SUMMARY OF CHANGES (REV.)

The following have been added by full text:

SUMMARY OF CHANGES AMEND 0003

1. This amendment removes Section 00100 - Bidding Schedule/Instructions to Bidders and replaces it with the attached revised Section 00100 - Bidding Schedule/Instructions to Bidders.

2. This amendment removes Attachment I – Change Order Markup Rates/Extended Overhead and replaces it with the attached revised Attachment I_Revision 01 - Change Order Markup Rates/Extended Overhead.

3. This amendment removes the P-834 Portal Crane Specifications and replaces it with the attached revised Portal Crane Specification_Amendment 03.

4. This amendment removes Section 01 57 19.01 20 – Supplemental Temporary Environmental Controls (from RFP Attachment 01) and replaces it with the attached revised Section 01 57 19.01 20 – Supplemental Temporary Environmental Controls; This attachment is located in the “P834ESA” portion of the attachment titled “Attachments_E704_E711_S560_P834ESA”. Additional attachments are referenced in the pre-proposal inquiry responses below.

5. The Site Visit photographs (attachment titled: Attachment_K_P834_SV_Photos) and attachments associated with pre-proposal inquiry responses will be available on safe.arl.army.mil once access is requested. Receive access by emailing Amanda.bonus@navy.mil. Once access is granted, SAFE ARL will send an instructional email (check junk mail); Internet Explorer is recommended for this site.

6. Standard Form 1442, Block 13a, is revised from 18 June 2019 to 19 June 2019, 2:00 P.M. (PST). The price proposal due date of 19 August 2019 is not changed with this amendment.

7. This amendment provides Government response to the following Pre-Proposal Inquiries (PPIs):

PPI 020: Reference drawing S-560. On section C2, C4 and A2, there is no #9 steel reinforcing bar shown in the middle third of the crane foundation. On section A2 there is a callout for headed #9 bars with arrows pointing to the middle third of the crane foundation. Please clarify if headed #9 steel reinforcing bars are to be included in this area of the crane foundation or not.

Govt Response: See revision to drawing S-560 provided with this Amendment; Attachment is titled:

“Attachments_E704_E711_S560_P834ESA”

PPI 021: Should the contractor include a bid contingency for contaminated soil and/or obstructions not shown in the contract documents?

Govt Response: Negative. Proposals shall not contain bid contingencies.

PPI 022: Please provide the dollar amount of the bid contingency that the contractor should allow in its bid for either contaminated soil or obstructions that are not indicated in the contract documents.

Govt Response: There are no known soil contaminants within the limits of construction; Refer to PPI 021 response.

PPI 023: Factor 5, Small Business Utilization. Section 00100, paragraph 5.1 defines five (5) technical factors including Factor 5 – Small Business Utilization. Section 00100, paragraph 5.3(5) submission requirements for (1) a narrative; (2) Small business Subcontracting Record (Attachment F); (3) Individual Subcontracting Reports (ISR);

(4) Small business Participation and Commitment Strategy (Attachment G); and (5) a 5-page narrative. The RFP states these will be evaluated to demonstrative a history of successful implementation of the Offeror’s Small Business Subcontracting Program. However, Section 00100, paragraph 4.1 states to submit in the Technical Proposal only Factors, 1-4. The following paragraphs state that Attachment G (Small Business Participation and Commitment Strategy should be submitted separately two (2) days after receipt of the price proposal with the Small Business Subcontracting Plan (Attachment B). Where and when should the remaining elements of Factor 5 be submitted?

Govt Response: The remaining elements of Factor 5 – Small Business Utilization shall be submitted with the Price Proposal. This amendment removes Section 00100 - Bidding Schedule/Instructions to Bidders and replaces it with attached revised Section 00100 - Bidding Schedule/Instructions to Bidders.

PPI 024: Factor 4, Technical Solution. This Factor logically should go with the Price on August 19, because the Technical Solution and the Price go hand-in-hand, as was noted in a previous question. The Technical Solution is worked out as we analyze all the intricacies of the Price. We ask you to reconsider your reply to that question and allow Factor 4 to be submitted with the Price.

