6 Tab C.(1) (i) Discussion: RFP states - For purposes of this evaluation, a relevant contract is further defined as Base Operations Support (BOS) services (or equivalent) encompassing technical specifications 1502000 – Facility Investment and 0402000 – Fire and Emergency Services and a minimum of one other technical specification with performance at a level comparable to the contract requirements in this solicitation, at least one (1) year of contract performance completed and a contract value of $3 Million or greater per year. Fire and Emergency Services is a very unique function and a function which is not normally found on a BOS contract. It usually is a function reserved for Government. As an experienced BOS provider, we consider the function to be a very important function, but having this as a relevant requirement limits the competition and gives incumbent a distinct advantage.

Question: Will the Government consider removing the requirement for an Offeror to have had Fire and Emergency Services as experience to have a relevant contract?

No.

274 Solicitation Section F.2 Request that the Government provide a "plug number" for transition to allow non-incumbent contractors a more equitable bidding position.

Per F.2, There is not a separately priced CLIN for phase-in and phase-out and such costs can be distributed however the offeror chooses.

ELINS There is no section for Management and Administration in the ELINs for pricing.

Refer to B.6 Fully Loaded Pricing, Costs for technical specifications 0100000 and 0200000 shall be considered overhead; therefore, their costs shall be allocated and included throughout the prices quoted for all other technical specifications
