CONTRACTOR QUESTION 7:
In Section C, pages 20-21, paragraph C.18.14.1 (Maintenance Support), ELIN 114AA (Series), the RFP requires Contractor Multi-Trade person’s assigned when a ship’s crew is occupying the craft to work a 48 hour work week with all 48 hours charged to a “straight time” only ELIN. Any work performed by Contractor Trade personnel (mechanics) in excess of 40 hours per work week is to be paid at the time and a half rate per the U.S. Dept. of Labor, Fair Labor Standards Act and a variety of Federal and State contract labor rules and regulations. Request an overtime ELIN also be included so Contractor Multi-trade mechanics required overtime can be properly paid and accounted for as required by the U.S. Dept. of Labor and 48 CFR 52.222.4.
This overtime requirement may also need to be added to ELIN’s 115AA (Series) and 116AA (Series) when overtime is required to accomplish undisclosed work.
GOVERNMENT RESPONSE:
The Government has determined that a separate ELIN for overtime will not be created at this time.
CONTRACTOR QUESTION 6:
In Section C, page 15, paragraph C.8.2.1 (Temporary Services), ELIN’s 102AA-AD (Series), when Berthing Barge tie-up/cast-off and temporary services are unexpectedly required to be connected/disconnected after established M-F working hours (nights, weekends, holidays, Heavy Weather and Emergent/Unplanned events), will overtime be allowed and reimbursed to cover the cost of these Gov’t requested Unplanned or Emergent events?
GOVERNMENT RESPONSE:
Properly authorized overtime will be paid in accordance with FAR Clause 52.222-4, which is incorporated into the solicitation by reference.

CONTRACTOR QUESTION 5:
In Section L, Volume I, Sub-factor A, paragraph (A1), the solicitation states that contractors holding ABRs must also provide an approved Remote Site Performance Plan, if applicable, along with a plan for personnel to be used at a remote site. Volume VII, paragraph 3.3.4 of the Joint Fleet Maintenance Manual (JFMM) discusses Remote Site Performance Plans as a requirement of MSRA holders. Paragraph 3.3.5 of the JFMM, Agreement for Boat Repair Requirements, does not address Remote Site Plan requirements. Would the Government please clarify if ABR holders are in fact required to submit a Remote Site Performance Plan?
GOVERNMENT RESPONSE:
Per section L of the solicitation, ABR holders shall submit a Remote Site Performance Plan, if applicable.
REQUEST FOR SPECIFICATION CLARIFICATION

Would the Government please indicate what instruction or other guidance the contractor should use in its place?

CONTRACTOR QUESTION 4:
Section L, Volume 1, Subfactor A indicates that documentation of an approved remote site performance plan must be provided, if applicable. Later in paragraph A1, the requirements specify that offerors must provide an approved remote site performance plan and a plan for personnel to be utilized at a remote site by time of award. Would the Government clarify what performance plan needs to be submitted with the proposal and what will be required at time of award, if there is a difference?
GOVERNMENT RESPONSE:
Per the solicitation, offerors shall provide an approved Remote Site Performance Plan, if applicable, and a plan for personnel at a remote site by time of award.

