About this file
This document is a Q&A file containing government responses to 14 contractor questions about a shipyard contract at Norfolk Naval Shipyard (NNSY). The contract appears to involve Fire Watch and Tank Watch personnel, with key requirements including: providing employees with final security clearances, maintaining less than 50% subcontractor utilization, using forklift operator wage determinations when specific labor categories are not listed, and providing personal safety equipment like fall arrest systems. Contractors are responsible for medical surveillance, respirator qualifications, and tracking personnel training and certifications.
Additional notable requirements include monthly invoicing via WAWF, 30-45 days advance notice for potential option periods, maintaining a muster area for personnel, and allowing personnel to charge time while waiting for badge processing if they are on shipyard premises. The contract is a short-term (3-month) standalone procurement with Key Personnel resumes evaluated as part of the technical factor. Contractors must comply with specific safety regulations including training for heavy metals exposure, fall protection standards, and maintaining fire extinguishers, with most equipment and safety responsibilities falling to the contractor rather than the government.

Government Question 1 - Will invoicing be submitted monthly via WAWF (2-in-1) for all labor performed in the prior month, or on a different cadence (e.g., bi-weekly or per task order)?
Answer 1 - Monthly is fine. But it really doesn’t matter.
Government Question 2 - Will the Government provide Red Badges at no cost, or should the contractor (and/or subcontractor) plan to cover all costs associated with background checks and badging? Also, what is the typical lead time from submission to badge issuance?
Answer 2 - The contractor should be providing employees that already have clearances.
Access to Restricted Data requires employees to have a FINAL clearance.
Government Question 3 - Please confirm that a WOSB prime may utilize a staffing subcontractor to supply Fire Watch/Tank Watch personnel while the prime retains full responsibility for management, reporting, OPSEC/QC, and invoicing.
Answer 3 – Yes, utilizing a subcontractor for staffing is not disqualifying. However, please keep in mind if you pay over 50% of the TCV minus the supply costs, you will be violating the limitations on subcontracting which may be subject to fines, penalties, and/or debarment.
Government Question 4 - Are Key Personnel résumés evaluated as part of Factor 1 – Technical at base award (and with any replacements evaluated post-award), or only at the task-order level?
Answer 4 - As this is a standalone for 3 months the Key Personnel resume’s will be evaluated as part of Factor 1.
Government Question 5 - For the ≤ 75% utilization threshold in the Capacity factor, is this calculated as [(total personnel committed across all active contracts) ÷ (total available personnel)] at time of proposal, or another specific formula?
Answer 5 - All active Contracts at time of proposal.
Government Question 6 - For pricing compliance, which labor classification(s) under the Wage Determination should Fire Watch and Tank Watch be mapped to, if the titles are not explicitly listed?
Answer 6 - We have historically based it off of the forklift Operator when the titles are not explicitly listed.
Government Question 7 - If the Government intends to exercise the option period, what advance notice should the contractor plan for staffing continuity?
Answer 7 - 30 to 45 days.
Government Question 8 - Fire Extinguishers
Section 5.8.4.1 requires the contractor to provide both pressurized water and CO₂ extinguishers, whereas the previous solicitation had NNSY furnishing these. Can NNSY clarify if this shift in responsibility is intentional, and confirm whether the Government will provide refill/maintenance services or if the contractor is expected to manage certification and servicing?
Answer 8 – NNSY provided fire extinguishers will be in use.
Government Questions 9 - Training/Heavy Metals Section 5.8 training requirements include Asbestos, Lead (29 CFR 1915.1025), and Chromium (VI) (29 CFR 1915.1026). Can NNSY clarify whether contractors are expected to provide the full scope of medical surveillance and training requirements for lead and hexavalent chromium (e.g., blood lead level testing, monitoring, documentation), or if certain elements will be provided by the Government?
Answer 9 - The contractor is expected to provide all medical and respirator qualification, maintenance and usage tracking.
Government Question 10 - Muster Location (Connex/Trailer) Section 5.8.4.1.9 requires the contractor to provide a Connex box, trailer, or equivalent muster structure, subject to Government approval. Will NNSY provide the actual Connex box/trailer, or must the contractor procure and maintain it? Additionally, will NNSY provide site space and utility hookups (power, lighting, HVAC), or must the contractor fully self-sustain?
Answer 10 - There is a muster area for the Tank Watch/ Fire Watch personnel on each project. The Contractor is required to maintain (cleanliness).
Government Question 11 - Badge / ATMS Class Delay Section 8 requires all trades to hold Red Badges and complete training. Once contractor personnel have received their badges but are awaiting ATMS class dates, will the contractor be able to charge those personnel to the contract during the waiting period?
Answer 11 - If the contractors are at the shipyard, or shipyard proper, then they can charge for the time they are at NNSY.
Government Question 12 - For the purpose of proposal formatting, should the Sections included in the table of paragraph 2 of FAR 52.212-1, “Instructions to Offerors – Commercial Items”, be considered individual volumes, such as Vol. I, Vol. II, etc., or should the proposal be formatted to include all Sections A through E in one proposal, with the table of contents listing each section accordingly?
Answer 12 – You can separate them into Volumes. See updated Performance Work Statement.
Government Questions 13 - Please provide the relevant SCA labor category to use for compliance and pricing purposes.
Answer 13 - We have historically based it off of the forklift Operator when the titles are not explicitly listed.
Government Questions 14 - Personal Fall Arrest System Section 5.8.4.1.8. Please confirm if the Personal Fall Arrest System per 29 CFR 1926.502, para (d) to include: Body Harness, Vertical lifeline/lanyard, Webbing (ropes and straps), Anchorages, Horizontal lifeline and Connectors will be provided by the Government or Contractor.
Answer 14 - Contractor will be required to provide their employees with Fall Arrest systems.
