SUMMARY OF CHANGES

SECTION SF 30 - BLOCK 14 CONTINUATION PAGE

The following have been added by full text:

The purpose of this amendment is to:

I. Include the following Attachments:

a. RFP N5523621R0010 Conformed Through A0008

i. Interport Differential (IDP) values have been recalculated to remove Basic

Allowance for Subsistence (BAS). RFP is changed as follows:

1. Section L, paragraph V.f.

2. Section M, paragraph III.2.d.

ii. Estimated award date under Section L, paragraph I.d. is changed from 14 March 2022 to 10 April 2022.

b. Attachment J-3 Pricing Workbook REV5

i. Correction to formula for Cell B12 on “Total Evaluated Price” tab

II. Answer the following Pre-Proposal Inquiries:

Question 1:

Section M, Paragraph III. 2. d. Inter-port Differential (IPD): To assist the bidder’s understanding of the performance, financial, and schedule risks associated with the RFP, please provide the detailed derivation of the RFP Inter-port Differential value(s). Based upon the competitive nature of this RFP and to ensure that the Govt’s price evaluation includes an accurate estimate of the Availability’s total estimated cost to the Gov’t, bidder considers the detailed derivation of the RFP Inter-port Differential value(s) to be critical information required to prepare its proposal. In addition, the detailed derivation of the RFP Inter-port Differential value(s) will help confirm the RFP’s competitive fairness and equity.

Answer 1:

The IPD Memo for the USS CURTIS WILBUR is available by request. Requests shall be directed to Mercedes Cook, Contracting Officer, and Cindy Wong, Contract Specialist, at mercedes.e.cook@navy.mil and cindy.wong@navy.mil, respectively.

Question 2:

Work Item 857-11-003, Temporary Duty Section Berthing Off-Ship; provide (OPTION ITEM)

Paragraph 3.1 states, “Provide and maintain off-ship berthing facility for each duty section on a 7 days a week basis from each crew move ashore to crew move aboard.”

• Contractor notes Amendment 0004 provided Q&A response #1,

1. Work Item 857-11-003 is an option item to be priced by both out of homeport and in homeport bidders. Port and location is undetermined.

2. SWRMC does not guarantee that a barge will be available within homeport. Due to unknown availability of berthing barge, Work Item 992-11-003 will require pricing and may or may not be invoked.

• Contractor notes it is unlikely that California State and San Diego County and City Local Health and Environmental regulations will allow for usage permit for the Temporary Duty Section Berthing mailto:mercedes.e.cook@navy.mil mailto:cindy.wong@navy.mil in the Contractors Industrial (Shops, Offices and Laydown) areas of the Shipyard as directed in the statement of work in this specification as written… note these requirement are historically accomplished in the Port of San Diego CA. at contractors facilities because the Customer (Gov’t) provides a Berthing & Messing Barge that is moored in the contractor Facility and not subject to such permitting requirements.

Bidder’s Question:

1) Can the Customer confirm that under Work Item 992-11-003 a Berthing & Messing Barge is planned if this avail is awarded to a bidder in the vessels Home Port of San Diego CA?

Answer 2:

The requirements of 857-11-003 and 992-11-003 are not the same and both are required to be priced as option items by all offerors. WI 992-11-003 is support for the Navy berthing barge if one is available for the Navy to provide. In the event a Navy berthing barge is available, WI 857-11-003 Option item will not be exercised as its requirements would be satisfied by the Navy berthing barge as the duty section (as identified in WI 857-11-003) can be supported by the berthing barge. In the event a Navy berthing barge cannot be provided, WI 992-11-003 will not be exercised, but WI 857- 11-003 will be exercised as support for the duty section must be provided separately if the Navy berthing barge is not available.

Question 3:

C-217-H005 GROWTH AND NEW WORK (NAVSEA) (JAN 2019)

(a) The Contractor is required to notify the Contracting Officer via email regarding growth and new work within 30 days of discovery:

(1) of any apparent errors or omissions in the contract (SF 33, specifications, drawings, etc.); and,

(2) of any/all conflicts between the contract package and actual conditions observed during ship check(s) and/or contract execution.