CONTRACTOR QUESTION 11:
In Section C, pages 28, paragraph C-217-H005 (Growth and New Work) and ELINs 115 (Series) and 116 (Series) undisclosed/ undefined work requirements: Since new work/growth work and undisclosed/undefined work is usually non-repetitive, work for which no contract ELIN exists, for clarification and estimating purposes, please clarify and explain how this type of work will be identified, scoped, planned, processed and priced for future task orders/delivery orders:
A. Once identified, will there be a Gov’t provided statement of work (SOW)?
B. Will contractor man-hours be allowed when pricing this type of new/growth work to cover such associated or incurred costs such as ship-checks, troubleshooting, equipment/parts research, Gov’t property/scrap processing, disposal processing, estimating, material ordering, admin, etc.?
C. What level of detail will be required for SOW estimate preparation?
D. Will all new work/growth work be priced at the IDIQ Contractor Approved Forward Pricing Rate (FPR)?
E. Will FPR overtime be authorized for new work/growth work required to be accomplished on an Emergent basis or on nights, weekends and holidays?
GOVERNMENT RESPONSE:
Delivery orders will be issued and priced in accordance with the procedures set forth in the solicitation.
CONTRACTOR QUESTION 12:
Can the Government please confirm if there is a Contract Maximum Dollar Amount (Base Year and all Option Years) established for this contract and, if so, what the Contract Maximum Amount is?
The Contract Maximum Amount will be determined at award.
CONTRACTOR QUESTION 9:
In Section C, pages 14, paragraph C-211-H005 (Plant Protection), NSI 009-72, plant protection is normally a manned ship/MSR/Shipyard responsibility when a berthing barge/craft accompanies a ship into a contractor’s shipyard or plant for major maintenance/dry-docking repairs. The barge IDIQ contract holder would have no input or responsibility for the MSR plant/shipyard security requirement. If a berthing barge/craft is placed in a shipyard for routine repairs (no ship’s crew would be occupying the barge) this requirement would not be required. Please confirm that this is the case as described above or should this clause be deleted?
GOVERNMENT RESPONSE:
Per the solicitation, NSI 009-72 will be invoked for this requirement. If a berthing barge is placed in a contractor's facility for repairs, offerors shall comply with 009-72.
Clause C-211-H005 is required for all NAVSEA ship repair contracts.
CONTRACTOR QUESTION 10:
In Section C, pages 25, paragraph C-211-H010 (Tug and Pilot Service), Tug/Pilot Service is normally a MSR/Shipyard requirement when a berthing barge/craft accompanies a ship into a contractor’s shipyard or plant for major maintenance/dry-docking repairs and is always covered by a work item included in the ships repair/overhaul work package. Please confirm that this requirement is only required when an unmanned berthing barge/craft is placed in a shipyard or plant for berthing barge/craft general maintenance and repair.
CONTRACTOR QUESTION 13:
In Section C, pages 16-17, paragraph C.8.5.1(d) through (i), (Fire Fighting Equipment/Systems), please confirm for estimating purposes, if the Government requires the following for system tests, inspections and certifications:
A. Are these tests, inspections and certifications required to be conducted by Certified or OEM authorized alarm system service technicians?
B. Is a detailed system inspection report required?
C. Is a system certification certificate required?
D. If system repairs or unit replacements are required, how will the parts and labor be funded?
E. If some systems require OEM reprogramming (Special OEM system software, programs and passwords) how will travel/labor/special equipment costs for out of area technicians be funded?
GOVERNMENT RESPONSE:
Offerors shall comply with paragraph C.8.5 regarding Fire Fighting Equipment: Replace, Repair and Maintain. Delivery orders will be issued on a firm fixed price basis. Specific questions regarding funding and travel will be handled at the delivery order level.
CONTRACTOR QUESTION 14:
What Fiscal Year NAVSEA Standard Items should the contractor use for compiling cost estimates for all ELINs for all years?
GOVERNMENT RESPONSE:
Per the solicitation, the contractor shall comply with the latest revision of these documents in effect at solicitation closing and when each option year is invoked.
Clause C-211-H010 is required for all NAVSEA ship repair contracts.
CONTRACTOR QUESTION 8:
In Section C, pages 14, paragraph C.8.1 (Tow Barges), ELIN 101AA (Series), ELINs for Barge Towing require a base year and four option year pricing which must include fuel market prices and fuel surcharge pricing. Sub-contractors and vendors have been reluctant to quote pricing beyond the base year. The market fuel prices and fuel surcharge prices are extremely difficult to calculate for each of the four option years (unknown future market conditions/high risk pricing). Will the Government amend the RFP to include an Economic Price Adjustment (EPA) clause, 52.216-2?
GOVERNMENT RESPONSE:
The Contracting Officer has determined FAR Clause 52.216-2 to be inappropriate for this requirement; and therefore, will not be added to the solicitation.