Govt Response: In order to proceed with a timely award, the technical proposals (Factors 1-4) are due in June 19, 2019. Faced with the decision to either have the Price Proposals due at the same time as the Technical Proposals or to allow the Offerors additional preparation time for the Price Proposals, the Government decided to allow the Offerors more time for preparation of the Price Proposals.

PPI 025: Attachment I - Change Order Markup Rates/Extended Overhead. This form indicates a P-834 Maximum Funding Limitation of $73,058,744. This limitation does not appear to be indicated in the front-end RFP nor elsewhere in the contract documents. This was the same initial value provided in the first solicitation for this project in 2018. The original solicitation was cancelled based on the following statement in the letter to offerors: “The Military Construction funds that have been authorized and appropriated for this project are insufficient to award a construction contract to any of the offerors at this time.” The current solicitation states on the SF1442: “The estimated total contract price range is between $100,000,000 and $250,000,000 (DFARS 236.204).” Can you confirm the limitation of $73M listed on Attachment I is incorrect? Please provide the actual maximum funding limitation for this project.

Govt Response: With this amendment, Attachment I - Change Order Markup Rates/Extended Overhead is removed and replaced with attached revised Attachment I_Revision 01 - Change Order Markup Rates/Extended Overhead. The correct maximum funding limitation (MFL) value of $98,880,000. Refer to Attachment I_REV01.

PPI 026: Section 00100 - Bidding Schedule/Instructions to Bidders; page 9, subsection 4.1 Proposal Due Date, Submission Instructions, and Format states: "TECHNICAL PROPOSALS: one original with original signature and date, six additional hardcopies, and one copy on CD, of Factors 1,2,3, and 4." Has Factor 5 been intentionally omitted from the CD Version, and should bidders include Factor 5 along with Factors 1-4 in the original and hardcopy versions of the Technical Proposal?

Govt Response: Refer to PPI 023 response.

PPI 027: Reference: 5.3 Proposal Submittal Requirements and Basis of Evaluation for Each Factor a. Non-Price Factors: (1) Factor 1 – Experience (3) Fabrication and installation of portal style cranes, with a minimum 25-ton capacity. Project description(s) shall demonstrate the crane supplier’s ability to perform all of the following: design, fabrication, equipment electrification, assembly, crane installation, crane testing, and operational testing. Please confirm that "portal style cranes" are gantry cranes by definition of word "portal".

Govt Response: Negative. Portal and pedestal cranes are covered under ASME B30.4. Gantry and bridge cranes are covered under ASME B30.2.

PPI 028: Please confirm that a pedestal crane, required for this project, is not a portal style crane

Govt Response: Portal and pedestal cranes are both covered under ASME B30.4. This contract includes a crane that is a portal style on a fixed pedestal.

PPI 029: Lighting Control Panel LCP-2 is shown in drawing E-133. Please provide panel schedule for LCP-2.

Govt Response: Added LCP-2 to sheet E-711 and revised LCP-1 control to work with LCP-2. See revised E-711 provided with this Amendment; Attachment is titled

PPI 030: Drawings E-704 Systems Pathway T-04 and T-22's "End 1” reference Enclosure E-01. There is no Enclosure E-01 listed in Comm System enclosure schedule on drawing E-705. Also, there is no E-01 enclosure found in plan sheets. Please provide E01 on Comm System Enclosure schedule and location of E01 on plan sheet.

Govt Response: Revised Pathway T-04 and T-22 End 1 to connect to Vault V-01. See revised drawing E-704 provided in this Amendment; Attachment is titled: “Attachments_E704_E711_S560_P834ESA”

PPI 031: Drawings E-704 Pathway T10 "End 2" designation is Substation 11. Drawing E-405 shows T10 terminating into Substation 13. Please clarify if T10 is terminating at Substation 11 or Substation 13.