(b) Growth work is synonymous with over and above work, which is described in DFARS 252.217- 7028, Over and Above Work and it provides the process for adjudication.

(c) New work is distinguished from over and above work and is outside the scope of the competitively procured requirement. New work will be approved in accordance with FAR Part 6 and associated policies and procedures.

(d) The Government will NOT negotiate modifications to increase the contract price to address errors or omissions to the contract package which were reasonably apparent to the contractor prior to proposal submission.

• Contractor has submitted pre-proposal inquiries (PPIs) which have identified disparities in the Specification package and has received subsequent revisions to the specifications through Errata(s) 1 and 2. Although the deadline to submit PPIs has passed, the contractor continues to identify anomalies within the specifications and submit PPIs for correction.

Bidder’s Question: Are there any other known errors or omissions to the contract package that the Customer is aware of, as there are no others reasonably apparent to us?

Answer 3:

The Government is not aware of any other errors or omissions to the contract package.

Question 4:

Regarding Attachment J-3 Pricing Workbook REV4, the following error has been discovered;

1. “Total Evaluated Price” tab, Cell B12 references cells D6, D9 and D12 on the “Daily Extension Rate” tab and should be E6, E9, and E12. This error results in an incorrect Total Evaluated Price.

Please review and correct as soon as possible.

Answer 4:

The government concurs. Please see Attachment J-3 Pricing Workbook REV5.

Question 5:

This question is a result of answers provided in Amendment 0007 which was received after the question deadline.

Amendment 0007 answer 7 states “Work items 857-11-001 is cancelled in its entirety. See Errata 8.

Work Item 857-11-001 will not be reinstated into the J-3 pricing Workbook.”

Question #1 - How does this change the inter-port differential?

Question #2 - Since San Diego is the home port of the USS Curtis Wilbur isn’t there still a known need for this work in the event the contract is awarded to an out of homeport offeror?

Question #3 – If the answer to question #2 is “no”, is it the intent of the Government to treat this known requirement as growth after award?

Question #4 – If the answer to question #2 is “yes”, will the J-3 Pricing Workbook be revised to include item 857-11-001 as “OPTION ITEM, OUT OF HOME PORT ONLY”?

Please provide answers to all four of the questions listed above.

Answer 5:

Please request a copy of the Interport Differential (IPD) memo to review any adjustments. The government does not anticipate adding this work back into the availability.

Question 6:

This question is a result of answers provided in Amendment 0007 which was received after the question deadline.

Amendment 0007 answer 9 states “Work items 857-11-002 is cancelled in its entirety. See Errata 8.

Work Item 857-11-002 will not be reinstated into the J-3 pricing Workbook.”

Question #4 – If the answer to question #2 is “yes”, will the J-3 Pricing Workbook be revised to include item 857-11-002 as “OPTION ITEM, OUT OF HOME PORT ONLY”?

Please provide answers to all four of the questions listed above.

Answer 6:

Please request a copy of the Interport Differential (IPD) memo to review any adjustments. The government does not anticipate adding this work back into the availability.

b. Offerors are advised that the Government intends to make award on the basis of initial proposals without conducting discussions with Offerors, but reserves the right to conduct discussions if determined by the Contracting Officer to be necessary (FAR 52.215-1(f)(4)). Therefore, each initial offer should contain the Offeror’s best terms from a price and technical standpoint.

c. Offerors are advised that the Government will not evaluate any proposal information not contained within the body of the proposal, except for the following:

i. The Government reserves the right to use our own research to determine which commercial and government resources the contractor has in order to determine responsibility.

ii. The Government reserves the right to review past performance on Offerors’ ability to subcontract to small business and various small business goals. This includes, but is not limited to past ISRs.

