ADDITIONAL INFORMATION

Questions for N61340-11-R-0039

Question 0007:

Is the contractor required to submit the entire Volume 3, Past Performance (1 original paper, 4 paper copies, and 1CD) IAW Section L and M requirements within two (2) weeks after RFP release date of 16 March 2011 (thus submission of Past Performance Volume on 30 March 2011)? If not, then what information is required to be sent on this date? Is the verbiage in the RFP that states “it is requested” and “should be submitted” a specific “requirement” and “shall be submitted” or just a request that it should be? Is the information that is being “requested” that “should” be submitted referencing the MS Word chart in Section L, Part B, Para 3.6 – Past Performance Data Requirements – and that this is the only information assumed to be due with the two weeks of the RFP release date? What is the reference to the Past Performance information submitted as per paragraph 4.1 and 4.2 – what Section or Part is being referenced to 4.1 and 4.2?

Answer 0007:

If an offeror chooses to submit Volume 3 two weeks after the RFP release date, it should be the entire Volume 3 (1 Paper Original, 4 Paper Copies/1 CD), not just one copy. If an offeror does not have any changes to Volume 3, which was submitted early, offerors are not required to submit another Volume 3 with its final proposal submission. If an offeror has additional information that was not in the submitted Volume 3, please resubmit the entire volume with its final proposal submission.

Question 0019:

The collective bargaining agreement associated with the RFP breaks down the vacation benefits as follows:

1. Less than 5 years or less vested service

2. More than 5 years, but less than 14 years vested service

3. More than 14 years vested service

What is the number or percentage of incumbent employees in each category?

Answer 0019:

Information is not available and will not be requested by the Government as we consider it to be proprietary to the incumbent. Neither the contractor nor any subcontractor under the contract shall pay any service employee performing any of the contract work, regardless of whether such employee was employed under the predecessor contract, less than the wages and fringe benefits provided for in the collective bargaining agreement, to which such employee would have been entitled if employed under the predecessor contract. See FAR clause 52.222-41(f), "Service Contract Act of 1965 (Nov 2007)."

Question 0020:

Is the 130 hours of Premium time per year expected to be a total included for each CBA covered Full time employee, or is the 130 hour total expected to be divided across all CBA Full Time employees equally?

Answer 0020:

Reference: RFP SOW Chg 2 to paragraph 4.5 & 4.5.5, RFP Amendment 003

1. The allowance of Premium Time is divided across all employees, but not equally. The time applies to any on-site contractor labor category the COR authorizes and tasks to provide premium labor. A labor category, such as Aircraft Mechanic, may be tasked with most premium labor hours, while another category, such as Supply Clerk, may not be tasked with any premium labor hours. The quantity of actual premium labor hours to be used for each category is unknown at this time.

Question 0021:

Will the incumbent (DynCorp) be paying out to each employee their unused vested vacation when DynCorp’s Prime Contract terminates, thus resulting in each employee starting with zero vested vacation under the successor contractor?

Or, Will the unused vested vacation liability transfer over to the successor contractor? If so, will DynCorp be required to compensate the successor contractor for the cost of the unused vested vacation liability?

Answer 0021:

Neither the contractor nor any subcontractor under the contract shall pay any service employee performing any of the contract work, regardless of whether such employee was employed under the predecessor contract, less than the wages and fringe benefits provided for in the collective bargaining agreement, to which such employee would have been entitled if employed under the predecessor contract. See FAR clause 52.222-41(f), "Service Contract Act of 1965 (Nov 2007)."

Attached via amendment 03 is the latest CBA (Attachment 5) as of 18 January 2011.

Question 0022:

After January 1, 2011, are the overtime hours worked included in the hourly Flexible Benefit Credit paid to employees covered under the CBA?

Answer 0022:

Neither the contractor nor any subcontractor under the contract shall pay any service employee performing any of the contract work, regardless of whether such employee was employed under the predecessor contract, less than the wages and fringe benefits provided for in the collective bargaining agreement, to which such employee would have been entitled if employed under the predecessor contract. See FAR clause 52.222-41(f), "Service Contract Act of 1965 (Nov 2007)."

Attached via amendment 03 is the latest CBA (Attachment 5) as of 18 January 2011.

Question 0023:

Question: For the purpose of developing pricing, would the Government agree that the wages identified in the CBA with the effective date of 1-11-11 are the rates that should be used for this proposal? Can the Government confirm which CBA rates and benefits are to be used for pricing for this effort (assumption is the as of 1-11-11 versus the “current rate”).

Answer 0023:

The offers should use the wage and fringe benefits for the period effective 1-01-11in the CBA.

Attached via amendment 03 is the latest CBA (Attachment 5) as of 18 January 2011.

Question 0024:

Question: Will the current incumbent contractor be accomplishing an inventory prior to contract award, as well as during transition?