Govt Response: Revised Pathway T-10 End 2 to connect to Substation 13. See revised drawing E-704 provided in Amendment 0003; Attachment is titled: “Attachments_E704_E711_S560_P834ESA”

PPI 032: Drawings E-203 detail B1/E-203 shows Systems Pathways T-26/T-02/T-23. Pathway T-26 is not listed in the Systems Pathway Schedule on sheet E-704. Please provide pathway T26 on the Systems pathway schedule.

Govt Response: Added T26 to the systems pathway. See revised drawing E-704 provided in this Amendment; Attachment is titled: “Attachments_E704_E711_S560_P834ESA”

PPI 033: Standard Form 1442, Box 11 indicates the Contractor shall begin performance within 15 calendar days and complete it within 880 calendar days after receiving award, but on page 43 of the RFP 52.211-10 it states “The Contractor shall be required to: (a) commence work under this contract within fifteen (15) calendar days after the date the Contractor receives the notice to proceed. Shall the work commence 15 days after award, or after notice to proceed? Please clarify.

Govt Response: Work shall commence 15 days after award.

PPI 034: On Page 9, last paragraph, the Notes states that Attachment G – Small Business Participation and Commitment Strategy and Attachment B – Individual Small Business Subcontracting Plan shall be submitted electronically…no later than the close of business two business days after receipt of the price proposals.” Shall the Small Business Achievements 2-page narrative and Attachment F (Small Business Subcontracting Record) be submitted at this time, or with the Technical Proposal?

Govt Response: Refer to PPI 023 response.

PPI 035: Reference Attachment A of Specification Section 01 57 19.01 20. The second paragraph of Part 1.2 – General Requirements states the “referenced documents will be made available to the contractor when finalized”.

Are these documents finalized and can they be provided at this time?

Govt Response: See Section 01 57 19.01 20 of revised P-834 ESA Attachment (which also includes finalized reference documents) provided with this amendment. Attachment is titled:

PPI 036: Drawing G 006 and SD 101 instruct the bidder to demolish the existing South Service Pier and Wave Screen. Please provide existing drawings for these structures to quantify the demolition effort required to accomplish this work.

Govt Response: See attachments in this Amendment: NFF-432, NFF-1021, NFF-1022, and P-395.

These attachments have been combined and titled as “Attachments for PPI 036”

PPI 037: Section 00100, Paragraph 5.3 Factor 1 – Experience Requirements Scope and Complexity requires: “(3) Fabrication and installation of portal style cranes, with a minimum 25-ton capacity. Project description(s) shall demonstrate the crane supplier’s ability to perform all of the following: design, fabrication, equipment electrification, assembly, crane installation, crane testing, and operational testing.” Does experience in fabrication and installation of gantry cranes meet the Navy’s requirement for “portal-style” cranes?

Govt Response: See response to PPI 027.

PPI 038: Section 01 57 19.01 20 Paragraph 3.1.18 reads as follows – “Merchantable forest products such as timber and firewood must be appraised, and payment received by the Government prior to disturbance or removal, in accordance with MNAVREGNWINST 11015.1, Forest Product Sales and Permit Program. Purchase, through the Navy Forestry program, merchantable forest products at a neutrally determined rate. Timber value and related expenses are not reimbursable under any circumstance. Federal timber may not be exported, and timber excise tax is the responsibility of the purchaser.” What value for the merchantable forest products should we anticipate paying the Government?

Govt Response: The value of the merchantable forest products is $5,000.

PPI 039: Referencing Item 1 of the Instructions to Bidders on page 10 of 71 of the RFP. With the Technical Proposal due on June 18, 2019 and the Price Proposal due August 19, 2019 there are likely to be more questions after the Technical Proposal is submitted. Please consider allowing questions (PPI’s) to be submitted up to 10 days prior to the due date of the Price Proposal.

Govt Response: The Government will accept Price and Factor 5 related PPI’s through July 25, 2019.

8. All other solicitation terms and conditions remain unchanged. Offerors are reminded to acknowledge receipt of this amendment when submitting proposals in accordance with the RFP instructions.

e. CAGE Code and DUNS # as required by FAR 52.204-7;

f. Tax ID Number; and

g. Acknowledgement of all amendments.