II. BASIS FOR AWARD

a. The Government will select the best overall offer, based upon an assessment of non-price factor and price. A contract may be awarded to the Offeror who is deemed responsible in accordance with FAR 9.104, whose proposal conforms to the RFP’s requirements (to include all stated terms, conditions, representations, certifications, and all other information required by Section L of this solicitation) and represents the best value to the Government utilizing Lowest Price Technically Acceptable (LPTA), in accordance with the evaluation criteria.

b. The best value basis for award will be based on the following evaluation factors.

Non- Price Factor

1. Factor 1: Technical Eligibility Factor

a. Sub-factor A: Master Ship Repair Agreement (MSRA)

b. Sub-factor B: Dry Dock and Pier Facilities

Ratings will be applied to the Non-Price Factor as follows:

Non-Price Factor 1 – Technical Eligibility in terms of acceptable or unacceptable.

The Government will initially only evaluate the Offeror with the lowest priced proposal.

Following price evaluation, the Government will then make a determination as to whether the lowest priced offeror meets the minimum technical requirements. If the lowest priced offeror is determined to be technically acceptable, no competing proposals will be reviewed. If the Government determines discussions are necessary, the Government will complete a technical eligibility evaluation of all Offerors and establish a competitive range. The SSA will base the source selection decision on an assessment of proposals against all source selection criteria in the solicitation.

Price Factor

1. Factor 2: Total Evaluated Price

III. EVALUATION FACTORS DESCRIPTION

A. Factor 1: Technical Eligibility

a. Subfactor A: Master Ship Repair Agreement (MSRA): Offerors must provide a current copy of their current Master Ship Repair Agreement (MSRA) in accordance with DFARS 217.71 or proof of equivalency subject to the requirements under CNRMC instruction 4280.1 in order to be eligible for award. b. Subfactor B: Dry Dock and Pier Facilities: The Government will assess whether the Offeror has ownership or committed access to a dry dock and pier capable of berthing the vessel, in accordance with Section L. The Government will also assess if the proposed dry-dock is certified in accordance with MIL-STD-1625D, and remains certified from “Avail Start” through “Contract Complete” as outlined in Attachment J-5 and should the dry-dock certification in accordance with MIL-STD-1625D lapse anytime during the proposed docking period, the Offeror has adequately described a plan for recertification.

2. Factor 2 – Total Evaluated Price

a. Total Evaluated Price for the availability shall be calculated by adding:

v. The price of the Interport Differential (as identified in Section L of this solicitation).

b. Evaluated price for Extension Day Rates and Fully Burdened Ship Repair Labor Rates & Material Burden Rates (as applied to LOE to Completion CLINs and New Work) shall be calculated in the following manner:

i. LOE to Completion Reservation CLINs (Base and Option)

1. Multiply the proposed fully burdened ship repair labor rate by the number of hours associated with (1) each LOE to Completion CLIN and (2) New Work allocation to yield the labor hour price.

2. Multiply the material burden rate proposed by the dollar value of material associated with (1) each LOE to Completion CLIN and (2) New Work allocation to yield the burdened material price.

3. Add the sum of labor hour and material dollar price to find the total price for each LOE to Completion CLIN and New Work allocation. (Note, the offeror’s Fully Burdened Ship Repair Labor Rate & Material Burden Rate as applied to New Work allocation will be included in the Total Evaluated Price for evaluation purposes only. This figure will not be incorporated into the contract at the time of award; however, the offeror’s Fully Burdened Ship Repair Labor

Rate & Material Burden Rate will be utilized for pricing of New Work arising during contract execution.)

c. Extension Day Price

1. Multiply the proposed daily rate by the number of days associated with that rate to yield the evaluated price the dry dock and pier-side extension. Offerors are advised that the number of extension days used to calculate the Extension Day Price are for evaluation purposes only.

d. Inter-port Differential (IPD)

The Inter-port Differential is calculated using foreseeable costs for fuel, towing and pilot charges, and travel to the Contractor’s facility by applicable Government personnel (Management Oversight, Assessment, Survey, Certification, and Ship’s Force (to include relocation, sustainment, and crew training costs)). Offerors shall enter the applicable Inter-port Differential in accordance with the values below in the appropriate section of the J-3:
