About this file
This document is a Federal Acquisition Regulation (FAR) clause 52.212-2 Evaluation for Commercial Products and Commercial Services, which outlines the government's evaluation criteria for contract award. The solicitation will utilize a Best Value Trade-Off process, considering four primary evaluation factors: (1) Technical Narrative, (2) Past Performance, (3) Capacity, and (4) Price Reasonableness. Each factor will be rated as either "Acceptable" or "Unacceptable", with contractors required to meet specific standards across these areas.
Key evaluation details include: vendors must submit a technical narrative demonstrating understanding of the Performance Work Statement (PWS), with utilization rates not exceeding 75% of total capacity. Price quotes must be considered fair and reasonable, with prices held firm for 60 days. The government reserves the right to award to a contractor other than the lowest-priced offeror if the perceived benefits of a higher-priced proposal merit the additional cost. Contractors who fail to possess an acceptable technical narrative will not be considered for award, and their quotation will not be further evaluated.

52.212-2 EVALUATION--COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV 2021)
The Government intends to award a contract resulting from this solicitation to the offeror whose proposal represents the best value to the Government, considering both price and non-price factors. This procurement will utilize the Best Value Trade-Off process as described in FAR 15.101-1, allowing for trade offs between price and non-price evaluation factors.
Award may be made to other than the lowest priced offeror or the highest technically rated offeror. The Government reserves the right to accept other than the lowest price if the perceived benefits of a higher-priced proposal merit the additional cost. Conversely, the Government may award to a lower-priced offer if the technical merit of the proposal is not worth the additional cost.
The Offeror’s proposal shall be in the form prescribed by and shall contain a response to each of the areas identified in the solicitation.
(1) Factor 1 - Technical Narrative
(a) Technical Narrative - Technical narrative will represent the assessment of how well you understand and propose to fulfill the requirements outlined in the Performance Work Statement
(PWS).
Vendors must submit a sufficient narrative demonstrating their ability to successfully execute the Performance Work Statement. This document should clearly outline their understanding of the requirements, proposed execution strategies, and operational readiness.
Technical acceptability will be defined as follows:
Technical Evaluation Ratings
Contractors who fail to possess an acceptable technical narrative will not be considered for award and the other elements of their quotation will not be evaluated.
(2) Factor 2 – Past Performance
(a) Past Performance proposals will be rated “Acceptable” or “Unacceptable” using the ratings and descriptions outlined in Table 2. To develop an overall rating, the Government’s evaluation will take into account recent and relevant information submitted by each Offeror as part of its proposal and the Government’s assessment.
(b) In the case of an Offeror without a record of “Recent” and/or “Relevant” Past Performance or for whom information on Past Performance is not available or so sparse that no meaningful Past Performance rating can be reasonably assigned, the Offeror may not be evaluated favorably or unfavorably on Past Performance. Therefore, the Offeror shall be determined to have “Unknown Past Performance”. In the context of “Acceptability”/“Unacceptability”, “Unknown” shall be considered “Acceptable”.
Table 2 – Past Performance Rating Rating Description Acceptable Based on the Offeror’s performance record, the Government has a reasonable expectation that the Offeror will successfully perform the required effort, or the Offeror’s performance record is unknown.
Unacceptable Based on the Offeror’s performance record, the Government does not have a reasonable expectation that the Offeror will be able to successfully perform the required effort.
Table 1 – Technical Narrative Rating
Acceptable Quote meets all of the requirements identified.
Unacceptable Quote does not meet all of the requirements identified.
(3) Factor 3 - Capacity
(a) Capacity – Capacity proposals will be rated “Acceptable” or “Unacceptable” using the ratings and descriptions outlined in Table 3. The Capacity evaluation will assess the Offeror’s available manpower to fulfill the requirements listed in the PWS. Utilization rates must not exceed 75% of total capacity.
Table 3 – Capacity Rating
Acceptable Offeror’s utilization rate at or below 75% shall be deemed acceptable for performance considerations.
Unacceptable Offeror utilization rate exceeding 75% shall be considered unacceptable.
(4) Factor 4 - Price Reasonableness
(a) Price Reasonableness - The Government will evaluate the proposed price for reasonableness in accordance with Federal Acquisition Regulation (FAR)Subpart 13.5 - Simplified Procedures for Certain Commercial Items and FAR 13.106-3. The estimated amount for each line item will be added together to determine the total estimated price, which will become the evaluated price.
The vendor’s proposed price will be evaluated on the basis of price reasonableness. All prices must be considered fair and reasonable as determined by the Government. Price quote shall be held firm and valid for sixty (60) days