Question: Will the incumbent contractor work with the winning contractor to coordinate and schedule inventory prior to five (5) days prior to CSD?

Answer 0024:

Reference: SOW paragraphs 3.1.1.a (amendment 003) and 3.1.4; Exhibit A: CDRL A001 and A002

1. Yes, however it may not be a total (wall to wall) inventory. CDRL A001 and A002 annex allows for a total or subset inventory. IMRL and Non-IMRL items that will be inventoried by the Contractor at mobilization will be restricted to the subset of items in the “X” work centers (Contractor supported work centers). The Contractor may elect to do a total inventory.

2. The Government can encourage the incumbent, but cannot mandate inventory concurrency. SOW paragraph 3.1.1.a allows the mobilizing Contractor to observe maintenance service of the incumbent on a not-to-interfere basis. SOW paragraph 3.1.4 specifies Contractor requirement for CDRL A001 and A002 IMRL/Non-IMRL inventories during the Mobilization period.

Question 0025:

The RFP states: “It is the responsibility of the Contractor to ensure all its personnel are trained and certified as required by directives prior to providing CMSS under this contract.”

Question: Of the current, incumbent personnel, hired by the incoming contractor, will their certifications be honored during the phase in period if the certifications are current and valid, without expiration?

Answer 0025:

Reference: SOW paragraphs 4.3.3.2, 3.1.1.b and 4.5.7.3 (amendment 003).

Per the SOW paragraph 4.3.3.2, the Contractor is responsible for “certifying” all its employees. The Government will accept the mobilizing contractor’s certifications of present, incumbent certified employees providing the criteria/requirements for the employee’s certification has not expired at the time of the new contractor’s certification. Employee qualifications must be accepted by the COR and PCO.

Question 0026:

Areas in RFP. In the SOW it calls for the contractor to have CDI/CDQAR for inspection of contractor accomplished work.

Question: Will the contractor be the sole authorizing authority of these individuals or will the USG review the qualifications prior to these individuals being appointed to these positions?

Answer 0026:

Reference: SOW paragraph 4.3.4.2 and SOW paragraph 4.3.4.3 (amendment 003)

As part of the Contractors quality assurance plan, the contractor shall be the sole authority for qualifying Contractor CDI/CDQAR personnel.

Question 27:

The RFP states: “CACs cannot be issued until the Contractor provides proof to the COR and CVS-Trusted Agent that Contractor personnel have been vetted (i.e., passed a National Agency Check with Inquiries (NACI) security background investigation and had a favorable return/acceptance of finger prints by the Federal Bureau of Investigation(FBI). “

Question: Will the Government accept the contractors pre-employment background checks to fulfill this requirement or is a different, specific –installation background investigation required? Currently, our pre-employment background check contains the following: verification of: Social Security, Previous residences – last 7 yrs, National Access Search (e.g. Sex Offenders), Terrorist Watch List, and Federal Criminal investigation last 7 years.

Answer 27:

Reference: SOW paragraph 4.3.1.2; Exhibit A Annex to CDRL 0006 (Std Form SF-85P). Directive-Type Memorandum (DTM) 08-003, “Next Generation Common Access Card (CAC) Implementation Guidance”

No. Procedures specified in SOW paragraph 4.3.1.2 apply. Refer to http://www.cac.mil/assets/pdfs/DTM-08-003.pdf for added assistance.

Question 0028:

The RFP states: “Contractor shall comply with Navy Safety requirements (during cleaning, paint removal, priming and painting) to prevent injury to personnel and damage to USG equipment.”

Question: What are the current toxic substance exposures levels in the paint shop in regards to OSHA 29cfr 1910 Subpart Z? If employees exposures to determined substances are reported to be above the Permissible Exposure Levels set by OSHA will the cost of required Periodic Industrial Hygiene Monitoring and employee required medical surveillance be provided as cost reimbursable by the Government (e.g. hexavelant chromium)

Answer 0028:

The paint facility in buildings 307 and 3202 both exceed all requirements for ventilation under OSHA 29 CFR 1910.107. Enforcement of OSHA requirements for Contractor employees shall be the responsibility of the Contractor and shall include PPE, the Respirator Program, and any costs associated with medical surveillance/evaluation (e.g., painters, Paint Shop X55). The Government will perform the Periodic Industrial Hygiene Surveys of applicable work spaces (e.g., areas with high noise potential, areas requiring ventilation, etc.).

Question 0029:

The RFP states: “The USG will provide all tools (except hand tools…)”

Question: Due to personal tools (hand tools), the current CBA states that the contractor is liable for stolen/lost/misplaced tools up to a certain dollar amount. What type of secure storage will be provided for contractor’s tool boxes?