5. Basis of Award

a. The Government reserves the right to eliminate from consideration for award any or all offers at any time prior to award of the contract; to negotiate with Offerors in the competitive range; and to award the contract to the Offeror submitting the proposal determined to represent the best value – the proposal most advantageous to the Government, price and other factors considered.

b. Intent to Award without Discussions (discussed above in Section 00010 - Description of Work).

c. The best value tradeoff process is selected as appropriate for this acquisition. The Government considers it to be in its best interest to allow consideration of award to other than the lowest priced Offeror or other than the highest technically rated Offeror.

d. Any proposal found to have a deficiency in meeting the stated solicitation requirements or performance objectives will be considered ineligible for award, unless the deficiency is corrected through discussions. Proposals may be found to have either a significant weakness or multiple weaknesses that impact either the individual factor rating or the overall rating for the proposal.

5.1 Evaluation Factors for Award

a. The solicitation requires the evaluation of price and the following non-price factors:

Factor 1 – Experience Factor 2 – Past Performance Factor 3 – Safety Factor 4 – Technical Solution Factor 5 – Small Business Utilization

The distinction between corporate experience and past performance is corporate experience pertains to the types of work and volume of work completed by a contractor that are comparable to the types of work covered by this requirement, in terms of size, scope, and complexity. Past performance pertains to both the relevance of recent efforts and how well a contractor has performed on the contracts.

b. The relative order of importance of the non-cost/price evaluation factors is the technical factors (Factors 1, 3, 4 and 5) are of equal importance to each other and, when combined are equal in importance to the past performance evaluation/performance confidence assessment factor (Factor 2). When the proposal is evaluated as a whole, the technical factors and past performance/performance confidence assessment factor combined (i.e., the non-price evaluation factors) are approximately equal to price.

The importance of price will increase if the Offerors’ non-cost/price proposals are considered essentially equal in terms of overall quality, or if price is so high as to significantly diminish the value of a non-cost/price proposal’s superiority to the Government. Award will be made to the responsible Offeror(s) whose offer conforms to the solicitation and represents the best value to the Government, price and non-price factors considered.

5.2 Evaluation

a. The price proposal shall be separate from the technical proposals

b. Firms must demonstrate that they possess the proven competence and experience to perform the subject solicitation.

c. While the Government may elect to consider data obtained from other sources, the burden of providing detailed, current, accurate, and complete past performance, experience, safety, and management information rests with the Offeror.

5.3 Proposal Submittal Requirements and Basis of Evaluation for Each Factor

a. Non-Price Factors:

(1) Factor 1 – Experience

(i) Solicitation Submittal Requirements: The Offeror shall submit the following information:

(a) Construction Experience:

Submit a minimum of two (2) and a maximum of five (5) construction projects for the Offeror that best demonstrate your experience on relevant projects that are similar in size, scope, and complexity to the RFP. For purposes of this evaluation, a relevant project is further defined as:

Size and Scope:

(1) Construction of steel pipe pile supported piers with a minimum project cost of $10,000,000 and 2,000 square feet of pier deck area.

(2) Construction of pre-cast concrete floating structures.

(3) Fabrication and installation of portal style cranes, with a minimum 25-ton capacity. Project description(s) shall demonstrate the crane supplier’s ability to perform all of the following: design, fabrication, equipment electrification, assembly, crane installation, crane testing, and operational testing.

Complexity:

Construction that is subject to compliance with complex environmental regulations and requires extensive environmental monitoring during in-water construction activities.

(b) Additional Construction Experience Submittal Requirements:

Projects submitted for the Offeror shall be substantially complete within the past ten (10) years of the date of issuance of this RFP.

A project is defined as a construction project performed under a single task order or contract. For multiple award and indefinite delivery/indefinite quantity type contracts, the contract as a whole shall not be submitted as a project for evaluation; rather Offerors shall submit the work performed under a task order as a project.

The attached Construction Experience Project Data Sheet (Attachment C) is

MANDATORY and SHALL be used to submit project information. Except as specifically requested, the Government will not consider information submitted in addition to this form. Individual blocks on this form may be expanded;

however, total length for each project data sheet shall not exceed one (1) double-sided page or two (2) single-sided pages.