Answer 0029:

Reference: SOW paragraphs 4.2.3, 4.3.4.3, 4.3.4.1 and 2.2 (Amendment 003; Document: FRCMA-PAX LCP- Tool Control Program) The Government will provide secure lockable spaces for tools. All personal and Contractor provided hand tools brought into a Government work center shall be controlled under the same tool control accountability and directives as Government tools (i.e., tool control). Loss or misplaced tools in a work center is a serious violation of tool control and potential FOD hazard. All work spaces are locked during non-work shift hours with the exception of Hanger 301. Hanger 301 has a military-manned duty office that serves as a controlled, single-point of entry. Within Hanger 301 in the GSE compound, there is a lockable caged area where the contractor’s roll-around tool boxes are stored during off shift hours. The first line of defense is personal responsibility/prevention and the application of prudent personal security measures (i.e., using a quality lock on personal tool boxes). Tool control is a required part of the Contractor Safety and Quality Assurance plans/training.

LIMITATION OF GOVERNMENT’S OBLIGATION (MAY 2006)

(a) Contract line item(s) TBD through TBD are incrementally funded. For these item(s), the sum of $TBD of the total price is presently available for payment and allotted to this contract. An allotment schedule is set forth in paragraph (j) of this clause.

(b) For item(s) identified in paragraph (a) of this clause, the Contractor agrees to perform up to the point at which the total amount payable by the Government, including reimbursement in the event of termination of those item(s) for the Government’s convenience, approximates the total amount currently allotted to the contract. The Contractor is not authorized to continue work on those item(s) beyond that point. The Government will not be obligated in any event to reimburse the Contractor in excess of the amount allotted to the contract for those item(s) regardless of anything to the contrary in the clause entitled “Termination for Convenience of the Government.” As used in this clause, the total amount payable by the Government in the event of termination of applicable contract line item(s) for convenience includes costs, profit, and estimated termination settlement costs for those item(s).

(c) Notwithstanding the dates specified in the allotment schedule in paragraph (j) of this clause, the Contractor will notify the Contracting Officer in writing at least ninety days prior to the date when, in the Contractor’s best judgment, the work will reach the point at which the total amount payable by the Government, including any cost for termination for convenience, will approximate 85 percent of the total amount then allotted to the contract for performance of the applicable item(s). The notification will state (1) the estimated date when that point will be reached and (2) an estimate of additional funding, if any, needed to continue performance of applicable line items up to the next scheduled date for allotment of funds identified in paragraph (j) of this clause, or to a mutually agreed upon substitute date. The notification will also advise the Contracting Officer of the estimated amount of additional funds that will be required for the timely performance of the item(s) funded pursuant to this clause, for a subsequent period as may be specified in the allotment schedule in paragraph (j) of this clause or otherwise agreed to by the parties. If after such notification additional funds are not allotted by the date identified in the Contractor’s notification, or by an agreed substitute date, the Contracting Officer will terminate any item(s) for which additional funds have not been allotted, pursuant to the clause of this contract entitled “Termination for Convenience of the Government.”

(d) When additional funds are allotted for continued performance of the contract line item(s) identified in paragraph (a) of this clause, the parties will agree as to the period of contract performance which will be covered by the funds. The provisions of paragraphs (b) through (d) of this clause will apply in like manner to the additional allotted funds and agreed substitute date, and the contract will be modified accordingly.

(e) If, solely by reason of failure of the Government to allot additional funds, by the dates indicated below, in amounts sufficient for timely performance of the contract line item(s) identified in paragraph (a) of this clause, the Contractor incurs additional costs or is delayed in the performance of the work under this contract and if additional funds are allotted, an equitable adjustment will be made in the price or prices (including appropriate target, billing, and ceiling prices where applicable) of the item(s), or in the time of delivery, or both. Failure to agree to any such equitable adjustment hereunder will be a dispute concerning a question of fact within the meaning of the clause entitled “Disputes.”

(f) The Government may at any time prior to termination allot additional funds for the performance of the contract line item(s) identified in paragraph (a) of this clause.

(g) The termination provisions of this clause do not limit the rights of the Government under the clause entitled “Default.” The provisions of this clause are limited to the work and allotment of funds for the contract line item(s) set forth in paragraph (a) of this clause. This clause no longer applies once the contract is fully funded except with regard to the rights or obligations of the parties concerning equitable adjustments negotiated under paragraphs (d) and (e) of this clause.

(h) Nothing in this clause affects the right of the Government to terminate this contract pursuant to the clause of this contract entitled “Termination for Convenience of the Government.”

(i) Nothing in this clause shall be construed as authorization of voluntary services whose acceptance is otherwise prohibited under 31 U.S.C. 1342.

(j) The parties contemplate that the Government will allot funds to this contract in accordance with the following schedule:

On execution of contract

$ TBD

5252.201-9501