For all submitted projects, the description of the project shall clearly describe the scope of work performed and the relevancy to the project requirements of this RFP (e.g., unique features, area, construction methods).

If the Offeror is a joint venture, partnership, or mentor protégé, relevant project experience should be submitted for projects completed by the joint venture, partnership, or mentor protégé entity. If the joint venture, partnership, or mentor protégé does not have shared experience, projects may be submitted for the joint venture, partnership, or mentor protégé members. At least one relevant project shall be submitted for each joint venture, partnership or mentor protégé member.

Offerors who fail to submit experience for all joint venture, partnership, or mentor protégé members may be rated lower. Offerors are still limited to a total of five (5) projects combined.

A minimum of one project must be submitted by the Offeror (matching the company name, address, and/or DUNS number on the SF1442 and/or Cover Letter, or otherwise demonstrating how the experience is attributable to the Offeror itself).

If the Offeror is utilizing experience information of any other entity

(name/address/DUNS is not exactly as stated on the SF1442 and/or cover letter), the proposal shall clearly demonstrate that the other entity will have meaningful involvement in the performance of the contract. The proposal shall establish a nexus or connection between itself and the entity and state specific commitments of technical resources (personnel or equipment) from the entity that will be utilized in performance of this contract. This information shall be included in box 10 of Attachment C.

In addition, the Offeror shall submit a signed copy of a joint venture agreement, partnership agreement, or approved mentor protégé agreement (MPA) for each member of the Offeror’s joint venture team.

(ii) Basis of Evaluation:

The basis of evaluation will include the Offeror’s demonstrated experience and depth of experience in performing relevant construction projects as defined in the solicitation submittal requirements. The assessment of the Offeror’s relevant experience will be used as a means of evaluating the capability of the Offeror to successfully meet the requirements of the RFP. The Government will only review five (5) projects for construction. Any projects submitted in excess of the five (5) will not be considered.

Scope element (1) must be demonstrated at least twice within the submitted projects. Scope element (2), scope element (3) and the complexity element must be demonstrated at least once within the submitted projects. Failure to meet these stated criteria will result in a lower rating.

Failure to comply with the Attachment C requirements may result in the project being considered not relevant and may result in a lower rating.

Relevant projects that demonstrate experience self-performing relevant features of work may be considered more favorably than those who do not demonstrate self-performance.

Higher ratings may be given if size and scope (all size and scope elements), and complexity are demonstrated in a single relevant project.

Higher ratings may be given if the Offeror demonstrates experience driving 36-inch diameter or greater steel pipe piles that support foundations in a marine environment.

Higher ratings may be given if the Offeror demonstrates experience driving piles of 120 feet or greater in length.

Higher ratings may be given if the Offeror demonstrates scope element (2) or scope element (3) more than once within the submitted projects.

Projects submitted by Joint Ventures, where the joint venture partnerships performed together (either as joint venture partners or in a prime-sub relationship), may be given more weight than submitted projects in which the Joint Venture firms did not perform together.

(2) Factor 2 – Past Performance

(i) Solicitation Submittal Requirements:

IF A COMPLETED CONSTRUCTION CONTRACTOR APPRAISAL SYSTEM (CCASS) or

CONTRACTOR PERFORMANCE ASSESSMENT REPORTING SYSTEM (CPARS) EVALUATION IS

AVAILABLE, IT SHALL BE SUBMITTED WITH THE PROPOSAL FOR EACH PROJECT INCLUDED IN

FACTOR 1 FOR CONSTRUCTION EXPERIENCE. IF THERE IS NOT A COMPLETED CCASS OR CPARS

EVALUATION, the Past Performance Questionnaire (PPQ) included in the solicitation is provided for the Offeror or its team members to submit to the client for each project the Offeror includes in its proposal for Factor 2 Past Performance. AN OFFEROR SHALL NOT SUBMIT A PPQ WHEN A COMPLETED CCASS or CPARS IS

AVAILABLE.

IF A CCASS OR CPARS EVALUATION IS NOT AVAILABLE, ensure correct phone numbers and email addresses are provided for the client point of contact. Completed PPQs should be submitted with your proposal. If the Offeror is unable to obtain a completed PPQ from a client for a project(s) before proposal closing date, the Offeror should complete and submit with the proposal the first page of the PPQ (Attachment D), which will provide contract and client information for the respective project(s). The Government may make reasonable attempts to contact the client noted for that project(s) to obtain the PPQ information; however, Offerors should follow-up with clients/references to ensure timely submittal of questionnaires. If the client requests, questionnaires may be submitted directly to the Government's point of contact, Amanda Bonus, via email at Amanda.bonus@navy.mil prior to proposal closing date. Offerors shall not incorporate by reference into their proposal PPQs, CCASS, or CPARS previously submitted for other RFPs. However, this does not preclude the Government from utilizing previously submitted PPQ information in the past performance evaluation.

Offerors may provide any information on problems encountered and the corrective actions taken on projects submitted under Factor 1 – Experience. Offerors may also address any adverse past performance issues.

Explanations shall not exceed two (2) double-sided pages or four (4) single-sided pages in total.

The Government reserves the right to contact references for verification or additional information. The Government’s inability to contact any of the Offeror’s references or the references unwillingness to provide the information requested may affect the Government’s evaluation of this factor.

While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate and complete past performance information rests with the Offeror.

A copy of the blank Past Performance Questionnaire to be used for requesting client references is included as Attachment D.

(ii) Basis of Evaluation:

The degree to which past performance evaluations and all other past performance information reviewed by the Government (e.g., PPIRS, Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), performance recognition documents, and information obtained from any other source) reflect a trend of satisfactory performance considering:

- A pattern of successful completion of tasks;

- A pattern of deliverables that are timely and of good quality;

- A pattern of cooperativeness and teamwork with the Government at all levels (task managers, contracting officers, auditors, etc.); and

- Recency of tasks performed that are identical to, similar to, or related to the task at hand

This evaluation focuses on how well the Offeror performed on the relevant projects submitted under Factor 1 – Experience, and past performance on other projects currently documented in known sources. More emphasis will be placed on more relevant projects. In addition to the above, the Government reserves the right to obtain information for use in the evaluation of past performance from any and all sources including sources outside of the Government. Other sources may include, but are not limited to, past performance information retrieved through PPIRS using all CAGE/DUNS numbers of Contractors who are part of a partnership or joint venture identified in the Offeror’s proposal, inquiries of owner representative(s), and any other known sources not provided by the Offeror.

The Government will consider the currency and relevance of the information, the source of the information, context of the data, and general trends in the Contractor’s performance. This evaluation is separate and distinct from the Contracting Officer’s responsibility determination. The assessment of the Offeror’s past performance will be used as a means of evaluating the Offeror’s probability to successfully meet the requirements of the RFP.

Offerors lacking relevant past performance history will not be evaluated favorably or unfavorably in past performance and will receive a Neutral Confidence rating.

(3) Factor 3 –Safety

(i) Solicitation Submittal Requirements:

The Offeror shall submit the Past Performance Worksheet for Safety (Attachment E). The Offeror shall submit the following information on or attached to the worksheet: (For a partnership or joint venture, the following submittal requirements are required for each contractor who is part of the partnership or joint venture; however, only one safety narrative is required. EMR, DART and TRC Rates shall not be submitted for subcontractors.)

(a) Experience Modification Rate (EMR): Include five (5) previous complete calendar years’ worth of data. This rate compares company’s annual losses in insurance claims against its policy premiums. The Offeror may submit an insurance company-provided equivalent rate if no EMR exists. If the Offeror has no EMR or premium, for any year, affirmatively state so and explain why. Any extenuating circumstances that affect the EMR and negative trends should be addressed as part of the factor submission.

(b) OSHA Days Away from Work, Restricted Duty, or Job Transfer (DART) Rate and

Total Recordable Case (TRC) Rate: Submit five (5) previous complete calendar years’ worth of data. If an Offeror cannot submit an OSHA DART and TRC rates, for any year, affirmatively state so and an explanation must be provided. Any extenuating circumstances that affected the OSHA, DART, and TRC rate data negatively must be addressed as part of this factor submission.

(c) Technical Approach for Safety: Describe the plan for safety that will be implemented to evaluate safety performance of potential subcontractors as part of the selection process for all levels of subcontractors. The Offeror shall submit a narrative that fully describes the safety management system that they will use to oversee the safety compliance and performance of self-performed and subcontractor performed work. The Offeror will describe any innovative methods that will be employed to ensure and monitor safe work practices at self-performed and/or all subcontractor levels. Additionally, the contactor will describe their methodology to execute an effective program that facilitates sound mishap prevention techniques and processes, employee reporting of unsafe conditions, unsafe activities, and near-miss mishaps. The technical approach to safety narrative shall be limited to two (2) single-sided pages.

The Government is seeking to determine that the Offeror has consistently demonstrated a commitment to safety and that the Offeror plans to properly manage and implement safety procedures for its self-performed work and the work of its sub-contractors. The Government will evaluate the Offeror’s overall safety management system, safety performance record, and the Offeror’s methodology of qualifying, evaluating, selecting and overseeing its subcontractors. The Government’s sources of information for evaluating safety will include, but are not limited to: OSHA, NAVFAC’s Enterprise Safety Applications Management System (ESAMS) database, NAVFAC’s Contractor Incident Reporting System (CIRS), Contractor Performance Assessment Reporting System (CPARS), and other related databases.

While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate and complete safety information regarding these submittal requirements rests with the Offeror. The Government will evaluate the narrative to determine the degree to which subcontractor safety performance will be considered in the selection of all levels of subcontractors on the upcoming project and the specific management practices that will be in place for providing deliberate safety program management and mishap prevention support.

The evaluation will collectively consider the following:

- Experience Modification Rate (EMR)

- OSHA Days Away from Work, Restricted Duty, or Job Transfer (DART) and Total Recordable Case

(TRC) Rates

- Offeror Technical Approach to Safety

- Other sources of information available to the Government

(a) Experience Modification Rate (EMR): For the five (5) previous complete calendar years the Offeror will submit EMR. If no EMR exists, the Offeror may submit an insurance company-provided equivalent rate explaining why not. If an insurance company-provided equivalent rate is provided, it will be treated the same as an EMR. Any extenuating circumstances that affected the EMR and negative trends should be addressed as part of this selection factor. The board will evaluate the EMR to determine if the Offeror has demonstrated a history of safe work practices taking into account any negative trends and extenuating circumstances that impact the rating.

(b) OSHA Days Away from Work, Restricted Duty, or Job Transfer (DART) and Total Recordable Case (TRC) Rates: For the five (5) previous complete calendar years, the Offeror will submit their OSHA DART and TRC, as defined by the U.S. Department of Labor, Occupational Safety and Health Administration. If unable to submit OSHA DART and TRC rates, affirmatively state so, and an explanation must be provided. Any extenuating circumstances that affected the OSHA DART and TRC rate data and negative trends should be addressed as part of this element. The board will evaluate the OSHA DART and TRC rates to determine if the Offeror has demonstrated a history of safe work practices taking into account any upward trends and extenuating circumstances that impact rates.

(c) Technical Approach to Safety: The Offeror will describe their plan to evaluate their safety performance and that of potential subcontractors. Also, describe any innovative methods that the Offeror will employ to ensure and monitor safe work practices at all subcontractor levels. The Safety Narrative shall be limited to two pages. The board will evaluate the narrative to determine the degree to which subcontractor safety performance will be considered in the selection of all levels of subcontractors on the upcoming project. The board will evaluate the narrative to determine the degree to which innovations are being proposed that may enhance safety on this procurement and validate the contractor has addressed methodology to be used in the execution of an effective program that facilitates sound mishap prevention techniques/processes, employee reporting of unsafe conditions, unsafe activities, and near-miss mishaps. Those Offerors whose plan demonstrates a commitment to hire subcontractors with a culture of safety and who propose innovative methods to enhance a safe working environment may be given greater weight in the evaluation.

(d) Other Sources of Information Available to the Government: Other sources for safety may include but are not limited to OSHA data, NAVFAC’s Contractor Incident Reporting System (CIRS) in Enterprise Safety Applications Management System (ESAMS), Contractor Performance Assessment Reporting System (CPARS) and other related databases.

(4) Factor 4 – Technical Solution

Provide a narrative based on the requirements in the plans and specifications that describe the Offeror’s ability to ensure a completion of the project at or within 880 calendar days from the notice to proceed. Narrative shall not exceed five (5) double-sided pages or ten (10) single-sided pages, and shall be no smaller than 11 pitch font in 8 ½” x 11” format. The submission shall be in narrative form only. Gantt Charts, Critical Path Method (CPM) schedules, etc. are not desired and will not be evaluated. The narrative shall address the following:

(a) Schedule:

Anticipated overall construction duration (clearly identify number of days) Anticipated sequence of construction Anticipated critical path and critical path mitigation means Long lead items and plan to mitigate resulting schedule impacts Anticipated security restrictions and resulting delays Weather delays and use of project calendars

(b) Technical Approach:

Approach to manufacturing process, delivery, staging, and installation procedure for steel pipe piles

Proposed delivery method of piles Approach to meeting environmental requirements for Marbled Murrelet and marine mammal monitoring requirements

Evaluation of this factor will be a subjective assessment of the Offeror’s approach to accomplishing the project’s goals and requirements, and completing the project within the required timeframe to determine if it is realistic and demonstrates the ability to properly accomplish the requirements of the project. Failure to address any of the submission requirements may result in lower ratings. Restating the RFP requirements may result in lower ratings.

Higher ratings may be given for demonstrating a realistic period of performance that is less than the required 880 calendar day period of performance (POP). Upon award of the contract, the contract completion date will be reduced accordingly if Offeror’s proposed period of performance is less than 880 days.

Higher ratings may be given for demonstrating proactive measures that can be taken to prevent critical delays to critical path work activities.

(5) Factor 5 - Small Business Utilization

This factor assesses both historical achievements in utilizing small business concerns as subcontractors and proposed small business participation and commitment strategies.

1. SMALL BUSINESS ACHIEVEMENTS: All Offerors shall provide a narrative (limited to one (1) double-sided page or two (2) single-sided pages) to describe their achievements in supporting the Government’s policy to provide maximum practicable opportunities for small business (SB), veteran-owned small business (VOSB), service-disabled veteran-owned small business (SDVOSB), historically underutilized business zone (HUBZone) small business, small disadvantaged business (SDB), and women-owned small business (WOSB) concerns to participate as subcontractors consistent with efficient contract performance.

In support of narrative submissions:

a. All Offerors shall submit small business subcontracting information associated with each project cited under the Corporate Experience Factor in the format provided in Attachment F, Small Business Subcontracting Record.

b. Offerors representing as other than small businesses shall also provide copies of the most current individual subcontracting reports (ISRs) associated with each project cited under the Experience Factor if a small business subcontracting plan was required by the contract. If such projects were completed under specific task orders, provide ISRs for the overall contract. For cited projects with state and local government agencies, provide similar subcontracting performance reports if required by the contracts. When not specifically addressed in the ISR or similar report, Offerors shall provide explanations for all instances of failures to meet dollar or percentage goals in individual subcontracting plans.

Note: The Government reserves the right to consider achievements information on other recent, relevant projects from all available sources.

Offerors utilizing achievements information of team members or key subcontractors shall clearly demonstrate how these companies will have meaningful involvement in the management of the subcontracting program for this acquisition. If not, such achievement information will not be considered under this factor. If the Offeror is a new joint venture, partnership or other entity consisting of more than one company, provide achievements information for each individual business entity(ies) that will be responsible for managing the subcontracting program and clearly describe those responsibilities.

Failures to provide ISRs or any other requested information must be fully explained and may negatively impact your evaluation.

2. SMALL BUSINESS PARTICIPATION AND COMMITMENT: All Offerors shall submit a small…
